Following this ruling, the state of Texas refused to further represent the university. Texas A&M; officials instead hired a private lawyer, and appealed the case to the United States Supreme Court. In their brief, Texas A&M; officials changed tactics. They now argued that recognizing the Gay Student Services organization would encourage more homosexual conduct, thus leading to increased psychological and physical problems.

However, only about 25% of gay men and 40% of lesbians are in shared- household partnerships at any one time, according to non-Census surveys. For every same-sex couple tallied in the census, there could be three to six more homosexual un-partnered individuals who would not be counted as gay. The census reported that same-sex male couples numbered 336,001 and female same- sex couples numbered 329,522.

Conahan was born in Charlotte, North Carolina and moved with his family to Punta Gorda, Florida shortly after birth. His parents expressed displeasure at his homosexuality during his high school years and sent him to a psychiatrist. He graduated Miami Norland High School in 1973 and joined the United States Navy in 1977, stationed at Naval Station Great Lakes in Illinois. She also argues that this is actually changing the nature of fa'afafine itself, and making it more "homosexual".

Ecki is then evicted from the team, with his mistake being used to cover the real reason--the revelation that he is gay that comes about when he is observed by some of his teammates kissing another player Tobias on the mouth. The Junior Brazos began working for Consejo Mundial de Lucha Libre (CMLL) in 2003 before the Alvarez family decided that their sons should create characters of their own instead of being the "Junior Brazos". Brazo de Oro Jr. became La Máscara, Brazo de Plata Jr. became Kronos (and later "Psycho Clown" in AAA's Los Psycho Circus). José Christian Alvarado was repackaged as Máximo ("Maximus"), a character inspired by the Roman era and was supposed to team up with Los Romanos (Caligula and Mesalla) but instead he was turned into an Exótico character, a character that skirts the gender definitions and appears to be more homosexual than heterosexual. Máximo retained the "toga" look that came from his original idea but turned to pinks and purple colors to boost the Exótico image.

While Jennings was one of the founders of the Mattachine Society, his views on how to best fight for equal rights for homosexuals differed from the organization as a whole. Harry Hay, the primary founder of the society, believed that “gays were a unique and especially talented group who had been a primary part of tribal societies and needed to come together and reclaim those sacred and traditional roles”. Jennings believed that there essentially was no difference between a gay man and a straight man. Jennings adopted a more private role, believing that homosexuals as a group had very little in common, and wanted to fight for the right to be left alone while Hay and the rest of the Mattachine Society collectively wanted to make homosexuality visible to the public and fought for more homosexual awareness.
