Bonhomme Richard was originally an East Indiaman named Duc de Duras, a merchant ship built at Lorient according to the plan drawn up by the King's Master Shipwright Antoine Groignard for the French East India Company in 1765. Her design allowed her to be quickly transformed into a man-of-war in case of necessity to support the navy. She made two voyages to China, the first in 1766 and the second in 1769. At her return the French East India Company had been dissolved, and all its installations and ships transferred to the French Navy.

The English judicial system was not very developed in the seventeenth and eighteenth centuries, as it was based on the Statute of Winchester of 1285, which created a basic organisation for keeping the peace prescribing the contribution of all citizens for: patrolling the streets at night in turns, hurrying to the “hue and cry”, serving as a parish constable for a period of time, and being armed with suitable objects for intervention in case of necessity.

In 1609, the Spanish Manila galleon San Francisco encountered bad weather on its way from Manila to Acapulco, and was wrecked on the Japanese coast in Chiba, near Tokyo. The sailors were rescued and welcomed, and the ship's captain, Rodrigo de Vivero, former interim governor of the Philippines, met with the retired shōgun Tokugawa Ieyasu. Rodrigo de Vivero drafted a treaty, signed on 29 November 1609, whereby the Spaniards could establish a factory in eastern Japan, mining specialists would be imported from New Spain, Spanish ships would be allowed to visit Japan in case of necessity, and a Japanese embassy would be sent to the Spanish court.

In the 18 and 19th centuries, merchantmen featured gunports, as they were useful to ventilate the ship and lighten the deck, and allowed to arm some merchantmen as warship in case of necessity; for instance, after the Mississippi Company was bankrupt in 1770, all its possessions were transferred to the Crown, and its ships were commissioned in the French Royal Navy. Furthermore, some warships could be armed en flûte, removing guns from some of the gunports to make room for storage and men. This could make it non-trivial to discriminate ships in naval service from those that sailed for commerce. In the Action of 4 August 1800, the large East Indiaman passed herself as a 74-gun ship of the line when she chased the much stronger French frigate Médée; after sunset, she perfected the illusion by opening and illuminating all her gunports, whether armed or not; her appearance was so convincing that when she caught up with Médée, the frigate struck as if hopelessly overpowered.

From the Roman Catholic standpoint, lay confession is of historical interest only. It is found under two forms: first, confession without relation to the sacrament, second, confession intended to supply for the sacrament in case of necessity. In the first instance, it consists of confession of venial sins or daily faults which need not necessarily be submitted to the power of the keys; in the second, it has to do with the confession of even grievous sins which should be declared to a priest, but which are confessed to a layman because there is no priest at hand and the case is urgent. In both cases the end sought is the merit of humiliation which is inseparable from freely performed confession; but in the first no administration of the sacrament, in any degree, is sought; in the second, on the contrary, sacramental confession is made to a layman for want of a priest.

The discipline of the Eastern Orthodox Church, Oriental Orthodoxy and the Assyrian Church of the East is similar to that of the Eastern Catholic Churches. They require the baptizer, even in cases of necessity, to be of their own faith, on the grounds that a person cannot convey what he himself does not possess, in this case membership in the Church. The Latin Catholic Church does not insist on this condition, considering that the effect of the sacrament, such as membership of the Church, is not produced by the person who baptizes, but by the Holy Spirit.
