The structure of today's family has evolved over the past decades from the "traditional" married, heterosexual couple to an increasing number of alternative family lifestyles. Non-traditional family units can include single-parent families, families with one biological parent and a step-parent, blended families, gay marriage families, and families where parents are absent and grandparents or other relatives take over parental roles. While all these non-traditional family lifestyles might present social challenges for the children as well as create undesirable career experiences, the two units that warrant the most consideration are the single-mother and same-sex partner lifestyles. Many the services provided for families post adoption are dedicated to special cases of adoption for example for children with special needs. Where joint adoption of children by same-sex couples is legal, so too is step-parent adoption. In all jurisdictions within Australia, a lesbian co-mother or gay co-father may use stepparent adoption provisions, although female couples in those states whose children were born through assisted conception may not actually need to adopt them, as the law there presumes the mother's female partner to be a legal parent as long as she consented to the conception. As of 2017, all states and territories, allow both same-sex partners to have a legally recognised relationship with their child - except Western Australia within surrogacy. Similar tales of a parent or a step-parent cursing their (step)children are the Irish legend of The Children of Lir, and The Wild Swans, a literary fairy tale by Danish author Hans Christian Andersen. An inversion of the story (humans turning into swans) can be found in the Dolopathos: a hunter sights a (magical) maiden bathing in a lake and, after a few years, she gives birth to septuplets (six boys and a girl), born with gold chains around their necks.

In 2014, the parent and step-parent of one of the 2012 Aurora, Colorado shooting victims, represented by Brady Center lawyers, filed suit against the companies from whom James Holmes purchased the ammunition, magazines, and body armor he used in the shooting. In 2015, the judge in the case dismissed the suit on the grounds that such a lawsuit is in violation of both Colorado law and the federal Protection of Lawful Commerce in Arms Act because the guns and ammunition obtained from the online companies, including Lucky Gunner and The Sportsman's Guide, worked as claimed. He also ordered the plaintiffs to pay the legal costs of the defendants, which came to $280,000. As the Brady Center lawyers would be expected to know applicable case law in such a lawsuit, it is not clear whether the Brady Center or the plaintiffs themselves are responsible for paying the judgment.

The NFSS survey of over 15,000 Americans between the ages of 18 and 39 was conducted by Knowledge Networks on behalf of the University of Texas at Austin. Its stated purpose was to determine differences in outcomes among young adults raised by same-sex parents compared to young adults raised by "their married biological parents, those raised with a step-parent, and those raised in homes with two adoptive parents." The survey collected data from young adults who had grown up in one of five unconventional families, namely, those where a parent had had a same- sex romantic relationship, biologically unrelated parents adopted the respondent, parents were unmarried but co-habiting, biological mother had a romantic relationship with another man, and biological mother did not have a romantic relationship with another man. The survey also collected data from young adults from conventional families as a control group.

Currently in 2020, Chile's Congress is debating the "Bill of the Integral Reform of the Adoption System in Chile" that would allow adoption by same-sex couples. On May 8, 2019, the Chamber of Deputies passed the bill by 104 votes in favor, 35 against and 4 abstentions, allowing joint and step-parent adoption by same-sex couples, within a marriage, civil union or not, and banning discrimination based on sexual orientation and gender identity in the process of adoption. Two amendments that were presented by the Government were rejected which sought to establish at all events that the opposite-sex couples of "father and mother" should be privileged, over same-sex couples, but another "discriminatory" amendment was successfully introduced stating that "if the child or adolescent expresses his will to have a father and a mother, the judge must consider it preferentially." The bill now moves to the Senate.

The parent and step-parent are not entitled to molest their children or to exceed the bounds of moderate and reasonable chastisement. Section 35(1) of the Interim Constitution provides expressly that the rights entrenched in it, including section 10—"every person shall have the right to respect for and protection of his or her dignity"—and section 11(2)—no "person shall be subject to torture of any kind, whether physical, mental or emotional, nor shall any person be subject to cruel, inhuman or degrading treatment or punishment"—shall be interpreted in accordance with the values which underlie an open and democratic society based on freedom and equality. In determining, then, whether punishment is cruel, inhuman or degrading within the meaning of the Constitution, the punishment in question must be assessed in the light of the values which underlie the Constitution. The simple message to be taken from this, according to the Constitutional Court, in S v Williams,1995 (3) SA 632 (CC).

Victorian law has allowed same-sex adoption since 1 September 2016. In May 2014, the state conference of the Victorian Labor Party unanimously approved a change in the party's platform, in support of full adoption rights for same-sex couples. After Labor won government at the November 2014 state election, the newly appointed Equality Minister Martin Foley promised to amend the Adoption Act 1984 to allow for adoptions by same- sex couples. Foley said Labor would also tackle other inequalities, including the inability of a step-parent to adopt their partner's child and the inability of a gay couple to jointly adopt a child conceived through IVF. A review of Victoria's adoption laws, commissioned by former chief parliamentary counsel Eamonn Moran QC, handed a final report to the Minister on 8 May 2015. A bill to give same-sex couples adoption rights was introduced to Parliament on 6 October 2015. The bill, subject to a conscience vote for the Liberal/ National opposition, was passed by the Legislative Assembly by 54 votes to 26, with 7 abstentions. No Liberal MP voted in favour of the bill, however six of the eight National MPs supported the legislation.
