The Civil Union Act, which came into effect on 30 November 2006, legalised same-sex marriage and also allowed for the legal designation of religious marriage officers without any religious restriction in accordance with the Constitution. Previously, religious marriage officers could only be legally designated as such "for the purpose of solemnising marriages according to Christian, Jewish or Mohammedan rites or the rites of any Indian religion" in accordance with the Marriage Act. Richard Fletcher, Bishop of Bristol, gave him some appointment in Bristol. Complaints were made about his teaching, and he published his ‘Catechism,’ 1591, which is a workmanlike presentation of Calvinism. In it he argues against bowing at the name of Jesus, and describes the right way of solemnising Christmas.

After the controversy of underage marriage of Keshub Chunder Sen's daughter, the Special Marriages Act of 1872 was enacted to set the minimum age of 14 years for marriage of girls. All Brahmo marriages were thereafter solemnised under this law. Many Indians resented the requirement of the affirmation "I am not Hindu, nor a Mussalman, nor a Christian" for solemnising a marriage under this Act. The requirement of this declaration was imposed by Henry James Sumner Maine, legal member of Governor General's Council appointed by Britain.

Marriages were only legally binding if they were notified to the superintendent registrar by the officiating minister so in effect, this required the presence of a local registration officer as the authorising person. When a nonconformist minister or other religious official, such as a rabbi, performed the ceremony it was necessary for the local registrar or his assistant to be present so that the marriage was legal. He appeared on the 30th; excused himself from residence in Orkney on account of the climate and his health; and denied that he knew F. Bothwell was a papist. For solemnising the royal marriage, "contrarie an act made against the mariage of the divorced adulterer," the assembly deprived him of all function in the ministry till such time as he should satisfy the assembly "for the slaunders committed by him." However, on 10 July 1568, the assembly restored him to the ministry, did not renew his commission to superintend the diocese of Orkney; but ordered him, as soon as his health permitted, to preach in the Chapel Royal ("kirk of Halyrudhous"), and after sermon confess his offence in the matter of the ill-fated marriage.
