Morris, a government paymaster, has been robbed of his mysterious box, which contained gold specie with which to pay the English troops in the area. Frank's prior light-hearted interest in Morris' box on the journey north is the basis for the charge. Upon Frank's vehement declaration of innocence, and the Justice's sympathetic acquittal, Morris abandons his suit against Frank.

Within the Court's 2006 judgement, as they reviewed the evidence against Truscott, the Court wrote that "In these circumstances, we cannot say that an acquittal is the only reasonable verdict." Truscott therefore remains a suspect in the killing of Lynne Harper. It is the third day of the trial of Doctor Sara Tancredi (Sarah Wayne Callies) in Chicago, Illinois. Despite objections from the prosecution, the judge allowed excerpts of Michael and Lincoln's "Declaration of Innocence" to be played for the jury and to be used as evidence. Meanwhile, Paul Kellerman (Paul Adelstein) hears about Sara's trial via a news report as he prepares to commit suicide. When his suicide attempt fails, due to his gun jamming, he calls his sister, who he confesses to about his previous misdeeds.

Under the settlement's terms BoA was allowed to deny any wrongdoing, which they did when pressed by Rakoff on the matter of guilt. Rakoff said the settlement did not "comport with the most elementary notions of justice and morality". Seven months later, Rakoff approved a $150 million settlement of the BoA case; BoA did not have to change its declaration of innocence. Agent Mahone watches the Declaration of Innocence video with analysts who believe that Burrows is lying, based on subtle movements he makes. These subtle movements were actually orchestrated by Kellerman, who told the brothers that such movements would confuse the analyzers. "Tell them you're the Green Lantern", Kellerman flippantly told the brothers, "but I know how they break down these tapes." The FBI analysts are transfixed on a Morse code message that Michael taps out with his hand ("the water is warm"), but Mahone knows that Michael is trying to throw them off the scent.

It's when he and the analysts pay attention to Michael's apology to Sara that Mahone figures out that the message isn't a Declaration of Innocence at all, and the brothers aren't going after President Reynolds: they're going after Sara. He immediately demands that Sara's records, contacts and habits be analysed for clues. At the same time, Sara Tancredi watches the video of Michael and Lincoln from the Jewell Glore Library in Kansas City, Missouri, flipping through a book as she does. At Fox River, Mahone questions Nurse Katie, only to find no useful information.

The very long Chapter 125Budge 2008, pp. 355–78. of the Book of the Dead lists names and provenances (either geographical or atmospheric) of the Assessors of Maat. A declaration of innocence corresponds to each deity: it is pronounced by the dead himself, to avoid being damned for specific "sins" that each of the 42 Judges is in charge of punishing. The deceased was accompanied in the presence of Osiris by the psychopomp god Anubis — where he would have declared that he was guilty of none of the "42 sins" against justice and truth by reciting a text known as "Negative confessions".
