The lawsuit contended that invocation of emergency powers to prevent "public disorder" was unnecessary because there was no clear danger of lack of access to care due to hospital overuse or other shortages, that church closure orders were not commensurate with those of commercial facilities, and specifically noted that there had been zero serious cases in Washington persons under 20 years old; and that the 1,000 COVID-19 related deaths in Washington was numerically comparable to flu and pneumonia deaths in other years, for example 1,037 in 2017. A separate suit was brought in state courts May 22 by public officials and citizens in Chelan and Douglas Counties making some of the same claims. A third lawsuit petitioned the Washington State Supreme Court for a writ of mandamus on the same grounds. More than 50 people held a rally on the federal courthouse steps in Tacoma in support of another civil rights lawsuit on May 1.

The government has significantly increased law enforcement efforts to combat all forms of trafficking, including those involving the most vulnerable populations. The 2009 anti-human trafficking law prohibits all forms of sex and labor trafficking and prescribes penalties of six months’ to 10 years’ imprisonment for child trafficking, trafficking of women and girls, and forced prostitution; these penalties are sufficiently stringent, but not commensurate with those prescribed for other serious crimes, such as rape. Penalties prescribed for labor trafficking offenses are not sufficiently stringent; offenses against adult male victims that do not involve aggravating circumstances are limited to a minimum of six months’ imprisonment and a fine. Jordan’s labor law assigns administrative penalties for labor violations committed against Jordanian or foreign workers, yet these penalties are not sufficiently stringent to deter the crime of human trafficking. The withholding of passports is a crime under Jordan’s passport law, which prescribes six months’ to three years’ imprisonment, as well as financial penalties.

Cyprus made some progress in its anti-trafficking law enforcement efforts in 2009 by convicting an increased number of traffickers; however, overall sentences for trafficking-related offenses remained inadequate. Cyprus prohibits both sex and labor trafficking through Law 87 (I)/2007, which also contains protection measures for victims. Although the penalties prescribed for sex trafficking range up to 20 years’ imprisonment, these penalties are not commensurate with those prescribed for other serious crimes, such as rape, for which the maximum sentence is life in prison. During the reporting period, police investigated 57 persons in 17 suspected trafficking cases, compared with 70 persons in 29 suspected trafficking cases in 2008. Of the 17 trafficking cases, eight were sent to court, seven are still under investigation, and two were “otherwise disposed of.” The government convicted ten sex trafficking offenders in 2009, compared with one in 2008, and courts handed down harsher penalties for some traffickers.

Under Northern Securities, Congress could deal with and affect the ownership of securities to protect the freedom of commerce, which it did in fashioning the divestiture remedy in PUHCA. Lastly, the Court dismissed the takings argument, noting that Congress had weighed the benefit to shareholders of efficient, common management of diversified companies against the actual and potential harm to the public, investors, and consumers from the use of pooled investments, and determined that the economic advantages of a holding company atop an unintegrated, sprawling electric system were not commensurate with the resulting economic disadvantages. In addition, it was not clear that there would be a loss necessary for a takings claim under the Fifth Amendment. PUHCA does not require the dumping or forced liquidation of the securities on the market for cash, so the stock of the companies ordered divested could be distributed to the shareholders or sold under a plan that protects shareholder rights.

Justice Henri Bernard of France argued that the tribunal's course of action was flawed due to Hirohito's absence and the lack of sufficient deliberation by the judges. He concluded that Japan's declaration of war "had a principal author who escaped all prosecution and of whom in any case the present Defendants could only be considered as accomplices" and that a "verdict reached by a Tribunal after a defective procedure cannot be a valid one.
