The imprisonment led to a substantial decline in Sam's health.3rd Marquess of Waterford in "Lord Waldegrave and Young Dutch Sam", Leiscester Chronicle, Leicester, England, pg. 4, 24 Feb 1838"Young Dutch Sam and The Morning Star Marquis", The Charter, London, England, pg. 9, 7 April 1839 In 1840, Young Dutch Sam's residence was used to finalize the financial arrangements as specified by contract for the English championship fight between Ben Caunt and Nick Ward.
Design by contract does not replace regular testing strategies, such as unit testing, integration testing and system testing. Rather, it complements external testing with internal self-tests that can be activated both for isolated tests and in production code during a test-phase. The advantage of internal self- tests is that they can detect errors before they manifest themselves as invalid results observed by the client. This leads to earlier and more specific error detection.
The NH Professional Theatres employ both AEA Actors' Equity Association performers and non-union working actors. The Actor's Equity Association is the union of actors and stage management professionals, and operates with many NH Professional Theatres by contract. AEA is a member of the AFL–CIO, and is affiliated with FIA, an international organization of performing arts unions. NHPTA member houses are found from the seacoast to the lakes and mountains and forested border with Vermont.
At this current time, Ninivaggi has now left ShoP Architects and is working to grow her own firm, K&Co;, which specializes in hospitality and large-scale multi-family residential interiors. Because of all of Krista Ninivaggi's success at the various companies she has worked for, she attended the 35th Annual Interiors Awards Breakfast hosted by Contract Magazine, which was held on January 24, 2014. Here she was named the Designer of the Year for 2014.
The work was done by contract, but since every "mozo" starts with a large debt, the usual advance on engagement, they become servants to the owner. # Independent tillers: living in the most remote provinces, survived by growing crops of maize, wheat or beans, sufficient to meet their own needs and leave a small margin for disposal in the market places of the towns and often carried their goods on their back for up to twenty five miles a day.
Work was the greatest authority on auction bridge, which was generally replaced by contract bridge during the late 1920s. Goren "became Mr. Work's technical assistant at the end of the decade". As a player Goren's "breakthrough" was the 1937 Board-a-Match Teams championship (now Reisinger) won with three other Philadelphia players: John Crawford, Charles Solomon, and Sally Young. His breakthrough as a writer may have been when Culbertson moved a newspaper bridge column from one syndicate to another.
The consequence of this legislation is that all individuals representing themselves, operating on a contract-by-contract basis, will be able to deduct almost all reasonable, business related expenses from their taxable income whilst operating under the loan-out corporate body. This legislation has sparked a rejuvenation of the concept of operating under a corporate body, which facilitates all payments, with the individual creator of the corporation loaning out their services, while allowing for expense deduction and asset protection.
However, the resident's land could be taken away if not put to good use. There were other details which provided for controlled rent, graduated rent for females, the right of unmarried women who were daughters of a resident to permanent residence (a resident's son, however, could only remain on an estate after reaching the age of eighteen with the owner's permission) and for the growing by Africans of cash crops only by contract with the owner.
The Fresno County Sheriff provides court protection, jail administration, and coroner services for all of Fresno County and its population of approximately of 994,400 residents. They operate the Fresno County Jail in downtown Fresno. The sheriff's provide police patrol and detective services for the unincorporated areas of the county which encompasses approximately 250,000 residents, or 25% of the county's total population. The Sheriff also provides law enforcement services by contract with the municipality of San Joaquin, population 4100.
The facility was designed by two prominent Kansas City architectsJames Oliver Hogg and A. Wallace Love, who was also Kansas City's Superintendent of Buildingswith suggestions from Major Brant. The base building cost proposal was for the building and for steel cells, totaling . The location is in questionable proximity to the city's population center, though it was coincidentally chosen for its generous natural deposit of yellow limestone. It would be quarried by inmates, and constructed by contract labor.
Douglas was pledged in marriage, by contract, in 1492, to Elizabeth, daughter and co-heir of the later James Auchinleck of that Ilk, by which contract he received a grant of the wardship of Auchinleck's estates. They had a son Sir Archibald Douglas of Glenbervie. Elizabeth Douglas survived her husband and entered the convent of St. Catherine of Siena, on the Burgh Muir of Edinburgh. This convent was to give its name to the Sciennes area of the city.
As such, EiffelStudio AutoTest is a means to exercising the "tests" or assumptions of the Design by Contract conditions. Therefore, unit and integration testing need not re-test through means of assertions or test oracles what has already been coded as specification in the contracts of the class text. EiffelStudio AutoTest provides the user with three methods of test case creation. First, for manually created tests EiffelStudio AutoTest creates a test class containing a framework for the test.
"Benjamin Tucker, Individualism, & Liberty: Not the Daughter but the Mother of Order". This led to a split in American individualist anarchism between the growing number of egoists and the contemporary Spoonerian natural lawyers. Tucker came to hold the position that no rights exist until they are created by contract. This led him to controversial positions such as claiming that infants had no rights and were the property of their parents because they did not have the ability to contract.
8) were about three times bigger than the earlier buildings. Some of the construction work was done by contract but some was also done by day labour with up to 360 men employed, the average being 100. After the major building program of the 1900s, some building work continued, mostly timber buildings for ancillary purposes rather than major new shops. The most prominent visually was the Time-keepers Office (R.17) at the front gates in North Street.
These trials are often conducted in a clinical trial clinic, where the subject can be observed by full-time staff. These clinical trial clinics are often run by contract research organization (CROs) who conduct these studies on behalf of pharmaceutical companies or other research investigators. The subject who receives the drug is usually observed until several half-lives of the drug have passed. This phase is designed to assess the safety (pharmacovigilance), tolerability, pharmacokinetics, and pharmacodynamics of a drug.
Test-driven development offers more than just simple validation of correctness, but can also drive the design of a program. By focusing on the test cases first, one must imagine how the functionality is used by clients (in the first case, the test cases). So, the programmer is concerned with the interface before the implementation. This benefit is complementary to design by contract as it approaches code through test cases rather than through mathematical assertions or preconceptions.
This makes them comparatively quick and cheap to develop, but unsuitable in most cases for long term use. In the second case, the systems are developed by experienced software developers that are not part of the organization's information systems department. These systems may be off-the-shelf software products or custom solutions developed by contract programmers. Depending on the expertise of the developers, these solutions may exceed the reliability of those created by the organization's information systems department.
Unlike in neighbouring Bohemia, the nobles held no allodial titles, as the conquered Milceni Land as a whole belonged to the king. In 1241 the boundary between the possessions of the Meissen bishops and the Bohemian Crown in Upper Lusatia were agreed by contract. Upper Lusatia (blue) held by the Margraves of Brandenburg, c. 1253-1319 Between the death of King Wenceslaus I of Bohemia in 1253 and 1262, the Ascanian margraves of Brandenburg attained Budissin Land.
It was the first brickworks to be established outside Brisbane capable of producing refractory firebricks, supplying these by contract to Queensland Railways. The place demonstrates rare, uncommon or endangered aspects of Queensland's cultural heritage. The site demonstrates a rare aspect of Queensland's history as the brickworks chimney stacks at the Pindi Pindi site are among the last remaining stacks in the district. The place has potential to yield information that will contribute to an understanding of Queensland's history.
Typical minimum staffing by contract personnel was eight persons, including electronic technicians, mechanics and housekeeping staff. The prefabricated tower was designed, built and installed in 1960 by J. Ray McDermott & Company of New Orleans. In July 1966 the program was transferred to the Manager, Antisubmarine Warfare Project Office and technical responsibility transferred to the Naval Research Laboratory (NRL). The research program was suspended on 30 June 1970 with occasional daytime inspections and maintenance work by NRL personnel.
Encapsulation is the very essence of an FBP component, which may be thought of as a black box, performing some conversion of its input data into its output data. In FBP, part of the specification of a component is the data formats and stream structures that it can accept, and those it will generate. This constitutes a form of design by contract. In addition, the data in an IP can only be accessed directly by the currently owning process.
It opened a similar building in Glasgow in 1936 in Albion Street. Glasgow printing ended in 1974 and Manchester in 1989 on the company's own presses. Johnston Press has a five-year deal, begun in March 2015, to print the northern editions of the Daily Express, Daily Star, Sunday Express and the Daily Star Sunday at its Dinnington site in Sheffield. The Scottish edition is printed by facsimile in Glasgow by contract printers, the London editions at Westferry Printers.
This include approving, establishing, expanding, reorganizing, and, in limited circumstances, dissolving cities and special districts. LAFCOs are also responsible for approving all outside service extensions by contract or agreement beginning in 2001. LAFCOs' regulatory powers are generally exercised in response to applications filed by other local agencies, landowners, or registered voters. LAFCOs' are also allowed to initiate certain proposals if consistent with a recommendation from its own planning studies, such as establishing, consolidating, or dissolving special districts.
Before the Superior Court of Quebec, the parties argued primarily as to whether the Quebec Charter of Human Rights and Freedoms and the Canadian Charter of Rights and Freedoms. Judge Turmel ruled that because the employment contract constituted a matter of private law between an employer (here the city of Longueuil) and an employee, neither charters applied, in so far as such rights as granted by the charters can, under civil law be willingly waived by contract.
Oxford University Press. In the United States, similar torts existed but have become superseded to some degree by contract law and the pure economic loss rule. Historically (and to some degree today), fraudulent (but not negligent) misrepresentation involving damages for economic loss may be awarded under the "benefit-of-the-bargain" rule (damages identical to expectation damages in contracts) which awards the plaintiff the difference between the value represented and the actual value. Beginning with Stiles v.
The vehicles also have to be decorated on the morning of each stage and, because they must return to ordinary highway standards, disassembled after each stage. Numbers vary but there are normally around 250 vehicles each year. Their order on the road is established by contract, the leading vehicles belonging to the largest sponsors. The procession sets off two hours before the start and then regroups to precede the riders by an hour and a half.
Before its official opening, the prison was used in various training exercises. Drills included escaped inmates and staff being taken hostage. It cost approximately $28 million to operate this prison each year TCI is maintained by contract maintenance, TKC Management Services. As a part of the North Carolina Department of Public Safety Division of Prisons, it opened in 2008, and housed, as of July 2014, a maximum of 1,752 inmates, providing over 500 jobs to the economically depressed area.
The massive incorporation of labor staff in the service of the Public Administration is a relatively recent phenomenon. Its relationship with the Administration is not statutory, like the one of the civil servants, but by contract. Its legal regime is governed by the rules of administrative law, something that does not preclude the application of the common labor law regime. In its contracting and dismissal, the principles of equality, publicity, merit and capacity must continue to be respected.
He handled fund-raising, appointments, and setting general policies.Cornelius Michael Buckley, Stephen Larigaudelle Dubuisson, S.J. (1786–1864) and the Reform of the American Jesuits. (2013) The American Jesuits were restored in 1804, and intellectually reflected the English Enlightenment, emphasizing reasonableness of faith, the right of individual conscience, private devotion, and active participation in the political life of the Republic. In Europe, by contract, the Jesuits were restored in 1814, as part of the Bourbon reaction against the French Revolution.
Many legal liens arise as a matter of law (by common law or by statute). It is possible, however, to create a legal lien by contract. The courts have confirmed that it is also possible to give the secured party a power of sale in such a contract, but case law on such a power is limited and it is difficult to know what limitations and duties would be imposed on the exercise of such a power.
D supports operator overloading, type forwarding, as well optional custom dynamic dispatch. Classes (and interfaces) in D can contain invariants which are automatically checked before and after entry to public methods. It is part of the design by contract methodology. Many aspects of classes (and structs) can be introspected automatically at compile time (a form of reflection using `type traits`) and at run time (RTII / `TypeInfo`), to facilitate generic code or automatic code generation (usually using compile- time techniques).
Public works and other services, such as land use and plat review, are operated by the Lafayette Consolidated Government to serve the City of Lafayette and unincorporated areas of Lafayette Parish, and by contract some of the area municipalities. Zoning rules apply only within the city. Some neighboring municipalities have adopted their own planning and zoning protocols. The suburban and rural cities and towns maintain independent city councils, local executives, police and fire departments, and other public services.
Contract zoning in the United States, also referred to as "zoning by contract", "rezoning by contract", or "rezoning subject to conditions" is a form of land use regulation in which a local zoning authority accommodates a private interest by rezoning a district or a parcel of land within that district to a zoning classification with fewer restrictions based on an agreement that the property owner abide by certain conditions or limitations imposed by the zoning authority for that parcel. Contract zoning is a contentious practice in that, by definition, it involves public servants or officials, namely an Urban planner, working outside of a locality’s general plan. Opponents of contract zoning are weary of the practice insofar as it might lead to “arbitrariness and random decision making” in land use planning and thus the overall design of a locality. Proponents of the practice argue that it is a useful tool for achieving dynamic development, especially in growing urban areas where there is an increasing emphasis on mixed-use and higher density development.
It was used as the post office, school, church, and was the county courthouse from 1854 to 1858. Elders' residence, occupied from 1848 until 1857, when the Utah War forced an exodus from the Mormon colony. On November 7, 1852, Colonel Henry Washington, deputy surveyor (by contract with the United States Surveyor General for California) surveyed the San Bernardino Base Line and Meridian from a point just west of Mount San Bernardino, at an elevation of , east of present-day Highland.
A stud manager or "stud master" is an individual responsible for an employer's breeding stock. The term is usually used for individuals working with dogs or horses. It is usually applied regardless of gender. The stud manager typically suggests desired matings to the owner, and arranges for the same, whether in-house or by contract with animals standing at stud, approves and arranges matings to the owner's animals at stud requested by outsiders, and keeps all records, including notifying the appropriate animal registries.
In a legal loan, each of these obligations and restrictions is enforced by contract, which can also place the borrower under additional restrictions known as loan covenants. Although this article focuses on monetary loans, in practice, any material object might be lent. Acting as a provider of loans is one of the main activities of financial institutions such as banks and credit card companies. For other institutions, issuing of debt contracts such as bonds is a typical source of funding.
The roll of St Matthew's Academy is drawn in the main from the ten cluster denominational primary schools located throughout North Ayrshire: St John Ogilvie's and St Mark's in Irvine; St Winning's and St Luke's in Kilwinning; St John's in Stevenston; St Anthony's in Saltcoats; St Peter's in Ardrossan; St Mary's in Largs; St Bridget's in Kilbirnie; and St Palladius’ in Dalry. Pupils from all areas other than Ardrossan, Saltcoats and Stevenston travel to St Matthew's Academy by contract bus.
With respect to a work (except a computer program work) which on the initiative of an employer is made by an employee in the course of the performance of his duties in connection with the employer's business and is made public by the employer as a work under its own name, such employer shall be treated as the author unless otherwise stipulated by contract, work regulations or the like at the time of creation of the work.Copyright Act art. 15, para. 1 (Japan).
The Arbitration Fairness Act of 2011 is a proposed law in the US Congress to reverse the effects of 14 Penn Plaza LLC v. Pyett556 U.S. 247 (2009) and AT&T; Mobility v. Concepcion.563 U.S. 333 (2011) Both judgments held, 5 judges to 4 dissenting justices, that employees and consumers were not entitled to claim for rights in public courts if they had agreed to arbitration in a collective or individual agreement. The result has been negation of statutory rights by contract.
By contract, the top two teams in the BCS Poll at the conclusion of the regular season were invited to the BCS national championship game. In 2000, the BCS Poll was a combination of four different systems: media and coaches' polls (Associated Press college football poll and USA Today Coaches' Poll), team records, a collection of eight different computer ranking systems, and a strength-of-schedule component based on opponent records.Fox Sports. "Bowl Championship Series chronology", The Bowl Championship Series.
In 1999, Scottish Hydro applied to add another 710 MWe of capacity at Keadby, and a variation to this consent was granted in November 2016. The project, called 'Keadby 2', was announced in May 2018. In March 2013 the power station was 'deep mothballed' in response to adverse market conditions; it reopened in December 2015 after winning a stand-by contract to provide 734 MWe of capacity. SSE also owns a 68 MWe capacity wind farm, Keadby Wind Farm, nearby.
He has learned that he may be liable for his wife's debts. The bishop, who is writing a book on the history of marriage, suggests that Edith and Cecil should revive the Roman concept of marriage by contract, but he thinks a traditional marriage is better. The Bishop's chaplain, a lawyer, tries to draw up a contract, though it proves a difficult task. All the characters have ideas about what should be in the contract, based on their own experience.
Bourke established the Colonial Architect's Department in 1832 to be responsible for the planning and supervision of the construction and repair of public buildings. In general, the Colonial Architect's Department had charge of public buildings and their furniture, the duty of preparing plans and specifications for construction and repair and superintending all works executed by contract. From 1833 to 1835 the Department briefly became the Architectural Branch of the Department of the Surveyor General before the Colonial Architect's Department was again separately established.
The book, often known as "OOSC", presents object technology as an answer to major issues of software engineering, with a special emphasis on addressing the software quality factors of correctness, robustness, extendibility and reusability. It starts with an examination of the issues of software quality, then introduces abstract data types as the theoretical basis for object technology and proceeds with the main object- oriented techniques: classes, objects, genericity, inheritance, Design by Contract, concurrency, and persistence. It includes extensive discussions of methodological issues.
The compiler, or author of the collection, owns copyright in the expression he or she contributed, which is primarily the selection and arrangement of the separate contributions, but may include such things as a preface, advertisements, etc., that the collective author created. The contributions remain the property of the authors by default, but the property may be passed to the owner of the collective work by contract. They may also obtain ownership of the contributions if they are works made for hire.
Between 2006 and 2007, Freelon's designs were honored with seven AIA North Carolina design awards in those two years. In 2008, The Freelon Group was recognized by Contract Magazine as The Designer of the Year. In 2009, along with partners J. Max Bond, Jr. (of Davis Brody Bond) and David Adjaye (of Adjaye Associates), Freelon was selected by unanimous decision to design the Smithsonian National Museum of African American History and Culture. The Museum has five floors above ground and four below.
As of 2020, the long wheelbase R-Class is still produced and exported to China with two engine choices (R 300 4MATIC Long and R 400 4MATIC Long), both equipped with 7-speed 7G-TRONIC automatic gearboxes and 4MATIC drivetrain. The R-Class enjoys steady popularity in China with annual sales between 12,000 and 14,000 units per year. Due to the still rather low production numbers, the R-Class is assembled by contract manufacturer AM General in Indiana since 2015 to the present.
This was due to the popularity of Ombre, the game that introduced the concept of bidding. The British and the Scandinavians are the most resistant against stripped decks, having maintained the 52-card format since receiving them in the 15th century. The British have also propagated that deck size through whist, the most popular card game of the 19th century. In the 20th century, this has been followed by contract bridge, gin rummy, canasta, and poker which all require that deck size.
The buildings are not inhabited although they have been used as temporary shelter from time to time by contract workers and have water and power connected. Although the dairy, stables, blacksmith's shop and buggy shed were still standing when recorded by the National Trust in 1979, they have since collapsed. The Awoonga Dam project at its highest projected levels will make an island of the site from time to time. This level of inundation is not planned for about 50 years.
In October his mother rented "a little house by the sea just beyond Dalkey Harbour. Beckett accompanied her, laden with his books, manuscripts and typewriter. But he never settled down there and questioned ‘how people have the nerve to live so near, on the sea. It moans in one’s dreams at night.’"Knowlson, J., Damned to Fame: The Life of Samuel Beckett (London: Bloomsbury, 1996), p 173 The beach there – "by contract with most Irish beaches – is notoriously composed of shingle and pebble".
All current Bank of England banknotes are printed by contract with De La Rue at Debden, Essex. They include the printed signature of the Chief Cashier of the Bank of England, Sarah John, for notes issued since mid-2018, and depict Elizabeth II in full view, facing left. On the left-hand side of the Series F £20 and £50 notes there is a hidden watermark, featuring the Queen facing right. The £5, £10 and £20 polymer notes do not contain a watermark.
Both are based on a set of principles, including design by contract, command–query separation, the uniform-access principle, the single-choice principle, the open–closed principle, and option–operand separation. Many concepts initially introduced by Eiffel later found their way into Java, C#, and other languages.Formal Specification Languages: Eiffel, Denotational Semantics, Vienna Development Method, Abstract Machine Notation, Petri Net, General Books, 2010 New language design ideas, particularly through the Ecma/ISO standardization process, continue to be incorporated into the Eiffel language.
Waller LJ, Rimer LJ and Aikens LJ reversed the High Court and allowed the unfair prejudice petition to proceed. In this particular case it was clear that Mr Shanahan had acted without the company's fully informed consent. The opportunity had come to Mr Shanahan in his capacity as a director of Allied Business Ltd, and so must in principle be accountable for any profit. Aas was distinguishable as a case of partnership, where the business relationship had been circumscribed by contract.
Barbara Liskov and Jeannette Wing described the principle succinctly in a 1994 paper as follows: > Subtype Requirement: Let be a property provable about objects of type . Then > should be true for objects of type where is a subtype of . In the same paper, Liskov and Wing detailed their notion of behavioral subtyping in an extension of Hoare logic, which bears a certain resemblance to Bertrand Meyer's design by contract in that it considers the interaction of subtyping with preconditions, postconditions and invariants.
The daughter of Angel Mazarelli, citizen of the city of Paris from Italy, and Marie-Catherine Mathée, she must defend in court in 1750 against accusations about her birth and manners. By contract from 1 June 1765, she married in Paris Charles-Louis-Auguste de Vieuville, Marquis de Saint-Chamond, Count of Vienne and Confolens, first Baron of Lyonnais who was a colonel-owner of an infantry regiment. They had a son also named Charles-Louis-Auguste, born June 6, 1766.
For code based testing there is support for both xUnit Testing (This involves MDA transformation of Classes to NUnit or Junit Classes with the ability to generate unit tests from the model and automatically record the results against the tested Classes). and Testpoint testing ( a model based code testing. It is parallel to test contracts defined in ‘Design by Contract’ and it runs using debug definitions. Both methods support the test definitions and test results being logged against related Classes in the model.
The group was subsequently signed to Ode Records, but their record was never released. Kent joined Blood Sweat & Tears in 1974 and toured with them until the end of that same year. However, he never recorded with the group as he was still bound by contract with Ode Records at the time. In 1977, Kent released his first solo album, World Class, on RCS Records, produced by Cy Frost at Abbey Road Studios in St. John's Wood, London, and Applewood Studios in Colorado.
The Sarpy County Sheriff's Department is responsible for enforcing the law within the unincorporated areas of the county. By contract, the department is also responsible for enforcing the law within the city limits of Gretna and Springfield. The cities of Bellevue, La Vista, and Papillion have their own City Police Departments which are primarily responsible for law enforcement within their respective city limits. The Sheriff's Department has secondary responsibility for law enforcement within these three cities, providing essentials such as backup support.
In an agency context, a principal may be obligated to indemnify their agent for liabilities incurred while carrying out responsibilities under the relationship. While the events giving rise to an indemnity may be specified by contract, the actions that must be taken to compensate the injured party are largely unpredictable, and the maximum compensation is often expressly limited. There is no unified law of indemnities: the law governing indemnities varies from country to country, because contract law itself varies from country to country.
The production car is 12mm narrower and 12mm lower than the Concept (pictured). The Jaguar I-Pace was designed by Ian Callum. The concept version of the car, described as a five-seater sports car, was unveiled by JLR at the 2016 Los Angeles Motor Show and shown on-road in London in March 2017. The I-Pace is built by contract manufacturer Magna Steyr in Graz, Austria, and the production version of the I-Pace was revealed in Graz on 1 March 2018.
The gold roll and the silver roll were racially coded payroll categories of workers employed by the U.S. builders of the Panama Canal. After the U.S. revival in 1904 of the abandoned French-led canal construction project, skilled workers and management staff were recruited almost exclusively from the United States. By contract, these U.S. employees were paid in gold-backed U.S. dollars. Unskilled labor was variously sourced, but the great majority of laborers were West Indians; their wages were paid in local silver-backed currency.
In California, a sheriff is an elected official and the chief law enforcement officer in any given county. The sheriff's department of each county polices unincorporated areas (areas of the county that do not lie within the jurisdiction of a police department of an incorporated municipality). As such, the sheriff and his or her deputies in rural areas and unincorporated municipalities are equivalent to police officers in the cities. The sheriff's department may also provide policing services to incorporated cities by contract (see contract city).
From 30 June 1868, the government discontinued the ferry's operation and the position of caretaker, leaving travellers to work the ferry themselves. The news was not well received, with newspaper letters complaining of the great inconvenience to the users of the shorter coastal route. As a result, the government reappointed a caretaker on 30 March 1869. In 1894 the ferry was finally abandoned in favour of a wooden bridge adjacent to old ferry jetties, which was built by contract at a cost of £1700.
California Casualty Group comprises California Casualty Indemnity Exchange (the “Exchange”), and its four wholly owned subsidiary insurance companies: California Casualty Insurance Company, California Casualty & Fire Insurance Company, California Casualty General Insurance Company of Oregon and California Casualty Compensation Insurance Company. The insurance business of the Exchange and its subsidiary insurance companies is managed, by contract, by California Casualty Management Company, a separate and independent company. The relationship between California Casualty Management Company and the Exchange has been in place since the founding of the Exchange in 1914.
Murder by Contract was directed by Irving Lerner from an original screenplay by Ben Simcoe. At some point, Ben Maddow, who had been nominated for an Academy Award for his screenplay for The Asphalt Jungle, did uncredited work on the script (Maddow also worked uncredited on several other notable films of the era, including Johnny Guitar and The Wild One). The film was shot in seven days in February 1958 in Los Angeles. Produced by Orbit Productions, it was distributed theatrically in December 1958 by Columbia Pictures.
Siaw then decided to go into business and borrowed £50 (£1500.00 in 2013 relative value) to start up as a cocoa broker. In four months he had made £600 (£18,000.00 in 2013 relative value) profit. In April 1950 he became a siding clerk at Kwahu Praso, transporting cocoa to Accra, Ghana's capital. He repaid the £200 security charge for the clerking employment with interest in six months and was bound for a further six months, by contract, but he decided to stay for only four.
For over 2 decades, the Mavetys supplied their grapes by contract to other commercial wineries. In 1991, the Mavetys had sufficiently refined their skills at viticulture and wine making so as to release their first wines under the Blue Mountain label. Shortly after the first release, The Mavetys' son Matt joined the family business. Matt earned a degree in agricultural economics from the University of British Columbia (his father's alma mater) and a post-graduate degree in viticulture studies at Lincoln University in New Zealand.
Despite this non-traditional schedule, Island High still follows the same standard school calendar set by the district. Students may also earn additional subject credits through completion of Contracts and Challenge Exams. A Contract is an additional project taken on by a student in addition to their regular class workload that is to be completed outside of class time, subject credits vary by contract. Challenge Exams are tests that are administered once every Hex and if passed, applies five credits in the exam's subject area.
Initially formed by Air Transport Command (ATC) in early 1943 at Homestead Army Air Base, Florida. Manned primarily by contract civilian pilots, the mission of squadron was ferrying aircraft along the South Atlantic Air Transport Route through the Caribbean to Brazil; then to Africa and then to combat airfields in Europe, Middle East, India or Australia. Redesignated as a training squadron in June 1943. Provided transition training in a wide variety of aircraft to experienced military and civilian pilots prior to them being assigned to ferrying duty.
As the > leading case on integration by contract, it has been the subject of > extensive commentary and controversy. The decision may raise as many > problems as it settles, but the rule of Standard Stations is one which must > be reckoned with in all vertical integration cases, and comprehension of > this rule is essential to evaluation of the impact of antitrust upon > integration.Friedrich Kessler and Richard H. Stern, Competition, Contract, > and Vertical Integration, 69 L.J. 1, 24 (1959). The case has been the subject of extensive scholarly commentary.
Classes taught by contract faculty were already suspended owing to their instructors being on strike. Lenton and the Board of Governor's move to take control of academic policy from the Senate received the unanimous censure of the Canadian Association of University Teachers (CAUT), an organization representing most all academic staff in Canada. According to CAUT, not only was this in contravention with past practice, but it was also in contravention of the York Act, the act of the Legislature of Ontario that created York University.
Ada is a structured, statically typed, imperative, and object-oriented high- level programming language, extended from Pascal and other languages. It has built-in language support for design by contract (DbC), extremely strong typing, explicit concurrency, tasks, synchronous message passing, protected objects, and non-determinism. Ada improves code safety and maintainability by using the compiler to find errors in favor of runtime errors. Ada is an international technical standard, jointly defined by the International Organization for Standardization (ISO), and the International Electrotechnical Commission (IEC).
Repudiated by the King, she was sent far away from Versailles: She was hastily married on 25 November 1755, by contract signed before Mr. Patu, notary in Paris, with Jacques Pelet de Beaufranchet, Seigneur d'Ayat (born 5 March 1728). The marriage was arranged by the inner circle of Madame de Pompadour. The Duke of Luynes and the Marquis de Valfons recorded that the Prince of Soubise and the Marquis de Lugeac received the task to find a husband for Marie-Louise O'Murphy and arrange her marriage.
Classes of workers who are exempt from the regulation include certain types of administrative, professional, and executive employees. To qualify as an administrative, professional, or executive employee and therefore not be entitled to overtime, three tests must be passed based on salary basis, duties, and salary level. There are many other classes of workers who may be exempt including outside salespeople, certain agricultural employees, certain live-in employees, and certain transportation employees. Employees can neither waive their FLSA protections nor abridge them by contract.
Jackie Opel Amphitheatre On September 24, 1979, the then Minister of Communications and Works, the Hon. Lindsay Bolden turned the sod at the Cheapside location to signal the start of construction of the GPO's new headquarters. At a cost of $16 million, the complex, which was designed by Barbadian architect Mervyn A. Awon initially, was awarded by contract to Sir Robert McAlpine Limited, a British company. However, that contract was terminated and a new one was awarded to a Guyanese company, A. Nabi and Sons Limited.
Styled as the Prince of Montauban from birth, at the death of his father in February 1766 he became the Prince of Rochefort, which was created a hereditary title in 1728. He married Marie Henriette Charlotte d'Orléans-Rothelin, daughter of Alexandre d'Orléans, Marquis of Rothelin and Marie-Catherine de Roncherolles. The couple were wed at the Église Saint-Sulpice by contract in Paris on 20 May 1762 and officially on 24 May. The marriage produced five children only one of which went on to have further issue.
The speed camera program began in 2005 and earned the city $600,000 in revenues, as nearly 7,000 tickets (at $85 each) were issued during that time period. In March 2006, the Jefferson County Court of Common Pleas ruled that the city ordinance of supporting the speed camera program was illegal and unconstitutional. The city refused to remove the cameras, however, because it stated it was "bound by contract to continue the services" of Traffipax, Inc., the US subsidiary of ROBOT Visual Systems, a German corporation.
Eiffel's most important contribution to software engineering is design by contract (DbC), in which assertions, preconditions, postconditions, and class invariants are employed to help ensure program correctness without sacrificing efficiency. Eiffel's design is based on object-oriented programming theory, with only minor influence of other paradigms or concern for support of legacy code. Eiffel formally supports abstract data types. Under Eiffel's design, a software text should be able to reproduce its design documentation from the text itself, using a formalized implementation of the "Abstract Data Type".
Large parts of today's old town of Constance are on the terminal moraine, and the north-south direction of the old town is due to the direction of the moraine. By contract, Stadelhofen, the southernmost town of the Constance area, was built on the former lake bed. In Kreuzlingen, the moraine extends along the Hauptstrasse ("Main Street"), roughly from the border to the intersection with Remisbergstrasse. Both the old and the new location of the monastery at Kreuzlingen are in the area of the moraine.
He was washing his car on a street in Bensonhurst when his close friend and fellow Ramper James Emma was gunned down by contract killers from the Colombo crime family sent on orders by Colombo crime family capo Dominick Scialo. The gunmen then turned their guns on Gerard. At that exact moment, a car was passing and Pappa dove in through an open window. The driver of the car was so overcome with fear that he did not notice Gerard in the backseat and sped off.
In December 1890 the Grubb mine was less than deep, but until end of June 1893 then a level has been put in and the lode cut at and from the surface at both these levels. At that time the north end of the level showed nearly of clean metal. The ore assays up to 127oz silver and 82% lead, and this lode has shown a significant improvement in quality as depth was gained. After consultation with the mine manager, a tunnel was extended by contract labour.
A transporter wagon system was opened here, too; wagon could be delivered to any point on the whole line. The Biel–Täuffelen–Ins line remained the only line of the Seeländische Lokalbahnen. The Seeländische Lokalbahnen was renamed the Biel-Täuffelen-Ins- Bahn (Biel-Täuffelen-Ins Railway, BTI) as of 1 September 1945. The cooperation between the Oberaargau-Jura railway (Oberaargau-Jura-Bahnen, OJB) and the Solothurn-Niederbipp Railway (Solothurn-Niederbipp-Bahn, SNB), which had existed for some time, was regulated by contract from 1960.
Warranties are breached when the promise is not performed at all, or not performed in accordance with the contract. The seller may honor the warranty by making a refund or a replacement. The statute of limitations depends on the jurisdiction and contractual agreements. In the United States, the Uniform Commercial Code § 2-725 provides for a four-year time limit, which can be limited to one year by contract, starting from the date of delivery or if future performance is guaranteed from the date of discovery.
The main entrance vestibule was ornamented in "richly coloured" Cudgegong marble, whilst the main entrance stair landings and mid landings were tiled with panels depicting Apollo, the Sun God. By contract, the rest of the interiors were considered to be quite plain. The newspaper took pride in the fact that "wherever possible" Australian materials, "in keeping with the national character of the paper" were used. One very unusual feature associated with the building was the two landscaped plots in front of the Elizabeth Street facade.
If a limited monopoly over the combustion stoker switch were > allowed, it would not be a monopoly accorded inventive genius by the patent > laws, but a monopoly born of a commercial desire to avoid the rigors of > competition fostered by the antitrust laws. The Court acknowledged that the 1909 decision in Leeds & Catlin v.
However, a Washington superior court judge ruled that Soloway was in default. Soloway pleaded guilty to three counts on 14 March 2008. He formerly operated a company based in Seattle, Washington which he is calling "Broadcast E-mail Service" that offers "mailing services" by contract as well as a software program which the site promises will allow the buyer to "email your Web site to 2,500,000 opt-in email addresses for free." E-mails advertising Soloway's company have been sent with forged headers (the headers purport to be "from" the person they were sent "to").
By contract on 12 March 1237, William was betrothed to Margaret of Guelders, daughter of Gerard III, Count of Guelders and Margaret of Brabant. Most sources accept Margaret as the mother of William's elder children but there is no evidence that this marriage was ever consummated. Further, William is known to have married Margaret's sister, Richardis of Guelders (c. 1215 – 1293/98), prior to January 1250 but there is no evidence of a papal dispensation which would have been required for William to marry the sister of his first wife.
Belief in a distinction between positive and negative rights is usually maintained, or emphasized, by libertarians, who believe that positive rights do not exist until they are created by contract. The United Nations Universal Declaration of Human Rights lists both positive and negative rights (but does not identify them as such). The constitutions of most liberal democracies guarantee negative rights, but not all include positive rights. Nevertheless, positive rights are often guaranteed by other laws, and the majority of liberal democracies provide their citizens with publicly funded education, health care, social security and unemployment benefits.
If rights are only negative then it simply means no one has a duty to enforce them, although individuals have a right to use any non-forcible means to gain the cooperation of others in protecting those rights. Therefore, he says "the distinction between negative and positive is quite robust." Libertarians hold that positive rights, which would include a right to be protected, do not exist until they are created by contract. However, those who hold this view do not mean that police, for example, are not obligated to protect the rights of citizens.
FINRA offers regulatory oversight over all securities firms that do business with the public, plus those offering professional training, testing, and licensing of registered persons, arbitration and mediation, market regulation by contract for the New York Stock Exchange, the NASDAQ Stock Market, Inc., the American Stock Exchange LLC, and the International Securities Exchange, LLC; and industry utilities, such as Trade Reporting Facilities and other over-the-counter operations. FINRA was formed by a consolidation of the member regulation, enforcement, and arbitration operations of the New York Stock Exchange, NYSE Regulation, Inc., and NASD.
Yordan's secretary claimed that she had written it. Confronted by Sperling, Yordan argued that she had taken down his words and been given a bonus for her work however he had admitted enough to warrant his dismissal from the project Sperling then hired a new writer. Yordan then did uncredited writing on Murder by Contract and The Lost Missile. After serving as a writer-producer for The Harder They Fall, Columbia studio head Sam Briskin hired Yordan, provided he keep an office on the lot and that his authorship of any scripts would be guaranteed.
The foray into the online realm culminated in the Lost Experience, an Internet-based alternate reality game produced by Channel 7 (Australia), ABC (America), and Channel Four (UK), which began in early May 2006. The game presents a five-phase parallel storyline, primarily involving the Hanso Foundation. Short mini- episodes ("mobisodes") called the Lost Video Diaries were originally scheduled for viewing by Verizon Wireless subscribers via its V-Cast system but were delayed by contract disputes. The mobisodes were renamed Lost: Missing Pieces and aired from November 7, 2007, to January 28, 2008.
Screenwriters write a screenplay – or script – that provides the words for media productions such as films, television series and video games. Screenwriters may start their careers by writing the screenplay speculatively; that is, they write a script with no advance payment, solicitation or contract. On the other hand, they may be employed or commissioned to adapt the work of a playwright or novelist or other writer. Self-employed writers who are paid by contract to write are known as freelancers and screenwriters often work under this type of arrangement.
On Gol was merged into VRG Linhas Aéreas and thus VRG Linhas Aéreas became an airline with two different brands: Varig and Gol. As a consequence, on mid-April 2009, Varig's booking systems were integrated into Gol's and the Smiles frequent flyer program was reformulated to include Gol. In June 2009, "new" Varig ceased to operate its own flights and started to use Gol's flight numbers. From 2006 to 2009 "new" Varig was obliged by contract to purchase a minimum of 140 hours/month of services from "old" Varig.
It should normally be delivered in advance to the appropriate supervisor or superior, and contain such information as the intended last day at work. A period of notice may be required expressly by contract, impliedly by the pay interval, or otherwise. Nevertheless, in practice, some resignations can be effective immediately. For courtesy's sake, a letter of resignation may thank the employer for the pleasure of working under them and the opportunities and experience gained thereby, and also offer to assist with the transition by, for example, training the replacement.
University of Rhode Island sports are televised regionally on the Ocean State Network, a joint venture of Cox Communications and WJAR. OSN provides television and streaming coverage of all regular season men's basketball games not broadcast on a national carrier, and select football, baseball, soccer and women's basketball games. Select men's basketball games are also covered by ESPN, and A-10 tournament games are televised by contract with ESPN, CBS and NBC. The University's ACHA men's ice hockey and women's basketball home games have live streaming video available on their respective websites.
After the bankruptcy, the ship Res Cogitans had consumed unpaid fuel, and no money had traded hands. Both OWB's assignee, and the subcontractor which had physically delivered the bunker were pressing the ship's owners for payment. To whom, if anyone, was payment due? Payment was due to OWB by contract, but the subcontractor claimed that the supply of bunker was not a sale of goods, the bunkers were still their property, and they were entitled to be paid by the ship if OWB was not able to pay on the ship's behalf.
In 2008, contract workers at the El Salvador and four other Codelco mines went on strike, suspending production on 16 April. They demanded that Codelco fulfil agreements reached the year before regarding increases in pay and improvement of working conditions. Protests by contract workers blocked access to the mine and severe damage to the mine resulted, due to loads borne on columns not designed to support weight for extended periods of time. This resulted in unstable conditions within the mine (as reported by an external consulting firm hired by Codelco).
Replays would show that there was no illegal contact – a point that Stabler himself would all but concede in interviews years later. The call would ultimately prove fatal to the Patriots, as Stabler would score on a short touchdown run with less than a minute left, and the Raiders held on for a 24–21 win. Partially because of the controversy, the league never assigned Dreith to officiate Patriots games again. The 1977 season was a disappointing one for the Patriots, aided by contract holdouts by offensive linemen John Hannah and Leon Gray.
Pierre II de Villiers was Chamberlain of King Charles VI of France, when, on 21 May 1383, he married, by contract, Jeanne de Châtillon, daughter of Charles and Jeanne de Coucy. As the King's Chamberlain, he negotiated with the Parisians on behalf of the Duke of Anjou. In 1390, a suit was brought against him by his half-brother, also called Pierre, Archdeacon of Sologne, concerning the estate of their father. On 20 August 1390 Pierre II was ordered to pay his half-brother six hundred pounds in land and an increased dowry.
Tayune is brutally powerful in combat, possibly second only to Nadeshiko when the latter is fully empowered among Kaoru's inukami. ; :A gray-haired Inukami who near-constantly wears a white lab coat and may be the oldest of Kaoru's Inukami. Gokyōya is studying seriously to become a doctor at some point and is close friends with two other of Kaoru's Inukami, Furano and Tensō. Before she became Kaoru's inukami, she was linked by contract to Keita's father, Sōta; she still has warm feelings for him, which she has in part transferred to Keita.
The dam provides electricity to Ghana and its neighboring West African countries, including Togo and Benin. Initially 20% of Akosombo Dam's electric output (serving 70% of national demand) was provided to Ghanaians in the form of electricity, the remaining 80% was generated for the American-owned Volta Aluminum Company (VALCO). The Ghana Government was compelled, by contract, to pay for over 50% of the cost of Akosombo's construction, but the country was allowed only 20% of the power generated. Some commentators are concerned that this is an example of neocolonialism.
FieldCraft operations are divided into production (of items licensed directly to the public) and services (contracts undertaken and fulfilled for other corporations). Research and software development come under production, with several products on the market. Geological services are strictly undertaken as services by contract to other corporations. Generally, web development and project management are undertaken as internal services for the purpose of supporting production operations, however, they can also be offered as services to other companies subject to a lack of conflicting interests arising from the respective project objectives.
He was also the one who lured World End into meeting Tsubaki, causing the Servamp of Gluttony to lose his power. This reveals that the Jinn that comes out during Lawless and Licht's rescue operation, is in fact, World End's, meaning that Hugh never lose his power. ; : :Lawless is the Servamp of Greed and the fifth youngest Servamp, bound by contract to Licht Jekylland Todoroki. His contract name is , which coincides with Licht's middle name "Jekylland", referencing the story of Jekyll and Hyde and symbolizing their antagonistic relationship.
In 2008 Best signed to play in the Indian Cricket League because he had not played international cricket since 2006. He returned to the side when the West Indies fielded a side weakened by contract disputes between leading players and the West Indies Cricket Board but was dropped shortly after. On his return to the Test side on 10 June 2012, he broke the record for highest score by a number 11 batsman, making 95 against England at Edgbaston. But,later in 2013 his record was surpassed by Ashton Agar who scored 98.
Due to John's and Shaun's involvement in their previous band, they were bound by contract to release an album under Victory Records. They began to record their first album in April 2004 and released their self-titled debut album Straylight Run on October 12, 2004 after a one-month postponement. The album sold over 11,000 copies in the first week, and made the Billboard Top 100 Albums list. The album featured Nate Ruess, former lead singer of The Format and current frontman of the indie-pop group fun.
15 By contract between SAF and FMV, FMV T&E; use the base as part of the Vidsel Test Range. SAF is responsible for keeping Vidsel Air Base in operational status and that the airport related activities are carried out in accordance with Swedish military regulations. The airfield is located in the south-east corner of Vidsel Test Range, which is a missile test range consisting of 7,200 km² restricted airspace and 3,300 km² restricted ground space. There is operational support staff at Vidsel Air Base supporting airfield ops at all times.
The Vancouver Fire Department provides fire protection and emergency medical services to the city of Vancouver and, by contract, Clark County Fire District 5, in Washington. The department's response area is with a population of over 270,000 (2019). The Vancouver Fire Department is chronically understaffed and underfunded- it has the dubious distinction of the highest call volume per firefighter in the state. ALS (Advanced Life Support, or paramedic staffed) transport is provided by AMR, making Vancouver Fire's service area population by far the largest in Western Washington without public ALS ambulance service.
Only a conveyance, as a separate legal act, can effect the transfer of the property agreed to by contract between the parties. Scotland has an abstract property legal system, meaning the conveyance does rely on the cause of the transfer. In Scots law _the recognised causa for transfer of property are loan for consumption (deriving from the Roman mutuum), gift, barter (an exchange is termed a Contract of Excambion),sale, ex facie absolute transfer in security and transfer in trust, expressly or otherwise._ Stair Memorial Encyclopaedia, Vol 18, Property, Ch 13, para 609.
SCOOP processors are independent of underlying concurrency mechanisms like processor threads, multiple processor cores, and distributed computer systems. In addition to the concept of separateness, SCOOP exploits the principles of design by contract as part of the SCOOP strategy for synchronizing access to shared separate resources. For example, a precondition for a consumer wishing to access an item in the inventory example above, might be that such an item does currently exist. This would be expressed with a contract on the feature of class `INVENTORY` which returns the item.
The rules governing the exchange are dictated by contract law where each party is highly incentivized to act in their best interest, with the nature of the relationship being adaptable, suggesting that the terms of the contract can be changed or renegotiated at minimal costs. Well known MGMs include fair trade certification, the European Union Emission Trading System and Payment for Ecosystem Services (PES). MGMs, meanwhile, are not to be confused with market-based instruments. MGMs, as a group, includes command and control regulations as well as regulatory economics.
After the United Kingdom prohibited slavery by the mid 19th century, it introduced a new indentured labor system that scholars suggest was slavery by contract. According to Richard Sheridan, quoting Dookhan, "[the plantation owners] continued to apply or sanction the means of coercion common to slavery, and in this regard the Indians fared no better than the ex-slaves". In this new system, they were called indentured labourers. South Asians began to replace Africans previously brought as slaves, under this indentured labour scheme to serve on plantations and mining operations across the British empire.
In 1902, it detached all land but its present area, and the area that separated became Grandview Heights in 1906. The village was named "Arlington" for a short time, which led its new neighbor to the north, incorporated in 1918, to name itself Upper Arlington. Marble Cliff is bordered by the cities of Upper Arlington, Grandview Heights, and Columbus. Most of the village's public services are provided by contract with Grandview Heights, including police and fire, and it is included in the Grandview Heights School District and public library system.
Research chemicals are fundamental in the development of novel pharmacotherapies. Common medical laboratory uses include in vivo and animal testing to determine therapeutic value, toxicology testing by contract research organizations to determine drug safety, and analysis by drug test and forensic toxicology labs for the purposes of evaluating human exposure. Many pharmacologically active chemicals are sold online under the guise of "research chemicals," when in reality they are untested designer drugs that are being consumed by buyers taking advantage of many of the compounds' transitional or nonexistent legal status.
ADTs are a theoretical concept, in computer science, used in the design and analysis of algorithms, data structures, and software systems, and do not correspond to specific features of computer languages—mainstream computer languages do not directly support formally specified ADTs. However, various language features correspond to certain aspects of ADTs, and are easily confused with ADTs proper; these include abstract types, opaque data types, protocols, and design by contract. ADTs were first proposed by Barbara Liskov and Stephen N. Zilles in 1974, as part of the development of the CLU language.
The Orange Bowl is one of five Bowl Championship Series (BCS) bowl games that have been played at the conclusion of every college football season since 2006.Between 1998 and 2006, there were four BCS games. As defined by contract, the bowl matches the champion of the Atlantic Coast Conference (ACC) against an at-large pick chosen by a special committee. On December 6, 2008, the Virginia Tech Hokies defeated the Boston College Eagles in the 2008 ACC Championship Game, thus winning an automatic bid to the 2009 Orange Bowl Game.
The Mishnah taught that a Hebrew manservant (described in ) was acquired by money or by contract, and could acquire his freedom by years of service, by the Jubilee year, or by deduction from the purchase price. The Mishnah taught that a Hebrew maidservant was more privileged in that she could acquire her freedom by signs of puberty. The servant whose ear was bored (as directed in ) is acquired by boring his ear, and acquired his freedom by the Jubilee year or the master's death.Mishnah Kiddushin 1:2, in, e.g.
The Civil Code of Germany regulates registered non-profit, and for- profit associations regarded as juridical persons (') in sections 2179 and any other associations by contract (' in sections 705740. The Verein is the basic type of a juridical person while the Gesellschaft is dogmatically more a partnership. Due to this theoretical distinction, the concept of Verein is also the legal basis for particular economic entities (') such as GmbH and Aktiengesellschaft, which are also endowed with juridical personhood. These are regulated in separate statutes as special economic associations but bear the same basic features.
Netherlands Institute for War Documentation, Collection: 1997.A.0117, Reel or Fiche Number: 347, Admin Number: Collection 250F, C(62)312.1 1, . After the re- opening in 1943, 70 Jews from Kamp Vught and 600 Jews from Kamp Westerbork of British, American and Hungarian nationality were briefly sent to Kamp Amersfoort. They were joined by contract breakers of the German Arbeitseinsatz (forced labour program), deserting Waffen SS soldiers, deserting German truck drivers of the Nationalsozialistische Kraftfahr-Korps, and lawbreaking members of the NSB (the Dutch National Socialist Movement).
These oracles are typically associated with formalised approaches to software modelling and software code construction. They are connected to formal specification, model- based design which may be used to generate test oracles, state transition specification for which oracles can be derived to aid model-based testing and protocol conformance testing, and design by contract for which the equivalent test oracle is an assertion. Specified Test Oracles have a number of challenges. Formal specification relies on abstraction, which in turn may naturally have an element of imprecision as all models cannot capture all behaviour.
Towers for fourth order, fixed (non-flashing) lights on Woody Island were completed by contract in 1866 and the lanterns were placed and fixed by the pilot's boat crew in 1867. Bringing the lenses and holophotes down from Maryborough and getting them up into the lanterns and finally adjusting them, took around ten days. A call for tenders for the construction of lighthouses and a lightkeeper's cottage on Woody Island was advertised in the Maryborough Chronicle on 26 May 1866. Plans and specifications for the buildings were available in the Harbor Office in Maryborough.
Most provinces in Canada regulate the use of handcuffs and weapons (such as firearms and batons) by contract security companies and their employees, either banning such use completely or permitting it only under certain circumstances. Additionally, in some provinces, some terms, or variations of them, are prohibited either on a uniform or in self-reference. Canada's federal laws also restrict the ability of security officers to be armed. For example, section 17 of the Firearms Act makes it an offense for any person, including a security officer, to possess prohibited or restricted firearms (i.e.
After The X-Files was cancelled in 2002, Chris Carter and his crew started working with a goal of releasing a second X-Files film. In 2003, Carter called Snow, who by that time lived in London, UK and said he wanted him to return for another film. Snow was positive to the idea, but filming got bogged down by contract issues between Fox and Carter. Once the contract issues were sorted out, Carter re-contacted Snow about the development and later on sent him the script for the film.
Columbia County Rider (CC Rider), a service of the Columbia County Transit Division, provides six intercity bus lines and one "flex route" serving various points of downtown St. Helens and downtown Scappoose. As of 2016, CC Rider buses are operated by contract drivers supplied by MTR Western, a charter motor coach operator. The transit agency is largely funded by grants from the Oregon Department of Transportation and the federal government. Attempts at making CC Rider a separate transit district and to introduce new taxes to fund it have repeatedly failed since 2015.
The EVR was not yet fully open, and thoughts now turned urgently to the working arrangements for their line. On 15 June 1860, an agreement was concluded with the joint operating committee of the South Wales Railway and the Great Western RailwayThe GWR was working the South Wales Railway by contract. as to the working of the Mwyndy branch by the GWR, and a corresponding agreement for the Ely Valley main line was finalised soon after. The effective date of these agreements was to be 1 August 1860.
The law of costs is often known as the English rule. The situation contrasts with that in the U.S. where legal fees may be sought only if the parties agree by contract before the litigation, or if some special act or statute allows the successful party to seek such fees, the American rule. Federal district court and Court of Appeals judges award costs to the prevailing party under Federal Rules of Civil Procedure.FRCP 54(d) Generally, state court judges have no common law right to award such fees against the losing party.
Smallholders work on the plasma farm usually organized in farmers' cooperatives and by contract have to sell to the larger company for a price set by the government. The motivation for this kind of organizational and contractual arrangement is mainly that the initial investments to establish a plantation is considerable. Clearing land, building roads, and planting trees on sizeable areas requires not only elevated economic power but also technological skills. This part, therefore, is in the company's responsibility while the costs are later deducted from the payments made to the farmers.
Halifax Community College was chartered on September 7, 1967, as Halifax County Technical Institute, part of the North Carolina Community College System. It began operations in February 1968 under Phillip W. Taylor, and from June 1968 to April 1977 was located at the old Colonial Manor Hotel property on Highway 301. The current 109-acre campus, centrally located on Highway 158 in Weldon, was purchased in 1972, built in 1975, 1976 and 1977, and dedicated on May 22, 1977. In 1971, a general education program was added, by contract with East Carolina University.
Unbeknownst to the parties, the sodium nitrite preservative used in the Norwegian herring meal produced a substance, dimethylnitrosamine (DMNA), toxic to many animals, highly so to mink. None of the parties were aware that DMNA (the potential dangers of which were known, although lethal dosages were not) was present in the meal. When Ashington Piggeries withheld payment for the feed, Christopher Hill sued, and Ashington Piggeries counterclaimed for damages which they claimed were caused by violation of contract. According to them, Christopher Hill had supplied an ingredient not sanctioned by contract: herring meal plus DMNA.
Sandford had been popular and widely respected in Lithgow as a relatively benevolent employer, who had the interests of his workers at heart. In 1893, when orders at Lithgow were slack, he obtained work for some of his employees at the Onehunga Ironworks in New Zealand. He provided cheap land for his workers and assistance to build their houses, including providing house designs and guaranteeing their bank loans. He had engaged his workers by contract with an element of profit sharing; an arrangement which he advocated and in which he took some personal pride.
Phase two would burn liquefied natural gas (LNG). The LNG infrastructure associated with the LNG Terminal at Dabhol was going to cost around $1 billion. In 1996 when India's Congress Party was no longer in power, the Indian government assessed the project as being excessively expensive and refused to pay for the plant and stopped construction. The Maharashtra State Electricity Board (MSEB), the local state run utility, was required by contract to continue to pay Enron plant maintenance charges, even if no power was purchased from the plant.
On 27 June 2013, during the public debate on the Protection of Life During Pregnancy Act 2013, a Youth Defence billboard truck parked outside the Dublin Rape Crisis Centre with the anti-abortion slogan of "The abortion bill won't make women safer, it will just kill babies". A photo of the truck was posted to the Broadsheet.ie website. AdMobile, the billboard company, said that the driver was taking a photograph of the truck as required by contract and was unaware of the proximity of the Rape Crisis Centre.
D gained some features before C++, such as closures, anonymous functions, compile-time function execution, ranges, built-in container iteration concepts and type inference. D adds to the functionality of C++ by also implementing design by contract, unit testing, true modules, garbage collection, first class arrays, associative arrays, dynamic arrays, array slicing, nested functions, lazy evaluation, scoped (deferred) code execution, and a re-engineered template syntax. D retains C++'s ability to perform low- level programming and to add inline assembler. C++ multiple inheritance was replaced by Java-style single inheritance with interfaces and mixins.
The secret sign by which members of the conspiracy recognise each other is to eat a sausage roll - a food of which they are by now all heartily sick. It is clear that Ernest will win the election which is to follow the coup and become Grand Duke, which troubles Julia Jellicoe, a famous English comedian. As leading lady of the company, she is bound by contract to play the leading female role in any production. If Ernest, the manager, becomes the Grand Duke, she reasons that she will have to be the Grand Duchess.
Gavin Dalzell, 2nd Earl of Carnwath (1627−1674), styled by the courtesy title Lord Dalzell from 1639, was a Scottish nobleman and Royalist supporter during the English Civil War. He was the son of Robert Dalzell, 1st Earl of Carnwath and Christian Douglas. He married, firstly, Margaret Carnegie, daughter of David Carnegie, Lord Carnegie and Lady Margaret Hamilton, circa 21 July 1637, with whom he had seven children. He married secondly by contract, Lady Mary Erskine, daughter of Alexander Erskine, Earl of Kellie and Lady Anne Seton, on 14 December 1663.
In 2009, the district reported employing over 300 teachers with a starting salary of $39,000 to $124,430 for a 189-day work year. The average teacher salary is $53,412. By contract the teachers work a 6-hour-50-minute day. Additionally, the teachers receive a defined benefit lifetime pension, health insurance (employee pays 10% of the monthly premium), vision insurance, dental insurance, college course reimbursement, 3 paid personal days, 10-12 paid sick days, sabbatical leave, a lump-sum retirement bonus payment for unused sick days of up to $7500, and other benefits.
It was not uncommon for a courtesan to enter into an arranged long-term liaison by contract with a wealthy benefactor. These contracts were written up by and witnessed by lawyers, and were binding. Most included some provision for the financial welfare of the courtesan beyond the end of the relationship in the form of an annuity. Many such women became so powerful socially and financially that they could be particular about the men they associated with; in other words they chose their paramour as would any other mistress, not the other way around.

In some software design approaches, postconditions, along with preconditions and class invariants, are components of the software construction method design by contract. The postcondition for any routine is a declaration of the properties which are guaranteed upon completion of the routine's execution.Meyer, Bertrand, Object-Oriented Software Construction, second edition, Prentice Hall, 1997, p. 342. As it relates to the routine's contract, the postcondition offers assurance to potential callers that in cases in which the routine is called in a state in which its precondition holds, the properties declared by the postcondition are assured.
The Philomel-class gunvessels were an enlargement of the earlier Algerine-class gunboat of 1856. The first six of the class were ordered by the Admiralty from the naval dockyards between April 1857 and April 1859. Another twelve were ordered on 14 June 1859 to be constructed by contract in private yards, receiving their names on 24 September the same year; these were then fitted out at naval dockyards. The last eight of the class, of which Newport was the first, were ordered on 5 March 1860 for construction in naval dockyards, although six of them were later cancelled.
He gradually becomes disillusioned with his lifestyle and job, and he begins to suspect that he is being set up himself. One day, D. D., who had previously always treated him coldly, has sex with him. When Ben wakes up the next day, he is attacked by contract killers; Ben kills them and then breaks into CIA headquarters. He discovers that Project Fire is not a new experimental project, but rather something that has been going on for years; each such Project Fire agent is killed once the agent's superiors decide he has become a liability.
Parliament on the other hand, particularly the Commons, first of all saw the relationship as a partnership. Parliament believed the king ruled by contract (an unwritten one, yet fully binding). Parliament believed that its own rights to exist and to function in the ongoing work of the government of the country were as sacrosanct as those of the King and, in that sense, Parliament's rights were equal to those of the King. Furthermore, Parliament believed that in return for grants of subsidies to the Crown, the king should take its views on policy formulation and execution into account.
If one of them refused to work, he or she was put in prison on the spot. Finally, the wages were extremely low. The work was done by contract, but since every "mozo" starts with a large debt, the usual advance on engagement, they became servants to the owner. ## Independent tillers: living in the most remote provinces, survived by growing crops of maize, wheat or beans, sufficient to meet their own needs and leave a small margin for disposal in the market places of the towns and often carried their goods on their back for up to twenty five miles a day.
Born in 1942 in Normandy, the daughter of a doctor and the granddaughter of primary school teachers, she was awarded a degree in law in 1962 at the age of 20, the diploma of the Sciences Po in 1964 and a doctorate in public law in 1969. She was a lawyer and a member of the bar of the department of Hauts-de-Seine. Republished four times and widely distributed, her doctoral thesis on relations between the State and private teaching establishments linked by contract to the public sector has become the standard reference work in that area.
Glyn Colliery was the only significant development in the valley, and even its aspirations for expansion were in vain. In 1892 the management of the Glyn Colliery on the Treferig branch approached the TVR, asking for a workmen's train service to be run by contract. This was operated from April 1892, without obtaining the sanction of the Board of Trade for passenger operation. The trains ran to and from Treferig Junction; there was no platform and the miners walked to and from Llantrisant, a mile away, though later the trains were extended to run from Common Road bridge.
The NLRB applies a similarly strict standard in reviewing unions' enforcement of exclusive hiring halls, i.e., those in which the employer is bound, by contract, to hire only employees referred to it by the union. The NLRB requires unions to establish clear procedures and to follow those procedures in order to minimize the likelihood that the union would use a hiring hall procedure to exclude non-members or those out of favour with the union from the workplace. On the other hand, the NLRB applies the more deferential standard applied to union decisions generally in the case of non-exclusive hiring halls, i.e.
It was 816-576-7104, but the 576-7xxx system worked in the 913 area code too, covering both Missouri and Kansas-based stations in the Kansas City metro area. Previously, the only way many FM radio station owners could make a profit was to lease ten percent of the signal out for a subsidiary communications authority (SCA) channel. Muzak was a huge customer, using FM stations to broadcast "elevator music" to banks, restaurants and stores. Mark Wodlinger recognized the value of this service, and brought AgReports to Kansas City, using the 103.3 subcarrier of KPRS by contract.
From 1971 on, it was part of the French national education system and was secular. It was organized as an “établissement privé sous contrat d'association” (a private school associated by contract with the state), a category of French schools that are privately managed, but bound to the national system by contracts which provide basic funding and teacher's salaries, and require adherence to national curricula and other standards. On February 9, 2014, President Andre Gast announced that the College would be closing its doors at the end of the school year, faced with mounting financial difficulties and declining enrollment.
He was prohibited by contract from recording the roles he had played with D'Oyly Carte, and so in this collection he sang Ko-Ko in The Mikado, the Sergeant of Police in Pirates, Private Willis in Iolanthe, Don Alhambra in The Gondoliers, and Reginald Bunthorne and Major Murgatroyd in Patience. In the 1970s, Adams also recorded roles with Gilbert and Sullivan for All. These were complete recordings of Trial by Jury and Cox and Box, and excerpts (as much as would fit on two sides of an LP record) of seven others. He also made two recordings of lesser-known Sullivan music.

Guillaume IV de Melun was the son of Jean II (Viscount) de Melun and Jeanne Crespin, married by contract signed on 4 September 1389 and celebrated on 21 January 1390 to Jeanne de Parthenay Larchevêque, who gave him a child named Marguerite de Melun, Viscountess of Tancarville. In 1393 he was sent to England to establish a peace treaty until the recovery of King Charles VI's health. In 1396 he went to Italy to take possession of the Republic of Genoa, which had been given to the king. He went to Florence and Cyprus to enter into treaties of alliance.
William Knox D'Arcy A BP Motor Spirit advertisement from 1922 In May 1908, a group of British geologists discovered a large amount of oil at Masjed Soleyman located in the Khuzestan Province in southwest of nowadays Iran. It was the first commercially significant find of oil in the Middle East. William Knox D'Arcy, by contract with Ali-Qoli Khan Bakhtiari, obtained permission to explore for oil for the first time in the Middle East, an event which changed the history of the entire region. The oil discovery led to petrochemical industry development and also the establishment of industries that strongly depended on oil.
Nagata reluctantly accepts the challenge. Meanwhile, Tiger Mask is struggling as his recent actions have eroded his trust with the NJPW, leaving him alone and still bound to the GWM by contract, despite his assault against The Third. As a result, he is forced by Miss X to fight Miracle 4 in another match. Miracle 4 reveals himself to be Universal Mask, an expert in aerial combat while the two fight in a special ring elevated from the floor level and with pipes, giving Universal Mask a one-sided advantage, which is meant to punish Tiger Mask for his betrayal.
The specialty engineer is responsible to design only those elements which the manufacturer is commercially obligated to supply (e.g. by contract) and to communicate the assembly procedures, design assumptions and responses, to the extent that the design relies on or affects work by others, to the Engineer of Record – usually described in the manufacturer's erection drawings and assembly manuals. The manufacturer produces an engineered product but does not typically provide engineering services to the project. In the context described, the Architect and Engineer of Record are the designers of the building and bear ultimate responsibility for the performance of the completed work.
The bodies of the victims were transported to four hospitals in Cairo. Chinese consular officials in the Arab Republic of Egypt and Hong Kong Immigration Department officers were scheduled to travel with the family members of the Hong Kong victims to Cairo. Kuoni Travel, the Hong Kong travel agency that organized the tour attended by the Hong Kong passengers, made plans for the six tour members who did not take the balloon ride to leave Egypt. The tour agency stated that, in addition to the US$7000 per person stipulated by contract, additional compensation would be given.
In 2001 it was named #1 of The Top 10 Commercial Interiors products of the Past 50 Years by Contract Design Magazine. The chair has been in continuous production since its introduction and has sold over 8 million units. General Fireproofing held the license for the chair from 1963 until 2002 when the company was taken over by OSI Furniture LLC. In 2013, Howe Europe, (now Howe a/s), of Denmark, which had had a sublicense to the chair in Europe, Africa, Australia, New Zealand and Asia (except for Indonesia) acquired the license for the 40/4 in the United States and Canada.
The data is primarily for NATO and the armies of the U.S. and Germany, but it is shared with the AMA as well. As of 2016 weather balloon launches are done by contract and NATO meteorologists working together at the Hamid Karzi International Airport on the NATO side of the complex. NATO has a Combined Meteorological Unit that is staffed by a Romanian Officer in Charge, Czech Republic military, and U.S. and Turkish contractors. The mission is to provide full services while the Afghans are trained to take over operations, which is in keeping with the NATO Resolute Support mission.
The consignor retains ownership of the goods until the bill of lading is transferred to the consignee. Most bills of lading today are governed by international conventions such as the Hague Rules (International Convention for the Unification of Certain Rules of Law Relating to Bills of Lading); Hague-Visby Rules, which is a revised version of the Hague Rules by a Brussels Protocol in 1968; and Hamburg Rules. These rules impose minimum responsibilities and liabilities that cannot be softened by contract. On the other hand, the United States and the United Kingdom adopted the Carriage of Goods by Sea Act (COGSA).
In February 1942, after the United States' entry into World War II, the United States Army Air Corps 1454th Base Unit was assigned to Wold-Chamberlain Field to conduct a survey about the usefulness of the airport to the war effort. The unit's mission was to organize, coordinate and supervise the movement of cargo and passengers travelling though the airport by contract airlines and to and from Ferrying Command. Northwest Airlines remained in control of the control tower and flight facilities. Other construction was initiated to expand flight facilities, base operations, passenger service facilities, customs and port of entry facilities.
Following a chance discovery in 1963, reserve U.S. Air Force major William O'Dwyer was asked to research into Whitehead. He became convinced that Whitehead did fly and contributed research material to a second book by Stella Randolph, The Story of Gustave Whitehead, Before the Wrights Flew, published in 1966. O'Dwyer and Randolph co-authored another book, History by Contract, published in 1978. The book criticised the Smithsonian Institution for its contracted obligation to credit only the 1903 Wright Flyer for the first powered controlled flight, claiming that it created a conflict of interest and had been kept secret.

That is, if a case originates in a federal court, there is no ability for a defendant to remove a case from federal court into state court. If the federal court lacks jurisdiction, the case is dismissed. Only cases that originate in a state court and are improperly removed to a federal court may be sent back to the state court where they started. A defendant can waive the right to remove by contract, although courts take different positions about what language is necessary to create a waiver.Coale, Visosky & Cochrane, Contractual Waiver of the Right to Remove to Federal Court,” 29 Rev. The Fiesta Bowl was one of five Bowl Championship Series (BCS) bowl games that plays at the conclusion of the college football season. As defined by contract, the bowl matches up the champion of the Big 12 Conference against an at-large pick. On December 4, 2010, the Oklahoma Sooners defeated the Nebraska Cornhuskers 23-20 in the 2010 Big 12 Championship Game to earn the automatic bid to the 2011 Fiesta Bowl. The at-large spot in the Fiesta Bowl was filled via a round-robin selection procedure defined by the other Bowl Championship series games and the automatic bids.
The historic named "Carpenter Arms" started to be used after a forfeit of title by Baron Carpenter in 1719. When the Carpenter Arms were re-patented, this caused a legal conflict with the Alehouse pubs called "Carpenter Arms." The English courts determined in a series of rulings from 1725 to 1734 that the business use in England of Carpenters Arms and similar Arms could continue, provided they did not display the full arms issued by patent such as the supporters, motto and crest. In addition, they could not claim patronage in any way to the Arms unless given by contract.
Such EULAs are, in essence, efforts to gain control, by contract, over matters upon which copyright law precludes control. This kind of EULAs concurs in aim with DRM and both may be used as alternate methods for widening control over software. In disputes of this nature in the United States, cases are often appealed and different circuit courts of appeal sometimes disagree about these clauses. This provides an opportunity for the U.S. Supreme Court to intervene, which it has usually done in a scope-limited and cautious manner, providing little in the way of precedent or settled law.

Though their singles were only moderately successful, their albums consistently scored high in the charts. Davies's relationship with Hodgson was changing and the two began writing most of their songs separately again, though they agreed to have them all credited to Davies/Hodgson by contract. Among the songs credited to both but actually written solely by Davies are the hits "Bloody Well Right" and "Goodbye Stranger". The group had relocated to the United States by 1977 and it was there that they recorded their best-selling album, Breakfast in America from April 1978 to February 1979.
The following month, the company was further criticized for having purchased a stake in the beer rating website RateBeer, leading to concerns that the purchase was a conflict of interest. In July 2017, the company terminated its contract with "Casa Mia" pizzeria in Munich after the politician Ernst Dill vainly tried to persuade the owner to ban Pegida supporters amongst his guests. The year before Anheuser-Busch InBev already bound the owner of "Casa Mia" by contract to interpose at any sign of political activities. A company spokesperson said that the contract termination was not politically motivated.
Daily and Sunday newspapers owned by APN News & Media, Fairfax New Zealand, Allied Press, Ashburton Guardian, The Gisborne Herald, The Wairoa Star Ltd, Whakatane Beacon and the Westport News were members of NZPA. Until January 2006, member newspapers were obliged by contract to supply their home town news copy to NZPA. Sub-editing was done at NZPA's Wellington headquarters and the copy then redistributed to all members. NZPA's own journalists also contributed to the national news wire, which by 2005 consisted of approximately 50 per cent each of copy contributed by the member newspapers and the other half by NZPA's own staff.
The legislature of the State of Michigan enacted Public Act 425 of 1984 which is also known by the title Intergovernmental Conditional Transfer Of Property By Contract Act. It became effective March 29, 1985, and was subsequently amended in 1998. It is often simply referred to as “Act 425” and contractual agreements entered into pursuant to this statute are frequently called “425 Agreements.” The purpose of Act 425 is to provide for a means for two local units of government to share tax revenues resulting from new or expanding development in the areas of their jurisdiction.
After the costly U.S. involvement in World War I, isolationism grew within the nation. Congress refused membership in the League of Nations, particularly due to Article X of the League's charter. Pursuant to Article X, the charter would have required by contract the United States Military to intervene if a member of the League were attacked; this prompted the United States Senate to vehemently oppose the Treaty of Versailles. Isolationism further grew after the events of the Nye Committee, which investigated corrupt military spending and fueled the Merchants of death argument, thus increasing anti-war opinions.

While desktops have long been the most common configuration for PCs, by the mid-2000s the growth shifted from desktops to laptops. Notably, while desktops were mainly produced in the United States, laptops had long been produced by contract manufacturers based in Asia, such as Foxconn. This shift led to the closure of the many desktop assembly plants in the United States by 2010. Another trend around this time was the increasing proportion of inexpensive base-configuration desktops being sold, hurting PC manufacturers such as Dell whose build-to-order customization of desktops relied on upselling added features to buyers.
With the end of the war, the Air Transport Command found itself in limbo. Senior USAAF authorities considered ATC to be a wartime necessity that was no longer needed, and expected its civilian personnel, including former airline pilots, to return to their peacetime occupations. Senior ATC officers, on the other hand, thought that ATC should be developed into a national government operated airline, an idea that was soundly opposed by the airline industry. While the war had firmly established the necessity of a troop carrier mission, most military officers believed the role performed by ATC should be provided by contract carriers.
299 She was ordered in August 1740, to be constructed by contract by shipwrights Grevill and Whetstone on the waterfront at Limehouse on the River Thames, and was then fitted out, armed and commissioned at Deptford Dockyard. Her dimensions were in keeping with other vessels of her class, with an overall length of , a beam of and measuring 205 tons burthen. Construction costs were low, being ₤1,550 in shipwright fees and building expenses and a further ₤1,505 for fittings. Hawk had two masts, supported by a trysail mast aft of the main mast, being square-rigged on the fore and main masts.
They were established in 1963 in all California counties except San Francisco, which would obtain one only in 2001, by the California State Legislature. Their current legal authority and mandate are defined by the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000 (Government Code Section 56000 et seq). LAFCOs' powers and duties have expanded in step with subsequent legislation and most recently include regulating cities and districts' ability to provide services outside their jurisdictional boundaries by contract or agreement. LAFCOs also must approve requests by districts to either expand their service powers and/or divest existing service powers.
Madonna had to sign a contract that forbade the book from including images of child pornography, bestiality, or religious imagery. Not long after signing the agreement Madonna founded Maverick, a multi-media entertainment company in partnership with Time Warner. Since by contract she had total artistic control over any work released by Maverick, who were now the book's publisher, the agreement she signed with Time Warner over the content in Sex was null and void. Sexs stylized, sado-masochistic look had a range of influences from punk rock, to early fashion iconoclasts like Guy Bourdin and his surrealism, and Helmut Newton.
Streaming services would still be able to negotiate other royalty rates directly with the mechanical license owner if they so chose. # It assures that songwriters are paid a portion of mechanical license royalties for either physical or digital reproduction of a song with their lyrics, at a rate set by contract. # It revamps the rate court process when disagreements over royalty rates arise. Previously, a single judge in the United States District Court for the Southern District of New York was assigned to handle all cases; the bill would assign a random judge in this Court to oversee these cases.
After the death of his wife in 1686, Johann Adolf married a second time in Querfurt on 3 February 1692 to Christiane Wilhelmine of Bünau. This marriage was morganatic and only made by contract; the completion of the marriage in the presence of a clergyman was left to his discretion. Johann Adolf give her 6,000 Taler as Morgengabe and an annual income of 3,000 Taler and the use of Schloss Dahme for her residence as dower. He admonished his sons to show her due respect, and should any children come from this marriage he would make further divisions over the family lands.
Lernoux was born into a comfortable Catholic family in California and excelled in school. She enrolled in the University of Southern California in the late 1950s and, after being nominated to Phi Beta Kappa, qualified as a journalist for the United States Information Agency (USIA), a government arm devoted to promoting U.S. policy overseas. Lernoux began working in Latin America in 1961, just before the Second Vatican Council. She worked in Rio de Janeiro and Bogotá for the USIA until 1964 and then moved to Caracas to write for Copley News Service, to which she remained bound by contract until 1967.
Current plans include the installation of digital information screens installed throughout the interior of the bus which will provide real-time information such as time, weather, advertisements, & service advisories. The screens are supplied by contract from 3 different vendors and are installed on new bus deliveries starting in 2017 while buses built after 2008 are currently receiving retrofits. A new livery was also introduced, replacing the blue stripe livery on a white base that had been in use in one variation or another since the late 1970s. The first of these buses entered service in mid-May 2016 on the Q10 route.

She died on 21 February 1740, leaving several children who bore her surname of Leslie.

The Commonwealth Bank applied to the High Court for special leave to appeal, section 35A of the Judiciary Act 1903 (Cth). arguing that the matter was one of public importance as the terms and conditions of most employees were regulated by contract, that the High Court should resolve the differences of opinion between different courts. Kiefel & Keane JJ granted special leave on the condition that the Commonwealth Bank pay Mr Barker's costs in the High Court and also not seeking to disturb orders for costs made in the court below which were favourable to Mr Barker.Transcript 13 December .
The design goals of the language attempted to combine the performance and safety of compiled languages with the expressive power of modern dynamic languages. Idiomatic D code is commonly as fast as equivalent C++ code, while also being shorter. The language as a whole is not memory-safe "It's close, and we're working to close the remaining gaps." but does include optional attributes designed to check memory safety. Type inference, automatic memory management and syntactic sugar for common types allow faster development, while bounds checking, design by contract features and a concurrency-aware type system help reduce the occurrence of bugs.
Some kinds of tying, especially by contract, have historically been regarded as anti-competitive practices. The basic idea is that consumers are harmed by being forced to buy an undesired good (the tied good) in order to purchase a good they actually want (the tying good), and so would prefer that the goods be sold separately. The company doing this bundling may have a significantly large market share so that it may impose the tie on consumers, despite the forces of market competition. The tie may also harm other companies in the market for the tied good, or who sell only single components.
By the 1880s, a second approach took over, treating newcomers as "immigrants by contract". An implicit deal existed where immigrants who were literate and could earn their own living were permitted in restricted numbers. Once in the United States, they would have limited legal rights, but were not allowed to vote until they became citizens, and would not be eligible for the New Deal government benefits available in the 1930s. The third and more recent policy is "immigration by affiliation", which Motomura argues is the treatment which depends on how deeply rooted people have become in the country.
Construction started by contract the following month.John Thomas revised J S Paterson, A Regional History of the Railways of Great Britain: Volume 6, Scotland, the Lowlands and the Borders, David and Charles, Newton Abbot, 1984, The engineer for the scheme was Thomas Grainger, in his first large undertaking; he had previously been chiefly engaged in road schemes. When he became engaged on the construction of the railway, he took as his assistant John Miller, and a year later the two men formed a partnership, Grainger & Miller, which was to be heavily involved in Scottish railway schemes.
Moral rights in Canadian copyright law are protected under the Copyright Act of Canada and include an author's right to attribution, integrity and association of a work. Moral rights are to be distinguished from economic rights; moral rights essentially being derived from the reflection of the author's personality in his or her work, whereas economic rights grant an author the ability to benefit economically from their work. An author of a work retains moral rights for the length of the copyright, even if the copyright has been assigned or licensed to another party. Moral rights cannot be assigned or licensed, but can be waived by contract.
Towards the end of their marriage, Rambova was banned from his sets by contract. Valentino and Rambova divorced in 1925. Lord Sumption held that BT could introduce the new scheme. Ofcom rejected the scheme solely because of the welfare test, and it had not been shown BT’s new charges would produce consumer benefits. BT was entitled by contract to vary charges, unless inconsistent with Directive 2002/21 art 8, which included a need to ensure consumer benefits. There was no finding of a lack of consumer benefit, so Ofcom could not reject charges just because they might have adverse consumer consequences, without any reason to think they would. They applied an extreme precautionary principle to a dynamic and competitive market, at odds with the Directives’ market-oriented and permissive approach.
With version 8.5 (released in 2005) the advertisements were completely removed and the primary financial support for the browser came through revenue from Google (which is by contract Opera's default search engine). Among the new features introduced in version 9.1 (released in 2006) was fraud protection using technology from GeoTrust, a digital certificate provider, and PhishTank, an organization that tracks known phishing web sites. This feature was further expanded in version 9.5, when GeoTrust was replaced with Netcraft, and malware protection from Haute Secure was added. In 2006, Opera Software ASA was released as well as Internet Channel and Nintendo DS Browser for Nintendo's DS and Wii gaming systems.
The sitting member, Thomas Leishman Brown, won the preselection, but lost the election to the Ministerial (later Liberal) candidate Henry Carson. Dooley then ran for and won the East Ward of the Geraldton Municipal Council in 1910, following a decision by that body to let municipal work by contract, and he served two terms as a councillor thereafter. He enjoyed the support of the Geraldton Express newspaper, edited by John Drew, a member of the Legislative Council who was later to join the Labor Party. Dooley succeeded in becoming the endorsed Labor candidate ahead of the 1911 state elections against fellow Geraldton councillor E. C. Bartlett and one other candidate.
The yoke has connotations of subservience and toiling; in some ancient cultures it was traditional to force a vanquished enemy to pass beneath a symbolic yoke of spears or swords. The yoke may be a metaphor for something oppressive or burdensome, such as feudalism, imperialism, corvée, tribute, or conscription, as in the expressions the "Norman Yoke" (in England), the "Tatar Yoke" (in Russia), or the "Turkish Yoke" (in the Balkans). The metaphor can also refer to the state of being linked or chained together by contract or marriage, similar to a pair of oxen. This sense is also the source of the word yoga, as linking with the divine.
A courtesan (Okino) is tired of her life in Edo, and is starting to be outshone by younger women, so she tricks a man (Yaji) into helping her escape the brothel where she is bound by contract to stay. Okino claims that her father is dying of "hearth trouble" and she needs to visit him right away. The two pair up with an actor (Kita) who made a mess of a scene in a popular kabuki play and so cannot show his face in Edo, and the three set out to find her father. They meet with various adventures along the way to Okino's hometown.
With the end of World War II, the United States Army Air Forces Air Transport Command found itself in limbo.
Before the formation of the National Symphony Orchestra, there was an amateur symphony orchestra, founded in 1907 under the auspices of the Lima Philharmonic Society (Sociedad Filarmónica de Lima). The National Symphony Orchestra was founded during the administration of Óscar R. Benavides by law of 11 August 1938. It initially consisted of sixty-four musicians, half of them native Peruvians, the other half foreigners then living in Peru or hired by contract from abroad. The orchestra gave its first concert on 11 December 1938 at the Teatro Municipal de Lima, under the baton of Theo Buchwald, as part of the eighth International Conference of American States.
Dlib is a general purpose cross-platform software library written in the programming language C++. Its design is heavily influenced by ideas from design by contract and component-based software engineering. Thus it is, first and foremost, a set of independent software components. It is open-source software released under a Boost Software License. Since development began in 2002, Dlib has grown to include a wide variety of tools. As of 2016, it contains software components for dealing with networking, threads, graphical user interfaces, data structures, linear algebra, machine learning, image processing, data mining, XML and text parsing, numerical optimization, Bayesian networks, and many other tasks.
Since then, the government has indicated it is willing to go much further, announcing plans to sell more than 10,000 of China's 13,000 medium-sized and large state enterprises. As a condition for joining the World Trade Organization in 2001, China had to "break the Iron Rice bowl", a step that was disputed by some economists. Efforts to break the iron rice bowl continued in Guangdong province in 2011 with a new plan of grassroots recruitment, employment by contract, and pay based on performance. The new arrangement will be included in the 12th five- year plan of the People's Republic of China (2011–2015).

Through the Lapp Codicil of 1751, this tradition was regulated by contract between the countries.Eventually, as a majority of these Sami became Swedish citizens, grazing and reindeer herding rights from Sweden became a burden for Norway. During the negotiations of 1905, it was thought this cross-border reindeer herding included 80,000-100,000 Swedish reindeer in Troms and Nordland, and in comparison there were only 7000 Norwegian reindeer grazing in Sweden during the winter. During the Karlstad Convention, this was finally resolved so that Norway accepted the grazing rights from Sweden, but was curtailed so that reindeer migration had to occur after June 15, six weeks later than previous regulations.
These 128-ton vessels were the first sloops built to serve as effective warships, carrying eight minions and two falconets, subsequently replaced by a uniform armament of twelve 3-pounder guns. In 1709 Dummer also designed and built the small sixth rate HMS Swan by contract with the Navy Board, and in the same year they purchased from him a similar vessel which he was building on speculation – the Sixth rate HMS Hind. The French captured Ferret in 1706, the Hind unfortunately stranded and wrecked off the Isle of Wight just two months after her launch in 1709, and the Weazle and Swan were sold in 1712.
The Center was developed by a prestigious group of award-winning designers. Its unique structure, designed with the goal of creating a physical representation of The Center's vision and a world-class destination for Atlanta, was created by design architect Philip Freelon in partnership with HOK. Freelon is best known for leading the design team of the Smithsonian National Museum of African American History and Culture in Washington, D.C. His work has been published in national professional journals and he was named Designer of the Year in 2008 by Contract magazine. HOK is the largest U.S.-based architecture-engineering firm and the country's third-largest interior design firm.
Armstrong Patents Co., [1986] A.C. 577, [1986] All E.R. 850 (H.L.). The opinion by Lord Templeman in that case pointed out that an implied license might be negatived by express language, under principles of freedom of contract, but that was not so when non-derogation instead is involved: “The right cannot be withheld by the manufacturer of the car by contract with the first purchaser and cannot be withheld from any subsequent owner.” That is, the nature of property makes the right inherent and not a matter of freedom of contract. It is thus seen that the effect is comparable to the US license that is implied by operation of law.
In July, Ferrucci was banned from four F2 races (Hungary and Belgium) after making deliberate contact with his teammate Maini after the Sprint Race at Silverstone on the weekend of the British Grand Prix. He was also disqualified from the Sprint Race results at Silverstone for a separate incident when he deliberately forced Maini off the track. He was also found to have driven his car between the F2 and F1 paddock without one glove and while holding his phone, which resulted in a €6,000 fine. On July 18, Ferrucci was summarily fired by the Trident F2 team, citing behavioral issues, and non-payment of money required by contract.
While, by contract, Richard Donner had major editorial control over what was theatrically released, the Salkinds had editorial control on what was shown outside of theaters. This was the result of deals that had been made between the producers and the ABC television network prior to the film's release. Financially, the more footage that was restored for television, the more revenue that could be made for the broadcast (the producers charged by the minute for every bit of footage added back in). During production of the film, Alexander and Ilya Salkind had been relegated to having to sell more and more of their rights back to Warner Bros.
This use was inherited by contract bridge, a modern development of whist defined in 1925 that became very popular in Britain and America by 1930. Tennis has a long history of adopting golf custom and Grand slam appears to have entered tennis not directly from card sport but via golf as it was used since 1930, when Bobby Jones won the four major championships, two British and two American tournaments. Although John F. Kieran of The New York Times is widely credited with first applying the term "grand slam" to tennis to describe the winning of all four major tennis tournaments in a calendar year,Martin, John (12 September 2017).
It was in 1460 that the construction of the first church dedicated to São Jorge occurred in the area of Velas, from the testaments of Infante D. Henrique. What is certain is that the island was populated by the time that João Vaz Corte Real, the Donatary-Captain of Angra do Heroísmo (Terceira) obtained the captaincy of the island, by contract on 4 May 1483. By 1500, the settlement of Velas was elevated from villa to municipality (giving rise to the supposition that Velas was the first center on the island). By 1659, the parochial church had already undergone public restoration, that gave origin the present church in that municipality.
The power project was the first step in a $20 billion scheme to help rebuild and stabilize India's power grid. Enron, GE (which was selling turbines to the project), and Bechtel (which was actually constructing the plant), each contributed 10% equity. During 1996, when India's Congress Party was no longer in power, the Indian government assessed the project as being excessively expensive and refused to pay for the plant and stopped construction. The Maharashtra State Electricity Board (MSEB), the local state- owned utility, was required by contract to continue to pay Enron plant maintenance charges, even if no power was purchased from the plant.
An analysis conducted by contract laboratory ChromaDex indicated that MonaVie contained low levels of antioxidant vitamin C and of phytochemicals such as anthocyanins and phenolics associated with antioxidant activity in test tubes. MonaVie promoted that the juice had key polyphenol antioxidants from açai and other fruits in the blend; However, there is no physiological evidence that any fruit polyphenols have such actions in humans or that oxygen radical absorbance capacity (ORAC) has any relevance in the human body. Research shows that although polyphenols are good antioxidants in vitro, antioxidant effects in vivo are probably negligible or absent."Studies force new view on biology of flavonoids", by David Stauth, EurekAlert!.
Edwards as Ben Casey, with guest star Sammy Davis, Jr. (1963) Edwards studied acting at the American Academy of Dramatic Arts; his classmates included Anne Bancroft, John Cassavetes, and Grace Kelly. In 1950, he was signed to a contract by Paramount Pictures, making his film debut as Vincent Edwards in 1951's Mister Universe. The following year he played the lead role in Hiawatha. Although he had major roles in several films, including film noirs The Killing (1956) and Murder by Contract (1958), it was not until he was featured as the title character in the highly successful Ben Casey television series that he achieved stardom.
The 1980s were a period of growth and modernization. The Command's command, control, communications and surveillance system underwent a modernization during the late 1970s and early 1980s. The labor-intensive, 1950s era Aircraft Control and Warning radar stations were replaced with minimally attended AN/FPS-117 long range radars, and the stations were closed in 1983; being reduced to unmanned sites supported by contract civilian personnel. The White Alice Communications network was inactivated in 1979, being replaced by an Alascom owned and operated satellite earth terminal as part of an Air Force plan to divest itself of the obsolete radio system and transfer the responsibility to a commercial firm.
The construction of the Vakhsh Canal is underway which is one of the largest constructions of the first Five-Year Plan. Two Americans come by contract; a grizzled spy Colonel Bailey (Boris Vinogradov), who introduces himself as a harmless traveler by the name of Mr. Murray, only later to be caught red-handed and unmasked, and Mr. Clark (Sergei Kurilov), who arrives to the canal to "make money" and gradually becomes convinced that work and politics are not that different concepts. Not accepting socialism he is quite sympathetic to the enthusiasm of the Soviet people. Love for the Komsomol translator Maria Polozova (Izolda Izvitskaya) helps Clark to comprehend what is happening.
Unlocked phones command higher resale prices, so can then be sold on at a profit, and can even be used by contract customers. Additionally, online marketplaces (like eBay) enable box breakers to operate internationally and exploit fluctuations in currencies and price differences between countries."Low pound fires breakers" - Mobile Magazine Historically, box breakers have been procuring a large number of handsets directly from handset retailers stores that eventually suffer revenue losses from box-breaker practices. While chains like O2 and Carphone Warehouse have clamped-down on sales to box-breakers, there are many other outlets, including catalogue stores and supermarkets that have not addressed this phenomenon.
Weyuker, Elaine J.; "The Oracle Assumption of Program Testing", in Proceedings of the 13th International Conference on System Sciences (ICSS), Honolulu, HI, January 1980, pp. 44-49 Oracles often operate separately from the system under test.Jalote, Pankaj; An Integrated Approach to Software Engineering, Springer/Birkhäuser, 2005, However, method postconditions are part of the system under test, as automated oracles in design by contract models. Determining the correct output for a given input (and a set of program/system states) is known as the oracle problem or test oracle problem, which is a much harder problem than it seems, and involves working with problems related to controllability and observability.
A dual-price system was introduced, in which (State-owned enterprise reform 1979) state- owned industries were allowed to sell any production above the plan quota, and commodities were sold at both plan and market prices, allowing citizens to avoid the shortages of the Maoist era. Moreover, the adoption of Industrial Responsibility System 1980s further promote the development of state-owned enterprise by allowing individuals or groups to manage the enterprise by contract. Private businesses were allowed to operate for the first time since the Communist takeover, and they gradually began to make up a greater percentage of industrial output. Price flexibility was also increased, expanding the service sector.
Schulman received Oscar nominations for Best Original Screenplay for Love with the Proper Stranger in 1963 and for Best Adapted Screenplay for Goodbye, Columbus in 1969. He also received three Writers Guild nominations for Best Screenplay for Wild Is the Wind, A Hole in the Head and Love with the Proper Stranger, and a Writers Guild award for Goodbye, Columbus. He was also the recipient of a Humanitas Prize award in 1994 for his work on And the Band Played On. He is credited as the screenwriter of Players, although the script was rewritten without his consent, and by contract he wasn't able to take his name off.
Orders can be matched either on a price/time or pro rata basis, configurable by contract, with transacted prices and volumes and the aggregate size of all bids and offers at each price level updated on a real-time basis. Users can continually notified of all active orders in the central order book, making market depth easy to monitor. NYSE Liffe also offers its customers the Bclear and Cscreen services, which bridge the listed and over-the-counter (OTC) markets. This provides a simple and cost-effective way to register and process wholesale derivatives trades through NYSE Liffe to clearing at NYSE Liffe Clearing.
By becoming commercial surrogates women in India are enabling themselves to improve not only their lives but also the lives of their families. It is common for surrogates to have had limited access to education, which could limit the opportunities for employment in the market. Payment for surrogacy varies by contract, estimates range from the equivalent of three times what the head of household could make in a month, to earning in nine months an amount that would take fifteen years worth of work. This amount of money can provide access to better housing, food, education, and sanitation, that would otherwise not be probable.
Sealift is a military logistics term referring to the use of cargo ships for the deployment of military assets, such as weaponry, military personnel, and materiel supplies. It complements other means of transport, such as strategic airlifters, in order to enhance a state's ability to project power. A state's sealift capabilities may include civilian-operated ships that normally operate by contract, but which can be chartered or commandeered during times of military necessity to supplement government-owned naval fleets. During WWI, the United States bought, borrowed or commandeered vessels of various types, ranging from pleasure craft to ocean liners to transport the American Expeditionary Force to Europe.
In the context of the 2013 global surveillance disclosures, German news magazine Focus cited Uhl as saying that U.S. contracting companies such as Cisco Systems, which manages much of the German armed forces' data, needed to be required by contract not to pass sensitive material to the U.S. National Security Agency (NSA).Michelle Martin (21 December 2013), Germany should ban U.S. contracting companies passing data to NSA - report Reuters. At the same time, Uhl was a longstanding supporter of using telecommunications data retention by German authorities in order to monitor internet traffic and telephone conversations. With regard to control of internet pages, Uhl referred to China as an example in 2009.
Tying is a variation of razor and blades marketing that is often illegal when the products are not naturally related, such as requiring a bookstore to stock up on an unpopular title before allowing them to purchase a bestseller. Tying is also known in some markets as 'Third Line Forcing.'Trade Practices Act - Third Line Forcing Some kinds of tying, especially by contract, have historically been regarded as anti-competitive. The basic idea is that consumers are harmed by being forced to buy an undesired good (the tied good) to purchase a good they actually want (the tying good), and so would prefer that the goods be sold separately.
Daniel Huston, Jr., (1824-1884) opposite Bismarck, Dakota Territory. Hunting and camping party near Fort Abraham Lincoln (George Custer, center) The three-company infantry post's name was changed to Fort Abraham Lincoln on November 19, 1872, and expanded to the south to include a cavalry post accommodating six companies. Among the 78 permanent wooden structures at Fort Lincoln were a post office, telegraph office, barracks for nine companies, seven officer's quarters, six cavalry stables, a guardhouse, granary, quartermaster storehouse, bakery, hospital, laundress quarters, and log scouts' quarters. Water was supplied to the fort by being hauled from Missouri River in wagons, while wood was supplied by contract.
In other decisions, the courts appear to have resorted to what may be described as the "productive capacity" test. This test was formulated in Martin Brassey’s article "The Nature of Employment" in the following terms: > The independent contractor “sells the job” whereas the employee “sells his > hands” [... E]mployment is a relationship in which one person is obliged, by > contract or otherwise, to place his or her capacity to work at the disposal > of another [... A]n employee is to be distinguished from an independent > contractor, who undertakes to deliver, not his or her capacity to produce, > but the product of that capacity, the completed work.
The President also helps with the establishment of regional support teams. Title three also explains the reimbursement process for expenditures by federal agencies under the Act. The federal government is not liable for any claims based on "the exercise or performance of or the failure to exercise or perform a discretionary function or duty on the part of Federal agency or an employee of the Federal Government in carrying out the provisions of this Act". In general, the expenditure of federal funds for debris clearance, reconstruction, or other emergency assistance which is carried out by contract with private organizations or firms is given to those organizations and firms already residing in or doing business in the affected area.
In return for loans, typically from a bank, companies will often be required by contract to give their creditors a security interest over the company's assets, so that in the event of insolvency, the creditor may take the secured asset. The Insolvency Act 1986 limits powerful creditors ability to sweep up all company assets as security, particularly through a floating charge, in favour of vulnerable creditors, such as employees or consumers. If money is raised by offering shares, the shareholders' relations are determined as a group by the provisions under the constitution.See Borland’s Trustee v Steel Brothers & Co Ltd [1901] 1 Ch 279 The law requires disclosure of all material facts in promotions, and prospectuses.
By allocating variables with data types that are large enough to contain all values that may possibly be computed and stored in them, it is always possible to avoid overflow. Even when the available space or the fixed data types provided by a programming language or environment are too limited to allow for variables to be defensively allocated with generous sizes, by carefully ordering operations and checking operands in advance, it is often possible to ensure a priori that the result will never be larger than can be stored. Static analysis tools, formal verification and design by contract techniques can be used to more confidently and robustly ensure that an overflow cannot accidentally result.
Holt, at p. 54 However, disposals by the United States during the territorial period of lands under navigable water should not be regarded as intended unless there was a definite declaration by contract, statute, or other similar action.Holt, at p. 55 At the time of Minnesota's admission as a state, Mud Lake and other much-larger navigable waters within its limits were included in the Red Lake Indian Reservation. The Chippewas Tribe ceded to the United States their right of occupancy of the surrounding lands, leaving the Red Lake Reservation as a remainder of their original aboriginal territory. While the area was recognized as a reservation, it was never formally set apart as such.
In South Korea, only providers registered with the government are authorized to offer VoIP services. Unlike many VoIP providers, most of whom offer flat rates, Korean VoIP services are generally metered and charged at rates similar to terrestrial calling. Foreign VoIP providers encounter high barriers to government registration. This issue came to a head in 2006 when Internet service providers providing personal Internet services by contract to United States Forces Korea members residing on USFK bases threatened to block off access to VoIP services used by USFK members as an economical way to keep in contact with their families in the United States, on the grounds that the service members' VoIP providers were not registered.
The concession for the construction and operation of the marina was awarded for 75 years to a private company, by contract with the Portuguese State, on September 21, 1995. There were considerable criticisms of the development. These centered on the potential environmental impact; the change to the nature of the landscape; and the difficulty in predicting the behavior of the currents, especially with regard to the deposit of sand, potentially forming new beaches and removing others. Such fears came, in part, to be realised, particularly in regard to the visual impact of the marina on the cove of Santa Marta, and the Casa de Santa Maria and the Santa Marta Lighthouse on the cove’s banks.
More recently, there has been renewed interest following the Great Recession. Currently, no country in the world requires full-reserve banking. Banks operating under a full-reserve ratio generally do so by choice or by contract, although the governments in some countries such as Iceland and the US have considered implementing full reserve banking to avoid future financial crises.Iceland's daring raid on fractional reserve banks, Financial TimesA banking revolution Jeremy Warner, UK Telegraph In 2018, Switzerland voted on the Sovereign Money Initiative which has full reserve banking as a prominent component of its proposed reform of the Swiss monetary system.Switzerland's ‘Vollgeld’ banking overhaul: how reform would work The measure was overwhelmingly rejected.
Lorna's first song was "Bebdo" (), which she performed on Miramar Beach, Goa, shocking the crowd with a song of this type in Konkani. She soon became well-known for her other songs, such as "Nachomia Kumpasar", "Pisso", "Red Rose", "Lisboa", "Adeus", "Tuzo Mog", "Noxibak Roddttam", "Abghat", "Calangute", "Aik Re Khobrankara", "Sorga Rajeant", "Pavsachea Tempar", "Amerikak Pavxi", "Sorg Tujea Dolleamni", "Tum Ani Hanv", "Ugddas" and "Mhoji Mai". She became so popular that the public started demanding just her solo performances from Perry, who bound her by contract to not perform with anyone else for twenty years. She subsequently left music for a period of 23 years after a disagreement with him when she was 26 years old.
In his separate opinion, Lord Templeman pointed out that an implied licence might be negatived by express language, under principles of freedom of contract, but that was not so when non-derogation instead is involved: "The right cannot be withheld by the manufacturer of the car by contract with the first purchaser and cannot be withheld from any subsequent owner." That is, the nature of property makes the right inherent and not a matter of freedom of contract. This case appears to be the first one extending the non-derogation doctrine from cases involving realty to cases involving personal property (chattels). Lord Templeman seems to have recognized this point in his opinion.
1928 was by far be her biggest year, with her appearing in seven films, including Prowlers of the Sea starring Carmel Myers and Ricardo Cortez, and Marriage by Contract starring Patsy Ruth Miller. In 1929 her career slowed considerably, with her starring in only one film, Campus Knights. She did make a semi- successful transition to "talking films", with all of her roles being in B-movies, and in 1930 she appeared with Dorothy Sebastian and Neil Hamilton in Ladies Must Play, her only film of that year. In 1932 she appeared in This Sporting Age, and in 1933 she starred in probably her most recognizable role, starring opposite John Wayne in Somewhere in Sonora.
In 2004, President George W. Bush, on the recommendation of the 9/11 Commission, issued a directive ordering new, uniform identification standards for federal employees, including contract employees. Previously, federal contract employees were not generally required to undergo background investigation, except as required by specific contracts. Pursuant to this directive, the Department of Commerce mandated that contract employees with long-term access to federal facilities must complete a background check and set an October 2007 deadline for completion of this effort. The Jet Propulsion Laboratory (JPL), a NASA facility that is operated by the California Institute of Technology (Caltech) under government contract and hence is staffed entirely by contract employees, was subject to this requirement.
By the end of the story, Hazel has begun to walk, and Upsher and Doff have been silenced by contract killer The Brand, The Will's sister, using a substance that will kill them if they report their findings of the family to anyone else. The fourth Volume, which begins Book Two, establishes the family living on the planet Gardenia, with Alana acting in an underground entertainment program called the Open Circuit in which all the actors wear masks. Hazel is now speaking in simple phrases, while Prince Robot IV's son is born. A disgruntled robot janitor, Dengo, kills Prince Robot IV's wife, kidnaps his infant son and journeys to Gardenia, where he kidnaps the family.
Working mothers of a certain low socioeconomic status and with proof of an employment contract and working hours receive subsidized child care through legislation passed in 1994. This system excludes: women whose household income is too high, unemployed women, women working in the informal sector, and women whose jobs are not by contract. Chile offers paid maternity leave for women working in the formal sector, paying women 100 percent of their salary during the leave, and also allows women a one-hour feeding break each day until the child has reached the age of two. Female workers unattached to the formal market and without an employment contract do not receive paid maternity leave.
George Yabu and Glenn Pushelberg became Officers of the Order of Canada – the country's highest honour – for their contributions to design excellence internationally in December 2013. They were named by Town & Country magazine as two of the “101 People You Must Meet in 2011” and by Condé Nast Traveler magazine as the “Hot Interior Design Firm” of 2011, Platinum Circle Award, for their exceptional achievement in the hospitality industry, as well as the James Beard Foundation award for Excellence in Restaurant Design. In 2001, George Yabu and Glenn Pushelberg were together named Designer of the Year by Contract Magazine, and in 2002 were inducted into the Interior Design Magazine Hall of Fame.
It includes secondary runs in the country of first issue, but also international usage which may not be managed by the originating producer. In many cases, other companies, TV stations, or individuals are engaged to do the syndication work, in other words, to sell the product into the markets they are allowed to sell into by contract from the copyright holders, in most cases the producers. First-run programming is increasing on subscription services outside the US, but few domestically produced programs are syndicated on domestic free-to-air (FTA) elsewhere. This practice is increasing, however, generally on digital-only FTA channels or with subscriber-only, first-run material appearing on FTA.
The 1991 Washington Huskies football team represented the University of Washington in the 1991 NCAA Division I-A football season. Head coach Don James, in his 17th season at Washington, was assisted by coordinators Keith Gilbertson (offense) and Jim Lambright (defense), both head coaches themselves within two years. The 1991 team was arguably the finest team in school history and split the national championship with the Miami Hurricanes, who were also 12–0, and won the AP Poll by four votes, while Washington took the coaches' poll by nine. Washington could not have played Miami in a bowl game because the Pac-10 champion was bound by contract to play in the Rose Bowl against the Big Ten champion.
Trust, Ethnicity, and Identity deals with the economic role of laws and institutions in achieving social order in a decentralized economy. This book mainly examines how ethnic kin-based trading networks can rely on trust when a well-developed framework of contract laws is missing. Specifically, this book considers the coordinating role of three major nonprice institutions—ethnic trading networks, contract law, and gift- exchange—in economizing on transaction costs and thus facilitating the process of exchange in decentralized economies in different historical contexts. The major unifying theme of the book is this: identity matters when traders operate in an environment characterized by contract uncertainty, where the legal framework for the enforcement of contracts is not well developed.
On July 26, 2000, Isaacs testified in the A&M;/Leiber vs. Napster lawsuit, using the case of Skycycle as an example of "what we, and hundreds of other bands, have been through with the antiquated business model of the major label", and showing that it is possible to generate interest for a band by allowing people to listen to their music through media such as Napster. Isaacs illustrated their struggles with how the record label's advance payments for recording costs were recoupable by contract, meaning that the record company would recoup its investment before the band would receive money. As Skycycle were dismissed but never fully released from their contracts, MCA could demand payment of its recoupable expenses even if Skycycle were signed to another label.
The three service academies that play in Division I FBS—Air Force, Army, and Navy—are theoretically subject to this rule, but are exempt in practice because all students at these schools receive full scholarships from the federal government. Starting in 2014, the FBS began playing a four-team tournament culminating in a National Championship Game to determine its national champion, a system that will be in place from the 2014-2025 seasons by contract with ESPN, broadcaster of the games. But since the College Football Playoff is not sanctioned by the NCAA, this makes FBS football the only sport without an NCAA-sanctioned champion. The FCS is the highest division in college football to hold a playoff tournament sanctioned by the NCAA to determine its champion.
With the introduction of high speed (broadband) connections directly to homes, it is feasible to share images and videos without going through a central service. The advantages of peer-to-peer sharing are reduced hosting costs and no loss of control to a central service. The downsides are that the consumer does not get the benefit of off-site backup; consumer Internet service providers (ISPs) often prohibit the serving of content both by contract and through the implementation of network filtering, and there are few quality guarantees for recipients. However, there are typically no direct consumer costs beyond the purchase of the initial software, provided the consumer already has a computer with the photos at home on a high speed connection.
Ideologies and Political Theory: A Conceptual Approach. Oxford University Press. p. 276. Tucker first favored a natural rights philosophy in which an individual had a right to own the fruits of his labor, but then abandoned it in favor of egoist anarchism (influenced by Max Stirner) in which he believed that only the right of might exists until overridden by contract. According to Charles A. Madison, Tucker was a "champion of complete individual liberty" and thus "disliked all types of communism", believing that even a stateless communist society must encroach upon the liberty of individuals, insisting instead on the voluntary nature of all association and rejecting majority rule, organized religion and the institution of marriage due to their compulsory nature.
In 1821 Commissioner Bigge supported Macquarie's improvements to the dockyard and recommended they be completed as soon as possible. Francis Greenway noted that the Macquarie-era building works at the dockyards were carried out partly by convict and partly by contract labour. In the 1822 Macquarie's report to the Secretary of State for War and the Colonies, Earl Bathurst (on his return to England) details his works at the dockyard:Historical Records of Australia, 1, 10, 685 This last item was the Coxswains Barracks - later known as Cadman's Cottage - part of the Macquarie- era dockyard establishment. The Government Coxswain supervised shipping from Sydney Cove; rostered boat crews who procured and shipped stores, timber, grass and shells for lime, and provided crews for the Governor's and naval officer's boats).
The Restatement (Second) of Torts, a highly influential restatement of United States tort law Tort law generally covers any civil action between private parties arising from wrongful acts which amount to a breach of general obligations imposed by law and not by contract. Tort law covers the entire imaginable spectrum of wrongs which humans can inflict upon each other, and of course, partially overlaps with wrongs also punishable by criminal law. Although the American Law Institute has attempted to standardize tort law through the development of several versions of the Restatement of Torts, many states have chosen to adopt only certain sections of the Restatements and to reject others. Thus, because of its immense size and diversity, American tort law cannot be easily summarized.
UpdateTV is a multipath worldwide distribution system which allows digital televisions to automatically receive firmware upgrades and software patches sent out via terrestrial broadcast, digital cable networks, and the Internet. The network and technology has been under development by UpdateLogic since 2004, was completed in 2006, first shipped in TV sets in 2008 by Sony Electronics, and is now shipped in TVs from Sanyo and others. In the terrestrial case, the UpdateTV solution which works within the ATSC A/97 (Software Data Download Service, or SDDS) protocol, will be datacast by National Datacast on PBS TV stations across the United States. Major cable operators are required by contract to transmit the data such that the software upgrades are also passed to their customers.
Credit counseling (known in the United Kingdom as Debt counselling) is commonly a process that is used to help individual debtors with debt settlement through education, budgeting and the use of a variety of tools with the goal to reduce and ultimately eliminate debt. Credit counseling is most often done by Credit counseling agencies that are empowered by contract to act on behalf of the debtor to negotiate with creditors to resolve debt that is beyond a debtor's ability to pay. Some of the agencies are non-profits that charge at no or non-fee rates, while others can be for-profit and include high fees. Regulations on credit counseling and Credit counseling agencies varies by country and sometimes within regions of the countries themselves.
Brewster Kahle of the Internet Archive talks about archiving operations Kahle has been critical of Google's book digitization, especially of Google's exclusivity in restricting other search engines' digital access to the books they archive. In a 2011 talk Kahle described Google's 'snippet' feature as a means of tip-toeing around copyright issues, and expressed his frustration with the lack of a decent loaning system for digital materials. He said the digital transition has moved from local control to central control, non-profit to for-profit, diverse to homogeneous, and from "ruled by law" to "ruled by contract". Kahle stated that even public-domain material published before 1923, and not bound by copyright law, is still bound by Google's contracts and requires permission to be distributed or copied.
Assertions can function as a form of documentation: they can describe the state the code expects to find before it runs (its preconditions), and the state the code expects to result in when it is finished running (postconditions); they can also specify invariants of a class. Eiffel integrates such assertions into the language and automatically extracts them to document the class. This forms an important part of the method of design by contract. This approach is also useful in languages that do not explicitly support it: the advantage of using assertion statements rather than assertions in comments is that the program can check the assertions every time it runs; if the assertion no longer holds, an error can be reported.
While ships are slower than their airborne counterparts and may require port facilities to unload their cargo, their larger capacity allows them to transport heavy armoured forces or bulky supplies that only the largest strategic airlifters (such as the C-5 Galaxy) could normally handle, and in much greater quantities. A state's sealift capabilities may include civilian-operated ships that normally operate by contract, but which can be chartered or commandeered during times of military necessity to supplement government-owned naval fleets. Some smaller navies have built multi-role vessels that combine sealift with other capabilities, such as those of a patrol frigate or a command-and- control vessel. The Royal Danish Navy's and the Royal New Zealand Navy's multi-role vessel being two examples.
Under a pure licensing agreement, the licensor, under its terms and by common-law, can cancel the agreement at will and without cause, unless it is coupled with an interest or made irrevocable by contract. A license that has been coupled with an interest is not revocable by the licensor without exposure to liability and potential damages. In the event a license is coupled with an interest, the licensor must provide reasonable time for the licensee to remove that interest from the property prior to termination. Additionally, because a license does not confer any possessory interest in the licensee, in the event of a sale of the property, the license is terminated and cannot be enforced against the new owners of that property.
An eastbound stopping train at Machynlleth in 1951The rupture with the GWR over working arrangements having proved final, the company called on the Oswestry and Newtown Railway to work its line; the O&NR; was already working the Llanidloes and Newtown Railway. In practice it was Thomas Savin actually working the O&NR; by contract, and the contract was extended to cover the N&MR; also. The limited motive power and rolling stock of the N&MR; was inadequate, and the N&MR; arranged with David Davies to spend up to £20,000 on additional rolling stock as a matter of urgency. The negotiation with the O&NR; developed into an agreement to amalgamate; the agreement, arranged under the O&NR;'s 1860 Act, meant that the O&NR; leased the N&MR; for 100 years.
George William therefore wanted George Louis to marry his daughter Sophia Dorothea, whose marriage prospects were otherwise not bright, given the circumstances of her birth. To George William's annoyance, George Louis and his parents refused the proposal on the grounds of precisely the birth status of the intended bride. After the rejection of his daughter, George William decided to improve definitively the status of Eléonore and Sophia Dorothea: by contract signed on 22 August 1675 and in open violation of his previous promise, George William declared that his marriage to Eléonore was not morganatic but valid to both church and state, with a second wedding ceremony being held at Celle on 2 April 1676. George William's younger brother Ernst August and specially his wife Sophia of the Palatinate demonstratively stayed away from this second wedding.
The stands at Raymond James Stadium were mostly empty on the day of the game. Almost immediately after the selection of Virginia Tech and Boston College, concerns about potential attendance at the 2008 ACC Championship Game arose. Because the same matchup resulted in such low attendance at the 2007 championship game in Jacksonville, it was doubted that Tampa, which is several hundred miles further south and more distant from the two schools, could attract as many spectators as the previous season's game. Adding to the problem of selling tickets was the 2008 economic crisis, which many fans cited as a reason for not purchasing tickets. By the Wednesday before the game, Virginia Tech had sold just 3,000 of the 10,000 tickets it was required by contract to sell.
On 8 June 2020, the RFEF and La Liga agreed to start the window on 4 August and end on 5 October due to the 2019–20 La Liga season concluding on 19 July after hiatus. Although a few transfers were announced prior to the starting date, the transferred players will not officially become part of their new club until the window's opening. New signings that were originally included in rosters for the post-hiatus 2019–20 UEFA Champions league and Europa League knockout phases went on to play the competition with their former club by contract, they were ready for use at their new club once the tournaments concluded. All loan spells ending on 30 June 2020 were extended until the rescheduled end of their clubs' respective 2019–20 season.
Toxicology testing, also known as safety testing, is conducted by pharmaceutical companies testing drugs, or by contract animal testing facilities, such as Huntingdon Life Sciences, on behalf of a wide variety of customers.Household Product Tests BUAV According to 2005 EU figures, around one million animals are used every year in Europe in toxicology tests; which are about 10% of all procedures.Fifth Report on the Statistics on the Number of Animals used for Experimental and other Scientific Purposes in the Member States of the European Union, Commission of the European Communities, published November 2007 According to Nature, 5,000 animals are used for each chemical being tested, with 12,000 needed to test pesticides. The tests are conducted without anesthesia, because interactions between drugs can affect how animals detoxify chemicals, and may interfere with the results.
In the early 1900s rebuilding continued, with many modern improvements. Southwestern Bell Telephone Company established an office in Seligman,Mitchell et al, p. 31. in 1904 postal rural routes were established,Mitchell et al, p. 29. Before rural routes were established, mail was delivered at the post office and outlying areas were serviced by contract carriers who would pick up the mail at Seligman and carry it to the country stores or trading posts in the region. in 1905 the Bank of Seligman was opened by C.C. Fawver,Mitchell et al, p. 22. and in 1910 George Finn established the Farmers and Merchants Bank.Mitchell et al, p. 24. Also in 1910, the North Arkansas line was extended from Seligman through Eureka Springs to Harrison, Arkansas.Mitchell et al, p. 46.
During his battle with Keita, he reveals that he has often granted the wishes of humans for the same price; by contract, he is allowed to murder the family members as they reach adulthood, one by one, until the whole family is dead. In the case of the Shindō family, Boryoku no Umi delighted in fighting any protectors they contracted with their own favored style of combat - and winning, killing all those who would not surrender. In addition to wearing a black shinigami robe, which deflects most ranged attacks, Boryoku no Umi is skilled in a vast array of martial arts and possesses powers of evil magic. Some of his favorite tricks are to awaken a person's deepest fears to paralyze them, or to evoke madness and terror by uttering a deafening shriek.
He was nominated for Golden Globe Awards for Best Performance by an Actor in a Television Series - Musical or Comedy in 1971 and 1972. He voiced Woodhead the rocking horse in Filmation's Journey Back to Oz. He also provided the Cowardly Lion's singing voice while Milton Berle provided the character's speaking voice. He also appeared as Joe Vitelli in the 1977 TV miniseries Seventh Avenue. In Hail to the Chief (1985), a comedy on ABC, Bernardi played Helmut Luger. Bernardi was in several notable films, including Murder by Contract (1958), A Cold Wind in August (1961), The George Raft Story (1961), Irma La Douce (1963), Love with the Proper Stranger (1963), No Deposit, No Return (1976), and The Front (1976), a film about blacklisting in the entertainment industry.
Comunicato sul sito ufficiale During 2007, on occasion of the International Women's Day, the insignia of Cavaliere della Repubblica (Order of Merit of the Italian Republic) was awarded to Elena Miroglio. The insignia was bestowed by virtue of the contribution made by the Elena Mirò brand and by the Group toward "emancipating women from a constrictive concept of beauty", as declared during the award ceremony by Giorgio Napolitano, President of the Italian Republic.Articolo di Repubblica In June 2008, the Miroglio Group acquired a stake in the Ayaydin Group, a sector leading competitor, specialising in womenswear fashion, across the Turkish marketplace. As agreed by contract, the Miroglio Group works toward building up the market footprint forged by the Ayaydin Group across the homeland and across emerging markets (such as Russia, Romania, Ukraine, Bulgaria, Kazakhstan, and Moldavia).
During World War II, a meter long tunnel was built at above sea level by command of the Nazi Gauleiter of Carinthia, Friedrich Rainer, to bypass the steep upper parts of the mountain road. Work was performed by the Viennese Universale Hoch- und Tiefbau construction company, employing 660 civilian workers, several posted by the Service du travail obligatoire of Vichy France, and 1,652 forced labourers supplied by contract with the SS. These prisoners were interned in two minor subcamps of the Mauthausen-Gusen concentration camp, one on each side of the pass. They were put under the command of Obersturmführer Julius Ludolf, who served in Mauthausen since 1940 and was notorious for his excessive beatings. Loibl subcamp memorial Tunnel construction started on the south side in March 1943.
The Exo commuter trains operate on tracks owned by either Canadian National or Canadian Pacific. The Mont-Saint-Hilaire line run on CN trackage and operate out of Central Station, while the Vaudreuil-Hudson, Saint-Jérôme, and Candiac lines run on CP trackage and operate out of Lucien L'Allier terminus, beside the historic Windsor Station. The Saint-Jérôme line also runs on Canadian Pacific (CP) trackage and on the RTM's own trackage between Sainte-Thérèse and Saint-Jérôme. The Deux-Montagnes line, including trackage and all infrastructure, as well as the Mount Royal tunnel, is fully owned by the RTM.L’AMT FAIT L’ACQUISITION DE LA LIGNE DE TRAINS DE BANLIEUE DEUX-MONTAGNES (In French) Operation of all commuter rail was provided by contract to CN and CP (on their respective rail networks) until June 30, 2017.
Further, the appropriate level of detail is fairly well-defined: "We spend time and effort focused on specifying boundary conditions, argument ranges and corner cases rather than defining common programming terms, writing conceptual overviews, and including examples for developers." In between these views is the assertion that comments are neither beneficial nor harmful by themselves, and what matters is that they are correct and kept in sync with the source code, and omitted if they are superfluous, excessive, difficult to maintain or otherwise unhelpful.Non-existent comments can make it difficult to comprehend code, but comments may be detrimental if they are obsolete, redundant, incorrect or otherwise make it more difficult to comprehend the intended purpose for the source code. Comments are sometimes used to document contracts in the design by contract approach to programming.
Although it is unclear where Bermejo received his training, his complete mastery of the oil glaze technique suggests direct contact with 15th century Flemish painting, which he was able to adapt perfectly to the demands of Spanish altarpieces of the period: large-scale retables with many panels. Though his documented career spans over thirty years, he was peripatetic: he never settled in one place for more than a decade. Also, in a period and place where painting was a business, and work was generally negotiated by contract, there is both direct and indirect evidence that he was professionally unreliable, though apparently his outstanding talent made patrons willing to take the risk. One contract (discussed below) contained a clause providing for the excommunication of the painter in the event of unsatisfactory performance.
Yarmouth station in 2008 From the outset the working agreement between the FY&NR; and the IoWCR was contentious, due to the supposed inadequacy of structures and earthworks, for which the IoWCR was unwilling to accept the liability. The IoWCR may have suggested that a third-party contractor take that responsibility, for the FY&NR; wrote to the IoWCR stating that "the principle of our line being maintained by any other person than the working company is not feasible. We find that there is no such case in the whole railway systems of Great Britain."Letter from FY&NR; to IoWCR prior to July 1889, partly quoted in Blackburn, page 11 Whether the FY&NR; did the maintenance by direct labour or by contract, it was inadequate from the outset.
Earlier establishments had merely laid out the principal dimensions for each type of warship from the 100-gun first rates down to the 20-gun sixth rates, although with effect from the 1719 Establishment this was augmented by defining the sizes and thicknesses of wood to be used in the construction. These establishments had left the actual design of each vessel to the Master Shipwright in each Naval Dockyard, with the Surveyor of the Navy responsible only for common designs for those ships built by contract by mercantile shipbuilders. However, under the new 1745 Establishment the responsibility for preparing designs ("draughts") for all ships was given to the Surveyor of the Navy, with the Master Shipwrights now responsible only for constructing ships to those common Surveyor's designs for each vessel type.
The extended enterprise associated with "McDonald's", for example, includes not only McDonald's Corporation, but also franchisees and joint venture partners of McDonald's Corporation, the 3PLs that provide food and materials to McDonald's restaurants, the advertising agencies that produce and distribute McDonald's advertising, the suppliers of McDonald's food ingredients, kitchen equipment, building services, utilities, and other goods and services, the designers of Happy Meal toys, and others. Extended enterprise is a more descriptive term than supply chain, in that it permits the notion of different types and degrees and permanence of connectivity. Connections may be by contract, as in partnerships or alliances or trade agreements, or by open market exchange or participation in public tariffs. How an extended enterprise is organized and structured and its policies and mechanisms for the exchange of information, goods, services and money is described by the enterprise architecture.
Torsella's policy proposals included universal college savings accounts, portable IRAs for Pennsylvania workers whose employers do not offer retirement savings plans, banning the corrupt practice of third-party marketers introducing money managers to the state, appointing a chief integrity officer for Treasury, creating an online Pennsylvania Sunshine Checkbook that shows all state spending, disclosing all state contracts on alternative investments, adding political contributions by contract-holders to the Treasury's state contracts database, and requiring those trading public funds to disclose their personal trades. He also garnered high-profile endorsements from Barack Obama, Mayor Michael Bloomberg, and Governor Ed Rendell. On November 8, 2016 Torsella was elected to Pennsylvania State Treasurer, defeating Republican Otto Voit III of Berks County. Torsella captured 50.66% of the vote, winning by a larger margin (380,593 votes) than any other statewide candidate.
The implied term test was explained by Lord Loreburn: > In most of the cases it is said that there was an implied condition in the > contract which operated to release the parties from performing it, and in > all of them I think that was at bottom the principle upon which the court > proceeded.F.A. Tamplin in S.S. The defendant here agreed by contract to rent a flat located at Pall Mall from the plaintiff, for the purpose of watching the coronation procession of Edward VII scheduled for June 26 and 27.Beale (2002) p.
In 1786 and 1787, Bentham travelled to Krichev in White Russia (modern Belarus) to visit his brother, Samuel, who was engaged in managing various industrial and other projects for Prince Potemkin. It was Samuel (as Jeremy later repeatedly acknowledged) who conceived the basic idea of a circular building at the hub of a larger compound as a means of allowing a small number of managers to oversee the activities of a large and unskilled workforce. Bentham began to develop this model, particularly as applicable to prisons, and outlined his ideas in a series of letters sent home to his father in England. He supplemented the supervisory principle with the idea of contract management; that is, an administration by contract as opposed to trust, where the director would have a pecuniary interest in lowering the average rate of mortality.
In most jurisdictions, it is customary for the foreclosing lender to obtain a title search of the real property and to notify all other persons who may have liens on the property, whether by judgment, by contract, or by statute or other law, so that they may appear and assert their interest in the foreclosure litigation. This is accomplished through the filing of a lis pendens as part of the lawsuit and recordation of it in order to provide public notice of the pendency of the foreclosure action. In all U.S. jurisdictions, a lender who conducts a foreclosure sale of real property that has a federal tax lien must give 25 days notice of the sale to the Internal Revenue Service. Failure to give notice results in the lien remaining attached to the real property after the sale.
After his baseball career, Sisler was an executive with the investment firm A. G. Edwards for more than 30 years, reaching the level of vice-chairman. A. G. Edwards was a sponsor of a semi-professional baseball tea in St. Petersburg, Florida; when the "Stockbrokers" were invited to play in season-ending tournament to decide a champion, Sisler, a senior executive for the firm, denied the funding for the team, forcing them to decline if no other monies were raised. It was an unexpected decision considering that Sisler was former baseball player, but he did not feel that A. G. Edwards was benefitting, with the costs of running the team becoming more than originally agreed to by contract. In 2004, the possibility arose of his father's record of 257 hits in a season being surpassed by Ichiro Suzuki of the Seattle Mariners.
In the broadcasting industry, an owned-and-operated station (frequently abbreviated as an O&O;) usually refers to a television or radio station that is owned by the network with which it is associated. This distinguishes such a station from an affiliate, which is independently owned and carries network programming by contract. The concept of an O&O; is clearly defined in the United States and Canada (and to some extent, several other countries such as the United Kingdom, Australia, Brazil, Argentina, Chile and Japan), where network-owned stations had historically been the exception rather than the rule. In such places, broadcasting licenses are generally issued on a local (rather than national) basis, and there is (or was) some sort of regulatory mechanism in place to prevent any company (including a broadcasting network) from owning stations in every market in the country.
He has analyzed the theory and history of free banking, a system under which commercial banks and market forces control the provision of banking services.Lawrence H. White, Competitive Money, Inside and Out , Cato Institute Journal 3, Spring 1983, 281–99. He supports "depoliticizing the supply of money," considers "free market monetary arrangements" feasible and argues that market monetary institutions "can more credibly be found by contract to perform as desired."Lawrence H. White, "Depoliticizing the Supply of Money," in Thomas D. Willett, Political business cycles: the political economy of money, inflation, and unemployment, Duke Press Policy Studies, Duke University Press, 1988, p. 460, , White's Free Banking in Britain analyzes the efficient systems of free banking in Scotland for 128 years until it was suppressed by the British Parliament which was having problems with its own banking system.
Construction of the first section of the South Wales Railway, between Chepstow and Swansea, had been proceeding and it opened for traffic on 18 June 1850. The crossing of the River Wye at Chepstow was not ready, and this section was therefore isolated from the rest of the railway system for two years, until the river was bridged, on 19 July 1852. The Great Western Railway had been working the Bristol and Exeter Railway by contract, but the B&ER; had taken over its own working; accordingly the GWR had a temporary surplus of rolling stock, and was able to work the SWR line from its opening. The schism between the SWR and the GWR was partly resolved by March 1851, when the SWR determined to build to a terminal on the waterway known as Milford Haven instead of Fishguard.
303 John Pintard relates it as tradition, and John Fanning Watson, in his Annals and Occurrences of New York City and State (1846), tells the same. The printing of the Colonial Manuscripts of New York removed all doubt. In a letter of Lt. Governor Clarke to the Duke of Newcastle, dated New York, June 2, 1738, in which he announces the receipt of news that a Spanish land and naval force was arrived at St. Augustine from Cuba in order to make a descent upon Georgia, occurs this passage: > The Council were of opinion that there was sufficient cause to embargo Kip > and Griffith sloops—both owned by one William Walton, of this town, who, as > I am informed, has supplied that place for many years by contract. He > protested against the Custom House officers for refusing to clear ships.
Regarding the timeline to restart the flight testing and production, company president Dick Silva stated in September 2008, "There is a limit to how long we can go without resuming the project. Time is our enemy." In April 2009 Silva announced that the company had found sufficient funding to restart, would rehire staff and intended to have a replacement prototype ready to fly by the beginning of August 2009, with the aim of completing the certification of the 300C. The company also stated that investigation into the crash of the prototype ruled out in-flight failures or other problems with the aircraft. The August 2009 date to recommence flight testing was not met and the aircraft was then forecast to start flight testing by contract National Research Council test pilots in February 2010, though this date was not met either.
Attention to social equity in the field of public administration in the United States arose during the 1960s, amid growing national awareness of civil rights and racial inequality. The National Academy of Public Administration defines the term as “The fair, just and equitable management of all institutions serving the public directly or by contract; the fair, just and equitable distribution of public services and implementation of public policy; and the commitment to promote fairness, justice, and equity in the formation of public policy.”National Academy of Public Administration In 1968, H. George Frederickson articulated "a theory of social equity" and put it forward as the 'third pillar' of public administration. Frederickson was concerned that those in public administration were making the mistake of assuming that citizen A is the same as citizen B; ignoring social and economic conditions.
Although Generals like Leonard Wood attempted to negotiate with the local Datus of Moroland, some Datus weren't interested in giving up their sovereignty to these new colonisers, hostilities almost immediately broke out with minor incidents of murder and stealing of weapons from the Americans stationed there. The expedition to Bayang was said to be a retaliation to two murders, 3 weeks apart, the perpetrators were Moros or Muslim Filipinos who were hoping to obtain the Americans' Krag-Jorgensen rifle. In response, Baldwin took his entire command of 1,025 men on the expedition and added the 25th Battery of the Field Artillery (65 men), ten six-mule teams and 40 pack mules run by contract civilian packers, and 300 hired cargadores. 600 men of the 10th and 17th Infantry Regiments were moved to Malabang as temporary replacements for his forces and to serve as a reserve.
The new BBC Three service is delivered primarily via iPlayer, offering new, original content, as well as full series of previous BBC Three programmes (branded as "Box Sets"). New content consists of full-length programmes, and short-form web series and features; Kavanagh explained that the new BBC Three would focus primarily on original comedies and documentaries. All long-form programmes commissioned for BBC Three must be aired at a later date on BBC One or BBC Two. In February 2019, it was announced that BBC Three programmes would air Mondays through Wednesdays on BBC One on following the News at Ten, beginning on 4 March 2019. Despite the refocus on comedy, the proportion of the channel’s output (in minutes) devoted to comedy actually fell post-switch, from 41% to 33%. By contract, the proportions of the channel’s output devoted to factual programming did increase.
Thus, a gas company had no authority to unilaterally change a rate in a contract by filing a new rate schedule with the FPC. The opinion also explained that the NGA was different from the Interstate Commerce Act (ICA) then in effect, which required transportation companies to use the same rate schedule for all customers and did not authorize special rates to be set by contract with individual customers as the large number of customers engaged in interstate commerce did not permit an administrative agency to review contracts with special rates. In comparison, there were relatively few gas companies and customers, and the NGA’s authorization to set rates using contracts recognized that dedicated infrastructure and capacity with individualized costs might be required for a gas company to serve a customer. Based on this difference, the Court then distinguished the prior case of Armour Packing Co. v.
The painter Godfried Schalcken sees his true love, Rose, the niece of the artist Gerrit Dou, wedded by contract for a large sum of money to Vanderhausen of Rotterdam, a strange and ghostly figure. Filled with dread, Rose begs Schalcken to run off with her to save her from the marriage, but he is cowardly and ambitious and wants to continue his studies with Dou; instead he says he will buy back the marriage contract when he is successful. The marriage goes ahead as agreed, and nothing is heard of Rose until she escapes some time later and returns home distraught and starving and begging for protection, but she is pursued by her ghostly husband and disappears. On the death of Dou a melancholy Schalcken lingers in the church after the funeral service, where a terrifying encounter with his former love leaves his senses reeling.
Information on John is scant, but by most historical accounts he was highly competent, and highly trusted by Edward. He was named "Guardian of the Realm" when Edward III was out of the country, was asked to open Parliament in Edward's absence, and was named Warden of the northern Marches, which gave him virtual autonomy in that portion of England. As the younger brother of the English monarch, since early childhood marital negotiations were made for John: in March 1328 Edward III entered into negotiations for a marriage between his brother and María Díaz de Haro, heiress of the Lordship of Biscay. By contract signed on 28 September 1334, John was then betrothed with Maria de La Cerda, Lady of Lunel and daughter of Ferdinand de la Cerda (grandson of King Alfonso X of Castile) by his wife Juana Núñez de Lara, Lady of Lara.
After the death of his daughter's fiancé, George William was keen to negotiate an agreement over the inheritance of the Duchy of Lüneburg. He initially approached his younger brother Ernest Augustus, Elector of Brunswick-Lüneburg, to arrange a marriage between Sophia Dorothea and Ernest Augustus's eldest son George Louis, the future George I of Great-Britain. However, both his brother and sister-in-law, Sophia of the Palatinate, had misgivings about the proposed match due to the circumstances of Sophia Dorothea's birth. After the rejection of his daughter, George William decided to improve once for all the status of Sophia Dorothea and her mother; by contract signed on 22 August 1675, and in open violation of his previous promise never to marry, George William declared that Éléonore was his lawful wife in both church and state, with a second wedding ceremony being held at Celle on 2 April 1676.
The official date of Rusyn settlement in Vojvodina is January 17, 1751 when the administrator of Bačka Franc Josip de Redl signed a contract with Mihajlo Munkači from the village of Červenovo, in the county of Bereg, to bring 200 Rusyn families of Greek- Catholic rite from the upper Hungarian districts known as the "Upper-Land" (Горнїца) to Kerestur. Kerestur was a Serbian settlement mentioned 1741 as ruined and abandoned, as the settlers had moved to Čelarevo. The same administrator signed another contract on May 15, 1763 with Petro Kiš from Kerestur to bring 150 Rusyn families of Greek Catholic rite from the same areas in the "Upper-Land" to Kocur. As the population grew and arable land given to settlers by contract was limited, many families from Kerestur and Kocur decided to migrate to the town of Novi Sad in 1766 and 1767.
Stanley Beach was the son of Scientific American's editor (he became editor himself), and he had a long personal association with Whitehead. His father Frederick Converse Beach contributed thousands of dollars to support Whitehead's work on Stanley Beach's airplane designs from 1903–1910.History by Contract, O'Dwyer and Randolph (1978), p. 124 Beach also claimed to have taken most of the photos that appeared in Randolph's 1937 book Lost Flights of Gustave Whitehead.Sci. American, 10 April 1939 In 1908, Beach and Whitehead received a patent for a monoplane glider. There were multiple articles published in Scientific American under Beach's editorship in 1903, 1906, and 1908 which stated that Whitehead had conducted "short flights" and flew "short distances" in 1901, similar to the hops made by Maxim and Herring.Sci. American, 19 September 1903, p. 204Sci. American, 27 January 1906"Santos Dumont's Latest Flight", Sci Am, 24 November 1906, p.
For much of the history of the Victorian railway network, construction work was carried out by the Construction Branch of the vertically-integrated Victorian Railways (VR). The first major rail infrastructure project in Melbourne to be delivered by an independent entity was the City Loop railway line, which began construction in 1971. The Melbourne Underground Rail Loop Authority (MURLA), established by the Melbourne Underground Rail Loop Act 1970, pioneered a new approach to construction management, where the MURLA employed only a small staff and most work was outsourced to a private consortium by contract. The administrative costs of MURLA were jointly met by the VR, the Melbourne City Council and the Melbourne and Metropolitan Board of Works from their annual budgets, separately to the costs of the project itself. The Metro Tunnel project was first proposed in 2008 by the state government led by John Brumby, following the Eddington Transport Study's recommendation of a new north-south rail connection.
For almost 20 years Fontaine had national responsibility for the sensitive issue of relations between the private education sector and the public authorities at the Secrétariat général de l'Enseignement catholique (Catholic Education Secretariat), first of all as legal adviser, then as Deputy Secretary-General from 1972 to 1981 and finally as chief representative from 1981 to 1984. She was closely involved in discussions concerning and often the driving force behind the legislative and statutory changes which, over a period of two decades, shaped the legal framework which provides for balanced relations between the State and the private establishments linked by contract to the public education service. Fontaine was a member of the Conseil supérior de l'Education nationale (National Education Council) from 1975 to 1981 and a member of its standing committee from 1978 to 1981. Between 1980 and 1984 she was a member of the Conseil économique et social (Economic and Social Council), to which she submitted a report on publishing policy.
The defendant, CS Henry, agreed by contract on 20 June 1902, to rent a flat at 56A Pall Mall from the plaintiff, Paul Krell, for the purpose of watching the coronation procession of Edward VII scheduled for 26 and 27 June. The housekeeper of the premises had informed Henry that he would have an excellent view of the procession from the room. Desiring to secure the rental of Krell's flat for the purpose of observing the coronation procession, Henry wrote the following letter to Krell's solicitor: > I am in receipt of yours of the 18th instant, inclosing form of agreement > for the suite of chambers on the third floor at 56A, Pall Mall, which I have > agreed to take for the two days, the 26th and 27th instant, for the sum of > 75l. For reasons given you I cannot enter into the agreement, but as > arranged over the telephone I inclose herewith cheque for 25l.
Mr. Arthur has a daughter, Rose, who, after visiting him as a child during her holidays for several years, at last comes to live with him at his cottage. It is when she appears, however, that her father's troubles may be said to begin; for she falls in love with Jack Westcombe the son of a retired officer, whom Rose’s father declines to see, conscious of the cloud that rests on himself. Among other characters there are Pugsley the carrier, Sir Joseph Touchwood, who has made a fortune out of shoes supplied by contract to Lord Wellington's army, Julia Touchwood, and a Richard ("Dicky") Touchwood who achieves small honors at Cambridge, but greater ones at home as a rat-catcher. The villain of the plot is a Mr. Gaston who attempts every crime from murder to bribery to compass his ends, and succeeds in hoodwinking every one for some time and keeping Mr. Arthur out of his lawful inheritance.
She and Michael Gerrard published Climate Change and U.S. Law in 2015, and she has produced two other significant books: Moving to Markets in Environmental Regulation, Lessons after Twenty Years of Experience (2006, with economist Charles Kolstad) and Government by Contract: Outsourcing and American Democracy (2009, with Harvard Law School Dean Martha Minow). Freeman also co-authors a leading administrative law casebook. Her work has been published in several languages; a volume of her administrative law articles was published in Chinese in 2010. In 2006, Freeman authored an amicus brief on behalf of former United States Secretary of State Madeleine Albright in Massachusetts v. Environmental Protection Agency, the global warming case decided by the Supreme Court in 2007; in 2015, she and her colleague Richard Lazarus co-authored an amicus brief on behalf of William D. Ruckelshaus and William K. Reilly, former Administrators of the Environmental Protection Agency, supporting the government in the litigation over the Obama administration's Clean Power Plan.
On New Year's Eve, tug crews were ordered by the US Coast Guard to cut the rig loose, leading to her grounding. Kulluk's movement south for the winter was at least in part motivated by an effort to avoid State of Alaska property taxes on oil and gas extraction equipment. The tax in question is a state property tax of 20 mills (or 2 percent) "on property used or committed by contract or other agreement for use for the pipeline transportation of gas or unrefined oil or for the production of gas or unrefined oil at its full and true value as of January 1 of the assessment year." The tax liability for the rig is estimated at between 6 and 7 million dollars, based on the value of the rig; however Shell may seek a filing extension to try to pay a lower tax rate given that the rig was grounded, potentially reducing her value, as of January 1.
V., Osterholz-Scharmbeck: Saade, c. 1987, p. 5. in order to raise money to make a living and build up their farms. By contract with the mire commission each colonist had to commit himself to replace the initial sod roofed A-frame shack by a solid farm building within the span of one year, however, so many failed that the commission already counted the presence of timber as fulfilment of that obligation, and thus some simple mire cottages () were still to be found in the 1930s.Johannes Rehder-Plümpe, „Die Gebäude der Findorff-Siedlungen“, in: Die Findorff-Siedlungen im Teufelsmoor bei Worpswede: Ein Heimatbuch, Wolfgang Konukiewitz and Dieter Weiser (eds.), 2nd, revis. ed., Bremen: Edition Temmen, 2013, pp. 125-146, here p. 128\. . As the soil was poor, the farming revenues remained meagre, and their recipients lived in poverty and often suffered from malnutrition and disease such as rickets and tuberculosis.Guido Boulboullé and Michael Zeiss, Worpswede: Kulturgeschichte eines Künstlerdorfes, Cologne: DuMont, 1989, pp. 40seq. .
Section 3 of the Act provides that, where the occupier is bound by contract to allow third parties into his property, "the [common] duty of care which he owes to them as his visitors cannot be restricted or excluded by that contract, but (subject to any provision of the contract to the contrary) shall include the duty to perform his obligations under the contract, whether undertaken for their protection or not, in so far as those obligations go beyond the obligations otherwise involved in that [common] duty".Occupiers' Liability Act 1957 Section 3(1) Existing common law rules imply, however, that while he could not exclude liability based on the contract, he could exclude liability with a sign disclaiming such, as with other visitors to the property.Payne (1958) p.369 Section 5 extends the common duty of care to those people entering, using, bringing or sending goods to the property under the terms of a contract.
In October 2005, she published an account of her experiences, One Woman's Army, in which she claims that the abuses were done by contract employees trained in Afghanistan and Guantanamo Bay, and sent to Abu Ghraib under orders from the Secretary of Defense Donald Rumsfeld. She said her demotion was political retribution. Since this time, some of Karpinski's claim of top-level authorization have been affirmed by revelations of what are known as the Torture Memos, legal opinions prepared by political appointees including John Yoo in the Office of Legal Counsel, Department of Justice. His memo of March 14, 2003, five days before the US began its invasion of Iraq, concluded that federal laws related to torture and other abuses did not apply to interrogators working overseas; it was issued to William J. Haynes, the General Counsel of DOD, and finally revealed in 2008 as a result of a Senate hearing into enhanced interrogation techniques.
Only the Federal government has the authority to limit the powers of a tribal government, and a non-Indian's consent is not needed (by contract or otherwise) to exercise its sovereignty, to the contrary, the tribe may set conditions and limits on the non-Indian as a matter of right. "To presume that a sovereign forever waives the right to exercise one of its sovereign powers unless it expressly reserves the right to exercise that power in a commercial agreement turns the concept of sovereignty on its head." Marshall then addressed the Commerce Clause issues, and the argument of the Solicitor General that the section of the Commerce Clause that dealt directly with Indians applied rather than the argument of the oil companies that the section dealing with interstate commerce applied. First, Marshall noted that the case history of the Indian Commerce Clause was to protect the tribes from state infringement, not to approve of Indian trade without constitutional restraint.
There are national emergencies which require that the Government should temporarily enter the field of business, but they must be emergency actions and in matters where the cost of the project is secondary to much higher considerations. There are many localities where the Federal Government is justified in the construction of great dams and reservoirs, where navigation, flood control, reclamation, or stream regulation are of dominant importance, and where they are beyond capacity or purpose of private or local government capital to construct. In these cases power is often a by-product and should be disposed of by contract or lease. But for the Federal Government deliberately to go out to build up and expand such an occasion to the major purpose of a power and manufacturing business is to break down the initiative and enterprise of the American people; it is the negation of the ideals upon which our civilization has been based.
Palmes, 109 U. S. 244. The court found that it was not an answer to this conclusion to say that the act of consolidation, having been made in pursuance of the tenth section of the charter of the Cairo and Fulton Railroad Company, was the exercise by that company of a right secured to it by contract which no subsequent Constitution or law of the State of Arkansas could impair or defeat. For what was the contract? Construed in the most liberal spirit in favor of the company, it cannot be extended beyond a stipulation on the part of the state that the Cairo and Fulton Railroad Company may at any time thereafter, by consolidation with any other railroad company, form and become a new corporation, with such powers and privileges as at the time when the offer is accepted and acted upon may be within the power of the state to confer, and lawful for the new corporation to accept.
Between 1902 and 2001 the company was a private limited company, later a limited liability company (SARL), constituted to build and operate the Benguela Railway concession, granted by the Portuguese government by contract of November 28, 1902, approved by decree of the same date. This contract, known as the "Williams Contract", was concluded between the Government of Portugal, represented by António Teixeira de Sousa, at the time Minister of the Navy and Overseas, and the Scottish engineer Robert Williams,"Gênese do Caminho de Ferro de Benguela", in Boletim da Sociedade de Geografia de Lisboa, Setembro- Outubro de 1929, pp. 330-331. who in exchange for the concession guarantees was obliged to build and operate a railway line from the port of Lobito to the eastern border of Angola, and respective branches in Angolan territory. Under the terms of that contract, the exploration concession was valid for 99 years and ended on November 28, 2001, reverting to the Angolan State, as successor to the Portuguese State in the respective contract, all fixed and current means of the company.Empresa.
Secondly, the FPA also allows the FPC to set aside a contract upon a determination that the rate is unlawful. The parties during the FPC proceeding had stipulated that a reasonable or fair rate of return (ROR) for PG&E; was 5.5%, and that the contract rate provided a ROR of 2.6% while the new filed rate schedule provided a ROR of 4.75%, which was the lowest that PG&E; stated it would accept. The FPC had in its order found that the 1948 contract rate to be unreasonably low and unlawful because of its low ROR. The Supreme Court, however, noted that while a regulatory agency such as the FPC may not normally impose upon a public utility a ROR that is less than the fair ROR, it did not follow that the public utility may not itself agree by contract to a ROR that is less than the fair ROR, or that if it does so, that it is entitled to regulatory relief of its improvident bargain.
The entry in the 1942 Annual Report of Smithsonian Institution begins with the statement "It is everywhere acknowledged that the Wright brothers were the first to make sustained flights in a heavier-than-air machine at Kitty Hawk, North Carolina, on December 17, 1903" and closes with a promise that "Should Dr. Wright decide to deposit the plane ... it would be given the highest place of honor which it is due" The following year, Orville, after exchanging several letters with Abbott, agreed to return the Flyer to the United States. The Flyer stayed at the Science Museum until a replica could be built, based on the original. This change of heart by the Smithsonian is also mired in controversy – the Flyer was sold to the Smithsonian under several contractual conditions, one of which reads: Researchers who promote the accomplishments of pioneer aviator Gustave Whitehead have commented that this agreement renders the Smithsonian unable to make properly unbiased academic decisions concerning any prior claims of 'first flight'.O'Dwyer, Major William J. History by Contract.
In Kosovo the copyright in the collective work lasts for seventy years after the lawful disclosure of the work, unless the natural persons who have created the work are identified as such in the versions of the work which are disclosed to the public. In case of identification of the authors, copyright will last for seventy years from the date of death of the last surviving author. Property rights and other copyrights pertaining to a database or collective work created during employment are considered to have passed to the employer exclusively and without limitations, unless the contract provides otherwise, A collective copyright work is a work created by collaboration of several authors, by combining their contribution separately into a whole such as encyclopedias, lexicons, databases, computer programs, collections and similar works at the initiative and under the direction of a natural or legal person as the ordering party. It is considered that the authors transfer unlimited and exclusive rights to all the material and other copyright in the collective work, unless otherwise provided by contract.
Herington Army Air Field was located eight miles from Herington, Kansas, on a 1,700-acre tract of land which had been purchased by the United States government. It was planned as a satellite of Topeka Army Airfield, a Second Air Force installation which was situated some 70 miles to the northeast and which served as the headquarters for the 21st Bombardment Wing. Construction of Herington Army Air Field, accomplished by contract under supervision of the Air Service Command, commenced in September 1942, and continued over a period of 14 months. Three runways were built with a dimension of 150 x 6750 feet, with a gross load capacity of 74,000 pounds, wheel load of 37,000 pounds. Runways and apron (500 x 4,750 feet) were constructed with a ten-inch gravel base placed in layers on a six-inch compacted earth subbase, and surfaced with one and one-half-inch asphalt cement; the service strip (80 feet wide) was a six-inch concrete slab, thickened to nine inches at the expansion and construction joints.
On April 9, 2009, Whedon rebutted speculation that Fox was set to cancel the show. Producer Tim Minear explained that the "missing" 13th episode (titled "Epitaph One") would be on the DVD release of the season. The reason Minear gave for that episode being dropped from the broadcast run was that the Fox network was counting the original first episode ("Echo"), which went unaired, as part of the original 13-episode order; in contrast, the Fox production company was required by contract to have a minimum of 13 completed episodes for international and DVD releases. According to both Minear and Whedon, the producers felt that the original first episode, having been subsequently scrapped entirely and having had its footage reused for other episodes throughout the season, should not be counted as a completed episode as part of their own 13-episode orders for international and DVD distribution but rather as a DVD extra, and thus Whedon produced a new 13th episode on a lower budget to fulfill the contractual requirements for the international broadcasts.
In February 1967, prior to the team's first spring training workouts, Womack signed a major league contract with the Yankees. On May 14, he was the winning pitching when Mickey Mantle hit his 500th career home run. Of the event, Womack said, "Most guys wouldn't have even thought of the pitcher at such an important time. His home run won the ball game for me, and after the game he came over and shook hands and thanked me for the opportunity to celebrate." He was the team's closer that season, going 5–6 with 18 saves and a 2.41 ERA in 65 games, tying Pedro Ramos for the club record in pitching appearances. In 97 innings, he allowed 80 hits and 35 walks, while striking out 57 batters. He led the team in appearances, games finished (48), saves and intentional walks (14) and finished second on the squad in ERA. He was second in the league in appearances, behind Minnie Rojas, and fourth in appearances and saves. Dissatisfied by contract offers proposed by the Yankees, Womack and fellow pitcher Al Downing did not initially report to spring training in 1968 — they were holding out for a better offer.
The Court, in a footnote quoted above (the Court's note 7), expressly refrained from stating any of the following: whether contractual language could overcome, or prevent triggering, the exhaustion doctrine; if so, what language would be effective to do so; and whether the surrounding circumstances would be relevant. To the extent that the exhaustion doctrine is grounded in considerations of public policy, and to the extent that the interests of the public and third parties (such as Quanta in the Quanta case) are to be considered as well as those of the contracting parties, the courts may be more likely to place limits on whether the parties can by contract make the doctrine inapplicable to the goods that are the subject of their contract. On the other hand, if the policy of the exhaustion doctrine is seen merely as a rule to make sure that downstream purchasers get fair notice that their use of goods whose purchase they are considering will be restricted, courts may be more likely to uphold such restrictions unless they collide with other policies, such as those of competition or antitrust law. The Court explicitly refused to consider this issue in Quanta.
