In 869, the Council of Capharthutha was held to regulate the relationship and resolve the differences between the two positions. The Council agreed that just as the patriarch consecrated the Maphrian, the consecration of a new Patriarch would be reserved to the Maphrian and that both would avoid interfering in the administration of the other. However, the Maphrians often had disputes with bishops within his own administration, such as the metropolitan of the Monastery of Mar Mattai near Nineveh, who was jealous of the preponderating influence of Tagrit. The maphrianate was based in Tagrit until 1089 upon the destruction of the main cathedral, known as the Green Church and was relocated to Mosul.

Beza did not believe it wise for the Company of Pastors to have a permanent head. He convinced the Company to petition the Small Council to have limited terms for the position of moderator.

On the other hand, it has been justly urged that the two passages are addressed to different persons. Thus the evidence for the identity of the two writers may on the whole be treated as preponderating. But the ambiguity of interpretation remains; and it would be impossible to rank Basilides confidently among dualists, even if the passage in the Acts stood alone: much more to use it as a standard by which to force a dualistic interpretation upon other clearer statements of his doctrine.

Convinced as he was of the necessity for union and reform, he contributed more than anyone to the adoption of the principle that, since the schism had survived the Council of Pisa, it was necessary again to take up the work for a fundamental union, without considering the rights of John XXIII any more than they had those of Gregory XII and Benedict XIII. From this point of view d'Ailly, together with his compatriot Cardinal Fillastre, took the preponderating part during the first few months. Afterwards, seeing the trend of events, he showed some uneasiness and hesitation. He refused, however, to undertake the defence of John XXIII, and only appeared in the trial of this pope to make depositions against him, which were sometimes of an overwhelming character.
