Gorman and other disgruntled UTW leaders filed suit against TWOC, claiming that UTW funds had been illegally appropriated by TWOC. A Rhode Island superior court ruled on November 30, 1938, that the TWOC-UTW agreement of March 9 was invalid. Gorman then denounced TWOC and Hillman, and sought to re-affiliate UTW with the AFL. On December 28, 1938, Gorman led a convention of 21 delegates in voting for affiliation with the AFL.

The action not only angered other New England locals, but undercut TWOC organizing efforts in the region. Determined to uphold the authority of TWOC and concerned that the council's action might spark a revolt by other New England local unions, Rieve revoked the charters of the seven locals. In late 1938, TWOC also saw a revolt from within. Hillman distrusted Gorman, and clearly favored Rieve as the leader of the union which would emerge once TWOC's organizing drives concluded.

Hillman was named the chairman, and Thomas Kennedy of the United Mine Workers its secretary-treasurer. The committee's other five members included Gorman and Rieve. TWOC organized impressive numbers of workers in its first six months. By September 1937, TWOC had organized 215,000 workers, most of them in the Northeast.

But the recession of 1937 led to layoffs and sharp drops in TWOC membership. Additionally, Hillman fell critically ill in October 1937. He did not return to the committee's leadership until April 1938, and Rieve (not Thomas) was named the committee's acting chairman. Meanwhile, TWOC opened its organizing drive in the Deep South, but its efforts against the "fortress of southern cotton" proved fruitless.

In England, Wales and Northern Ireland taking without owner's consent (TWOC), also referred to as unauthorised taking of a motor vehicle (UTMV) describes any unauthorised use of a car or other conveyance that does not constitute theft. A similar offence, known as taking and driving away, also exists in Scotland. In police slang usage, twoc became a verb, with twocking and twockers (also spelled twoccing and twoccers) used respectively to describe car theft and those who perpetrate it: these usages subsequently filtered into general British slang.

The AFL executive council approve the affiliation on February 3, 1939.Gorman was denied the presidency of the reaffiliated union, because AFL president William Green told him he must be penalized for agreeing to lead the union out of the AFL in the first place. Hillman and the TWOC leadership branded Gorman a traitor and replaced him with George Baldanzi, president of the UTW's dyers division. Realizing that the March 9 agreement might not survive court scrutiny, Hillman, Rieve and Baldanzi called a convention of UTW and TWOC locals for May 15, 1939.

The geographic spread of the industry encompassed 29 states, with nearly 75 percent of all textile employment in the virulently anti-union Deep South. But Sidney Hillman, president of the Amalgamated Clothing Workers of America and a CIO vice president, was adamant that the CIO undertake a comprehensive organizing drive in textiles. Now, two years after the victories in steel and automobiles, Hillman pressured CIO leaders to force the UTW into an agreement similar to that which had created SWOC. On May 9, 1937, the Textile Workers Organizing Committee (TWOC) was formed.

Some companies competed by setting up low cost units to compete for tendered services, such as Blue Bus and TWOC of Busways, and Merseyrider of Merseybus. West Midlands Travel set up an express coach service with London Regional Transport to compete with National Express, who would ironically later purchase WMT. One of the largest pieces of competition came from competition between MTL and GM Buses South, with both operators setting up operations in each other's areas. This led to both operators losing money, and was ended in a gentleman's agreement.

In law, knowledge is one of the degrees of mens rea that constitute part of a crime. The ACWA had played a leading role in the funding and leadership of the Textile Workers Organizing Committee, an organization founded by the CIO in 1939 as part of its effort to organize the South. The TWOC, which later renamed itself the Textile Workers Union of America, grew to as many as 100,000 members in the 1940s, but made little headway organizing in the South in the decades that followed. The ACWA merged with the TWUA in 1976 to form the Amalgamated Clothing and Textile Workers Union. The United Hatters, Cap and Millinery Workers International Union (UHCMW) merged into the union in 1983.

The judge at first instance described the defendant as a menace, having driven in ways that could so easily have killed wholly innocent road users while disqualified, while released on licence having been convicted of other aggravated TWOC offences, and while "out of his head" on ecstasy. He had a long track record of convictions. The judge imposed the maximum consecutive sentences for aggravated taking and driving while disqualified. According to R v March (2002) 2 Cr App R (S) 448, credit should be given for a guilty plea and Forbes felt a keen sense of injustice that he had been given the maximum sentence.

The strike represented the high point for union hopes of organizing textile workers in the South for the next several decades. When the CIO formed the Textile Workers Organizing Committee three years later, the TWOC focused on northern manufacturers outside the cotton industry. TWOC's successor, the Textile Workers Union of America, faced similar problems organizing in the South; the CIO's postwar organizing drive in the South fell apart chiefly because of its inability to organize textile workers there. The union might have escaped this disaster if it had characterized the strike as a first step, rather than attempting to pass it off as a victory.

That, however, would have required that the union also devote the resources necessary to follow up with renewed, systematic organizing efforts in the immediate aftermath of the strike, instead of concerning itself with the futile effort to win reinstatement for discharged strikers through the Textile Labor Board. The memory of blacklisting and defeat soured many Southern textile workers on unions for decades. The 1934 defeat was less cataclysmic in the North, in that the strike was in fact, a number of separate events, commencing at different times in separate industries and in furtherance of local goals. Northern employers were not as ruthless in blacklisting workers and the TWOC made some headway in organizing these plants in the years that followed.
