Money spent on a dietary supplement that the U.S. Food and Drug Administration considers "adulterated" is an economic injury that provides standing to sue even if the product otherwise lives up to expectations, a federal appeals court held Thursday in a case of first impression nationwide.
But missing from the elder Cruz's speeches and his otherwise detailed memoir is how he made ends meet after his financial undoing by working with Mannatech, a religiously inspired dietary supplement company whose history of questionable health claims has already popped up in the Republican presidential race.
"Then, when the dietary supplement law got enacted ... it opened a floodgate of quote-unquote probiotic products that weren't really probiotic, and the quality of the products were not as regulated as they should have been, having not gone through the ordinary FDA process," she said.
The agency said those products don't meet the FDA's standards for safety and effectiveness and could even put consumers at risk by giving them a false sense of security that a dietary supplement could prevent sunburn, reduce aging or protect from the risks of skin cancer.
The F.D.A. has been sending warning letters to some companies, many of them selling hemp oil, saying that they are illegally marketing their products as drugs and that cannabidiol cannot be sold as a dietary supplement because it is being studied for use as a drug.

As part of the settlement, Cure Encapsulations has agreed to never again make a "weight-loss, appetite-suppression, fat-blocking, or disease-treatment claims for any dietary supplement, food, or drug" unless the company has "competent and reliable scientific evidence in the form of human clinical testing" to support its claims.
But cannabidiol is still considered a Schedule I controlled substance by the federal government, and while the Drug Enforcement Agency recently eased restrictions on Food and Drug Administration-approved clinical studies investigating the compound for medicinal value, the FDA does not, contrary to some reports, classify cannabidiol as a dietary supplement.
As part of the trial, 604 patients with knee arthritis received either the NSAID drug celecoxib (brand name Celebrex, 200 milligrams a day), a dummy pill, or chondroitin (800 milligrams a day), a component of cartilage that cushions the joints and is sold as a dietary supplement in the United States.

" The announcement specifically calls out four products — GliSODin Skin Nutrients' Advanced Skin Brightening Formula, Napa Valley Bioscience's Sunsafe Rx, Pharmacy Direct's Solaricare and Sunergized LLC's Sunergetic — that it says "are putting people's health at risk by giving consumers a false sense of security that a dietary supplement could prevent sunburn, reduce early skin aging caused by the sun, or protect from the risks of skin cancer.
Also included was a July 18, 2013 email to Dr. Daniel Fabricant, director of the FDA's Division of Dietary Supplement Programs, from three trade organizations (The Council for Responsible Nutrition, Consumer Healthcare Products Association, and United Natural Products Alliance) asking the FDA to step in where the DEA wouldn't: "Kratom is not currently scheduled under the Controlled Substances Act (CSA), and that process is not likely to happen quickly given the lengthy process required for adding substances to the CSA," the email reads.
