Labussière endeavours to delay the fatal procession to the guillotine by saying that in so uncertain a time, it would be a fearful risk to send the prisoners to execution until it was certain that Dumas was restored to power or executed himself. Fouquier Tinville, dining out with a friend, orders the tumbrels to proceed on their way despite the uncertainty. An inspiration then seizes Labussière who declares that Fabienne is a nun who has broken her vows for the sake of her lover, Martial, and is entitled to stay of execution because she is pregnant.

Although already 10 km long when it enters Duffey Lake, a long lake which is the focus of its upper basin, at the lake's outflow it begins a rapid descent, carving deeply between the Cayoosh Range and the main Lillooet Ranges to the south. Duffey Lake is named for "Sapper Duffy", a Lieut. Patrick Duffey (or "Duffy") or the Royal Engineers, who was assigned to investigate the route of the Cayoosh valley as a possible wagon road from the head of Lillooet Lake to Lillooet, which because of the steep descent westwards from Cayoosh Pass was not gone forward with. The creek's final descent to the confluence with the Seton is a deeper and deeper canyon, narrow and twisting, with the last ridges of the Cayoosh Range forming a rock wall thousands of feet in height, immediately opposite the highway across a very narrow gorge below.

On June 13, 2006 the press reported that the winged Kliper project had been replaced by a study to develop a capsule under the Advanced Crew Transportation System program that ESA would fund. This rejection by ESA notwithstanding, Kliper was a Russian program that could still have been funded entirely by FKA - although this was unlikely if Russia and Europe would really have gone forward with the CSTS concept together. In mid July 2006, the Kliper tender process was cancelled, after having no winners. Reasons given for choosing the CSTS over Kliper included that the former would offer Europe the possibility to be a full partner in a Russian- European program, because the modular structure (see below) allows for a division of design responsibilities between the partners (for instance, Russia could be in charge of the overall design of the reentry capsule, while ESA works on the habitation module etc.).
