Article 7th.--This being the happy period of general peace and reconciliation, the Nabob Tippoo Sultan Bahadur as a testimony and proof of his friendship to the English, agrees that the Rajahs or Zemindars on this coast, who have favoured the English in the late war shall not be molested on that account. Article 8th.

This was during that interval in the long service of Ralph Hopton as Knight Marshal between 1556 and 1558, whose staunch Protestantism became irreconcileable with that position in the household. Despite his absences from Parliament Rous suffered little distraint on that account during Mary's reign,Hyde, 'Rous, Sir Edmund', History of Parliament. but his costs rose against him. In 1557 he was awarded 1,000 marks in respect of his rights in the manor of Okenhill at Badingham, payable by the Duke of Norfolk's executors,Suffolk Record Office, Ipswich: Iveagh (Phillips) Manuscripts, ref HD 1538/120/6 (Discovery Catalogue).

The increased focus of the police on celebrity drug use led, in author Peter Walsh's words, to "an unholy" alliance between the News of the World and Scotland Yard. In 1967 they began a campaign against many bands, including The Who, the Moody Blues and Cream. Walsh notes however, that "for all the common inches devoted to handcuffed rock stars, the amounts seized continued to be trifling". The News of the World was particularly well known for its prurient headlines and exposés, such as "celebrity scoops and sex scandals", gaining it the nickname of "News of the Screws" on that account.

The feats of the warmongering Lasakau tribe became widespread and abhorred by Missionaries such as Reverend Williams who stated, "The Lasakau people especially, were widely known as dangerous men (tamata rerevaki)".."Very bloodthirsty and cruel". Reverend Jagger said of the Lasakau, " much feared on that account, the circumstance of them having plenty of canoes at their command enables them the more effectively to carry their schemes into practice".Fiji and the Fijians, Rev Williams, 3 Mar 1845 Ratu Tanoa Visawaqa, Vunivalu of Bau. (1929-52) The introduction of firearms in tribal skirmishes by Bau added to their naval superiority.

Their concern for "liberty can scarcely be exaggerated". They believed that "government would employ education for its own ends" (teaching habits of obedience and indoctrination), and that government-controlled schools would ultimately teach children to rely on the State for all things. Baines, for example, noted that "[w]e cannot violate the principles of liberty in regard to education without furnishing at once a precedent and inducement to violate them in regard to other matters". Baines conceded that the then current system of education (both private and charitable) had deficiencies, but he argued that freedom should not be abridged on that account.

Pulcelina of Blois (died 1171) was a Jewish woman, mistress and/or moneylender to the count Theobald V of Blois. According to the chronicle, Pulcelina was a Jewish woman with great influence over Theobald V, which created envy among the local elite as well as the countess, Alix of France. The chronicle claims that she was the mistress of Theobald V, but she may have been only his moneylender, having had influence over him on that account, rather than as his lover. In 1171, a Jew of the local Blois community was accused of blood libel by the servant of a local nobleman, who used the accusation to go against Pulcelina.

One innocent man was condemned on that account and was immured in a fortress until a true culprit admitted his guilt to a confessor 32 years later. Charles Alexandre's reminiscences were not published until 1845. Charles Alexandre's nephew, Ernst Bogislaw von Croÿ (1620–1684), inherited both princely and ducal titles of Croÿ when he was just four years old. As his father died a month after his birth, Ernst Bogislaw was brought up by his mother, Anne de Croy (also known as Anna of Pomerania in her native land, where he was styled Prince of Massow and of NeugartenEdward Rymar, Rodowód książąt pomorskich, wyd.

A revolving account is an account created by a financial institution to enable a customer to incur a debt, which is charged to the account, and where the borrower does not have to pay the outstanding balance on that account in full every month. The borrower may be required to make a minimum payment, based on the balance amount. However, the borrower normally has the discretion to pay the lender any amount between the minimum payment and the full balance. If the balance is not paid in full by the end of a monthly billing period, the remaining balance will roll over or "revolve" into the next month.

The poem's mockery also extends to the English interlopers in Wales, and at least one reader has complained of its racial prejudice on that account. But the critic Tony Conran sees "Trouble at a Tavern" as being not just a comic romp but a poem shot through with multiple layers of irony, most notably in its hints that the Welsh hero is playing at being an Anglo-Norman lordling, and therefore getting a justified comeuppance. He also sees the possibility in the poem's final pious words of an ironic irreverence towards God himself. But perhaps it is simply a warning to impetuous young men not to be so foolish.

Broderip was a son of William Broderip, organist of Wells Cathedral, who died in 1726. In 1740 he was organist at Minehead. The first mention of him in the chapter records of Wells is on 2 December 1740, when he was admitted a vicar choral of the cathedral for a year on probation. On 1 April 1741 it was ordered by the dean and chapter that Broderip, who had supplied the place of organist from the death of Mr. Evans, should be paid the usual salary allowed on that account in proportion to the time, and he was admitted into the place of organist of the cathedral.

After her photograph was published, she accompanied Senator Charles Sumner, a leading abolitionist, on a publicity tour. The photo and tour made her famous, and she was compared to fictional character Ida May, the child hero of the then popular novel about a white girl kidnapped into slavery, Ida May: a Story of Things Actual and Possible by Mary Hayden Pike (1854). She was described in the words of a columnist in Frederick Douglass’ Paper as ‘perfectly white, and on that account produces intense excitement. We see daily white fugitives and the cupidity of a slaveholder would suffer him to keep anyone, even his mother, in slavery.

Brackenbury 1906, 22 Times L.R. 797 The limit of the surety's liability must be construed so as to give effect to what may fairly be inferred to have been the intention of the parties as expressed in writing. In cases of doubtful import, recourse to parol evidence is permissible, to explain, but not to contradict, the written evidence of the guarantee. As a general rule, the surety is not liable if the principal debt cannot be enforced. It has never been actually decided in England whether this rule holds good in cases where the principal debtor is a minor and on that account is not liable to the creditor.

Reed faced similar criticism when acquiring artifacts for the National Civil War Museum. Opponents and critics are most critical about the methods Reed used to fund the purchases without public oversight: "Every time the independent Harrisburg Authority floats bonds for the Harrisburg school district and other government agencies, it collects a fee and deposits it into an account. The mayor can draw on that account for any capital expense as long as he has the signatures of two members of the authority (all appointed by the mayor)." Reed won reelection in 2005, unopposed, after winning the Democratic Primary against Jason N. Smith, a Harrisburg entrepreneur and outspoken critic of the Old West Museum and artifact purchases.

He was consecrated Bishop of Cloyne in 1695, and promoted to the see of Clogher in 1697, and to that of Derry in 1717. He spent a large sum on refurbishing the episcopal palace at Clogher. He refused to become Archbishop of Tuam in 1716, on the ground that the stipend was inadequate. He had a reputation for being an absentee bishop and was sharply reprimanded on that account by William King, Archbishop of Dublin, who wrote that the enemies of the church were led by his conduct to conclude that "bishops are not necessary, since they can so long be spared", and pleaded with him to "think of coming home as soon as possible".

Tariff Reform League poster with Joseph Chamberlain C. Arthur Pearson (later described by Winston Churchill as "the champion hustler of the Tariff Reform League") had had a financial interest in the St. James's Gazette for several years. When the Tariff Reform battle started Pearson was the head of a syndicate which bought the morning Standard newspaper in 1904 for £300,000. With the acquisition went the London Evening Standard, which published every day a full list of Stock Exchange prices and was largely purchased on that account. Steinkopff sold the St. James's Gazette (or a controlling interest in it) to Pearson in 1903, who amalgamated it with the Evening Standard on 13 March 1905; the Gazette ceased publication thereafter.

In 1322 much damage was done to the castle by Robert the Bruce, whose attack it successfully resisted, but it was restored and strengthened by John of Gaunt, 1st Duke of Lancaster, who added the greater part of the Gateway Tower as well as a turret on the keep or Lungess Tower, which on that account has been named "John o' Gaunt's Chair". In 1322 the Scots burnt the town, it was rebuilt but removed from its original position on the hill to the slope and foot. Again in 1389, after the Battle of Otterburn, it was destroyed by the Scots. Lancaster Castle is well known as the site of the Pendle witch trials in 1612.

It is not known when Wei Wen was born. His father was Wei Xuanyan (韋玄儼), who served as a prefectural prefect late in the reign of Emperor Gaozong. Wei Wen's cousin—the daughter of Wei Xuanyan's younger brother Wei Xuanzhen (韋玄貞) -- was the wife and crown princess of Emperor Gaozong's son Li Zhe the Crown Prince, and on that account was quickly promoted. After Emperor Gaozong's death in 683, Li Zhe took the throne (as Emperor Zhongzong), but soon ran afoul of his mother Empress Dowager Wu (later known as Wu Zetian), who retained power as regent, partly over his desire to promote Wei Xuanzhen to be chancellor.

Much against the will of his father, who on that account broke off contact with him, he took a position little better than that of a servant with Friedrich Georg and Ernst Nikolaus von Kleist (), barons from Courland and officer cadets about to begin their military service, whom he accompanied to Strasbourg. Once there, he came into contact with the actuary Johann Daniel Salzmann, around whom had formed the literary group of the Société de philosophie et de belles lettres. This was frequented also by the young Johann Wolfgang von Goethe, who at this time happened to be in Strasbourg, and whose acquaintance Lenz made, as well as that of Johann Heinrich Jung-Stilling.

That the soul sinned in its pre-existent state and on that account was incarcerated in the body is regarded by the Catholic Church regards as a fiction that has been repeatedly condemned. Divested of that fiction, the theory that the soul exists prior to its infusion into the organism, while not explicitly reprobated, is obviously opposed to the doctrine of the Catholic Church according to which souls are multiplied correspondingly with the multiplication of human organisms. However, whether the rational soul is infused into the organism at conception, as the modern opinion holds, or some weeks subsequently, as medieval scholastics supposed, is an open question to some theologians. In her letters home, she often expressed her concerns for Indian welfare in political terms; this contrasts with the religious arguments she had used to persuade her family to accept her engagement.

The Heracleidae ruled in Lacedaemon until 221 BC, but disappeared much earlier in the other countries. This conquest of Peloponnesus by the Dorians, commonly called the "Return of the Heracleidae," is represented as the recovery by the descendants of Heracles of the rightful inheritance of their hero ancestor and his sons. The Dorians followed the custom of other Greek tribes in claiming as ancestor for their ruling families one of the legendary heroes, but the traditions must not on that account be regarded as entirely mythical. They represent a joint invasion of Peloponnesus by Aetolians and Dorians, the latter having been driven southward from their original northern home under pressure from the Thessalians.

If through no fault of the patron, the name of an ineligible person is presented, he is granted a certain time of grace to make a new presentation. If, however, an ineligible person has been knowingly presented, the spiritual patron loses for the time being the right of presentation, but the lay patron, so long as the first interval allowed for presentation has not expired, may make an after-presentation. Thus the presentation of the spiritual patron is treated more after the manner of the episcopal collation. On that account the spiritual patron is not permitted an after-presentation or a variation in choice, which is permitted the lay patron, after which the bishop has the choice between the several names presented.

These establishments are grouped by specialty and, on that account, must have accredited or certified technical personnel. Similar to the other South Indian Kshatriya clans the Kondas too may have claimed descent ultimately from the Mahabharata Kauravas. The name Konda had been widely used in the Pandya kingdom and the Sri Lankan chronicle Mahavamsa refers to Punkonda, Khuddakancha Kunda and Kanga Konda in connection with the 12th century Pandyan invasion by the General of Parákramabáhu the Great (Mahavamsa 76.94, 76.140, 76.171 & 76.184 ). Parantaka I, the Chola King who defeated the joint Sri Lankan and Pandyan armies had assumed the victory title Dorai Eelam Kondai on that account and therefore it appears that Kondai meant conqueror. Andhra Region Chola Adithya’s victory over Kondai Mandalam shifted the balance of power between the Pallavas and Cholas and was the beginning of the Chola empire.

Previously, a 2.9% fee applied to funds added via debit card, although Google dropped that ability as of May 2, 2016. Funds sent from a Wallet balance, debit card, or linked bank account are generally available to the recipient immediately, and if the recipient has his or her own Wallet account and card, he or she can make an immediate withdrawal of those funds from an ATM. If the funds are drawn on the sender's Wallet balance, the balance will also reflect this change immediately. Raymond Vaufrey, studying the industry of flint implements found at the foot of the engraved rocks, takes the naturalistic figures to the "Neolithic of the Capsian tradition" deriving from the Neolithic of Egypt, and places them between 4200 and 2000 B.C. The ram, which he considers domesticated, is only a transposition of the Egyptian cult of Ammon and the representations of it cannot be older than 2200 B.C. For Henri Lhote however, there is not any archaeological argument which should cause one to separate the rams, supposed to be later, from the giant hartebeest, elephants or rhinoceros. Being like them of Neolithic age, they cannot derive from the Egyptian ram, and need not on that account be considered as the ancestors of a cult of which the ram of Ammon would constitute a late sequel.

Charlemagne especially repressed the Saxons, and the Council of Paderborn was no different. It punished all sorts of idolatry, denied the existence of witchcraft and the efficacy of magic, ordered the death penalty for self-appointed witch-hunters who had caused the death of persons accused of witchcraft, condemned sorcerers to be servants to the church, commanded Saxons to have infants baptized the first year. The law is particularly noted for the way it also condemned to death "anyone who, blinded by the Devil, heathenwise should believe a person to be a witch and maneater, and should on that account have burned him or eaten his flesh, or given it to others to eat." It is part of the goal of rejecting the existence of witches and that burning them was considered a pagan custom.

The following account of Sabrisho's patriarchate is given by Bar Hebraeus: > In the year 623 of the Arabs [AD 1226], on the twelfth day of the fourth > month, on the first Sunday after Easter, Sabrisho bar Masihi, metropolitan > of Daquqa, was consecrated catholicus, because he bribed the caliph al-Zahir > with gold. This happened because he had won the respect of the caliph's > brothers, who were distinguished noblemen, just as he himself was an > honourable man, of a pleasant disposition, straightforward and affable, and > on that account loved by all. He was succeeded by Makkikha, metropolitan of Nisibis.

Describing Judgment Day, the poet used terms and concepts drawn from secular law. Some examples are highlighted in the Synopsis, above. Most strikingly, the King of Heaven issues His summons (kipannit daz mahal), using a technical expression rooted in Germanic law, but relevant also to contemporary politics (Finger, 90ff.). Comparisons have also been made with the roles of co-jurors and champions as laid down in the Lex Baiuwariorum, an 8th-century collection of laws: Et si maior pecunia furata fuerit, ... et negare voluerit, cum XII sacramentalibus iuret de leuda sua, vel duo campiones propter hoc pugnent ('And if a larger sum of money shall have been stolen, ... and if he wishes to deny the accusation, let him take an oath in company with twelve others from his people, or let two champions fight together on that account').

Templeman J held that Miss Esterman could get an injunction against the disciplinary proceeding. It was ‘impossible to convict any member of NALGO of conduct which rendered him unfit to be a member... on the ground that the member did not comply with the instructions’ to not co-operate with the election. The union had to have clear authority in the rules, and the member must have no reason to question whether the instruction was lawful. There were doubts whether the union executive could ‘take the serious step of interfering’ with the member’s right to do work outside normal employment. Templeman J said a member ‘cannot be found guilty on that account of conduct which renders him unfit to be a member of NALGO.’ There could, however, be ‘special circumstances’ where a union member could disobey a lawful instruction.

Rashbam explains his aim in Biblical exegesis thus: "Those who love pure reason should always remember that the sages have said a Biblical passage must not be deprived of its original meaning [on Genesis 37:1]. Yet as a consequence of the opinion expressed by them, that the constant study of the Talmud is one of the most laudable pursuits, commentators have been unable, by reason of such study, to expound individual verses according to their obvious meaning. Even my grandfather Solomon was an adherent of this school; and I had an argument with him on that account, in which he admitted that he would revise his commentaries if he had time to do so." One of the only two versions of the known manuscripts of Rashbam on the Chumash had missing parts of the commentary.

But Rabbi said that the nuns do not appear there on that account, but because constitute a separate book. It thus follows according to Rabbi that there are seven books of the Torah, and this accords with the interpretation that Rabbi Samuel bar Nahmani made in the name of Rabbi Jonathan of , when it says, "She [Wisdom] has hewn out her seven pillars," referring to seven Books of the Law. Rabban Simeon ben Gamaliel, however, taught that were written where they are to provide a break between two accounts of Israel's transgressions. The first account appears in , "they set forward from the mount of the Lord three days' journey," which Rabbi Hama ben Hanina said meant that the Israelites turned away from following the Lord within three short days, and the second account appears in , which reports the Israelites' murmurings.

These items include rings, alternative character costumes (which unlock as your character increases in level), tomes, allies (permanent pets that boost the player character's stats), wings, mounts, boats, sails, flasks (which are consumed to restore the player character's health), fishing rods, mag riders ( a form of quick travel mount limited to use on train-like mono- rails), and Emblems, which add to or alter the benefits provided by Flasks. A notable feature of Trove is the Collection. With the exception of Rings, Hats, weapons and masks, each of the other none loot drop items, once activated is added to the players library of unlocked items. Any character on that account can then access their own copy of that item from the collection and can select it from the corresponding item slot in their character equipment screen.

Using the above ideas Descartes can claim that it is obvious that there must be at least as much reality in the cause as in the effect for if there wasn’t you would be getting something from nothing. He says “the idea of heat, or of a stone, cannot exist in me unless it is put there by some cause which contains at least as much reality as I conceive to be in the heat or in the stone. For although this cause does not transfer any of its actual or formal reality to my idea, it should not on that account be supposed that it must be less real.” Since the idea of God contains the level of (objective) reality appropriate to an infinite substance it is legitimate to ask where an idea with this level of reality came from.

However, they refused to pledge themselves to a coalition with Whigs. The 1747 general election resulted in only 115 Tory MPs being elected, their lowest figure up until this point. After Jacobite riots in Oxford in 1748, the government wanted to give the King the power to nominate the Chancellor of the University of Oxford, which was considered a hotbed of Jacobitism and Toryism. Thomas Carte wrote to the Pretender that "the attempt against the university of Oxford brought them all up at once to town, which nothing else would, and in their zeal on that account, they entered into a sort of coalition with Prince Frederick's party to stand by the university of Oxford, to join in opposing all unconstitutional points, but to be under no obligation to visit Prince Frederick's court, nor unite in other points".

Moreover, opponents of the teaching argue that it emphasizes fear and guilt as a way of keeping believers "in line", while ignoring the forgiveness of Jesus Christ, who, according to Orthodox Christian teaching, came to earth to save the world and humanity when they least deserved it. On that account, the emphasis of the spiritual life thus changes from communion with a God of love, to fear of demons. Opponents of the teaching also consider it similar to the intermediary state taught by the Catholic Church in its doctrine of purgatory. While some say that the toll houses are only metaphorical, others believe in a real but not physical representation of "stations of taxation", where demons have the right to ask their victims to account for their wrongdoings, and actually let the victim go if a good enough payment (of victim's good deeds) is offered.

Other thinkers have posited non-disprovable analogies, such as J. B. Bury in his 1913 book, History of Freedom of Thought: > Some people speak as if we were not justified in rejecting a theological > doctrine unless we can prove it false. But the burden of proof does not lie > upon the rejecter.... If you were told that in a certain planet revolving > around Sirius there is a race of donkeys who speak the English language and > spend their time in discussing eugenics, you could not disprove the > statement, but would it, on that account, have any claim to be believed? > Some minds would be prepared to accept it, if it were reiterated often > enough, through the potent force of suggestion. Astronomer Carl Sagan in his 1995 book The Demon-Haunted World offered a similar non-disprovable analogy called the Dragon in the Garage as an example of skeptical thinking.

But it does not follow that a judgment in respect of such a disposition can on that account be set aside under common law, for, when the judgment was granted, no grounds existed for setting it aside. The court was fully entitled to grant the judgment on all the facts, and the causa which existed at the date of the judgment. A judgment, as such, is not a disposition "made by an insolvent," as contemplated by the Insolvency Act. In a case where the only purpose of taking judgment is to enable the judgment creditor to enforce his right to payment of the debt under a mortgage bond, by means of execution, if need be, it seems realistic, and in accordance with the views of the Roman-Dutch writers, to regard the judgment not as novating the obligation under the bond, but rather as strengthening or reinforcing it.

This criticism is illustrated with the following example: According to Russell, Thomas advocates the indissolubility of marriage "on the ground that the father is useful in the education of the children, (a) because he is more rational than the mother, (b) because, being stronger, he is better able to inflict physical punishment." Even though modern approaches to education do not support these views, "No follower of Saint Thomas would, on that account, cease to believe in lifelong monogamy, because the real grounds of belief are not those which are alleged." It may be countered that the treatment of matrimony in the Summa Theologica is in the Supplements volume, which was not written by Thomas. Moreover, as noted above,Thomas Aquinas#Condemnation of 1277 Thomas's introduction of arguments and concepts from the theistic non- Christian Aristotle and Muslim Averroes was controversial within the Catholic Church of his day.

The summons to open the door not being answered, the men, who were Whiteboys that had previously committed several acts of violence in the neighbourhood, burst it in with a tree log, which they used as a ram, and were about to rush upstairs when Barnes fired down on them. The shot did not kill anyone, and the leader of the party, seeing Barnes about to fire again, immediately took aim and shot him dead on the top of the stairs. The rest then ran up and knocked the clerk on the head, leaving him senseless, whilst they entered Barnes' office and abstracted every penny he had received that day. The military authorities hearing of the attack, turned out next day from Longford and captured a dozen of men, of whom several were hanged on the evidence of an informer, who did not receive any of the money taken from Barnes, and turned king's evidence on that account.

In 1908 he moved to the University of Sheffield to a full-time research appointment, and in 1913 applied for and was awarded the chair of organic chemistry at Imperial College, a post he was to hold until 1939. The previous incumbent was Thomas Edward Thorpe - although the two were not related, his father was a close friend of T. E. Thorpe and it was the latter who persuaded him to switch from engineering to chemistry in his undergraduate career. Although Ingold’s obituary [1] gives a good account of Thorpe’s scientific work it lacks references; Patrick Linstead [3] does give some references and on that account is the better source for Thorpe’s chemical research career. With William H. Perkin Jr. at Manchester he worked largely on terpenes (the primary constituents of many essential oils), in particular on camphor and its derivatives. [4] At Imperial College from 1913 he set about a much-needed reorganisation of the organic chemistry department.

Some few days after the examination at Maynooth, Dr. Magauran held a conference of his clergy in the different deaneries, and the Very Reverend K. Kilroe, P.P., St. Mary's, Athlone, who, at that time, was a young priest just home from college, and without a mission, and on that account was taken around by the bishop to the different places where the clergy assembled that there was no business at any of the conferences. It was kept as a holiday, the bishop was so pleased at the brilliant examination of Dr. O'Higgins, he entertained them with a most interesting and pleasing account of the triumphant and crushing defeat dealt out by the ex-professor from Paris to Dr. Renehan. "I have never witnessed," said the bishop, "such a display of theological learning." Even the students of Maynooth, although naturally on the side of the candidate of their own college, after the first day took to cheering and clapping O'Higgins.

God makes it clear in the Qur'an that the story of Cain and Abel was a message: "On that account: We ordained for the Children of Israel that if any one slew a person - unless it be for murder or for spreading mischief in the land - it would be as if he slew the whole people: and if any one saved a life, it would be as if he saved the life of the whole people. Then although there came to them Our apostles with clear signs, yet, even after that, many of them continued to commit excesses in the land." for the Children of Israel, as it had told them about the consequences of murder and that the killing of one person would be as if he/she had slain the whole of mankind. But still people rejected the message, of the story and continued to commit grave sins, slaying prophets, messengers as well as the righteous people. All the prophets who preached since the time of Adam were persecuted, insulted or reviled in one way or another.

Prideaux, Esquire".

They arrived with such short notice and major fanfare as to frighten away the Ionian-Athenian forces. The Cambridge Ancient History article attributes this swift arrival to the Persian cavalry, which also had no trouble tracking and catching the Ionians before the gates of Ephesus. The losses of the East Greeks were so great that they slunk away, so to speak, leaving Aristagoras and the rebels to fend for themselves. An air of doom pervaded the revolt, but they fought with such spirit that the rebellion spilled over into the islands After this battle, the Athenians refused to continue to fight in the Ionian Revolt and returned to Athens. Because of their participation in this battle, however, the Persian king, Darius, swore vengeance on Athens and commanded a servant to repeat to him three times every day at dinner, “Master, remember the Athenians.” The story is somewhat and probably hypocritically naive (but not necessarily on that account false), as the Persians intended expansion into the Balkans all along.

But in spite of the pressure of debt and poverty, which was not diminished during his term of office, the prior was as much interested as his predecessors had been in the course of public events. Like most of the clergy and religious of the period, he was in sympathy with Simon de Montfort, whom he looked upon as the champion of the Church; and in 1263, when the earl visited Dunstable, the prior went out to meet him, and admitted him to the fraternity of the house. In 1265 a council was held at Dunstable to consider the possibility of peace with the defeated barons, and the king and queen visited the house in the course of the year; but though Simon de Montfort had been there quite recently, and the sympathy of the prior with his cause could not have been altogether a secret one, no fine was imposed upon the priory on that account. In 1274 a long and expensive suit was begun between the prior and convent of Dunstable and Eudo la Zouche, who had become lord of Houghton and Eaton Bray by his marriage with Millicent de Cantelow.

Arnold criticizes the religious and utilitarian reformers of his own day for wanting only to improve humanity's moral and material condition, or for focusing "solely on the scientific passion for knowing," while neglecting the human need for beauty and intelligence, which comes about through lifelong self-cultivation. Arnold concedes that the Greeks may have neglected the moral and material, but: > Greece did not err in having the idea of beauty and harmony and complete > human perfection so present and paramount; it is impossible to have this > idea too present and paramount; but the moral fiber must be braced too. And > we, because we have braced the moral fibre, are not on that account in the > right way, if at the same time the idea of beauty, harmony, and complete > human perfection is wanting or misapprehended amongst us; and evidently it > is wanting or misapprehended at present. And when we rely as we do on our > religious organisations, which in themselves do not and cannot give us this > idea, and think we have done enough if we make them spread and prevail, > then, I say, we fall into our common fault of overvaluing machinery.

Examples of per incuriam are uncommon, partly because the device is perceived by upper courts as a type of lèse-majesté, and respectful lower courts prefer to distinguish such precedent cases if possible. The Court of Appeal in Morelle Ltd v Wakeling [1955] 2 QB 379 stated that as a general rule the only cases in which decisions should be held to have been given per incuriam are those of decisions given in ignorance or forgetfulness of some inconsistent statutory provision or of some authority binding on the court concerned: so that in such cases some part of the decision or some step in the reasoning on which it is based is found, on that account, to be demonstrably wrong. In R v Northumberland Compensation Appeal Tribunal ex parte Shaw [1951] 1 All ER 268, a divisional court of the King's Bench division declined to follow a Court of Appeal decision on the ground that the decision had been reached per incuriam for failure to cite a relevant House of Lords decision. Some academic critics have suggested that Re Polemis 1921 Re Polemis & Furness, Withy & Co Ltd (1921) 3 KB 560 was decided per incuriam as it did not rely upon the earlier decision in Hadley v Baxendale 1854.
