The Human Rights Watch continues with their report that provides further details of abuse suffered by transgender women in detention facilities across the country. At the end of the report, Human Rights Watch also provided recommendations to Congress, the Department of Homeland Security, and Immigration and Customs Enforcement (ICE) on how to improve the safety of transgender individuals in detention. They asked Congress to bar ICE from holding transgender women in men's facilities and to bar ICE "from placing any immigration detainees in administrative segregation for indefinite periods as a form of protection or for any other reason." Additionally, they asked the DHS to expand and improve upon the 2015 Transgender Care Memorandum.

This utilization of equal treatment theory led to the adoption of intermediate scrutiny as a standard for sex discrimination on the basis that men and women should be treated equally when in similar situations. While equal treatment theory provides a sound framework for equality, application is quite tricky, as many critics question the standards by which men and women should be treated similarly or differently. In this manner, libertarianism and equal treatment theory provide good foundations for their agendas in sex segregation, but conceptually do not prevent it, leaving room for mandatory and administrative sex segregation to remain as long as separation is based on celebrated differences between men and women. Some forms of mandatory and administrative segregation may perpetuate sex segregation by depicting a difference between male and female employees where there is no such difference, as in combat exclusion policies.

One of the policies of supermax confinement among other policies is designed to increase punishment by removing gang members from the mainline population and subject them to solitary confinement, whether it is for a set amount of time or an indefinite duration. In a recent study, it noted that the California Department of corrections has implemented ways to fix their alleged gang problem, such as using 'confidential informants', segregating gang members, intercepting gang communications, setting up task forces to monitor and track gang members, locking up gang leaders in high security prisons, and 'locking down' entire institutions. These facilities, supermax prisons, were originally designed to contain and control the worst criminals and those who did not adhere to the rules of prisons, AKA "the worst of the worst". As of 2001, the count of inmates in administrative segregation in California was 5,982 representing an 80.2% change over time, but this number is not quite correct due to deficient files provided.

For their own safety, LGBT people in prison are sometimes placed in administrative segregation or protective custody. Although homosexuality is "generally regarded as a factor supporting an inmate's claim to protective custody", homophobia among prison officials and a misperception among many guards that "when a gay inmate has sex with another man it is somehow by definition consensual" mean that access to such custody is not always easy or available. Another problem is that protective and disciplinary custody are often the same, which means that prisoners in "protective housing" are often held with the most violent inmates in highly restrictive and isolated settings—sometimes in more or less permanent lockdown or solitary confinement—that prevent them from participating in drug treatment, education and job-training programs, from having contact with other prisoners or outside visitors, or from enjoying privileges such as the right to watch television, listen to the radio, or even to leave their cells. The degree of safety that protective custody provides depends on the facilities.
