It is well established that liquidated damages for breach of contract are void if they seek to punish rather than to compensate for loss. For a contractual "penalty" clause to be valid, one must show that it was drawn up after a bona fide attempt to estimate loss in advance of the breach. The Woodsmith Mine Tunnel (also known as a Mineral Transport System [MTS]) is a long tunnel that will stretch between Woodsmith Mine at Sneatonthorpe near Whitby in North Yorkshire and the Wilton International complex on Teesside, England. The tunnel has been in development since 2016, but cutting of the tunnel bore did not start until April 2019, with an expected finish date of 2021. By the end of July 2020, over of tunnel had been dug out. When finished, the tunnel will be the longest tunnel in the United Kingdom and will also house the longest conveyor in the UK.Whilst the Channel Tunnel is underground for , it is not wholly within United Kingdom.

The moving of the de facto bus station and the transfer point for the former City of Poughkeepsie Transit and the current Dutchess County Public Transit bus systems to the Market Street end of the mall also softened the sting to some degree. Even with this minor success, the mall was beset with various access problems. The number of legal parking spots in the vicinity of the Main Mall were too few to handle even a moderate number of people. Delays in the construction of the Route 44/55 arterial pushed its finish date to 1979 which, coupled with the closure of Main Street in that area, made access to the area very difficult and led to frequent congestion of side streets not equipped to handle such traffic.

In January 2020 all Smart Motorway Projects were put under review due to concerns about their safety, during this period no new Smart Motorways could open, the review was published on the 12th March 2020 and required no immediate amendments to the design or construction, however new technology to detect static vehicles is required to be fitted within 3 years, and a review on spacing of Emergency Refuge Areas to be carried out in due course. The fourth lane was opened to traffic on 2nd April 2020, however with a temporary 50 mph speed limit, works are scheduled to take place until July 2020 to finish installation of technology, signs followed by testing and commissioning of the technology before the project is completed and can run at National Speed Limit. The upgrade work has overrun with the 50 mph speed limit and regular overnight closures remaining in place well into September 2020 with, as yet, no confirmed finish date.
