Its theology teaches that one must neither kill another living being, nor cause another to kill, nor consent to any killing directly or indirectly. Jains believe that violence negatively affects and destroys one's soul, particularly when the violence is done with intent, hate or carelessness, or when one indirectly causes or consents to the killing of a human or non-human living being.

For instance, G.W.F Hegel criticized Rousseau's general will, in that it could lead to tension. This tension, in Hegel's view is that between the general will and the subjective particularity of the individual. Here is the problem: when one consents to the general will, then individuality is lost as a result of one having to be able to consent to things on behalf of the populous, but, paradoxically, when the general will is in action, impartiality is lost as a result of the general will conforming to one course of action alone, that consented to by the populous. Another problem that Hegel puts forth is one of arbitrary contingency.
In August 2011, after a public submission and hearing process, the West Coast Regional Council and Buller District Council granted Buller Coal Limited the resource consents required under the Resource Management Act. Consent searches (or consensual searches) are searches made by police officers in the United States based on the voluntary consent of the individual whose person or property is being searched. The simplest and most common type of warrantless searches in the United States are searches based upon consent. No warrant, probable cause or reasonable suspicion is required to perform a search if a person, or someone else with the proper authority, consents to a search. A consent search assumes the individual, whose person or property is being searched, is aware that they have the right to refuse a search in a situation when confronted by law enforcement agents.

In his sustained analysis of the vice in Q. 35 of the Second Part (Secunda Secundae) of his Summa Theologica, the 13th-century theologian Thomas Aquinas identifies acedia with "the sorrow of the world" (compare Weltschmerz) that "worketh death" and contrasts it with that sorrow "according to God" described by St. Paul in 2 Cor. 7:10. For Aquinas, acedia is "sorrow about spiritual good in as much as it is a Divine good." It becomes a mortal sin when reason consents to man's "flight" (fuga) from the Divine good, "on account of the flesh utterly prevailing over the spirit."Summa, II-II, 35, 3.

In 2009, Portuguese Cardinal Jose Policarpo discouraged Portuguese girls from marrying Muslims, due to the fact that it is sometimes difficult to raise children in the faith after a marriage. Marriages between a Catholic and an unbaptized person are not sacramental and fall under the impediment of disparity of worship. They are invalid without a dispensation, for which authority lies with the ordinary of the place of marriage. In addition, the Catholic Church recognizes the Pauline privilege, wherein a Catholic may marry an unbaptized previously married person who consents to convert, but only if the unbaptized person's spouse refuses to become a Catholic also (similar to Muslim views on marrying previously-married non-Muslims).

The bookish Ernst theorizes that the island may once have been part of a land bridge connected to Asia. As the family settles in, Father opines that by going back to nature they have found everything they need in life. During their expedition, Fritz and Ernst come across the pirates, who have captured another ship and taken its captain and cabin boy captive for ransom.

She consents to marry him on one condition – that he abdicate his kingship for a year in favour of Conchobar, so that his sons will be able to call themselves the sons of a king. Often death has even been the subject of jokes, such as in the various versions of The Yellow Ribbon, in which a young girl wears a yellow ribbon around her neck and a young boy asks her about it, but she puts him off. The two grow up together and eventually marry with the boy/man often asking her about the ribbon, but she continues to disregard the subject as “not important” or “not the right time”. Finally when they are very old, she consents to have him untie the ribbon, and her head falls off. In Alice’s Adventures in Wonderland, she jokes that if she falls and dies, she will be "quite a story back home".
The Supreme Court of Canada ruling in Carter v. Canada (Attorney General) states that the law banning assisted suicide of terminally-ill patients (based on the Rodriguez v British Columbia (Attorney General) decision) was unconstitutional, and violated Section 7 of the Canadian Charter of Rights and Freedoms. The Supreme Court issued a 12-month suspended declaration of invalidity. As a result of the decision voluntary euthanasia was expected to be made legal for "a competent adult person who (1) clearly consents to the termination of life and (2) has a grievous and irremediable medical condition (including an illness, disease or disability) that causes enduring suffering that is intolerable to the individual in the circumstances of his or her condition".
The doctor moves forward to greet Don Pasquale, who tells him of Norina's intended assignation, and his own plan to expose her unfaithfulness before a magistrate. Malatesta persuades him to moderate his plan and Pasquale, believing him an ally, consents to his conditions, while plotting his revenge on Norina (Aspetta, aspetta, cara sposina – "Wait, wait, dear little wife"). Scenes 6–7: The garden, adjoining Pasquale's house In the garden, as night draws in, Ernesto sings of his love for Norina, as he waits for her arrival (Com'è gentil – "How lovely"). At last, Norina emerges, and they express their love: (Tornami a dir che m'ami – "Tell me once more that you love me").
Azeri society tradition from domestic violence to the social and political participation of women in the community A forced marriage is a marriage in which one or both of the parties is married against their will. Forced marriages continue to be practiced in parts of the world, especially in South Asia and Africa. The line between forced marriage and consensual marriage may become blurred, because the social norms of these cultures dictate that one should never oppose the desire of one's parents/relatives in regard to the choice of a spouse; in such cultures, it is not necessary for violence, threats, intimidation etc. to occur, the person simply "consents" to the marriage even if they don't want it, out of the implied social pressure and duty.
Knockaloe Farm, near Peel, Isle of Man Mona Craine and her brother react with nationalist pride when World War I is announced. In contrast, their father, Robert Craine, a tenant farmer at Knockaloe Farm, is concerned and dismayed at the bad that he fears will come of it. Mona and her father's lives are disrupted first by her brother being called up to fight in France, and then by the authorities agreeing with the owner of the farm to set up an internment camp for enemy aliens there at Knockaloe. Mona consents to live there still and supply food for "those Germans whose brothers are killing our boys in France", greatly against her wish and only for the sake of her ageing father.
Laws differ in the United States on how many parties must give their consent before a conversation may be recorded. In 38 states and the District of Columbia, conversations may be recorded if the person is party to the conversation, or if at least one of the people who are party to the conversation have given a third party consent to record the conversation. As of 2010, in California, Connecticut, Delaware, Florida, Illinois, Maryland, Massachusetts, Nevada, New Hampshire, Pennsylvania, Vermont, and Washington State, the consent of all parties of the conversation must be obtained in order to record a conversation. In Canada, telephone calls may be recorded without a court order if one of the parties to the call consents to the recording .
The unanimous decision in the further appeal of Carter v Canada (AG), stated that a total prohibition of physician-assisted death is unconstitutional. The court's ruling limits exculpation of physicians engaging physician-assisted death to hard cases of “a competent adult person who clearly consents to the termination of life and has a grievous and irremediable medical condition, including an illness, disease or disability, that causes enduring suffering that is intolerable to the individual in the circumstances of his or her condition.” The ruling was suspended for 12 months to allow the Canadian parliament to draft a new, constitutional law to replace the existing one.Supreme Court rules Canadians have right to doctor-assisted suicide Sean Fine, Globe and Mail 6 Feb.
The criticisms of sweatshops, and thus the reason for an anti-sweatshop movement, begins with the lack of safety regulations in sweatshops and their exploitative nature. Matt Zwolinski argues that though sweatshop laborers technically "choose" to work in sweatshops, this decision is not "fully voluntary" and that while sweatshops may provide opportunities that would not otherwise exist, when a worker "consents" to work in a sweatshop, they are also consenting to labor practices that cause more harm than good to the laborer overall. Another criticism includes the prevalence of child labor working heavy machinery for very low wages. This often requires children to be taken out of school, thus disrupting their education, and exposing them to very dangerous working conditions that may endanger their health.
After Hughie realizes what Butcher is doing, he pays a visit to MM's mother after his death, discovering she has grown into an enormous blob; her breasts have elongated to tentacles (explaining why MM displays nausea when snakes are described by a nature show in an earlier issue) and she seems only able to say "MY BOY..." when she spots Hughie, apparently not realizing he is not her son. When she grabs him with one tentacle and presents another with a distended nipple at the end, Hughie consents to drink, possibly hoping the milk will strengthen him (he is unable to keep it down, however). Laz Alonso portrays the character in the television series. This version's real name is Marvin T. Milk.
Anne, the daughter of a doctor, is in love with Dr. John "Dock" Gordon, her father's protege and a friend of her late brother Rob who was killed in the Civil War. Depressed by his war experiences, John gave up his medical practice for several years, but with Anne's encouragement resumes his practice and the two marry. Anne's father consents to the match, but warns her that John is too affected by the suffering he sees as a doctor and that he is likely to make a poor husband, so Anne will have to be very tolerant. Sally develops a relationship with John's friend Captain Ludwig Rausch, who has bought a small local rope-making business and begun building it into a large, updated factory.
Sanskrit Original: कौिटलीय अर्थशास्त्र, Arthashastra Book 3, Kautilya, pages 84-85 The chapter 2 of Book 3 of Arthashastra legally recognizes eight types of marriage. The bride is given the maximum property inheritance rights when the parents select the groom and the girl consents to the selection (Brahma marriage), and minimal if bride and groom marry secretly as lovers (Gandharva marriage) without the approval of her father and her mother.Sanskrit Original: कौिटलीय अर्थशास्त्र, Arthashastra Book 3, Kautilya, pages 81-82 However, in cases of Gandharva marriage (love), she is given more rights than she has in Brahma marriage (arranged), if the husband uses the property she owns or has created, with husband required to repay her with interest when she demands.
Argirio then summons his daughter, Amenaide to appear. She joins in the general songs of triumph which are expressed by the assembly, but is also disturbed by the fact that her secret beloved, Tancredi, has not rejoined her in spite of the fact that she has written a letter to him asking him to do so now that he is returning in disguise to Syracuse. The Senate, having already given Tancredi and his family's confiscated estates to Orbazzano, Argirio then offers Amenaide in marriage to him in order to help solidify the truce. He wishes to have the ceremony performed immediately, and although she dutifully consents to the arrangement, she pleads with her father to postpone it until the following day.
However, when he tries to rally the Greeks against the sacrifice, he finds out that "the entirety of Greece"—including the Myrmidons under his personal command—demand that Agamemnon's wishes be carried out, and he barely escapes being stoned. Clytemnestra and Iphigenia try in vain to persuade Agamemnon to change his mind, but the general believes that he has no choice. As Achilles prepares to defend Iphigenia by force, Iphigenia, realizing that she has no hope of escape, begs Achilles not to throw his life away in a lost cause. Over her mother's protests and to Achilles's admiration, she consents to her sacrifice, declaring that she would rather die heroically, winning renown as the savior of Greece, than be dragged unwilling to the altar.

X5 In 1908 Fauré wrote of Messager, "There are not many examples in the history of music of an artist with such a complete education, of such profound knowledge, who consents to apply his gifts to forms regarded, nobody knows why, as secondary". Baker's Biographical Dictionary of Musicians says of Messager, "His style may be described as enlightened eclecticism; his music was characteristically French, and more specifically Parisian, in its elegance and gaiety." In his book Composers of Operetta, Hughes comments that Messager combined "a flow of spontaneous melody worthy of Offenbach with a flair for economic workmanship at least the equal of Lecocq's" and in much of his music "a measure of Massenet's fluent grace, Saint-Saëns's aristocratic elegance, even Fauré's refined subtlety".Hughes, p.
Former politician Stockwell Day was particularly critical of the Court, saying, "[I]f you want to write laws, you should run for office." In an op-ed published on Canadian Broadcasting Corporation's website, he called for a nationwide debate concerning assisted-suicide legislation. In response to Carter, Conrad Black argued politicians should invoke the notwithstanding clause to send a message to the court that Parliament is supreme. The February 2015 Supreme Court decision in Carter v Canada (AG) limits physician-assisted suicides to "a competent adult person who clearly consents to the termination of life and has a grievous and irremediable medical condition, including an illness, disease or disability, that causes enduring suffering that is intolerable to the individual in the circumstances of his or her condition".
Jacopo d’Andrea Saltarelli (born 1459) was an apprentice goldsmith and male prostitute, sometimes described in modern literature as an artist's model, about whom nothing is known except the details of court records of several charges of prostitution, in one of which Leonardo da Vinci was among the accused.Abbott, p. 340 On April 9, 1476, an anonymous denunciation was left in the tamburo (letter box) in the Palazzo della Signoria (town hall) accusing him of being "party to many wretched affairs and consents to please those persons who request such wickedness of him". The denunciation accused four people of engaging in sodomy with Saltarelli: Baccino, a tailor; Leonardo da Vinci; Bartolomeo di Pasquino; and Leonardo Tornabuoni, a member of the aristocratic Tornabuoni family.
The village doctor suggests that Nuñez's eyes be removed, claiming that they are diseased and are "greatly distended" and because of this "his brain is in a state of constant irritation and distraction." Nuñez reluctantly consents to the operation because of his love for Medina-Saroté. However, at sunrise on the day of the operation, while all the villagers are asleep, Nuñez, the failed King of the Blind, sets off for the mountains (without provisions or equipment), hoping to find a passage to the outside world, and escape the valley. In the original story, Nuñez climbs high into the surrounding mountains until night falls, and he rests, weak with cuts and bruises, but happy that he has escaped the valley.
On 28 January 2005, Ngāi Tahu Properties Limited had applied for competing resource consents to take 3.96 m³/s of water from the Waimakariri River and use it for irrigation of 5,700 hectares of land to the north of the Waimakariri River. On 17 September 2005 the Ngai Tahu applications were publicly notified. A hearing before independent commissioners was held in February 2006.Ngai Tahu Properties Limited - Decision by Commissioners Philip Milne and Dr Brent Cowie, 21 July 2006. On 26 and 27 June 2006, Ngāi Tahu Properties Limited sought a declaration from the Environment Court that their application to take water from the Waimakariri River had 'priority' over the 2001 CPWT application and therefore could be granted before the CPWT application.
They may be symptoms of a systemic bias, a rigged process (where an agenda is not published in advance or changed when it becomes clear who is present to consent), fear of speaking one's mind, a lack of creativity (to suggest alternatives) or even a lack of courage (to go further along the same road to a more extreme solution that would not achieve unanimous consent). Unanimity is achieved when the full group apparently consents to a decision. It has disadvantages insofar as further disagreement, improvements or better ideas then remain hidden, but effectively ends the debate moving it to an implementation phase. Some consider all unanimity a form of groupthink, and some experts propose "coding systems ... for detecting the illusion of unanimity symptom".
The Rule in Dumpor's Case is a common law rule of property law first set forth by Sir Edward Coke in 1578 (4 Coke 119b [1578]), in the case of Dumpor v. Syms. In its most basic form, it states that once a landlord has consented to an assignment of a tenant's interest in a leasehold estate, the landlord implicitly consents to all future assignments by the assignee. This rule is still operative in some U.S. states and some other jurisdictions which follow English common law. The rule was abolished in England in 1859, as it has been in a number of U.S. states, but this does not automatically invalidate the rule in other jurisdictions which follow English common law.
Though somewhat incredulous, the dealer suggests a mirror as a gift, but Markheim takes fright at his own reflection, claiming that no man wants to see what a mirror shows him. Markheim seems strangely reluctant to end the transaction, but when the dealer insists that his visitor must buy or leave, Markheim consents to review more goods. However, when the dealer turns his back to select another item, Markheim pulls out a knife and stabs him to death. Surrounded by mirrors and ominously ticking clocks, and with only a candle to light up the dark shop, Markheim spends some minutes recovering his nerve when he hears someone moving about upstairs, though he knows the dealer's maidservant has taken the day off and no one should be there.
On April 20, 1998, the new Penal Code was enacted, removing the exceptions that had been instituted in 1973, including the provision for the pregnant woman's life. Under this Code, a person who performs an abortion with the woman's consent, or a woman who self-induces or consents to someone else inducing her abortion, can be imprisoned for two to eight years. A person who performs an abortion to which the woman has not consented can be sentenced to four to ten years in jail; if the person is a physician, pharmacist, or other health care worker, he or she is instead subject to between six and 12 years. El Salvador also amended its Constitution in January 1999 to recognize human life from the moment of conception.
Collectively, these represent about 20% of the entries in the National Register of Electors. Information provided by Canadian residents to the Canada Revenue Agency will only be shared with Elections Canada if the resident consents to such a transfer in their income tax and benefits return. If consent is granted, the Canada Revenue Agency will provide the resident's "name, address, date of birth, and Canadian citizenship information". Bill C-31 introduced an amendment to the Act to ensure that tax filers consenting to their personal information being included in the National Register of Electors are Canadian citizens; before this change, it was possible for non- citizen taxpayers to consent, and thus be included in the National Register of Electors, despite not being an eligible elector.
In short, the Red Knight, a knight who claims to owe no loyalty to King Arthur, attacks Lynette's home in the absence of any male figureheads, essentially holding the household hostage until her older sister, Leonie, consents to marry him and make him Lord. Lynette disguises herself as a servant boy and escapes, going all the way to Camelot and pleading with Arthur himself to help her rescue her sister. With the help of Merlin (who had appeared to her once before, after she was raped), she receives the king's blessing, but he only sends one man with her – Gareth, who she presumes to be a kitchen boy. She is quite rude to him, feeling very resentful towards Arthur for his choice.
Detail from The Story of Patient Griselda, painted c. 1500 The Marquis of Saluzzo, Gualtieri, overborne by the entreaties of his vassals, consents to take a wife, but, being minded to please himself in the choice of her, takes a husbandman's daughter. He has two children by her, both of whom he makes her believe that he has put to death. Afterward, feigning to be tired of her, and to have taken another wife, he turns her out of doors in her shift, and brings his daughter into the house in guise of his bride; but, finding her patient under it all, he brings her home again, and shows her children, now grown up, and honours her, and causes her to be honoured, as Marchioness.
The high level of sediment in Waiapu River means it is undesirable as a source of drinking water, however local marae and small communities have been known to use the water for domestic purposes on occasion. Farmers also allow livestock to drink directly from small streams flowing into the Waiapu River. There are no consents to take, use or dam water on the river or its tributaries, however a mini-hydro power station is expected to be operating in 2012 on a small stream in the catchment area. As very little water is taken from Waiapu River or its tributaries, the Gisborne District Council decided it was not necessary to implement the usual water plan regulating water usage in the district.
Meanwhile, Artie Abrams (Kevin McHale) notices Becky Jackson (Lauren Potter) observing the booths of the career fair and attempts to encourage her to attend college, but is rebuffed by Sue, who wants to keep Becky safe in McKinley as her secretary. Wanting to help Becky, Artie sings "Honesty" to her and later takes her on a tour of the University of Cincinnati, which has a program for students with special needs. Sue consents to the idea and later encourages Becky to attend college, realizing she is ready. In New York, Sam has a disastrous interview for a scholarship, and later confides in Rachel that he doesn't want to go to college and his dream is to become a male model.
Thus, failing to rescue a drowning child counts as a harmful act, as does failing to pay taxes, or failing to appear as a witness in court. All such harmful omissions may be regulated, according to Mill. By contrast, it does not count as harming someone if—without force or fraud—the affected individual Consents to assume the risk: thus one may permissibly offer unsafe employment to others, provided there is no deception involved. (He does, however, recognise one limit to consent: society should not permit people to sell themselves into slavery.) The question of what counts as a self-regarding action and what actions, whether of omission or commission, constitute harmful actions subject to regulation, continues to exercise interpreters of Mill.
As described in a film magazine, Dr. Arthur P. Hampton (MacLean), a struggling young physician, announces his marriage to a fictitious "Mary Jane Smith" in an effort to get his wealthy uncle George P. Hampton (Gordon) to give him and his two friends, a lawyer and a broker, sufficient funds to get them out of financial difficulties. He then finds himself in a difficult position when an injured young woman is brought to his office for treatment proves to be Mary Jane Smith (May) and his uncle appears to meet the bride. Mary consents to a temporary deception. Matters become complicated when the uncle insists on their accompanying him on a trip to Hawaii and informs them that he is to marry a Miss Burns (Thorne), who is Mary's aunt.
In properly regulated sport, there is a legal right to cause incidental injury. This is a criminal law version of the civil law principle volenti non fit injuria (Latin for consent does not make an [actionable] injury) and the victim consents to run the risk (not the certainty) of injury arising within the rules of the game being played. This does not give sport a license to enact rules permitting acts that are clearly, excessively and maliciously violent. Even professional sport should have an element of fun while the players are, in the more extreme cases, given criminal as well as civil law protection (see R v Johnson (1986) 8 Cr App R (S) 343 and R v Lloyd (1989) CLR 513 dealing with injuries inflicted on the rugby field in "off the ball" incidents).
In Canadian politics, a vote of no confidence is a motion that the legislature disapproves, and no longer consents to the governing Prime Minister or provincial Premier and the incumbent Cabinet. A vote of no confidence that passes leads to the fall of the incumbent government. The practice originates as a constitutional convention, and remains an uncodified procedure not outlined in any standing orders for the House of Commons of Canada. A no confidence motion may only be directed against the incumbent government in the legislature, with votes of no confidence against the legislature's Official Opposition being inadmissible At the federal level a vote of no confidence is a motion presented by a member of the House of Commons that explicitly states the House has no confidence in the incumbent government.
A local authority in England may detain a horse which is in any public place in its area if the local authority has reasonable grounds for believing that the horse is there without lawful authority, and if the land is lawfully occupied by a person that person consents to the detention of the horse or the local authority has reasonable grounds for believing that that person would consent to the detention of the horse. A local authority is defined as a county council, district council, London borough council, the Common Council of the City of London, or the Council of the Isles of Scilly. A public place is defined as any common land or town or village green or any highway (and the verges of any highway). A landowner may also exercise these powers.
Forced and child marriages are practiced in certain regions of the world, particularly in Asia and Africa, and these types of marriages are associated with a high rate of domestic violence.End early and forced marriage – Because I am a Girl A forced marriage is a marriage where one or both participants are married without their freely given consent. The line between forced marriage and consensual marriage may become blurred, because the social norms of many cultures dictate that one should never oppose the desire of one's parents/relatives in regard to the choice of a spouse; in such cultures it is not necessary for violence, threats, intimidation etc. to occur, the person simply "consents" to the marriage even if he/she doesn't want it, out of the implied social pressure and duty.
By way of a mutual acquaintance, she begins to receive beautiful letters from a lonesome Caribbean man named George Armstrong who is working on the Panama Canal. Being illiterate, Esther has one of her patrons respond to the letters, and over time the correspondence becomes increasingly intimate until George persuades her that they should marry, sight unseen. Meanwhile, Esther's heart seems to lie with the Hasidic shopkeeper from whom she buys fabric, and his heart with her, but the impossibility of the match is obvious to them both, and Esther consents to marry George. When George arrives in New York, however, he turns out not to be the man his letters painted him to be, and he absconds with Esther's savings, frittering it away on whores, liquor, and gambling.
Tre Kronor castle where much of the opera's action is set The opera takes place in the Tre Kronor castle in Stockholm and on an island in Saltsjön Bay in the weeks leading up to Queen Christina's abdication in 1654 and culminates with the abdication itself. The synopsis in this section is based on Casanova's libretto published in 1850. All the central characters are real historical figures associated with Queen Christina, although considerable liberties are taken with the time sequences, conflating events in the mid-1650s with those which occurred several years earlier. Cristina's unrequited love for Gabriele (Magnus Gabriel De la Gardie) and jealousy of his lover Maria Eufrosina (Maria Eufrosyne of Zweibrücken) are central to the opera's plot, and she only consents to their marriage at the moment of her abdication.
149-151; Kramer 1961 pp. 69-72 Christopher B. Siren (1999) based on John C. Gibson's Canaanite Mythology and S. H. Hooke's Middle Eastern Mythology Against Enki's wish, the gods decide to slay Kingu, and Enki finally consents to use Kingu's blood to make the first human, with whom Enki always later has a close relationship, the first of the seven sages, seven wise men or "Abgallu" (ab = water, gal = great, lu = man), also known as Adapa. Enki assembles a team of divinities to help him, creating a host of "good and princely fashioners". He tells his mother: Adapa, the first man fashioned, later goes and acts as the advisor to the King of Eridu, when in the Sumerian King-List, the me of "kingship descends on Eridu".
Miyagi initially declines, wanting instead to prevent the bullying entirely. However, a meeting with the arrogant and merciless John Kreese - a former Special Forces veteran running the Cobra Kai dojo and the bullies' sensei - proves largely futile; however, Kreese consents to a cessation of hostilities until the time of a karate tournament where Daniel and the bullying Cobra Kai students will compete. For his part, Miyagi agrees to teach Daniel. Miyagi starts Daniel's training with several seemingly non- karate-related house chores, albeit with specific rhythmic patterns: the first day of training sees Daniel waxing Miyagi's various cars; on the second, he sands the wooden floors of Miyagi's house; on the third, he paints a fence with vertical strokes; on the fourth, he paints Miyagi's house with horizontal strokes.
Dorothy stalls for time in court by pretending to be Lorelei, disguised in a blonde wig and mimicking her friend's breathy voice and mannerisms. When Malone appears in court and is about to unmask "Lorelei" as Dorothy, she reveals to Malone in covert language that she, Dorothy, loves him but would never forgive him if he were to do anything to hurt her best friend, Lorelei. Malone withdraws his comments, but then reveals Piggy has the tiara, exonerating Lorelei. Back at the nightclub, Lorelei impresses Esmond, Sr. with a speech on the subject of paternal money, and also makes an argument that if Esmond, Sr. had a daughter instead of a son, he would want the best for her, to which he agrees and consents to his son's marriage to Lorelei.
There is an inevitable overlap between the general offence of theft, contrary to section 1(1), and these offences because they cover both general and specific situations in which the defendant will appropriate property by using some form of deception. Deception offences are separately defined to avoid any problems that might arise when the "victim" consents to the taking. Because the effect of the deception may be to persuade the owner to pass title to the goods, albeit on a voidable title, those goods may not "belong to another" at the time of the appropriation. In fact, strong authority has emerged that this is not a real problem because an appropriation is the "assumption" of the rights of ownership, whether that assumption is effective in law: see R v Gomez [1993] AC 442 .
Lord Denning MR held that they were not entitled to compensation. The House of Lords had previously ruled in Smith v Baker & Sons [1891] AC 325 that an employee did not implicitly consent to risk arising from a dangerous workplace, and as such the defence of volenti non fit injuria (that an employer is not liable for injury that results from risk that the employee consents to) could not be relied upon in such a situation. However ICI was in full compliance with relevant safety regulations, having safety precautions in place and ensuring that their employees, including the experienced Shatwell, were aware of them. ICI was thus held not to be vicariously liable for compensation for injury resulting from Shatwell's active disregard of his employer's instructions and statutory regulations.
In an opinion by Justice Scalia and decided 6–3, the Court held that a warrantless search of premises, when a third party consents to the search but does not possess actual common authority over those premises, is valid if the authorities "reasonably believed" at the time of the search that the third party possessed common authority over the premises. In reaching its decision, the Court noted that "reasonableness", not consent, is the touchstone of Fourth Amendment jurisprudence; the Constitution only prohibits "unreasonable" searches and seizures. Therefore, the constitutional validity of a police determination of consent to enter is not judged by whether the police were correct in their assessment, but by whether, based on the facts available at the moment, it was reasonable to conclude that the consenting party had authority over the premises.
For example, in Australia, until 1983 a husband had to authorize an application for an Australian passport for a married woman. Other practices have included, and in many countries continue to include, a requirement for a husband's consent for an application for bank loans and credit cards by a married woman, as well as restrictions on the wife's reproductive rights, such as a requirement that the husband consents to the wife's acquiring contraception or having an abortion. In some places, although the law itself no longer requires the consent of the husband for various actions taken by the wife, the practice continues de facto, with the authorization of the husband being asked in practice. Although dowry is today mainly associated with South Asia, the practice has been common until the mid-20th century in parts of Southeast Europe.
2015 Specifically the Supreme Court held that the current legislation was overbroad in that it prohibits "physician‑assisted death for a competent adult person who (1) clearly consents to the termination of life and (2) has a grievous and irremediable medical condition (including an illness, disease or disability) that causes enduring suffering that is intolerable to the individual in the circumstances of his or her condition." The court decision includes a requirement that there must be stringent limits that are “scrupulously monitored.” This will require the death certificate to be completed by an independent medical examiner, not the treating physician, to ensure the accuracy of reporting the cause of death. The newly (November 2015) elected federal government subsequently requested a six-month extension for implementation; the arguments for this request were scheduled to be heard by the Supreme Court in January 2016.
Kajak turns out to be somewhat sour on earthmen, including his own son-in-law, presenting a picture of them very different from that of Burroughs. He regards Carter as something of a blowhard, claiming impossible prowess in battle, and Ulysses Paxton, the other earthman resident on Barsoom, as a rabble-rouser, advocating Terran ideas of equality and freedom unwelcome to the hierarchical, slave-owning Martians. Kajak suggests they seek guidance from Paxton's old mentor Ras Thavas, the so- called "master-mind of Mars," formerly villainous and still somewhat amoral. Thavas consents to aid the couple in return for some professional help from psychologist Shea; having previously had Paxton transplant his brain from his original aged body into a young and virile one, he has had difficulty adjusting to changed societal expectations, not to mention the youthful urges of his new form.
Accordingly, the defendant or property/casualty insurer transfers the obligation, through a legal device called a qualified assignment, to a third party. The third party, called an assignment company, will require the defendant or property/casualty company to pay it an amount sufficient to enable it to buy an annuity that will fund its newly accepted periodic payment obligation. If the claimant consents to the transfer of the periodic payment obligation (either in the settlement agreement or, failing that, in a special form of qualified assignment known as a qualified assignment and release), the defendant and/or its property/casualty company has no further liability to make the periodic payments. This method of substituting the obligor is desirable for defendants or property/casualty companies that do not want to retain the periodic payment obligation on their books.
Protection and management of archaeology in Australia is controlled by Federal and State Government legislation including the Commonwealth Aboriginal and Torres Strait Islander Heritage Protection Act 1984, The Environment Protection and Biodiversity Conservation Act and the various state archaeological legislation such as Victoria's Heritage Act 1995 (covering historical archaeology) and the Aboriginal Heritage Act 2006. Several states maintain archaeological site inventories as the main management tool. The principle of most forms of archaeological legislation in Australia is to provide blanket protection for all archaeological remains and sites, whether or not they have been recorded, and use a system of permits and consents to control change to those sites. for Aboriginal archaeological sites, there is often a requirement for consultation with traditional owners, and they sometimes have a role in approving works that impact on archaeological sites.
Volenti non fit iniuria (or injuria) (Latin: "to a willing person, injury is not done") is a common law doctrine which states that if someone willingly places themselves in a position where harm might result, knowing that some degree of harm might result, they are not able to bring a claim against the other party in tort or delict. Volenti applies only to the risk which a reasonable person would consider them as having assumed by their actions; thus a boxer consents to being hit, and to the injuries that might be expected from being hit, but does not consent to (for example) his opponent striking him with an iron bar, or punching him outside the usual terms of boxing. Volenti is also known as a "voluntary assumption of risk". Volenti is sometimes described as the plaintiff "consenting to run a risk".
He finally consents to give up his claim to the child if she can guess his name within three days (some versions have the imp limiting the number of daily guesses to three and hence the total number of guesses allowed to a maximum of nine). Her many guesses fail, but before the final night, she wanders into the woods (in some versions, she sends a servant into the woods instead of going herself, in order to keep the king's suspicions at bay) searching for him and comes across his remote mountain cottage and watches, unseen, as he hops about his fire and sings. In his song's lyrics— "tonight tonight, my plans I make, tomorrow tomorrow, the baby I take. The queen will never win the game, for Rumpelstiltskin is my name"— he reveals his name.
Due to the misguided rumors from John Thorpe, General Tilney's perception of Catherine changes in that he once held her in high esteem, thinking that she came from a wealthy family; however, when a spurned John Thorpe later tells General Tilney that Catherine's family is essentially destitute, he denies Henry's marriage proposal to Catherine. Eventually, after his daughter's marriage to a nobleman, General Tilney's anger subsides, and when he discovers the truth in that Catherine does in fact descend from a modestly well-off family, he finally consents to Henry and Catherine's marriage. Upon further analysis, General Tilney's behavior and attitude brings our attention to the social concerns that were common during Jane Austen's time period. Eleanor Tilney: She is the younger sister of Frederick and Henry Tilney, and the daughter of the tyrannical General Tilney.
An act, passed by the General Assembly of Virginia in 1988 and amended in 2013, provides the procedural requirements necessary for a physician to lawfully sterilize a patient capable of giving informed consent and incapable of giving informed consent. A physician may perform a sterilization procedure on a patient if the patient is capable of giving informed consent, the patient consents to the procedure in writing, and the physician explains the consequences of the procedure and alternative methods of contraception. A court may authorize a physician to perform a sterilization on a mentally incompetent adult or child after the procedural requirements are met and the court finds with clear and convincing evidence the patient is or is likely to engage sexual activity, no other contraceptive is reasonably available, the patient's mental disability renders the patient permanently unable to care for a child, and the procedure conforms with medical standards.
Julian Mintz, voiced by Nozomu Sasaki is the adopted teenage son of Yang Wen-li. Julian's role as Yang Wen-li's assistant starts as a minor character in the beginning of the series, usually seen as taking care of his messy and haphazard adopted guardian, but as the story progresses he becomes more central to the story of the Free Planets Alliance's struggle. Yang Wen-li regularly expressed a desire that Julian would not become a soldier, rather advocating that Julian take a civilian role, perhaps in government, but eventually consents to Julian's entry into the armed forces. After a successful mission to Earth to uncover and eventually (with the inadvertent assistance of the Imperial troops) destroy the headquarters of the notorious Terraist Church, he rises in stature before finally rising after the events of the third series to the reluctant military leader of the Iserlohn Republic Government, at age 18.
78 On December 31, 1862, an enabling act was approved by President Abraham Lincoln admitting West Virginia, on the condition that a provision for the gradual abolition of slavery be inserted in its constitution (as Rev. Battelle had urged in the Wheeling Intelligencer and also written to Lincoln). While many felt West Virginia's admission as a state was both illegal and unconstitutional, Lincoln issued his Opinion on the Admission of West Virginia finding that "the body which consents to the admission of West Virginia is the Legislature of Virginia", and that its admission was therefore both constitutional and expedient. The convention was reconvened on February 12, 1863, and the abolition demand of the federal enabling act was met. The revised constitution was adopted on March 26, 1863 and on April 20, 1863, President Lincoln issued a proclamation admitting the state 60 days later on June 20, 1863.
With the Darkness unleashed, Sam and Dean set out to try to find the Darkness, but are shaken to learn that the entity they are hunting is essentially God's sister, who was 'sacrificed' so that he could create the world. Manifesting as a woman who comes to call herself Amara, Sam learns Dean is drawn to her from a twisted attraction, but matters become even more complicated when Castiel consents to act the vessel for Lucifer when he becomes convinced that only an archangel has any chance against Amara. This strategy fails- speculated to be due to Lucifer's status as a fallen archangel- but the Winchesters are eventually contacted by the true God, now revealed to be Chuck Surely, the author who wrote the Winchester Gospels, who is able to make peace with Amara and depart. Sam briefly believes Dean is dead and is kidnapped by a mysterious woman.
Thio said that expressing the right to vote clearly in the Constitution would allow aspects of that right such as voter secrecy and the universality and equality of votes to be protected from unjust manipulation. A copy of the 1999 Reprint of the Constitution of Singapore However, the Minister for Law said the Government was of the opinion that as the right to vote is an implied right in the Constitution, it was unnecessary for the Constitution to be amended to expressly mention the right. Articles 65 and 66 of the Constitution would be entrenched once Article 5(2A) is brought into force. That Article, which has remained in abeyance since it was introduced in 1991, provides that a bill that seeks to amend, among other things, Article 65 or 66, must be supported at a national referendum by not less than two-thirds of the votes cast, unless the President consents to the amendment.
In July 2010, Taitz applied to the U.S. Supreme Court to stay the enforcement of sanctions, arguing that "allowing sanctions by judge Land to stand will signify beginning of tyranny in the United States of America and end to the Constitutional Republic which is the foundation of this nation". On July 8, the application was submitted to Associate Justice Clarence Thomas; on July 15, he denied it. Doubting that Justice Thomas signed the denial order, Taitz claimed to have requested of Chief Justice John Roberts that Thomas's signature be presented to her for verification. In the meantime, on August 9, the federal government filed an abstract of judgment, a document placing a lien in the amount of $20,000 plus interest on all her real property, prompting Taitz to say, "I will pay the money, and I will continue fighting," should it happen that her application for stay is ultimately denied and that the Supreme Court consents to her request to authenticate Justice Thomas's signature.
The Central Plains Water Trust applications for resource consents may not have been technically used as security for the loan from Dairy Holdings Limited. However, the Christchurch City Council report clarifies that Dairy Holdings Limited, will now get the benefit of the first use of water from the Rakaia River, under the loan arrangement. That benefit will flow from the date the consents are granted, which will be some years before any of the 'ordinary' farmer shareholders in CPWL receive water, once the full scheme is constructed. The concept of guaranteed public 'ownership' of the resource consents by Central Plains Water Trust, is somewhat of a fiction, given that a private company, Central Plains Water Limited, has an exclusive licence to operate the consents to take and use water for irrigation, and particularly given that Central Plains Water Limited has already granted a sublicence for the Rakaia River water to Dairy Holdings Limited.
Pari agrees in order to eliminate the last person who knows the truth about who had an affair with Goher, and when Durkhanay's brother Sharifullah, a laborer from Dubai, arrives, he consents to this proposal. Durkhanay mourns the deaths occurring around her and blames herself for Shireen's suffering; she goes to offer Shireen her condolences, and at her brother's request, vows to cheer her up. Shiri insists that Durkhanay look forward to the life ahead of herself instead of craving death, wistfully reciting the days of the wedding Durkhanay will have that Shiri herself did not experience. Meanwhile, Sharifullah stays in Pakistan and works for Pari as a zameendar, and at first wanted to remarry Shiri, but falls prey to Pari's hateful words against Shiri, who she resents once again for having a share in Saif-ur-Rehman's will, and declares her an evil woman; he then forbids Durkhanay to visit Shiri again.
The authority of the USPTO to issue a concurrent use registration is set forth in the Lanham Act, section 2 (d), enacted in 1947 and coded at , which states in relevant part: The headquarters of the United States Patent and Trademark Office in Alexandria, Virginia, where Concurrent Use applications are evaluated. Through these provisions, the Act effectively places three requirements on marks for which a later applicant seeks a concurrent use registration: :1) the later applicant must have used the mark in commerce prior to the time that the earlier registrant filed its application for registration, unless the senior registrant consents to the junior user's registration; :2) the later applicant's use in commerce must have been lawful :3) concurrent use of the marks must not result in a likelihood of confusion. The statute essentially codifies the Tea Rose- Rectanus doctrine, established by the United States Supreme Court in two cases decided in 1916 and 1918.Hanover Star Milling Co. v.
Munk- the Indigo Tribe representative of the New Guardians- manages to disrupt Larfleeze's constructs by tapping into the Orange light when Larfleeze attacks the New Guardians, with the regenerated Glomulus actively moving to protect Kyle, but the team are forced to prioritize when Invictus begins to attack the Vega system.Green Lantern: New Guardians #11 (July 2012) When Kyle Rayner learned that he needed to master all seven emotions of the spectrum to defeat the rise of the Third Army, he approached Larfleeze for aid. Although Larfleeze was initially unwilling to share his power, he consented when Carol Ferris offered to help him find his still- living family in return. Despite this offer, Larfleeze only consents to give Kyle access to his power if Kyle can get past him in a fight and recharge from his Orange battery, although Kyle manages to do this while Larfleeze is occupied fighting off the attacking Third Army.

He can hear and process auditory input but is unable to speak. He is recognized by Winnie, one of the victims of a crash he assisted in earlier, who tells the surgeons that their patient's name is Derek and that he is a surgeon as well. The hospital he is taken to is understaffed and under-equipped, and his head injury is not detected quickly enough by the arrogant doctors and inexperienced interns on duty that night; although one intern does suspect Derek had a head injury, her superior repeatedly shuts down her attempts to get him a head CT, prioritizing his abdominal bleeding beforehand and having him rushed into surgery even though he is stable enough for the CT. Although the neurosurgeon on call is paged multiple times after the doctors finally discover the head injury, he takes too long to arrive, and Derek is declared brain dead. Police arrive at Meredith's door and take her to see Derek, where she consents to remove him from life support.
Under Canadian law, a person has the constitutional right to a jury trial for all crimes punishable by five years of imprisonment or more. The Criminal Code also provides for the right to a jury trial for most indictable offences, including those punishable by less than five years' imprisonment, though the right is only constitutionally enshrined for those offences punishable by five years' imprisonment or more. Generally, it is the accused person who is entitled to elect whether their trial will proceed by judge alone or by judge and jury; however, for the most severe criminal offences—murder, treason, intimidating Parliament, inciting to mutiny, sedition, and piracy—trial by jury is mandatory unless the prosecution consents to trial by judge alone. Jury panel exhaustion Criminal Code Section 642(1): If a full jury and alternate jurors cannot be provided, the court may order the sheriff or other proper officer, at the request of the prosecutor, to summon without delay as many people as the court directs for the purpose of providing a full jury and alternate jurors.
Truthfulness balances what ought to be expressed and what ought to be kept secret: it entails both honesty and discretion. In justice, one man owes it to another to manifest the truth. The disciple of Christ consents to "live in the truth," that is, in the simplicity of a life in conformity with the Lord's example, abiding in his truth. "If we say we have fellowship with him while we walk in darkness, we lie and do not live according to the truth."(1 John 1:6) To keep “a clear conscience toward God and toward men”(Acts 24:16), Christians must follow Christ's example “to bear witness to the truth.”(John 18:37) The Christian is not to “be ashamed then of testifying to our Lord.”(2 Timothy 1:8) In situations that require witness to the faith, the Christian must profess it without equivocation. Christian witness to the Gospel and the obligations that flow from it are an act of justice that establishes the truth or makes it known.
As Joseph Perez pointed out, the expulsion "puts an end to an original situation in Christian Europe: that of a nation that consents to the presence of different religious communities" with which it "becomes a nation like the rest in European Christendom". "The University of Paris congratulated Spain for having carried out an act of good governance, an opinion shared by the best minds of the time (Machiavelli, Guicciardini, Pico della Mirandola)... [...] it was the so-called medieval coexistence that missed Christian Europe. Julio Valdeón affirms that the decision of the Catholic Monarchs, who "showed themselves, in their first years of rule, clearly protective of the Hebrews," was due to "pressure from the rest of Christianity" and to "the constant pressure of The Church, who often preached against those he called "deicides", as well as the "tremendous animosity that existed in the Christian people against the Jewish community." In this sense, he quotes the thesis of the Israeli historian Benzion Netanyahu that the expulsion was the consequence of the climate of racism that lived in the Christian society of the time.
B). A person commits an offense under section 43.25(b) if, knowing the character and content thereof, he employs, authorizes, or induces a child younger than 18 years of age to engage in a sexual performance, or if the person induces a child younger than 18 years of age merely to engage in sexual conduct. A parent or legal guardian or custodian of a child younger than 18 years of age commits an offense if he/she consents to the participation by the child in a sexual performance. This crime requires proof of inducement. However, inducement does not require threat, promise of payment or any specific incentive, or even verbal persuasion to be proven under Texas Penal Code § 33.021. Online Solicitation of a Minor is a criminal offense in the state of Texas that makes it illegal for someone 17 years and older to intentionally or knowingly communicate certain sexual content or try to induce or solicit a minor under 17 years of age, or any communication, language, or material, including a photographic or video image, that relates to or describes sexual conduct, as defined by Section 43.25.
He recalls the rite of the Horse sacrifice; he is shocked and saddened when he sees the "King Horse", whom he considers a noble beast and his friend, killed in front of him as a sacrifice to the gods. However, this leads to a conversation with his grandfather the King who tells him how the King used to be sacrificed with the Horse and how even now a true king of the Hellene people, whose duty is to look after his people, may need to make the ultimate sacrifice. His grandfather discusses the role of "moira" or fate in their lives but also emphasizes that in order for a king to lead his people, he must consent to the risk of sacrifice, in order that "he can walk with the god". This becomes a recurrent theme in the story as, time and time again, Theseus is faced with the choice of choosing a safe course of action over one where he places his faith in the "god" and his skill and where he consents to what he sees as the will of the god.
Individuals and human rights organisations increasingly criticised the coercion-based model for a variety of reasons, such as the requirement for the victim to actively resist an assault (thereby failing to address cases where victims are unconscious, intoxicated, asleep or suffer from involuntary paralysis – also known as "freezing" – due to fear or other state of helplessness, and thus unable to resist an assault) or not wear certain kinds of clothes to not 'provoke' an assault (shifting the responsibility for the crime from the perpetrator unto the victim), or the focus on physical violence (thereby failing to consider that a perpetrator sometimes needs to use little to no physical violence in order to conduct an assault, e.g. when the victim is unconscious, intoxicated, asleep or involuntarily paralysed; and also failing to address mental and psychological harm caused by rape and assault). The consent-based model has been advocated as a better alternative for enhanced legal protection of victims, and to place a larger responsibility on potential perpetrators to actively verify or falsify before initiating sex whether a potential victim actually consents to initiating sex or not, and abstaining from it as long as they do not.
