Angle Flying was presented for the first time in 2000 at the World Freestyle Competitions, the European Espace Boogie, and the Eloy Freefly Festival. Those given, objective parameters which are beyond people's control (and thus cannot normally be changed by them) limit the realm of possibilities in the future; they rule out some conceivable future developments or alternatively make them more likely to happen. In that sense human action is "determined" and "determinate". If that wasn't so, then it would be impossible to predict anything much about human behaviour. Some of these parameters refer to limits imposed by the physical world, others to limits imposed by the social set-up or social structure that individuals and groups operate within.
By the 1970s and 1980s, determinate sentencing, a new intellectual current that repudiated the rehabilitative model with its focus on using mathematical models and grids to determine sentences, had made inroads, making jury sentencing seem like more of an anachronism. Some offences have a minimum sentence, and there may also be a maximum sentence depending on the nature of the offence. The maximum determinate sentence is a life sentence with a 25-year parole ineligibility period. For offences committed prior to December 2, 2011 all life sentences and related parole ineligibility periods are served concurrently (at the same time). In cases of multiple murder, where the offence occurred after December 2, 2011 (the date new legislation came into force), a court may, after considering any jury recommendation, order consecutive parole ineligibility periods for each murder.

The number of managed colonies in the United States for honey production has been in decline since the 1940s and these losses have increased since the early 2000s. Colony losses during winter are normal within beekeeping, however the rate of honeybee colony deaths, higher losses during the summer, as well as the inability to find a determinate cause of these deaths has caused alarm. In 2006, some beekeepers reported losing 30-90% of their hives. Total colony loss reached 45% between 2012 and 2013, up from 28.9% and 36.4% in previous years.
Philo Philo attempted to fuse and harmonize Greek and Jewish philosophy through allegory, which he learned from Jewish exegesis and Stoicism. Philo attempted to make his philosophy the means of defending and justifying Jewish religious truths. Colonies, in the context of development, may be composed of two or more unitary (or solitary) organisms or be modular organisms. XXIV Jornadas Argentinas de Paleontología de Vertebrados A study of the growth stages of Pterodaustro concluded that juveniles grew relatively fast in their first two years, attaining about half of the adult size. Then they reached sexual maturity, growing at a slower rate for four to five years until there was a determinate growth stop. In 2004 a Pterodaustro embryo in an egg was reported, specimen MHIN-UNSL-GEO-V246. The egg was elongated, long and across, and its mainly flexible shell was covered with a thin layer of calcite, 0.3 millimeters thick.
Actual values of these lengths depend on cross-sections and load distributions. But detailed analyses have shown that it is sufficiently accurate to consider beams rigid-plastic, with plasticity confined to plastic hinges at points. While this assumption is sufficient for limit state analysis, finite element formulations are available to account for the spread of plasticity along plastic hinge lengths. By inserting a plastic hinge at a plastic limit load into a statically determinate beam, a kinematic mechanism permitting an unbounded displacement of the system can be formed.
Legal formalism is both a descriptive theory and a normative theory of how judges should decide cases. In its descriptive sense, formalists believe that judges reach their decisions by applying uncontroversial principles to the facts. Although the numerous decided cases imply numerous principles, formalists believe that there is an underlying logic to these principles that is straightforward and which legal experts can readily discover. The ultimate goal of formalism would be to formalise the underlying principles in a single and determinate system that could be applied mechanically (hence the label 'mechanical jurisprudence').
The pipeline was proposed already in 1993. On 27 December 2004, prime-ministers of Albania, the Republic of Macedonia and Bulgaria signed the latest political declaration, followed by the memorandum of understanding between representatives of Albania, the Republic of Macedonia and Bulgaria and Ted Ferguson, the president and CEO of AMBO. On 30 October 2006, Albania and the Republic of Macedonia signed a protocol to determinate the entrance points of the pipeline. The entrance point will be Stebleve village in Albania and Lakaica village in the Republic of Macedonia.
In both its specific and general forms, the ELIZA effect is notable for occurring even when users of the system are aware of the determinate nature of output produced by the system. From a psychological standpoint, the ELIZA effect is the result of a subtle cognitive dissonance between the user's awareness of programming limitations and their behavior towards the output of the program. The discovery of the ELIZA effect was an important development in artificial intelligence, demonstrating the principle of using social engineering rather than explicit programming to pass a Turing test.
Any potential for parole is not guaranteed but discretionary, making it an indeterminate sentence.In re Jeanice D., 28 Cal. 3d 210 (1980) ("25 years to life" is an indeterminate life sentence, implying that a minor convicted of first-degree murder was eligible for commitment to the California Youth Authority, rather than determinate life sentence, which would require incarceration in a regular prison). Even if a sentence specifically denies the possibility of parole, government officials may have the power to grant an amnesty, to reprieve, or to commute a sentence to time served.
Aquinas never doubted the Aristotelian theory of individuation by matter, but was uncertain which of the theories of Avicenna or Averroes are correct. He first accepted the theory of Avicenna that the principle of individuation is matter designated (signata) by determinate dimensions,De Ente et Essentia, c. 4 but later abandoned this in favour of the Averroist theory that it is matter affected by unterminated dimension which is the principle.In Boethium de Trinitate Q.4 a2 Later still, he seems to have returned to the first theory when he wrote the Quodlibeta.
When this negation itself is negated, which is called "absolute negation," what a Determinate Being is, is no longer dependent on what it is not for its own determination, but becomes an actual particular Something in its own right: a Being-Within-Self. Its negation, what it is not, is now "cut off" from it and becomes another Something, which, from the first Something's point of view, is an Other in general. Finally, just as Becoming mediated between Being and Nothing, Alteration is now the mediator between Something and Other.
At this point we have arrived back at simple Being from which all the previous developments had initially proceeded. This Being, though, is now in the standpoint of Infinity from which these developments can be seen as moments of itself and so it is (a) Being-for-Self as Such. Until this point Determinate Being was burdened with Finitude, depended on the Other for its own determination, and so was only relatively determined Being. From the Ideal standpoint of Infinity, Being-for-Self has become free from this burden and so is absolutely determined Being.
The immediate characteristic displayed by Essence, once it finally emerges from Being, is simply that it is not Being. This apparently puts us back into the sphere of Determinate Being (see above), where each side of a relation mutually determined the Other side as being not what it is. In this immediate, merely relative relation, Essence and Being thus become the Essential and the Unessential, respectively. There is nothing arising within this relation, however, to tell us what it is about something that is Essential and what Unessential.
With Positing Reflection, the Illusory Being that was posited was only a means for Essence's mediation with itself. Now, with c) Determining Reflection, not only is the moment of Illusory Being foregrounded again, but the specific determinations of this Being come into play as well. The absolute nothingness of Essence forms the background to any and all of the determinations it chooses to Reflect itself off of. These Determinations of Reflection—formerly known as Determinate Beings when they were in the realm of Quality (see above)—therefore share in the nullity that undergirds them.
In RQM, an interaction between a system and an observer is necessary for the system to have clearly defined properties relative to that observer. Since the two measurement events take place at spacelike separation, they do not lie in the intersection of Alice's and Bob's light cones. Indeed, there is no observer who can instantaneously measure both electrons' spin. The key to the RQM analysis is to remember that the results obtained on each "wing" of the experiment only become determinate for a given observer once that observer has interacted with the other observer involved.

Under the determinate sentencing law, if a judge chose a prison sentence as punishment for a given offense (as opposed to probation), the defendant would be sentenced to the middle prison term unless aggravating or mitigating circumstances justified sentencing to the upper or lower term. The judge had to state the reasons for the sentencing decision. The base term would then be extended by enhancements for specific details of the crime, for example the use of a firearm, great loss of property, or great bodily injury, as well as the defendant's prior criminal history.
The Article D101, paragraph 2 of the Criminal Procedure Code defines the mission of prisons on work: "Wherever possible, the work of each prisoner is chosen according not only on his physical and intellectual abilities, but also on the influence that this work can have on the prospects for his reintegration. It is also determinate according to his family situation and the existence of civil parties to compensate."French government, 2007, Article D101 of the Criminal Procedure Code. In reality the number of jobs is insufficient, and many inmates find themselves in forced inactivity.
An offender who is at least 17 years of age and has been convicted of at least two violent or sexual offences can be declared a dangerous offender and detained indeterminately. A judge must consider the potential of future harm that could be caused by offenders, the circumstances of their offenses, medical and psychiatric opinion and any other matters of relevance. The decision passed by the court is not reviewable; the indeterminate sentence(s) commence upon the expiration of any determinate sentence imposed and release is by way of an order from the Supreme Court.
Because a bell's swing takes a determinate time which cannot be much altered by the ringer, changes can be produced only by a bell exchanging places with one next to it in the order. The flower, which is one of the defining features of angiosperms, is essentially a stem whose leaf primordia become specialised, following which the apical meristem stops growing: a determinate growth pattern, in contrast to vegetative stems. The flower stem is known as a pedicel, and those flowers with such a stem are called pedicellate, while those without are called sessile. In the angiosperms, the flowers are arranged on a flower stem as an inflorescence. Just beneath (subtended) the flower there may be a modified, and usually reduced, leaf, called a bract.

The introduction of determinate sentencing and subsequent increases in prison sentence lengths was the largest driver in a nearly 900% increase in California's prison population over the next 3 decades. In 1994, as part of a wave of "tough on crime" laws passed across the country, California passed a Three Strikes Law that required a doubled sentence for any felony if the person convicted had a prior "serious or violent" felony conviction. It also required a mandatory 25-year-to-life sentence for any felony if the person convicted had two prior "serious or violent" felony convictions. Three Strikes was one of the largest drivers of California's increasing prison population over the next 2 decades. The highest recorded CDCR daily prison population was on October 20, 2006, with 173,643 people under custody. The California incarceration rate has ranged from about 0.1% of the population to about 0.5%. In response to this population growth, between 1984 and 2005 California built 21 of the 35 prisons that CDCR currently operates in the state (see List of California state prisons for full details).
The Upanishads teach that the knowledge of difference is avidyā or ignorance, and the knowledge of identity is true knowledge or vidyā or valid knowledge, which leads to life eternal. For the Cārvākas, perception is the only means of valid knowledge (pramana). Vadi Deva Suri of the Jaina school defines valid knowledge as determinate cognition which apprehends itself and an object and which is capable of prompting activity which attains a desirable object or rejects an undesirable object; the result of valid knowledge is cessation of ignorance. Vaisheshikas recognized four kinds of valid knowledge – Perception, Inference, Recollection and Intuition.
Both were then styled Herr (). In 1308 King Haakon V Magnusson of Norway abolished the lendman/baron institution, and it was probably also during his reign that the aristocracy apparently was restructured into two classes: ridder () and væpner (). It is difficult to determinate exactly how many knights and squires there were in the 14th and the early 15th century in Norway. When King Haakon V signed a peace treaty with the Danish king in 1309, it was sealed by 29 Norwegian knights and squires. King Haakon promised that 270 more knights and squires would give their written recognition.
A mark system is a penal system that allows prisoners to earn privileges and early release by accumulating "marks" through good behavior, achievement, and thrift. As devised by Alexander Maconochie, the goal of a mark system was to encourage reform by placing prisoners in control of their own destinies. The mark system sought to limit official discretion to the greatest extent possible and to make the release process transparent for prisoners. It was a determinate sentencing scheme in that the number of marks prisoners needed to earn, tabulated according to the seriousness of their offense, would be disclosed to them upfront.
By Dutch law, moord (murder) is the intentional and premeditated killing of another person.Article 289 Dutch Penal Code: "Any person who intentionally and with premeditation takes the life of another person shall be guilty of murder and shall be liable to life imprisonment or a determinate term of imprisonment not exceeding thirty years or a fine of the fifth category." Murder is punishable by a maximum sentence of life imprisonment, which is the longest prison sentence the law allows. Unlike other countries in Europe, there is no parole for any person sentenced to life imprisonment in the Netherlands.

Indeterminate types are "tender" perennials, dying annually in temperate climates (they are originally native to tropical highlands), although they can live up to three years in a greenhouse in some cases. Determinate types are annual in all climates. Tomato plants are dicots, and grow as a series of branching stems, with a terminal bud at the tip that does the actual growing.

In Mozambique, most of the cars in the roads are imported from Japan, where Toyota takes the lead in terms of brand. Imagine an entity that knows all facts about the past and the present, and knows all natural laws that govern the universe. If the laws of nature were determinate, then such an entity would be able to use this knowledge to foresee the future, down to the smallest detail. The view of scientific determinism goes back to Laplace: "We ought to regard the present state of the universe as the effect of its antecedent state." They also may not adequately take into account offenders' potential for rehabilitation. For example, Virginia's sentencing guidelines penalized offenders for being younger than twenty, unmarried, unemployed, or male, even though traditionally youth had been regarded as a mitigating rather than an aggravating circumstance. The goal of determinate sentencing schemes such as federal sentencing guidelines in mitigating sentencing disparities could be thwarted by incapacitation-based schemes that take into account certain factors, such as sex or race, that correlate to recidivism. Another critique of incapacitation is that small increases in prison sentences merely delay crimes rather than preventing them.
In contemporary literary and philosophical works concerned with gender, the term "phallogocentrism" is commonplace largely as a result of the writings of Jacques Derrida, the founder of the philosophy of deconstruction, which is considered by many academics to constitute an essential part of the discourse of postmodernism. Deconstruction is a philosophy of "indeterminateness" and its opposing philosophy, "determinateness". This surprising result has practical consequences in hypothesis testing. Assume that we are trying to compare the effects of two medical treatments (Y is better than X) and that, given the available data, the IDP test is indeterminate. In such a situation the frequentist test always issues a determinate response (for instance I can tell that Y is better than X), but it turns out that its response is completely random, like if we were tossing of a coin. Wages are exogenous in Keynes's system. The Adult Authority and the Women's Board of Terms and Paroles were replaced with a Community Release Board appointed by the governor. The Community Release Board was responsible for reviewing sentencing decisions for equity, hearing appeals to denial of "good time" credits, determining if parole should be revoked, and for applying the law retroactively. The Judicial Council of California, the policymaking body of the California courts, was instructed to formulate sentencing guidance, for example when to grant probation, criteria for enhancements, and criteria for selecting upper or lower terms. The Judicial Council was also tasked with reviewing and publishing data on determinate sentences.
Abalienatio, in Roman law, is a legal transfer of property by sale or other alienation. According to Cicero, abalienatio est ejus rei, quae mancipi est, aut traditio alteri nexu aut in jure cessio, inter quos ea jure civili fieri possunt. Cicero defines abalienatio to be ejus rei quae mancipi est; and this is effected either by traditio alteri nexu aut in jure cessio inter quos ea jure civili fieri possunt. According to this definition, abalienatio is of a Res Mancipi, a class of things determinate; and the mode of transfer is either by traditio nexu or by in jure cessio.
" Adams expresses a need to invigorate and extend the U.S. measure of defense, alluding to the United States Navy, in light of French conduct. Philoponus attempts to combine the idea of homogeneous space with the Aristotelian system. The argument made by Philoponus is that substances by themselves require some determinate quantity for their being. Similarly to Aristotle, who rejected the immaterial things, and in contrast to Plato who accepted immaterial substances in his metaphysics, Philoponus’ concept of substance refers to the material objects. The next step on Soto's works was incorporating time and real movement through the treatment of the space. The work should be an autonomous object, where <> situations were put into play, and not a plan where a determinate vision was projected. At the same time that the spectator was moving in front of the work of art, to obtain from it its optical vibrational effects, time and real movement were being incorporated. In the process of collecting and aggregating data into a database (the first three steps of the process of profile construction), translations are made from real-life events to machine-readable data. These data are then prepared and cleansed to allow for initial computability. Potential bias will have to be located at these points, as well as in the choice of algorithms that are developed. It is not possible to mine a database for all possible linear and non-linear correlations, meaning that the mathematical techniques developed to search for patterns will be determinate of the patterns that can be found.
Vals The Rheinwaldhorn is the culminating point of the eastern portion of the Lepontine Alps and the Adula group. In this area, the watershed between the Rhine and the Po river has no determinate direction, and exhibits a dislocated appearance. The peaks of the Adula form an irregular group, all the highest lying in a cluster not more five kilometres distant from the centre, which may be fixed as the foot of the Rheinwald Glacier. All historical logographic systems include a phonetic dimension, as it is impractical to have a separate basic character for every word or morpheme in a language. In some cases, such as cuneiform as it was used for Akkadian, the vast majority of glyphs are used for their sound values rather than logographically. Many logographic systems also have a semantic/ideographic component, called "determinatives" in the case of Egyptian and "radicals" in the case of Chinese. Typical Egyptian usage was to augment a logogram, which may potentially represent several words with different pronunciations, with a determinate to narrow down the meaning, and a phonetic component to specify the pronunciation.
Despite the increase in population, increases in crime levels plummeted in most categories for the first time in 30 years since 1960. Property crime had declined, growing only by 13,302 cases by the end of the 1980s compared to the beginning of the decade. There were also notable drops in the number of murders, with only an increase to 238 cases by the end of the 1980s. While there is no determinate cause to this significant drop in crime, it was widely believed that new and harsh law enforcement initiatives led to the decrease in crime across both Washington state and the United States.

Therefore, several cells lines, including thymidine kinase deficient (TK) and thymidylate synthase deficient (TS) were used in order to determinate the dependency and specificity of TK for the inhibition of TS. The study could show that FdUMP inhibited the cellular growness with a bigger power than 5FU. These direct inhibitors were also used with Raltitrexed and Pemetrexed, for instance. With the same cell lines, these inhibitors based in folic had also a bigger power than the fluoropyrimidines (FP).
Pratyaksha refers to the faculties of perception with which are connected thoughts (Chinta), imagination (Kalpana) and volition (Praytna), which four together as Chetas illuminate the Manas, the ordinary mental equipment of the individual, and give awareness or consciousness (Chetna). There are four types of valid perceptions – a) Indriya pratyaksha or sense perception, b) Manas pratyaksha or mental perception, c) Svavedana pratyaksha or self-consciousness, and d) Yoga pratyaksha or super normal intuition. In sense perception, which is an indeterminate perception the chittashakti (intelligence-energy) acts as the substratum of the senses. Mental perception arises when chittashakti, with the aid of Buddhi, reflects upon objects of senses, and is a determinate perception.

According to this Upanishad there are three stages of evolution of the universe, corresponding to three major hymns in the Rigveda. These are: Avyakta (non-manifest or invisible) stage found in the Nasadiya Sukta or the Hymn of Creation; Mahattatwa (determined indeterminate or manifest imprecisely) found in the Hiranyagarbha Sukta, and "Ahamkara (determinate)" or manifest state, explained in the Purusha Sukta dedicated to the Cosmic Being. There are limits to what can be expected from an a priori deduction of experience, and this, for Fichte, equally applies to Kant's transcendental philosophy. According to Fichte, transcendental philosophy can explain that the world must have space, time, and causality, but it can never explain why objects have the particular sensible properties they happen to have or why I am this determinate individual rather than another. This is something that the I simply has to discover at the same time that it discovers its own freedom, and indeed, is a condition for the latter. Dieter Henrich (1966) proposed that Fichte was able to move beyond a "reflective theory of consciousness".
In the view of realists, individual things interact by physical connection and the relations among things are mediated by physical processes that connect them to human brains and give humans a determinate chain of action to them and correct knowledge of them. Kant was aware of problems with the positions of both of these thinkers. He had been influenced by the physics of Newton and understood that there is a physical chain of interactions between things perceived and the one who perceives them. However, an important function of mind is to structure incoming data and to process it in ways that make it other than a simple mapping of outside data.
The Bosnian Church spread greatly across Bosnia and even further, throughout Croatia, southern parts of the Kingdom of Hungary and the Seaside and even went as far as Northern Italy and southern France during his reign. It became very illfamed in Rome and Buda – in the first because of its heretical teachings and opposings of the Roman Catholic Church, and in the latter because of its political influence amongst the Bosnians in Bosnia – which was a Hungarian vassalage. Stjepan's Bosnia was thus characterized as being half-Barbaric. Furious because of this, Pope Honorius III dispatched in 1221 his legate, Aconcius, to Bosnia, to determinate the status of the Bosnian heresy.
Cochrane argues for a sentientist democracy, one with the participation of animal representatives, who can serve as trustees of political communities' nonhuman members. Animals cannot be protected, it is argued, through legal means – even a Bill of Sentient Rights – alone; instead, determinate interpretations of human duties to animals, accountability of rulers to animals, and the self- determination of political communities call for the democratic inclusion of animals. Some species shed them into the water, and others protect their eggs in various ways. The fertilized egg divides by spiral cleavage and grows by determinate development, in which the fate of a cell can usually be predicted from its predecessors in the process of division. The embryos of most taxa develop either directly to form juveniles (like the adult but smaller) or to form planuliform larvae, in which the larva's long axis is the same as the juvenile's. Very broadly, much of the philosophical work that is done in quantum theory is trying to make sense of superposition states: the property that particles seem to not just be in one determinate position at one time, but are somewhere 'here', and also 'there' at the same time. Such a radical view turns many common sense metaphysical ideas on their head. Much of contemporary philosophy of quantum mechanics aims to make sense of what the very empirically successful formalism of quantum mechanics tells us about the physical world.
Epistemicism is a position about vagueness in the philosophy of language or metaphysics, according to which there are facts about the boundaries of a vague predicate which we cannot possibly discover. Given a vague predicate, such as 'is thin' or 'is bald', epistemicists hold that there is some sharp cutoff, dividing cases where a person, for example, is thin from those in which they are not. As a result, a statement such as "Saul is thin" is either true or false. The statement does not, as other theories of vagueness might claim, lack a truth-value – even if the determinate truth-value is beyond our epistemological grasp.
Although the finite element method and plastic design theory, both capable of analyzing redundant structures, had recently been formulated and had seen occasional use, they required significantly more calculation than the simple calculation methods for statically determinate structures, which precluded the use of redundant structural members. A great number of bridges were being designed at that time, and there were insufficient design engineers available to design many bridges as indeterminate structures. Nowadays, through-truss and other fracture-critical designs are avoided in most new bridges for moderate-sized spans. Using three or more parallel main beams or trusses allows the structure to survive a single component failure.
These include discretionary conditional release (DCR) prisoners serving more than 4 years whose offence was committed before 4 April 2005, prisoners given extended sentences for public protection (EPP) for offences committed on or after 4 April 2005, and prisoners serving standard determinate sentences who have been recalled to prison after being released on licence. The Parole Board considers whether these prisoners are safe to release into the community once they have completed the minimum time they must spend in prison and also whether the Secretary of State is justified in recalling them to prison for a breach of their parole licence conditions (the rules which they must observe upon release).

The victim might also be in attendance at the beginning of a hearing in order to present their victim personal statement. Oral hearings are used to consider the majority of cases where an indeterminate sentence prisoner is applying for release and also for some cases involving both determinate and indeterminate sentences where a prisoner is making representations against a decision to recall them to prison.

Like others of his generation, Rahner was much concerned with refuting the propositional approach to theology typical of the Counter- Reformation. The alternative he proposes is one where statements about God are always referring back to the original experience of God in mystery. In this sense, language regarding being is analogically predicated of the mystery, inasmuch as the mystery is always present but not in the same way as any determinate possible object of consciousness. Rahner would claim Thomas Aquinas as the most important influence on his thought, but also spoke highly of Heidegger as "my teacher", and in his elder years Heidegger used to visit Rahner regularly in Freiburg.
The Iberian Peninsula had multiple factors contributing to the strong chivalric ethos exemplified by Spanish knights. One determinate factor to the strong adoption of chivalric orders in Spain is the Reconquista, in which Christian kingdoms attempted to expel Muslims from the peninsula. The greatest foes of the Spanish knights were Muslims, who were not an imagined enemy but one deeply entrenched in reality and not as distant as the infidel, or enemy, was for the knights of France or Germany. In other Christian kingdoms, the fighting was initially waged between Christians of different kingdoms, and as such was more debated and contested within Christian circles.
Where terminal illness is the case, no specific timescale is strictly followed, however a life expectancy of three months or less is suggested. Prisoners serving determinate sentences are also eligible for compassionate release based on tragic family circumstances. Prisoners serving indeterminate sentences are excluded from this provision and are subject to further restricting criteria in an application for compassionate release on the basis of terminal illness. They will be assessed on the risk of re-offending, particularly of a sexual or violent nature, whether further imprisonment would reduce their life expectancy, whether adequate arrangements are available outside prison, and whether early release will provide some significant benefit to their family.
Indeterminate or chance music can be divided into three groups: (1) the use of random procedures to produce a determinate, fixed score, (2) mobile form, and (3) indeterminate notation, including graphic notation and texts. After a jury trial, Cunningham was convicted of continuous sexual abuse of a child in Contra Costa County Superior Court, California. Under California's Determinate Sentencing Law (DSL), the authorized sentences for this crime are either 6, 12, or 16 years. Under the DSL, the judge must conclude first, that there are aggravating facts, and second, that the aggravating facts outweigh any mitigating factors, before imposing the high term. In this case, at a post-trial hearing, the judge found by a preponderance of the evidence that Cunningham's victim was particularly vulnerable and that his conduct was violent, making him a danger to the community.
Seventh Circuit Chief Judge Frank H. Easterbrook noted in an opinion that an argument that since Cunningham's decision, "district judges no longer may find facts that affect federal sentences ... has become popular." The Seventh Circuit rejected that argument: :Cunningham holds that California’s determinate sentencing law violates the sixth amendment, as understood in [Apprendi, Blakely and Booker], by granting the judge rather than the jury the power to find facts that raise the maximum lawful sentence. [It is] contend[ed] that Cunningham applies to the federal Sentencing Guidelines as well as to California’s system. ... [However,] Booker solved th[e] [federal sentencing guidelines'] constitutional problem by making the Guidelines advisory.
The evolution of late scholastic terminology has led to the emergence of conceptualism, which stemmed from doctrines that were previously considered to be nominalistic. The terminological distinction was made in order to stress the difference between the claim that universal mental acts correspond with universal intentional objects and the perspective that dismissed the existence of universals outside the mind. The former perspective of rejection of objective universality was distinctly defined as conceptualism. Peter Abélard was a medieval thinker whose work is currently classified as having the most potential in representing the roots of conceptualism. Abélard’s view denied the existence of determinate universals within things.

This casts fresh light on the ancient conundrum of the divisibility of matter. The multiplicity of a material object--the number of its parts--depends on the existence, not of delimiting surfaces, but of internal spatial relations (relative positions between parts), and these lack determinate values. According to the Standard Model of particle physics, the particles that make up an atom--quarks and electrons--are point particles: they do not take up space. What makes an atom nevertheless take up space is not any spatially extended "stuff" that "occupies space", and that might be cut into smaller and smaller pieces, but the indeterminacy of its internal spatial relations.

Verbs of motion are a distinct class of verbs found in several Slavic languages. Due to the extensive semantic information they contain, Russian verbs of motion pose difficulties for non-native learners at all levels of study. Unprefixed verbs of motion, which are all imperfective, divide into pairs based on the direction of the movement (uni- or multidirectional — sometimes referred to as determinate/indeterminate or definite/indefinite). As opposed to a verb-framed language, in which path is encoded in the verb, but manner of motion typically is expressed with complements, Russian is a satellite language, meaning that these concepts are encoded in both the root of the verb and the particles associated with it, satellites.

Our linguistic systems contain a systemic complexity which supposedly could not be empirically derived: the environment seems too poor, variable and indeterminate, according to Chomsky, to explain the extraordinary ability to learn complex concepts possessed by very young children. Essentially, their accurate grammatical knowledge cannot have originated from their experiences as their experiences are not adequate. From Totems to Teachers New York: Columbia University Press The notion of evolution that the Boasians ridiculed and rejected was the then dominant belief in orthogenesis—a determinate or teleological process of evolution in which change occurs progressively regardless of natural selection. Boas rejected the prevalent theories of social evolution developed by Edward Burnett Tylor, Lewis Henry Morgan, and Herbert Spencer not because he rejected the notion of "evolution" per se, but because he rejected orthogenetic notions of evolution in favor of Darwinian evolution. The difference between these prevailing theories of cultural evolution and Darwinian theory cannot be overstated: the orthogeneticists argued that all societies progress through the same stages in the same sequence.

" Viens (2004) contends that "we do not know in any robust or determinate sense that infant male circumcision is harmful in itself, nor can we say the same with respect to its purported harmful consequences." In New Zealand, "preventive detention" is an indeterminate sentence of imprisonment, second only to life imprisonment in terms of seriousness. It may be given to offenders aged 18 or over who are convicted of a qualifying sexual or violent offence, and the court is satisfied that the person is likely to commit another qualifying sexual or violent offence if they were given a determinate sentence of imprisonment. Preventive detention has a minimum non-parole period of five years in prison, but the sentencing judge can extend this if they believe that the prisoner's history warrants it. A total of 314 people were serving terms of preventive detention in 2013, of whom 34 were on parole.

John Wheeler, 1985 Wheeler's delayed-choice experiment is actually several thought experiments in quantum physics, proposed by John Archibald Wheeler, with the most prominent among them appearing in 1978 and 1984.Mathematical Foundations of Quantum Theory, edited by A. These experiments are attempts to decide whether light somehow "senses" the experimental apparatus in the double-slit experiment it will travel through and adjusts its behavior to fit by assuming the appropriate determinate state for it, or whether light remains in an indeterminate state, neither wave nor particle until measured.
An offender who is at least 17 years of age and has been convicted of at least two violent or sexual offences can be declared a dangerous offender and detained indeterminately. A judge must consider the potential of future harm that could be caused by the offender, the circumstances of the offenses, medical and psychiatric opinion, and any other matters of relevance. The Early Girl tomato is a medium-sized globe-type F1 hybrid popular with home gardeners because of its early ripening fruit. The three points resemble either a triangle, or the letter A. Three-point attachment is the simplest and the only statically determinate way of joining two bodies in engineering. A three-point hitch attaches the implement to the tractor so that the orientation of the implement is fixed with respect to the tractor and the arm position of the hitch. EPR tried to set up a paradox to question the range of true application of quantum mechanics: Quantum theory predicts that both values cannot be known for a particle, and yet the EPR thought experiment purports to show that they must all have determinate values. The EPR paper says: "We are thus forced to conclude that the quantum-mechanical description of physical reality given by wave functions is not complete." The EPR paper ends by saying: > While we have thus shown that the wave function does not provide a complete > description of the physical reality, we left open the question of whether or > not such a description exists. We believe, however, that such a theory is > possible.
"Measure is the simple relation of the quantum to itself ... ; the quantum is thus qualitative." Previously, Quantum was held to be indifferent to the Quality of that which it quantified. Now, as Measure, Quality and Quantity though still distinct from one another are inseparable and in their unity comprise a specific Determinate Being: "Everything that exists has a magnitude and this magnitude belongs to the nature of the something itself." The indifference of Quantum is retained in Measure insofar as the magnitude of things can increase or decrease without fundamentally altering their Quality, and yet their essential unity nevertheless manifests at the Limit where an alteration in Quantity will bring about a change in Quality.
Although, like Ockham, he refused to construe relations as things distinct from absolute entities, he clearly ascribed them to an act of the soul by which absolute entities are compared and placed in relation to each other. He therefore completely rejected certain propositions Ockham had admitted reasonable, even if he did not construe them in the same way. Albert's voluminous collection of Sophismata (c. 1359) examined various sentences that raise difficulties of interpretation due to the presence of syncategorematic terms such as quantifiers and certain prepositions, which, according to medieval logicians, do not have a proper and determinate signification but rather modify the signification of the other terms in the propositions in which they occur.

Rodney Hulin, a 17-year-old prisoner, reported being raped, harassed and assaulted by fellow inmates of his age group after his November 1995 transfer to a division for younger offenders in Clemens.

By Walras's law, if all but one of the excess demands is zero then the last one has to be zero as well. Philosophy of Existence (German: Existenzphilosophie, 1938) is a book by German psychiatrist and philosopher Karl Jaspers. It is both a discussion on the history of philosophy and an exposition of Jaspers' own philosophical system, which is often viewed as a form of existentialism. In the past few decades, correctional institutions have seen a shift, with prisoners serving indeterminate sentences and release being assessed by parole boards, to offenders being released from prison after serving determinate sentences. Although, those released are not receiving sufficient preparation for returning to their communities due to limited in-prison and post-release reentry programs; this inadequate structure for re-entry directly influences the possibility of recidivism, also referred to as the "revolving door." United States spending for corrections is approximately $80 billion a year, with re-entry receiving the least amount of fiscal attention relative to other parts of the criminal justice system process. From 2001 to 2004, the United States' federal government allocated over $100 million for reentry programs.

It has been argued that gender is not genetically inherited but a process of structuring subjectivities, whereas sex is biologically determinate and static (Claassen 1992, Gilchrist 1991, Nelson 1997). To some professionals in the field, however, sex is not “the ground upon which culture elaborates gender” (Morris 1995, 568-569) and “sexing biases have been identified among the methods used in sexing skeletons… When sex is assigned to a skeleton of unknown sex, it is a cultural act” (Claassen 1992, 4), pointing out the more prominent cultural biases in the field of archaeology. These philosophies make Western biological anthropological methods of determining sex of fossils, not appropriate for cross-cultural studies given that not the same physical characteristics are used by all cultures to determine an individual’s sex. This approach of sexual fluidity, meaning that sex is not a cross-cultural concept and it is mostly culturally assigned, has been undermined by the wide application of DNA analysis to skeletal remains in Western Archaeology.

One of Hillgruber's leading critics, the British Marxist historian Timothy Mason, accepted the Stufenplan thesis, but argued that an economic crisis derailed the Stufenplan in the late 1930s. Socialist Alliance of Working People of Yugoslavia is the widest democratic front of working people and citizens and is under the leadership of the Communist Party in order to achieve political unity and action. In its framework it is possible to discuss social issues, launch political initiatives and harmonization of opinions to determine political attitudes.
The Greek mathematician Menaechmus solved problems and proved theorems by using a method that had a strong resemblance to the use of coordinates and it has sometimes been maintained that he had introduced analytic geometry. Anthropologists Edward Burnett Tylor in England and Lewis H. Morgan in the United States worked with data from indigenous people, whom they claimed represented earlier stages of cultural evolution that gave insight into the process and progression of cultural evolution. Morgan would later have a significant influence on Karl Marx and Friedrich Engels, who developed a theory of cultural evolution in which the internal contradictions in society created a series of escalating stages that ended in a socialist society (see Marxism).
