One of the most prominent functions of many modchips --the circumvention of copy protection mechanisms--is outlawed by many countries' copyright laws such as the Digital Millennium Copyright Act in the United States, the European Copyright Directive and its various implementations by the EU member countries, and the Australian Copyright Act. Other laws may apply to the many diversified functions of a modchip, e.g. Australian law specifically allowing the circumvention of region coding. The ambiguity of applicable law, its nonuniform interpretation by the courts, and constant profound changes and amendments to copyright law do not allow for a definitive statement on the legality of modchips.
Communist Wilhelm Pieck and Social Democrat Otto Grotewohl when their parties merged in 1946. The 9th Party Congress in May 1976 can be viewed as a midpoint in the development of SED policy and programs. Most of the social and economic goals announced at the 8th Congress had been reached; however, the absence of a definitive statement on further efforts to improve the working and living conditions of the population proved to be a source of concern. The SED sought to redress these issues by announcing, along with the Council of Ministers and the leadership of the FDGB, a specific program to raise living standards.
Article 38 (1) of the Statute of the International Court of Justice is generally recognized as a definitive statement of the sources of international law. It requires the Court to apply, among other things, (a) international conventions, whether general or particular, establishing rules expressly recognized by the contesting states; (b) international custom, as evidence of a general practice accepted as law; (c) the general principles of law recognized by civilized nations; (d) subject to the provisions of Article 59, judicial decisions and the teachings of the most highly qualified publicists of the various nations, as subsidiary means for the determination of rules of law.
The Collegeville Bible Commentary: New Testament by Robert J. Karris 1992 pages 885-886 Specifically, Peter declares, "You are the Christ, the Son of the living God." The proclamation of Jesus as Christ is fundamental to Christology; the Confession of Peter and Jesus' acceptance of the title "Messiah" form a definitive statement in the New Testament narrative regarding the person of Jesus Christ. In this New Testament narrative, Jesus not only accepts the titles Christ and Son of God, but declares the proclamation a divine revelation by stating that his Father in Heaven had revealed it to Peter, unequivocally declaring himself to be both Christ and the Son of God.
The two-source hypothesis was first articulated in 1838 by Christian Hermann Weisse, but it did not gain wide acceptance among German critics until Heinrich Julius Holtzmann endorsed it in 1863. Prior to Holtzmann, most Catholic scholars held to the Augustinian hypothesis (Matthew → Mark → Luke) and Protestant biblical critics favored the Griesbach hypothesis (Matthew → Luke → Mark). The Two-Source Hypothesis crossed the channel into England in the 1880s primarily due to the efforts of William Sanday, culminating in B. H. Streeter's definitive statement of the case in 1924. Streeter further argued that additional sources, referred to as M and L, lie behind the material in Matthew and Luke respectively.
One such case was Harbutt's "Plasticine" Ltd v Wayne Tank and Pump Co Ltd.[1970] 1 QB 447 The House of Lords was less than amused, and in the 1980 Photo Productions case they emphatically reaffirmed their decision in the Suisse Atlantique. Lord Wilberforce effectively overturned the "rule of law" doctrine of Karsales v Wallis and instead maintained a strict "rule of construction" approach whereby a fundamental breach is determined by examining the full circumstances, such as the parties' intentions at the time of the contract. These two cases (the Suisse Atlantique and Photo Productions) thus form the definitive statement of the law up to the Unfair Contract Terms Act 1977.
It consists of four movements: The first movement is in an expansive sonata form, including a fugato in the development and lasting nearly twelve minutes even though it forgoes the then- customary repeat of the exposition. The opening cello melody has its tonality only weakly defined, with the first cadence establishing the key of F major only occurring several bars into the movement. Another feature of the first movement is the delayed emotional recapitulation. As became one of Beethoven's many tools for emotional manipulation, delaying the grandiosity of the recapitulation for several bars after the establishment of the tonic key allowed Beethoven to heighten expectation of a definitive statement.
Nicolaus Copernicus published the definitive statement of his system in De Revolutionibus in 1543. Copernicus began to write it in 1506 and finished it in 1530, but did not publish it until the year of his death. Although he was in good standing with the Church and had dedicated the book to Pope Paul III, the published form contained an unsigned preface by Osiander defending the system and arguing that it was useful for computation even if its hypotheses were not necessarily true. Possibly because of that preface, the work of Copernicus inspired very little debate on whether it might be heretical during the next 60 years.
While Durkheim's work deals with a number of subjects, including suicide, the family, social structures, and social institutions, a large part of his work deals with the sociology of knowledge. While publishing short articles on the subject earlier in his career,For example, the essay De quelques formes primitives de classification (1902), written with Marcel Mauss. Durkheim's definitive statement concerning the sociology of knowledge comes in his 1912 magnum opus, The Elementary Forms of Religious Life. This book has as its goal not only the elucidation of the social origins and function of religion, but also the social origins and impact of society on language and logical thought.
He saw higher education as a vehicle of opportunity for the talented rather than an entitlement for the wealthy, so Conant devised programs to identify, recruit, and support talented youth. In 1943, he asked the faculty to make a definitive statement about what general education ought to be, at the secondary as well as at the college level. The resulting Report, published in 1945, was one of the most influential manifestos in 20th century American education.Anita Fay Kravitz, "The Harvard Report of 1945: An historical ethnography", Ph.D. dissertation, University of Pennsylvania, 1994, 367 pages; AAT 9427558 Between 1945 and 1960, admissions were opened up to bring in a more diverse group of students.
" Uncut also gave a positive review of the album, stating in their April 2014 issue that "the sound they've fashioned is glossy and supersaturated while still exhibiting the subversive impulse that yielded the supremely catchy but subtly sinister smash 'Pumped Up Kicks'". Melanie Haupt of The Austin Chronicle stated that the band, "working on an epic, operatic canvas, hide the spinach of existential angst into sweetly binge- worthy dance pop". John Aizlewood, writing for Q, opined that the "occasionally super Supermodel is an album of transition rather than a definitive statement". PopMatters writer Jeff Koch opined that the record was "startlingly different from Torches" and a "massive surprise", but nonetheless "achingly, devastatingly beautiful.
It was always assumed to be somewhere in northern Europe, despite its naming after the rustic Greek paradise in the Peloponnesus. Harlock gives the proper name of his ancestral birthplace as Hellingstadt meaning that Arcadia is most likely a nickname. During the World War II segment of the movie, Harlock II, while flying to Switzerland muses about Arcadia, leading viewers to assume that Arcadia was located there. However Harlock's cryptic comments about "paying rent" aside, this would still make little sense in the context of the movie as Switzerland was neutral during World War II. Matsumoto has never given a concrete definitive statement on Harlock's ethnicity or heritage However, Harlock is an actual name of Prussian origin.
The Combahee River Collective Statement is referred to as "among the most compelling documents produced by Black feminists", and Harriet Sigerman, author of The Columbia Documentary History of American Women Since 1941 calls the solutions which the statement proposes to societal problems such as racial and sexual discrimination, homophobia and classist politics "multifaceted and interconnected."Sigerman, Harriet. The Columbia Documentary History of American Women Since 1941, Columbia University Press, 2003, , pp. 316–317. In their Encyclopedia of Government and Politics, M. E. Hawkesworth and Maurice Kogan refer to the CRCS as "what is often seen as the definitive statement regarding the importance of identity politics, particularly for people whose identity is marked by multiple interlocking oppressions".
SystemC is defined and promoted by the Open SystemC Initiative (OSCI — now Accellera), and has been approved by the IEEE Standards Association as IEEE 1666-2011 \- the SystemC Language Reference Manual (LRM). The LRM provides the definitive statement of the semantics of SystemC. OSCI also provide an open-source proof-of-concept simulator (sometimes incorrectly referred to as the reference simulator), which can be downloaded from the OSCI website.www.systemc.org, the Open SystemC Initiative website Although it was the intent of OSCI that commercial vendors and academia could create original software compliant to IEEE 1666, in practice most SystemC implementations have been at least partly based on the OSCI proof-of-concept simulator.
In 451, the Council of Chalcedon settled christological disputes by condemning both Monophysitism, held by Eutyches, and Nestorianism. However, large sections of the Eastern Roman Empire, especially in Egypt, but also in Palestine and Syria, held monophysite (or, more strictly, miaphysite) views. In order to restore unity, the Patriarch of Constantinople, Acacius, devised an eirenic formula, which Emperor Zeno promulgated without the approval of the Bishop of Rome or of a synod of bishops. The Henotikon endorsed the condemnations of Eutyches and Nestorius made at Chalcedon and explicitly approved the twelve anathemas of Cyril of Alexandria, but avoided any definitive statement on whether Christ had one or two natures, attempting to appease both sides of the dispute.
The Oracle at Delphi Medb hErren In accordance with this definitive statement, such scholars as Frederick Poulson, E.R. Dodds, Joseph Fontenrose, and Saul Levin all stated that there were no vapors and no chasm. For the decades to follow, scientists and scholars believed the ancient descriptions of a sacred, inspiring pneuma to be fallacious. During 1950, the French hellenist Pierre Amandry, who had worked at Delphi and later directed the French excavations there, concurred with Oppé's pronouncements, claiming that gaseous emissions were not even possible in a volcanic zone such as Delphi. Neither Oppé nor Amandry were geologists, though, and no geologists had been involved in the debate up to that point.
Although the specification ebRIM v2.0 (5 december 2001) says at the beginning in its Design Objectives: "Leverage as much as possible the work done in the OASIS [OAS] and the ISO 11179 [ISO] Registry models" by the time of ebRIM v3.0 (2 May 2005) all reference to ISO/IOEC 11179 is reduced to a mention under informative references on page 76 of 78. It was recognised by some team members that the ebXML RIM data model had no place to store "fine grained artifacts" ie. the data elements which are at the heart of ISO/IEC 11179, but not until 2009 can an explicit and definitive statement from the team be found.
While experts have studied the mortality rates of different treatment settings, and given the wide differences in variables that affected outcomes, adequate information had not yet been gathered to make a definitive statement about what constituted optimal care in the Western African setting. Paul Farmer of Partners in Health, an NGO that only as of January 2015 had begun to treat Ebola patients, strongly supported IV therapy for all Ebola patients stating: "What if the fatality rate isn't the virulence of disease but the mediocrity of the medical delivery?" Farmer suggested that every treatment facility should have a team that specialises in inserting IVs, or better yet, peripherally inserted central catheter lines.
James Bryant Conant (president, 1933–1953) pledged to reinvigorate creative scholarship at Harvard and reestablish its preeminence among research institutions. Viewing higher education as a vehicle of opportunity for the talented rather than an entitlement for the wealthy, Conant devised programs to identify, recruit, and support talented youth. In 1943, Conant decided that Harvard's undergraduate curriculum needed to be revised so as to place more emphasis on general education and called on the faculty make a definitive statement about what general education ought to be at the secondary as well as the college level. The resulting Report, published in 1945, was one of the most influential manifestos in the history of American education in the 20th century.
Blender magazine described the album in a review on their website as "impossibly exciting pop-rock" and Pitchfork called the album "the band's definitive statement" and described the track "The Back of Love" as "the astonishing highlight of the group's career". CMJ critic Eric Chappe wrote that "the constant emotional peaks and valleys of Porcupine may be perhaps too strong for some, but the musical peaks achieved in getting there are really something to behold." The album appeared in the 1983 end of year critics' lists for both Melody Maker, where it was listed at number nine, and NME, where it was listed at number 32. The album is also listed in the 2006 book 1001 Albums You Must Hear Before You Die.

Written in 1939 and originally published in "Language, Culture and Personality: Essays in Memory of Edward Sapir" edited by Leslie Spier, 1941, reprinted in . The piece is the source of most of the quotes used by Whorf's detractors. in particular has been taken to be Whorf's definitive statement of the issue, and is his most frequently quoted piece. In his last year Whorf also published three articles in the MIT Technology Review titled "Science and Linguistics","Science and linguistics" first published in 1940 in MIT Technology Review (42:229–31); reprinted in "Linguistics as an Exact Science" and "Language and Logic".
The decision is regarded as the "first definitive statement of the doctrine of foreign state immunity."Caplan, Lee M. Litigation of International Disputes in U.S. Courts, §3.2 "Origin of Immunity," 2012. Also, the unwillingness of the Court to find jurisdiction without action by the political branches of government, along with some explicit dicta,"...the sovereign power of the nation is alone competent to avenge wrongs committed by a sovereign, that the questions to which such wrongs give birth are rather questions of policy than of law, [] they are for diplomatic, rather than legal discussion".
Annalen der Physik und Chemie 59: 446 In 1842 Clapeyron published his findings on the "optimal position for the piston at which the various valves should be opened or closed."Clapeyron (1842) "Mémoir sur le règlement des tiroirs dans la machines à vapeur", Comptes Rendus 14: 632 In 1843, Clapeyron further developed the idea of a reversible process, already suggested by Carnot and made a definitive statement of Carnot's principle, what is now known as the second law of thermodynamics. These foundations enabled him to make substantive extensions of Clausius' work, including the formula, now known as the Clausius–Clapeyron relation, which characterises the phase transition between two phases of matter. He further considered questions of phase transitions in what later became known as Stefan problems.
However, the Skii km Lax Ha, present-day descendants of the Raven Clan of the Laxwiiyip Tsetsaut who have not been amalgamated with the Nisga'a like many other Tsetsaut, claim the entire Bell-Irving River watershed along with the upper Nass River and other areas. Land claim disagreement between the Gitxsan and Nisga'a led to the Gitxsan and their neighbors, the Wet'suwet'en, to take the issue of territorial ownership to court in the case of Delgamuukw v British Columbia. This case began in 1984 and continued until 1997. Although the Supreme Court of Canada declined to make any definitive statement on aboriginal title a vast amount of research was conducted and documented and it was ruled that oral histories were just as important as written testimony.
The report would become known as the Davide Commission Report. Participants of the December 1989 coup would later blame perceived deficiencies in the Aquino government in areas as graft and corruption, bureaucratic inefficiency, and lenient treatment of communist insurgents as the reasons for the coup.Davide Commission Report, p. 470 In response, the Davide Commission recommended several short-term and long-term counter-measures, including the establishment of a civilian national police force, a crackdown on corruption in the military, a performance review of appointive government officials, reforms in the process of military promotions, a review of election laws in time for the 1992 presidential elections, and a definitive statement on the part of Aquino on whether she intended to run for re-election in 1992.
In the months prior to the July 1940 Democratic National Convention, there was much speculation as to whether Roosevelt would run for an unprecedented third term. The two-term tradition, although not yet enshrined in the Constitution, had been established by George Washington when he refused to run for a third term in the 1796 presidential election. Roosevelt refused to give a definitive statement as to his willingness to be a candidate again, and he even indicated to some ambitious Democrats, such as James Farley, that he would not run for a third term and that they could seek the Democratic nomination. However, as Germany swept through Western Europe and menaced Britain in mid-1940, Roosevelt decided that only he had the necessary experience and skills to see the nation safely through the Nazi threat.
It has been documented by numerous researchers that microbes associated with green-algal lichens have the potential to fix nitrogen in abundance. However, nearly all of these studies have relied solely on culture-based methods, which may provide an inaccurate picture of what the most abundant or important nitrogen-fixers are. Independent studies on lichens have used culture-free techniques to detect the presence of nifH, the primary gene involved in nitrogen fixation, and have uncovered sequences that share the same phylogenetic affinities as the LAR1 lineage. However, the diversity of bacteria found in environmental samples, the frequency with which horizontal gene transfer occurs in bacteria, and the lack of physiological studies make a definitive statement regarding the metabolic activity of this uncultured lineage impossible at this point.
The concept of avant-garde refers primarily to artists, writers, composers and thinkers whose work is opposed to mainstream cultural values and often has a trenchant social or political edge. Many writers, critics and theorists made assertions about vanguard culture during the formative years of modernism, although the initial definitive statement on the avant-garde was the essay Avant-Garde and Kitsch by New York art critic Clement Greenberg, published in Partisan Review in 1939. Greenberg argued that vanguard culture has historically been opposed to "high" or "mainstream" culture, and that it has also rejected the artificially synthesized mass culture that has been produced by industrialization. Each of these media is a direct product of Capitalism—they are all now substantial industries—and as such they are driven by the same profit-fixated motives of other sectors of manufacturing, not the ideals of true art.
Lennon's 1970 Rolling Stone interview became a key document in Beatles literature and, until the mid 1990s, was often viewed as the definitive statement on the Beatles' break-up. In its espousal of countercultural and New Left ideology, the interview also helped foster among rock journalists a more favourable view of Lennon than of McCartney, whose work as a solo artist, in line with Lennon's description of their respective approaches, was frequently ridiculed for its lack of profundity. The publication in book form aided these developments, in addition to Wenner continuing to present it as an accurate record of events, despite Lennon having contradicted or retracted some of his assertions in the years after the interview. Writing in her book The Beatles and the Historians, Erin Torkelson Weber recognises this as typical of a Beatles historiographical approach whereby the band's biographers allowed fact to be determined by "which side spoke loudest and gave the most interviews".
212 with an 8,000-seat congress hall; ten years later, the idea resurfaced as the Palace of Soviets. Competition terms specifically ruled out any revivalist styles. The Vesnins filed their draft, codenamed Antenna, in February 1923 along with 46 other entrants.Cooke 1999, p. 42Original drawings submitted by the Vesnins are lost, they survive only in journal publications. Artwork reproduced in modern history books is the preparatory material kept in family archives - Cooke 1999, p. 48 The rationalist arm of modernist architects led by Nikolai Ladovsky boycotted the competition, confident that the old-school commission led by Igor Grabar, Alexey Shchusev and Ivan Zholtovsky was biased against modernist art. Neoclassicists also neglected the contest, confident that the project would never materialize. The show attracted mostly constructivist architects and became a sweeping victory for the Vesnin brothers: their 125 meter tallCheredina, p. 345 reinforced concrete Palace, remotely reminiscent of Walter Gropius's Tribune Tower draft,Khan-Magomedov 2007, p.219 made headlines in the professional mainstream press. Reviews by Vladimir Mayakovsky and Moisei Ginzburg declared Vesnins’ draft the definitive statement of modernism.
The concept of dogma has two elements: 1) the deposit of faith, otherwise known as public revelation or the word of God, which is divine revelation as contained in Sacred Scripture (the written word) and sacred tradition (the evolving understanding of that teaching), and 2) a proposition of the Church, which not only announces the dogma but also declares it binding for the faith. This may occur through an ex cathedra decision by a Pope, or by a definitive statement made by an Ecumenical Council.Ott 5 Truths formally and explicitly revealed by God are dogmas in the strict sense when they are proposed or defined by the Church, such as the articles of the Nicene Creed which are drawn from the early Church councils. Catholicism holds that the understanding of Scripture continues to deepen and mature over time through the action of the Holy Spirit in the history of the Church and in the understanding of that faith by Christians, all the while staying identical in essence and substance.
He dubbed the album Redding's "definitive statement". Blender music critic Robert Christgau called Otis Blue, "the first great album by one of soul's few reliable long-form artists" and gave its 2004 collector's edition four out of five stars, which he said, "comes with many useless alternate takes, but also with live tracks that preserve for history Redding's country-goes-uptown style of fun". Nate Patrin of Pitchfork Media cited the album as the 1960s' "greatest studio-recorded soul LP", and further stated that it is "a hell of a record, the crowning achievement of a man who could sound pained and celebratory and tender and gritty and proud all at once, with a voice that everyone from John Fogerty to Swamp Dogg to Cee-lo owes a debt to". Claudrena N. Harold of PopMatters also praised the diverse sound, which, according to her, is a mixture of "Motown pop, the blues, British rock, and Southern Soul", although she cited Complete & Unbelievable: The Otis Redding Dictionary of Soul as Redding's best album.
Kronecker first postulated that the values of elliptic functions at torsion points should be enough to generate all abelian extensions for imaginary quadratic fields, an idea that went back to Eisenstein in some cases, and even to Gauss. This became known as the Kronecker Jugendtraum; and was certainly what had prompted Hilbert's remark above, since it makes explicit class field theory in the way the roots of unity do for abelian extensions of the rational number field, via Shimura's reciprocity law. Indeed, let K be an imaginary quadratic field with class field H. Let E be an elliptic curve with complex multiplication by the integers of K, defined over H. Then the maximal abelian extension of K is generated by the x-coordinates of the points of finite order on some Weierstrass model for E over H.Serre (1967) p. 295 Many generalisations have been sought of Kronecker's ideas; they do however lie somewhat obliquely to the main thrust of the Langlands philosophy, and there is no definitive statement currently known.
Written in 1926 (when Yeats was 60 or 61), "Sailing to Byzantium" is Yeats' definitive statement about the agony of old age and the imaginative and spiritual work required to remain a vital individual even when the heart is "fastened to a dying animal" (the body). Yeats's solution is to leave the country of the young and travel to Byzantium, where the sages in the city's famous gold mosaics could become the "singing-masters" of his soul. He hopes the sages will appear in fire and take him away from his body into an existence outside time, where, like a great work of art, he could exist in "the artifice of eternity." In the final stanza of the poem, he declares that once he is out of his body he will never again appear in the form of a natural thing; rather, he will become a golden bird, sitting on a golden tree, singing of the past ("what is past"), the present (that which is "passing"), and the future (that which is "to come").
7 (May 13, 2010): 27–30. along with these common “gypsy” characteristics create a concrete example of what is known as gypsy punk. “The word “gypsy” coupled with the term “punk” has interesting implications in that punk encapsulates a particular mode of rebellion, anarchy, and resistance in a Western context”Jablonsky, Rebecca. “Russian Jews and ‘Gypsy Punks’: The Performance of Real and Imagined Cultural Identities Within a Transnational Migrant Group.” Journal of Popular Music Studies 24, no. 1 (2012): 3–24. which is good to note since at the time Gogol Bordello and other bands were introducing this genre, “the punk movement became identified in mass culture as the definitive statement of the annihilation of musical and societal norms, collectively rejecting the rules of the past because of the bleak and hypocritical present and future they provided”. This is to say that the Roma that have settled down in the west have taken elements from “Romani music in a style that is indebted to Western punk” Because gypsy punk is a mixture of traditional music and popular music to the western culture, the Romani are colonizing and seemingly settling into a loose identity of their own. The music itself “is considered to be a post-colonial movement”.
