South Africa inherited the crime of "sodomy" from the Roman-Dutch law, which was introduced by the Dutch East India Company settlers at the Cape, and still forms the basis of South African law. Following an advance screening of the film, former GLAAD media director Scott Seomin asked Smith to make a $10,000 donation to the Matthew Shepard Foundation, as well as to include a reference to GLAAD's cause in the ending credits. On the bonus DVD (176 minutes), Smith explains in the on-camera intros of the deleted scenes that several scenes had to be cut from the theatrical release, due to the film initially receiving an NC-17 rating from the MPAA.

Geoff is a wimpy bespectacled office worker who constantly tries to pluck up the courage to fellate strange men in toilets or parks ("cottaging" is the slang term), but is always thwarted somehow, and when he finally succeeds with a fellow gay co- worker, he finds that he doesn't really like it (although they end up cuddling instead). The modern definition of frot emerged in a context of a debate about the status of anal sex within the gay male community; some in the anti-anal, pro- frot camp insist that anal sex ought to be avoided altogether. One view argued that the popularity of anal sex would decline, presumably with a corresponding drop in HIV rates, if gay men could somehow be persuaded to stop thinking of anal sex as a "vanilla" practice, but rather as something "kinky" and not- quite-respectable—as was the case in the 1950s and 1960s, when gay men who preferred to do only mutual masturbation and fellatio sometimes used the disparaging slang term brownie queen for aficionados of anal sex. Gay activist Bill Weintraub began to heavily promote and recommend the gender-specific meaning of "penis-to-penis rubbing" as frot on Internet forums sometime in the late 1990s, and said he coined the term. "I don't use the word 'frottage,' because it is an ersatz French word which can indicate any sort of erotic rubbing," he stated.

In 1838, Arkansas instituted the first statute against homosexual activity with a provision which read: "Every person convicted of sodomy or buggery will be imprisoned in the state penitentiary for not less than five years nor more than 21 years." In 1864, the Arkansas General Assembly raised the penalty to death, though this was repealed 9 years later, and the initial penalty was re-established. The first reported sodomy case occurred in 1921 in Smith v. State, where the defendant was found guilty of "disregarding the laws of nature". In 1925, the Arkansas Supreme Court unanimously held that fellatio (oral sex), whether heterosexual or homosexual, violated the sodomy statute. The legislation was subsequently amended in 1955 to lower the minimum penalty to one-year imprisonment, and in 1977 to penalize only homosexual acts, or sexual acts occurring between humans and animals; but in effect decriminalized sodomy by making it a Class A misdemeanor. In 1992, Governor Bill Clinton, during his presidential campaign, publicly called for the sodomy law to be repealed. The statement was published on the front page of the Washington Blade's 22 May 1992 issue.

The age of consent in Virginia is 18, with a close-in-age exception that allows teenagers aged 15 to 17 to engage in sexual acts but only with a partner younger than 18. The state code defines felony statutory rape as crimes against those under 15, while adults who have sex with minors over 15 can be prosecuted for a misdemeanor offense, "contributing to the delinquency of a minor." The legal age for non-penetrative sexual contact is 15. Section § 18.2-63 of the Code refers to minors younger than 15, while § 18.2-371 is about 15-, 16- and 17-year-olds. Section 18.2-63 states in part: > If any person carnally knows, without the use of force, a child thirteen > years of age or older but under fifteen years of age, such person shall be > guilty of ... felony ... For the purposes of this section, (i) a child under > the age of thirteen years shall not be considered a consenting child and > (ii) "carnal knowledge" includes the acts of sexual intercourse, > cunnilingus, fellatio, analingus, anal intercourse, and animate and > inanimate object sexual penetration. Consensual sex where one partner is 15, 16 or 17 and the other is over 18 is a class 1 misdemeanor. § 18.2-371. Causing or encouraging acts rendering children delinquent, abused, etc.
