In February 2010, New South Wales Attorney General Hatzistergos announced that the state government will introduce legislation for a statewide relationships register modelled on ones already in place in the ACT, Victoria and Tasmania. Entering into a "registered relationship" provides conclusive proof of the existence of the relationship, thereby gaining all of the rights afforded to de facto couples under state and federal law without having to prove any further factual evidence of the relationship. In this way, a registered relationship is similar to a registered partnership or civil union in other parts of the world. The law came into effect on 1 July 2010.

De facto relationships provide couples who are living together on a genuine domestic basis with many of the same rights and benefits as married couples. The new law changed the name from "civil partnership" to "registered relationship" and prohibited the state from offering ceremonies for those who do register their relationship in this manner. Following the 2015 state election, which saw Labor form minority government, the Parliament passed (in December 2015) the Relationships (Civil Partnerships) and Other Acts Amendment Act 2015, which restored state-sanctioned ceremonies for same- sex and opposite-sex couples and once more changed regulations referring to "registered relationships" with "civil partnerships". The law came into effect following a number of administrative matters occurring, with civil partnerships resuming in the state on 2 April 2016.

Two people can become a de facto couple by entering into a registered relationship (i.e.: civil union or domestic partnership) or by being assessed as such by the Family Court or Federal Circuit Court. Couples who are living together are generally recognised as a de facto union and thus able to claim many of the rights and benefits of a married couple, even if they have not registered or officially documented their relationship, although this may vary by state. It has been noted that it is harder to prove de facto relationship status, particularly in the case of the death of one of the partners.

The Assembly re-worded the amendment, though retained the ability for the register to conduct a ceremony in connection with a registered relationship, and the bill formally passed the Parliament on 16 February 2016. The bill received royal assent on 16 February 2016 and became the Relationships Amendment Act 2016. Portions of the law that; provided for immediate recognition of a domestic relationship for unions entered into in different jurisdictions, removed the previous 12-month living requirement for couples, and recognised de facto relationships, overseas same- sex marriages and civil unions on death certificates, went into effect on 1 July 2016. Under the commencement provisions of the legislation, the entirety of law went into effect on 1 October 2016.

The legislation passed the Parliament in December 2006. Under state law, equal superannuation entitlements for same-sex couples are provided for with the Statutes Amendment (Equal Superannuation Entitlements for Same Sex Couples) Act 2003. Equal rights in superannuation matters were eventually federalised in 2009.. Further legislation in 2011, the Statutes Amendment (De Facto Relationships) Act 2011, recognised same-sex couples in asset forfeiture, property and stamp duty applications. Further legislation in 2017, the Statutes Amendment (Registered Relationships) Act 2017, recognises the domestic partnerships of same-sex couples who enter into a registered relationship (see below) in 13 additional pieces of legislation, equalising treatment for such couples in matters relating to inheritance, correctional facilities, the South Australian Supreme Court, the first home buyers grant, surveying, Governor's pensions, civil liability, and conveyancing.
