In January 2006, prosecutors called for the death penalty to be handed down on Chan, after earlier calls for the same demand against Sukumaran – the only two calls of death put forward by prosecutors for any of the Bali Nine. While judges in criminal cases can usually impose a harsher prison sentence than the one demanded by prosecution, the death penalty can be handed down only if the accuser has specifically decided to seek it. In the decades since Furman, new questions have emerged about whether or not prosecutorial arbitrariness has replaced sentencing arbitrariness. A study by Pepperdine University School of Law published in Temple Law Review, surveyed the decision-making process among prosecutors in various states. The authors found that prosecutors' capital punishment filing decisions are marked by local "idiosyncrasies", and that wide prosecutorial discretion remains because of overly broad criteria.

Minor crimes were often delegated to seigneurial courts where fines of up to 500 livres could be handed down. The Florida legislature passed a new statute to comply with the judgement in March 2014, and it also changed the sentencing method, requiring a 10 jurors supermajority to issue a sentence of death. If fewer than 10 jurors vote in favor of the death sentence, life imprisonment is imposed (there is no hung jury nor retrial). Previously, the judge decided the sentence alone, and the jury gave only a non-binding advice. This was also challenged and in October 2014, the Florida Supreme Court struck down the law by a 5–2 vote, finding that death sentences can only be handed down by a unanimous jury.

Italy has a form of bargaining, popularly known as patteggiamento but that has a technical name of penalty application under request of the parts. In fact, the bargaining is not about the charges, but about the penalty applied in sentence, reduced up to one third. When the defendant deems that the punishment that would, concretely, be handed down is less than a five-year imprisonment (or that it would just be a fine), the defendant may request to plea bargain with the prosecutor. The defendant is rewarded with a reduction on the sentence and has other advantages (such as that the defendant does not pay the fees on the proceeding).

The Italian criminal system has a statute limiting the time for prosecution of all crimes, apart from felonies punishable by life imprisonment, to a period of time equalling the maximum penalty provided for by law, which cannot, though, be less than six years for delitti (felonies) and four years for contravvenzioni (misdemeanours). It is not enough that the criminal suit be started before the statute of limitations runs out: it is the definitive sentence (possibly involving three trials) that must be handed down before the term expires. There is also another statute of limitations, limiting the time for enforcing a penalty, to a period of time provided for by law: twice the time to be served, or ten years in the case of a fine, when dealing with a felony; five years, when dealing with misdemeanours.
