The concept was first proposed in Italy in 2014. Member of the Italian Parliament Stefano Quintarelli proposed a bill which states that users should be free to access content and use the applications they wish, provided they are legal, they do not impair safety and security, and they are not in violation of other laws or court orders. A limitation of this freedom by device manufacturers should be examinable on the grounds of anti consumeristic behaviour. A similar proposal was made by ARCEP, the French regulator for electronic communications, in February 2018.

Later on, members of the Ominde Commission in Kenya expressed the need for Kiswahili in promoting a national and pan-African identity. Kenya therefore began to offer Kiswahili as a compulsory, non-examinable subject in primary school, but it remained secondary to English as a medium of instruction. As can be seen from the above provisions, which all follow the principles of the Children and Young Peoples Act 1933, child protection is concerned with the child's exposure to, and consumption of, potentially hazardous products of all description. The act followed Donoghue v Stevenson [1932] UKHL 100 to reflect the new law of negligence and demolition of the privily barrier in the law of contract. The new law recognised that the product manufacturer may be many parties removed from the ultimate product consumer and that the product may contain potentially hazardous but un-examinable content. In 1949 she was employed as lecturer in the new Department of History and Methods of Science that was created under Wright's leadership. Dyason was assigned to teach first year medical students in a compulsory but non-examinable course, a difficult task that she nevertheless turned into a memorable experience for them. Her enthusiasm for the new academic field of History and Philosophy of Science led her in 1952-1953 to travel overseas where she attended lectures and seminars in the United States and Britain, including some given by James Bryant Conant at Harvard University and Sir Karl Popper at University College and the LSE in London. Open University modules are often assessed using an equal weighting of examinations and coursework. The coursework component normally takes the form of between two and seven tutor marked assignments (TMAs) and, occasionally, may also include up to six multiple-choice or "missing word" 10-question interactive computer marked assignments (iCMAs). The examinable component is usually an invigilated three-hour paper regardless of the size of the module (although on some modules it can be up to three three-hour papers), but an increasing number of modules instead have an EMA (End of Module Assessment) which is similar to a TMA, in that it is completed at home, but is regarded as an exam for grading purposes. Modules results are sometimes issued on a graded basis, consisting of pass grades 1 (threshold 85%, a distinction), 2 (70–84%), 3 (55–69%) & 4 (40–54%), and fail (below 40%).

This ambiguity, coupled with the disappearance of the holotype's remains, led to the scientists proposing giving priority to Hemprich and Ehrenberg's name C. lupaster, due to the type specimen having a more detailed and consistent description, and its remains being still examinable at the Museum für Naturkunde.
