They also added a section that limited expand of operations without consideration of noise.
She tends to act without consideration of others. The narrator interprets her habit of helping herself to his notebook and starting conversations with others at inopportune times as signs of her lack of inhibitions. At one point she is depicted as lecturing about math to another student who had no particular interest because the narrator was not there to listen to her. She tends to sulk when she feels that she is being ignored.
109 In the morning of 17 February, the fleets were about 6 km apart, the British forming a line and had captured Lawriston, while the French were scattered due to an error in interpreting night signals. Suffren formed a line without consideration for the order of battle,Cunat, p.111 and at 1500 he closed in within gun range, starting the Battle of Sadras. Suffren sustained about 30 men killed and 100 wounded,Cunat, p.
In others, teachers play a significant role in curriculum design and there are few top- down mandates. Curricular decisions within private schools are made differently from those made in public schools, and in most cases without consideration of NCLB directives. At times, an individual school district identifies areas of need within the curriculum. Teachers and advisory administrators form committees to develop supplemental materials to support learning for diverse learners and to identify enrichment for textbooks.

Don John brags to his valet about his latest exploits, Leonora emerges in the middle of the conversation, outraged by what she has just heard. She implores Don John to honour the engagement that binds them, but he dismisses her without consideration. Then six women enter who all claim to be the legitimate wife of Don John.
In physics and engineering, kinetics is the branch of classical mechanics that is concerned with the relationship between motion and its causes, specifically, forces and torques.kinetics. Encyclopædia Britannica OnlineKinetics must not be confused with kinematics, the study of motion without consideration of the physical circumstances causing it (see, e.g., ), which is a separate branch of classical mechanics. Since the mid-20th century, the term "dynamics" (or "analytical dynamics") has largely superseded "kinetics" in physics textbooks,See this discussion.
The cost index is calculated by dividing the per- hour cost of operating the plane by the cost of fuel. Generally a cost index of 999 gives ECON speeds as fast as possible without consideration of fuel and a cost index of zero gives maximum efficiency. ECON mode is the VNAV speed used by most airliners in cruise. RTA or required time of arrival allows the VNAV system to target arrival at a particular waypoint at a defined time.
For games, Mizuta is primarily focused on creating music that fits the title and the scene at hand, without consideration for how it might sound in isolation. On older consoles, the hardware restricted composers to three channels of audio. Working within these limitations, Mizuta was challenged to create strong, memorable melodies without the aid of atmospheric and accompanying lines. Even without such constraints in modern titles, he feels that this style has its merits and is worth preserving.
The Byzantines stipulated the restoration of Jarrahid governorship in Palestine under Fatimid suzerainty as a condition for peace, but az-Zahir refused. The Fatimids' rejection of this condition contributed to the collapse of the peace talks. The following year, the Jarrahids offered their loyalty to al-Dizbari in exchange for their former iqtaʿat in Palestine, but the attempt failed. The Fatimids and Byzantines ultimately concluded a ten-year peace treaty, without consideration of the Jarrahids' interests, in 1035.
James Brine, James Hammett, George Loveless, George's brother James Loveless, George's brother in-law Thomas Standfield, and Thomas's son John Standfield were arrested, found guilty, and transported to Australia. They became known as the Tolpuddle Martyrs. In the 1830s and 1840s, the Chartist movement was the first large-scale organised working class political movement which campaigned for political equality and social justice. Its Charter of reforms received over three million signatures but was rejected by Parliament without consideration.
Abrahams spent around 10 weeks in Nyasaland in 1946, taking evidence from colonial officials, estate owners and settlers, missionaries, African politicians and chiefs, and visiting almost all parts of the protectorate. He submitted his report in October 1946 and it was published in early 1947. Abrahams identified the main problem was the conflicting African and European concepts of land ownership. In addition, many European landowners either acted illegally towards tenants or exercised their rights harshly and without consideration of customary practices.
This description of school governance is simplistic at best, however, and school systems vary widely not only in the way curricular decisions are made but also in how teaching and learning take place. Some states or school districts impose more top-down mandates than others. In others, teachers play a significant role in curriculum design and there are few top-down mandates. Curricular decisions within private schools are often made differently from in public schools, and in most cases without consideration of NCLB.
The Führer, p. 255. Presaging this Nazi goal, Hitler wrote in Mein Kampf: "Without consideration of traditions and prejudices, Germany must find the courage to gather our people and their strength for an advance along the road that will lead this people from its present restricted living space to new land and soil, and hence also free it from the danger of vanishing from the earth or of serving others as a slave nation".Hitler (1971). Mein Kampf, p. 646.
Pellet exiting muzzle, with formula for energy overlaid. Muzzle energy is the kinetic energy of a bullet as it is expelled from the muzzle of a firearm. Without consideration of factors such as aerodynamics and gravity for the sake of comparison, muzzle energy is used as a rough indication of the destructive potential of a given firearm or cartridge. The heavier the bullet and especially the faster it moves, the higher its muzzle energy and the more damage it will do.
Deeds include conveyances, commissions, licenses, patents, diplomas, and conditionally powers of attorney if executed as deeds. The deed is the modern descendant of the medieval charter, and delivery is thought to symbolically replace the ancient ceremony of livery of seisin. The traditional phrase signed, sealed and delivered refers to the practice of seals; however, attesting witnesses have replaced seals to some extent. Agreements under seal are also called contracts by deed or specialty; in the United States, a specialty is enforceable without consideration.
Officially, the territory had belonged to the Crimean Khanate since the 1520s. The territory appeared as a consequence of the 1667 Treaty of Andrusovo, which divided the Cossack Hetmanate, without consideration of the local population between the Polish Crown and Muscovy. Since 1669, the Ottoman authorities granted protectorate to the Cossack statehood west of the Dnieper and designated it into a separate sanjak which was headed by Cossack Hetman Petro Doroshenko. It was confirmed by the Treaty of Buchach in 1672.
A bilateral offer can be revoked by the offeror at any time before acceptance. Under the firm offer rule, the fact that the offeror has promised the offeree to keep the offer open for acceptance for a certain period of time does not render such an offer irrevocable. It is because a promise without consideration is unenforceable in contract law. However, if the offeree provides consideration to the offeror for the purpose of keeping the offer open, then the offer becomes irrevocable.
This summary is based largely on the summary provided by the Congressional Budget Office, as ordered reported by the House Committee on Natural Resources on July 31, 2013. This is a public domain source. H.R. 1684 would require the United States Forest Service to convey, without consideration, 10 acres of federal land to the state of Wyoming. Based on information provided by the agency, the Congressional Budget Office (CBO) estimates that implementing the legislation would have no significant impact on the federal budget.
Only in the last 15 to 20 years have researchers begun to explore the extent to which computer technology could enhance the collaborative learning process. While researchers, in general, have relied on learning theories developed without consideration of computer-support, some have suggested that the field needs to have a theory tailored and refined for the unique challenges that confront those trying to understand the complex interplay of technology and collaborative learning.Stahl, G. (2002). Contributions to a theoretical framework for CSCL.
Giddens used concepts from objectivist and subjectivist social theories, discarding objectivism's focus on detached structures, which lacked regard for humanist elements and subjectivism's exclusive attention to individual or group agency without consideration for socio-structural context. He critically engaged classical nineteenth and early twentieth century social theorists such as Auguste Comte, Karl Marx, Max Weber, Émile Durkheim, Alfred Schutz, Robert K. Merton, Erving Goffman, and Jürgen Habermas. Thus, in many ways, structuration was "an exercise in clarification of logical issues."Giddens, A. (1993).
The Jim Thorpe Lifetime Achievement Award is the highest award presented by the Jim Thorpe Association. Without consideration of athletic accomplishments, the award recognizes a lifetime of achievement by people who "set the living examples that influence others to strive for the highest goals and leadership of men, and who blaze the trails of accomplishments which leave behind the pathways of tradition for others to follow." Only seven people have received this award since the association was founded in 1986.Lifetime Achievement Award .
She was then sent out to the East Indies under Suffren. Fortune and Annibal were the only two ships in the squadron not to have a copper sheathing. At the Battle of Porto Praya, her captain, Achille de Trémigon, failed to understand Suffren's intentions to illegally attack the British fleet without consideration for the Portuguese neutrality, and followed Héros into the harbour unprepared for battle. Trémigon was killed by a cannonball that struck his leg, and First Officer Morard de Galles assumed command.
Nonetheless, urban cemeteries which were heavily used were often very unhealthy. Receiving vaults and crypts often needed to be aired before entering, as decomposing corpses used up so much oxygen that even candles could not remain lit. The sheer stench from decomposing corpses, even when buried deeply, was overpowering in areas adjacent to the urban cemetery. Decomposition of the human body releases significant pathogenic bacteria, fungi, protozoa, and viruses which can cause disease and illness, and many urban cemeteries were located without consideration for local groundwater.
Mangroves are sensitive ecosystems, changing dynamically in response to storms, sediment blockage, and fluctuations in sea level and present a “moving target” for restoration efforts. Different restoration approaches face this challenge in different ways. The most common method simply consists in planting single-species stands of mangroves in areas thought to be suitable, without consideration of whether or not they supported mangroves in the past. This approach usually fails over the long term because the underlying soil and hydrological requirements of the mangroves are not being met.
For the execution of all of this we demand the formation of a strong central power in the Reich. Unlimited authority of the central parliament over the whole Reich and its organizations in general. The forming of state and profession chambers for the execution of the laws made by the Reich within the various states of the confederation. The leaders of the Party promise, if necessary by sacrificing their own lives, to support by the execution of the points set forth above without consideration.
The ASM Consortium developed a research proposal and was granted funding from the National Institute of Standards and Technology (NIST) in 1994. The focus of this work was addressing the complex human-system interaction and factors that influence successful performance for process operators. Automation solutions have often been developed without consideration of the human that needs to interact with the solution. In particular, alarms are intended to improve situation awareness for the control room operator, but a poorly configured alarm system does not achieve this goal.
James Maher had contracted with the city of Newport to collect all of the waste in the city for $137,000 per year for five years beginning in 1964. In 1967 Maher requested an additional $10,000 per year for refuse collection because of an unexpected increase in the number of dwellings in the city. Maher's request was approved, and a similar request the next year was also approved. The trial judge invalidated the extra payments because the modification of the contract was made without consideration.
In the photo series "Plastic Invader", which was mainly created in Shanghai in the summer of 2012, Vukovic searched for the traces of a grown and growing city in China. In doing so, she was able to document urban developments, sometimes in extreme dimensions. Ever larger, more extensive and extremely dense buildings being built without consideration of natural rhythms, whether of the inhabitants or the environment. Nature is displaced by plastic, by artificial things and buildings: an invasion of the plastic, the artificial, the non-natural.
Amongst men more so than women, it is highly favorable that psychological contract fulfillment and an official fair just treatment (procedural justice) be carried out. Whereas, in high power distance cultures employees are less likely to be themselves around authority; They are also less sensitive to insulting remarks, and more likely to accept an erroneous action from authority without consideration of fair treatment (procedural justice). For both low and high-power distance cultures, they perceived fair treatment to be a fulfillment of the psychological contract made by the organization.
Rukhṣa (Arabic رخصة, concession, alleviation, facilitation, permission, plural rukhaṣ رخص) is a technical term in the discipline of uṣūl al-fiqh in Islamic law that is mostly applied on ibadah. It is a special dispensation from performing an obligatory act or from submitting to a prohibition, as a result of a mitigating circumstance (ʿudhr). The result is the replacement of a command with an easier alternative in cases of need or duress. The opposite of rukhṣa is ʿAzīma (عزيمة, request) which means the request to observe the duty without consideration of any obstacles.
Sonderführer were called up to military service to use the skills and expertise of specialists on defined function positions. This status was limited as to time, and became revocable if a military trained soldier could fill this position. In this case, the Sonderführer was fit into the "regular" military training procedure etc. The former function position as Sonderführer – which contained a service "assignment" not including a service "grade" – remained without consideration. By order in 1942 – Sonderführer on officer assignments received regular military training, in order to join the reserve officer corps.
The later developments of Hasidism are unintelligible without consideration of Besht's opinion concerning man's proper relation with the universe. True worship of God, consists of the cleaving to, and the unification with, God. To use his own words, “the ideal of man is to be a revelation himself, clearly to recognize himself as a manifestation of God.” Mysticism, he said, is not the Kabbalah, which everyone may learn; but that sense of true oneness, which is usually as strange, unintelligible, and incomprehensible to mankind as dancing is to a dove.
Chinese ( or especially though not exclusively for written Chinese: ) is a family of East Asian analytic languages that form the Sinitic branch of the Sino-Tibetan languages. Chinese languages are spoken by the ethnic Han Chinese majority and many minority ethnic groups in China. About 1.2 billion people (around 16% of the world's population) speak a Chinese language as their first language. The varieties of Chinese are usually considered by native speakers to be regional variants of ethnic Chinese speech, without consideration of whether they are mutually intelligible.
Often this was done without consideration of the long-term consequences on municipal service delivery to Orange County residents. During the 1950s and early 1960s, some Orange County cities began to haphazardly add annex territory to their boundaries to serve newly developing areas. In addition, numerous special districts were created – many of them with overlapping boundaries, which created inefficiencies and higher costs for residents. To address these issues not only in Orange County, but throughout California, Local Agency Formation Commissions were established by the State Legislature in 1963 in each California county.
Accordingly, in April 1940, the division moved to the area south of Edinburgh, although elements were also based around Dumfries. The troops in Dumfries were also used to provide logistical support, for non-divisional assets, moving through the town en-route to Norway, as part of the Norwegian Campaign. In May, Kirke complained that "in spite of the fact that this Division has hitherto had an important defence role", it was being moved against his wishes and without consideration for his defensive plans. The division was then transported by rail to Wiltshire, to continue training.
The programme was created with a DIYer in mind. The costs, and thus any profit or loss for a given project, are assessed without consideration of the labour costs of the mechanic (the assumption is that a well-equipped and able enthusiast could complete all work him or herself) but if repairs require professional help, like body resprays, complicated electronics, or windscreen replacements, they are added to the final cost. Also addressed on each vehicle are its service history, bodywork defects (e.g. rust, dents), worn-out interiors and accessories.
The Upanishad adopts the Samkhya theory of three Guṇas or innate qualities, as being present in all beings. These three gunas are called: ' (goodness, constructive, harmonious), ' (passion, active, confused), and ' (darkness, destructive, chaotic).Alban Widgery (1930), The principles of Hindu Ethics, International Journal of Ethics, Vol. 40, No. 2, pages 234–237 The focus on "I", without consideration of its effect on other living beings, such as "I am the actor, I am the enjoyer" are considered Rajasic guna by those who have realized Brahman knowledge, states the text.
Once established, the Governor's Cabinet remains in effect until the Legislature supersedes the governor's organization. In early May 2000, Governor Frank Keating appointed Russell Perry as acting Secretary of Commerce and sent his nomination as full Secretary to the Oklahoma Senate for approval. However, his nomination was deemed rejected when the Oklahoma Legislature adjourned without consideration his nomination. In response, on May 26, 2000, Governor Keating issued Executive Order No. 2000-11, which abolished the Cabinet Department of Commerce and creating the Cabinet Department of Economic Development and Special Affairs.
He was born on 27 February 1859 as son of an Oberleutnant in the Austro-Hungarian Army. He entered the army in 1875 and by 1914 had become Feldmarschalleutnant and commander of the XVI Army Corps in Ragusa (today Dubrovnik). Promoted to Feldzeugmeister, he participated with his XVI Korps, as part of the 6th Army in the disastrous 1914 attack of Serbia. Commanding General Oskar Potiorek took all the blame for the failure, but Von Wurm had gained a reputation as a ruthless commander without consideration for his troops.
These include Diriyah, Manfuha and Wadi Laban. Unlike in the early days of development in Riyadh during which vernacular structures were razed to the ground without consideration, there is a new-found appreciation for traditional architecture. The Saudi Commission for Tourism and National Heritage is making efforts to revitalize the historic architecture in Riyadh and other parts of the kingdom. ;Ain Heet Cave Ain Heet cave has an underground lake (150 meters deep) situated at the face of Mount Al Jubayl in Wadi As Sulay in a small village called Heet in Riyadh.
Popular discussions of bonobos are a frequently cited example. Current research frequently expresses views such as that of the Natural History Museum at the University of Oslo, which in 2006 held an exhibition on animal sexuality: > Many researchers have described homosexuality as something altogether > different from sex. They must realise that animals can have sex with who > they will, when they will and without consideration to a researcher's > ethical principles. Other animal activities may be misinterpreted due to the frequency and context in which animals perform the behaviour.
In voting theory, non-dictatorship is a property of social choice functions which requires that the results of voting cannot simply mirror that of any single person's preferences without consideration of the other voters. The property of non-dictatorship is satisfied if there is no single voter i with the individual preference order P, such that P is always the societal ("winning") preference order. With other words, the preferences of individual i should not always prevail. Blind voting systems (with at least two voters) automatically satisfy the non-dictatorship property.
"--American Journal of International Law "...The scope, detail, and documentary rigor of [the book] make it an essential reference for future work in the field."-American Political Science Review "James Anaya has done for indigenous people in international law what Felix Cohen did for Native Americans in the United States. He has brought clarity, understanding, and order to a field previously understood only in isolated bits and pieces. It will now be impossible to think about this topic without consideration of Professor Anaya's prodigious research and deeply analytical jurisprudential and pragmatic insights.
While Brenner favored a cool, aseptic analytic technique, and opposed the idea that the transference could be separated off from the so-called working alliance,Malcolm, Impossible pp. and 45. he also challenged the mechanical use of the analysis of defences without consideration of the instinctual impulses involved.S. Akhtar, Comprehensive Dictionary of Psychoanalysis (2009) p. 69. Brenner pointed out that just as “it is presumptuous to act the analyst, unbidden, in a social or family situation. It is a technical lapse to be other than an analyst in one's relations with an analytic patient”.
After the end of apartheid allowed the consideration of the entire city of Johannesburg as one without consideration of race, it was determined that the previous structure of the city was wasteful and that there was much duplication of functions. Furthermore, some suburbs were affluent with well-established amenities while neighbouring areas lacked even the most basic of services. The new regions are presently smaller than previous mega-suburbs with each being home to about 300,000 people. The idea is that smaller regions are able to stay in closer contact with local communities.
In English law, the concept of legitimate expectation in the realm of administrative law and judicial review is estoppel's counterpart in public law. Promissory estoppel is often applied where there is a promise or an agreement made without consideration. When used as a defense by a defendant it is sometimes called a "shield", and when used affirmatively by a plaintiff it is sometimes called a "sword". It is most commonly used as a shield, with some commentators stating that it can only be used as a shield, although this varies with jurisdictions.
Those influenced by alcohol myopia are unable to comprehend this second set of cues, as the condition narrows an individual's ability for higher-level cognitive functioning. Therefore, these individuals tend to act rashly without consideration for the consequences of their actions. Studies have been conducted to test the effects of alcohol on the intensity of males’ aggressive response to external stimuli, demonstrating the role of inhibition conflict on alcohol myopia. Male subjects under the influence of alcohol often ignored external cues, both in laboratory settings and in real life situations.
View of Agadir following the earthquake Construction in Agadir progressed rapidly between 1945 and 1955, with specific conditions that may have contributed to the high degree of destruction. Challenging designs were often undertaken with untrained workers, and a lack of good supervision was typical, along with an accelerated effort to finish the job. As there had been no serious earthquakes prior to 1960, construction in the city had been done without consideration of seismic activity. Masonry buildings of more than one story did not fare well, but reinforced concrete structures varied dramatically in their response.
Constellations,12(3), 295-307. They point out that the actions of one state can and tend to affect the lives of women in surrounding territories, and even throughout the world with more powerful actors. Furthermore, the actions of non-state actors, especially those of international organizations, of the governmental and non-governmental varieties, have huge impacts on the lives of women without consideration of state borders. Likewise, communication at the scale it exists today can alter the lives of women, especially with "global mass media and cyber technology".
Wakeley championed the drift controls against the rest of the team, who found them aggravating. The game's lead artist, Ricky Berwick, had developed the vehicle concepts without consideration for their in-game function, and the vehicles were only later retrofitted to the gameplay. One of the robot vehicles was designed without an arm because the developers had run out of computer memory to store the data and liked the look anyway. Wakeley determined the game's high score "goal medal" objectives, in which players would attempt to better a set completion time on each level.
The act would require the BLM to convey the affected lands, without consideration, to the Powell Recreation District, which currently operates a shooting range on those lands. Because the act requires the district to pay all administrative costs associated with the conveyance, the CBO estimates that implementing S. 130 would have no significant impact on discretionary spending. In addition, the affected lands are not expected to generate receipts over the next 10 years under current law. S. 130 contains no intergovernmental or private-sector mandates as defined in the Unfunded Mandates Reform Act.
We demand the education at the expense of the state of outstanding intellectually gifted children of poor parents without consideration of position or profession. # The state is to care for the elevating national health by protecting the mother and child, by outlawing child-labor, by the encouragement of physical fitness, by means of the legal establishment of a gymnastic and sport obligation, by the utmost support of all organizations concerned with the physical instruction of the young. # We demand abolition of the mercenary troops and formation of a national army. # We demand legal opposition to known lies and their promulgation through the press.
His strength is also remarkable, breaking through Bansai's strings, stated to be as strong as steel, and pull down his helicopter, with nothing but raw power. In addition, his reflexes (while often downplayed for comedic purposes) are incredible, and he is capable of dodging, deflecting, or in some instances, throwing back knives, arrows and similar projectiles. One of his defining traits is his very high level of physical endurance. Gintoki fights without consideration his own life a majority of the time, giving him the ability to fight without limits, completely apathetic to crippling/massive or mortal injuries he sustains during combat.
Copernicus's heliocentric theory was inspired by the research of Aristotle and firmly followed the laws of natural science without consideration for divine intervention. That being said, at the introductory level Copernican theory was not entertained extensively because Peucer and other members of the circle believed the mechanisms to be too advanced for an introduction to planetary movements. At the Masters level, Copernican theory was covered more in depth, as well as treated with the same serious consideration Ptolemaic theory received. Peucer's work _Hypotyposes orbium coelestium_ states that the Copernican model could be utilized if two more spheres were added.
In many cases development proceeds without consideration of long- and short-term shoreline change, particularly erosion. Hundreds of millions of dollars of shorefront real estate is at risk due to both chronic, long-term erosion of coastal bluffs and episodic, storm- induced erosion of dunes and barrier beaches as well as worldwide increases in sea level. Several companies have seen the potential to make money on these developments and as a result a new industry of "Climate Change Risk Reporting" has formed. Online services promise to determine your risk of flooding due to climate change by using your physical address.
Granger has been defended by BYU Professor Steven Walker, who Stephanie Meyer has cited as the professor who had the greatest influence on her. Walker, who is also a believing Mormon, has commented that Granger has persuaded him that "Meyer’s religious thought is so crucial to her fiction that to read it without consideration of the theology is to miss much of the point", and that Granger's work succeeds in deepening Christian's reading of theology, showing that readers enter fully into the stories because of religious depths and heights which the Twilight novels share with the best English literature.
He shot the film in the style of a docudrama, using a minimum of dialogue. Megahey has stated that he was influenced in the making of the film by the Polish director Walerian Borowczyk, whose 1971 film Blanche also shows the fate of a young woman being decided by rich men, without consideration of her feelings or opinions. Like the earlier Whistle and I'll Come to You, Schalcken the Painter was listed as an episode of Omnibus. It aired on 23 December 1979, filling the slot traditionally taken in previous years by the BBC’s A Ghost Story for Christmas.
Zsoldos identified the castellan with Wytk Ludány, who came from a kindred of Bohemian origin, as Simon of Kéza's Gesta Hunnorum et Hungarorum preserved. The historian suggested that Wytk unlawfully tried to extend his influence over Sóvár by abusing the power of his position, but George Baksa and his nephew Sinka successfully repulsed the attack. Andrew III, whose whole reign was characterized by the confrontations with the oligarchs, regarded this act as a treachery without consideration of all aspects. After a few years of neglect, George Baksa regained his influence and confidence in the royal court.
The Federal Reserve made an additional $600 billion available for the purchase of financial assets. This prompted widespread criticism from China, Germany, and Brazil that the United States was using QE2 to try to devalue its currency without consideration to the effect the resulting capital inflows might have on emerging economies. Some leading figures from the critical countries, such as Zhou Xiaochuan, governor of the People's Bank of China, have said the QE2 is understandable given the challenges facing the United States. Wang Jun, the Chinese Vice Finance Minister suggested QE2 could "help the revival of the global economy tremendously".
Any living scientist is eligible for this award without consideration of race, sex, or nationality. Fourteen previous Aaronson Prize winners are returning to Tucson on Apr 3–4, 2017, for a scientific symposium in Marc's honor. Aaronson came to Steward Observatory as a postdoc after receiving his PhD degree from Harvard in 1977 and became an Associate Professor in 1983. His astronomical research focused on many of the most important problems of observational cosmology: the cosmic distance scale, the age of the Universe, the large-scale motion of matter, and the distribution of invisible mass in the Universe.
The 797 bus travels via Mulgoa Road and Floribunda Avenue, before arriving at Glenmore Park Shops and then looping around Surveyors Creek Road and The Lakes Drive, while the 799 bus travels via Mulgoa Road and Alison Drive, before arriving at Glenmore Park Shops, followed by a short trip around Shearwater Drive and Ridgetop Drive to St Andrews Drive, before returning the same way. A 2008 report in the Sydney Morning Herald described the suburb as "designed without consideration of public transport". According to the 2016 census 78.3% of residents travelled to work by car and 10% by public transport.
Since they do not qualify under the age criteria set for historic preservation nominations their historical aspect often escapes public recognition. Others frequently are threatened by demolition plans for new development without consideration of their cultural and historical importance to the community instead of motivating the implementation of plans to retain the buildings and integrate them into new plans. In 2006, the Sarasota County School Board slated one of Paul Rudolph's largest Sarasota projects, Riverview High School, for demolition. The board arrived at the decision despite protests by many members of the community, including architects, historic preservationists, and urban planners.
Salibi interprets Akhbar al-a'yan as the work of a Maronite layman, who wrote "as a Lebanese rather than a Maronite", without consideration to the theological activism of earlier Maronite historians such as Duwayhi and Ibn al-Qilai. Based in his reading of the chronicle, the historian Philip Hitti deemed it to be the work "a judge of the Shihab amirs and compiler of the annals of the feudal families of Lebanon". Asad Rustum commented on the Akhbar al-a'yan: "in a way, Shidyak's history is scarcely anything but an account of the Emir [Bashir]'s efforts to rid himself of his rivals".
Ogg is derived from "ogging", jargon from the computer game Netrek, which came to mean doing something forcefully, possibly without consideration of the drain on future resources. At its inception, the Ogg project was thought to be somewhat ambitious given the limited power of the PC hardware of the time. Although it is sometimes assumed that the name "Ogg" comes from the character of Nanny Ogg in Terry Pratchett's Discworld novels, the format's developers say that is not true. Still, to quote the same reference: "Vorbis, on the other hand is named after the Terry Pratchett character from the book Small Gods".
Justice Durham, writing for the 3-2 court, noted, "The fact that our constitution requires the state to prohibit polygamy does not necessarily mean that the state must deny any or all civil rights and privileges to polygamists." She noted that many things are crimes like polygamy, but we extend civil rights to perpetrators of those crimes. She stated, "It is not the role of the courts to make threshold exclusions dismissing without consideration, for example, the adoption petitions of all convicted felons, all persons engaging in fornication or adultery, or other persons engaged in illegal activities." Childbrides.
H.R. 993 would direct the United States Department of Agriculture to convey, without consideration, certain lands in Utah to the town of Fruit Heights City. Based on information from the Forest Service, the Congressional Budget Office estimates that implementing the legislation would have no significant impact on the federal budget. Enacting H.R. 993 would not affect direct spending or revenues; therefore, pay-as-you-go procedures do not apply. Under the bill, the Secretary of Agriculture would be required to convey about 100 acres of land within the Uinta-Wasatch-Cache National Forest to Fruit Heights City, Utah.
Crude oil map Main features of some qualities of crude oil Density and sulfur content of crude oils In the international petroleum industry, crude oil products are traded on various oil bourses based on established chemical profiles, delivery locations, and financial terms. The chemical profiles, or crude oil assays, specify important properties such as the oil's API gravity. The delivery locations are usually sea ports close to the oil fields from which the crude was obtained (and new fields are constantly being explored), and the pricing is usually quoted based on FOB (free on board, without consideration of final delivery costs).
Promissory estoppel is the doctrine that prevents a party from acting in a certain way because the first party promised not to, and the second party relied on that promise and acted upon it. In English law, a promise made without consideration is generally not enforceable, and is known as a gratuitous promise. For example, a car salesman promises not to sell a car over the weekend, but does so, the promise cannot be enforced. If however, the car salesman accepts one pound in consideration for the promise, the promise is binding and enforceable in court.
Joseph Estey Macmanus (born 1953) is an American diplomat who served as Executive Secretary of the United States Department of State from 2014 to 2017. Prior to that, he served as the U.S. Ambassador to International Organizations in Vienna from 2012 to 2014, as well as interim coordinator for efforts to implement President Barack Obama's Iran Nuclear Deal in 2015. He was President Donald Trump's nominee to become United States Ambassador to Colombia. This nomination was reported favorably by the Senate Committee on Foreign Relations in May 2018, but was returned to the President at the close of the 115th Congress without consideration by the full Senate.
Society decided to collect contribution of Rupees 3300/- per land holding of one Bigah and have completed the work of laying down pipeline successfully with 100% peoples participation. 10 check dams and 3 ponds are common properties of community, which they have decided to use for storage of water and not to waste for new construction. Now they have to distribute the water up to individual farms for that once again they have decided to get contribution of Rupees One Crore, which is also equal for all without consideration of distance of farms from storage locations. It reflects unity of villagers for any kind of challenge.
If performed without consideration for potential local environmental impacts, aquaculture in inland waters can result in more environmental damage than wild fisheries, though with less waste produced per kg on a global scale.Diamond, Jared, Collapse: How societies choose to fail or succeed, Viking Press, 2005, pp. 479–485 Local concerns with aquaculture in inland waters may include waste handling, side-effects of antibiotics, competition between farmed and wild animals, and the potential introduction of invasive plant and animal species, or foreign pathogens, particularly if unprocessed fish are used to feed more marketable carnivorous fish. If non-local live feeds are used, aquaculture may introduce exotic plants or animals with disastrous effects.
The AP began selecting All-Pros in 1940, and is the longest running annual selector of the top NFL players. The All-Pro Team is an annual selection of the best players in the NFL by position as selected by a national panel of AP media members. Unlike selection to the Pro Bowls, votes are cast for outstanding players by position without consideration for whether the player competes in the American Football Conference (AFC) or National Football Conference (NFC). The first team consists of the top one or two players at each position; the second team consists of the runners-up at each position.
The government declared a state of emergency; however, regional elections went ahead, and the FLNKS won control of three out of four provinces. The centre-right government elected in France in March 1986 began eroding the arrangements established under the Socialists, redistributing lands mostly without consideration of native land claims, resulting in over two-thirds going to Europeans and less than a third to the Kanaks. By the end of 1987, roadblocks, gun battles and the destruction of property culminated in the Ouvéa cave hostage taking, a dramatic hostage crisis on the eve of the presidential elections in France. Pro-independence militants on Ouvéa killed four gendarmes and took 27 hostage.
In 1910, hoping to save the younger brother from police action, Dhan Gopal's family sent him to Japan to study industrial machinery. Although he was initially fascinated with the positivistic spirit of industrialisation, later he became deeply disillusioned by the assembly line method of production and proclivity towards sheer efficiency which he viewed as dehumanising, degrading and debasing. He was particularly shocked by how assembly line workers who had suffered serious accidents were quickly replaced by other workers, without consideration by the factory owners or employers for either their medical recovery, health benefits or adequate compensation. After a short stay in Japan, he boarded a ship for San Francisco.
Under Article 227, a victim must still consent to the marriage, with the option available to her to refuse the marriage. Marry-your-rapist laws raise debate as to the appropriateness of such laws in the cultural context of a country like Tunisia. Opponents of Article 227 in Tunisia criticise the “second assault on a rape survivor’s rights” that the law supports by trapping the victim in a marriage to her rapist. Issue has been raised with Article 227 as it assumes that the best remedy for a victim of rape is marriage, without consideration of her own rights to freedom, dignity and autonomy.
If the delegatee fails to perform satisfactorily, the obligee may elect to treat this failure as a breach of the original contract by the delegator or may assert himself as a third party beneficiary of the contract between the delegator and the delegatee, and can claim all remedies due to a third party beneficiary. If the delegation is without consideration, the delegator remains liable for nonperformance, while the delegatee will not be liable to anyone for anything. Unlike an assignment, a delegation is virtually always for consideration, and never donative - few people are going to accept the charitable offer to perform a task contracted to someone else.
One of its most well- known initiatives was the development of a draft Universal Declaration of Human Responsibilities, which was an attempt to propose a set of responsibilities that were shared by all individuals to counterbalance the United Nations Universal Declaration of Human Rights. This new "global ethic" would provide a foundation of freedom, justice and peace in order for universal rights to be meaningful. These agreed values and standards complement universal rights, as the maximization of personal freedom at the expense of others, without consideration of others, is as problematic as having no rights at all. The current Secretary General is Tom Axworthy (2011-present).
It was "most unwisely and improvidently drawn by some one who gave but little thought to it, and was undoubtedly passed without consideration; and in our former opinion, when its provisions were pressed upon our attention, we were compelled to disregard them". Even so, the court held, the Act of August 7, 1895, acted as a repeal of the Act of December 21, 1893. This left the method of condemnation specified in the second part of the Act of August 7 inconsistent and unenforceable. But with the requirement to open North Capitol Street now repealed, the commissioners were not obliged to take the land.
Consideration will be found if a party promises to perform where there are unforeseen and/or unforeseeable circumstances sufficient to discharge the party from the obligation if any new or different consideration is promised (earlier payment or payment in stock), the promise is to ratify a voidable obligation (such as to go through despite fraud), the preexisting duty is owed to another person, and there is an honest dispute as to the duty. Also, under the Uniform Commercial Code, modifications may be made free of the Common Law legal duty rule even without consideration provided that the modification is made in good faith. See UCC § 2-209.UCC UCC However, the Statute of Frauds must be complied with.
Bearing in mind the many centuries that separate Denis from the present, an impression of his personality can be gathered from the historical record: he was determined, even obstinate, in his attempts to systematically centralise the government and consolidate royal power. For example, he launched general inquiries (Inquirições gerais) at a remarkably accelerated pace to investigate land ownership and identify cases where abuses were committed. Denis revealed early on his ability as an effective strategist in the pursuit of his goals, and as an innovator of proactive legislative policy. With the benefit of hindsight, it is clear that his administrative decisions were not made randomly or without consideration of his ideal of a well-governed nation.
Under the new rules, each district nominated one representative, who would represented a wide range of interests for their district. A separate party-list was introduced for voters to choose their favored party (in addition to votes for individual candidates) as a way to more accurately approximate the seats in the House of Representatives of Japan to the actual party votes in an effort to achieve more proportional representation. With only a single member in each district, this change allows for additional district-wide benefits. This is opposed to the preceding multi-member district wherein each representative appeals to either policy or geographic-based benefits or narrow set of interests in their constituencies without consideration for party interest.
Pre-bankruptcy equity holders may not, over the objection of a senior class of impaired creditors in a Chapter 11 plan, contribute new capital and receive ownership interests in a reorganized entity, when the opportunity is given only to the old equity holders under a plan adopted without consideration of alternatives. Rather, in order not to violate the absolute priority rule, a plan conferring an interest to old equity must extend an opportunity to others who may compete for the equity (e.g. at auction) or who may propose a competing reorganization plan. Cram down is barred if a junior interest (old equity) holder under a proposed Chapter 11 plan receives or retains property “on account of” such junior interest.
Selective acceptance involves taking as fact self-flattering or ego-enhancing information with little regard for its validity. Selective refutation involves searching for plausible theories that enable criticism to be discredited. A good example of selective acceptance and refutation in action would be: Selective acceptance is the act of accepting as valid an examination on which one has performed well without consideration of alternatives, whereas selective refutation would be mindfully searching for reasons to reject as invalid an examination on which one has performed poorly. Concordant with selective acceptance and refutation is the observation that people hold a more critical attitude towards blame placed upon them, but a more lenient attitude to praise that they receive.
Many human performance models share key features with Artificial Intelligence (AI) methods and systems. The function of AI research is to produce systems that exhibit intelligent behavior, generally without consideration of the degree to which that intelligence resembles or predicts human performance, yet the distinction between AI methods and that of HPM is at times unclear. For example, Bayesian classifiers used to filter spam emails approximate human classification performance (classifying spam emails as spam, and non-spam emails as importation) and are thus highly intelligence systems, but fail to rely on interpretation of the semantics of the messages themselves; instead relying on statistical methods. However, Bayesian analysis can also be essential to human performance models.
The rhetoric and composition pedagogy developed in the late nineteenth century, and still used in many schools today, is known as current-traditional rhetoric, commonly referred to among field scholars, and hereinafter, as "CTR". CTR is defined by an emphasis on the final product, usually the five-paragraph, informal essay or short research paper on an objective topic. In addition, CTR centers around the notion that discourse is delivered in a prescribed, mechanical form, leading to its pedagogical focus on grammar, spelling, syntax, and uniform style and arrangement. Further, CTR promotes the idea that the purpose of writing is the product, which is expected to reflect a predefined, stagnant reality without consideration for process, authorial identity, or audience.
Eliot founded the school "to fit [students] for public service both in church and in commonwealth in succeeding ages," and the school still considers instilling a desire to perform public service among its principal missions. The school's endowment is estimated at $189 million, Roxbury Latin School Fact Sheet the largest of any boys' day school in the United States. The school maintains a need-blind admissions policy, admitting boys without consideration of the ability of their families to pay the full tuition. Its previous headmaster, F. Washington Jarvis, who retired in the summer of 2004 after a 30-year tenure, published two books about Roxbury Latin: a history of the school and a collection of his speeches to boys at Roxbury Latin (With Love and Prayers).
Hildebrand focused on ethics more than on any other branch of philosophy. Throughout his ethical works, Hildebrand distinguishes three ways in which human choices and actions are motivated: # We can be motivated by the subjectively satisfying, that is, by what is pleasing to us as individuals, without consideration of what objectively fulfills our nature or is important in itself. # We can be motivated by the objective good for persons, that is, by what objectively fulfills the needs, abilities, appetites, and desires that we have insofar as we have human nature. # We can be motivated by values or what is important in itself, that is, by what calls for a certain response as due to it, without reference to our own fulfillment or satisfaction.
In December 2012, a study published in the journal Science claimed new tests had suggested the Grand Canyon could be as old as 70 million years. However, this study has been criticized by those who support the "young canyon" age of around six million years as "[an] attempt to push the interpretation of their new data to their limits without consideration of the whole range of other geologic data sets." The canyon is the result of erosion which exposes one of the most complete geologic columns on the planet. The major geologic exposures in the Grand Canyon range in age from the 2-billion-year-old Vishnu Schist at the bottom of the Inner Gorge to the 270-million-year-old Kaibab Limestone on the Rim.
He also challenged, in a friendly letter to the scientist and writer Ernesto Sábato, the notion that the middle classes had embraced Peronism out of resentment towards the wealthy: Jauretche's proposal was one of integration, whereby the common interest of the bourgeoisie and proletariat would be served by the development of a solid national economy. This position, which was difficult to reconcile with the populism of Peronism, attracted the enmity both of economic liberals and the justicialist leadership. In Los profetas del odio, Jauretche identified the chief enemies of national development as the liberal and cosmopolitan intelligentsia, whose fascination with European culture led them to apply European solutions uncritically to Argentine problems, without consideration for historical differences and the continents' distinct places in the international community.
During his term as governor, Altgeld expressed certain opinions on how buildings should be erected in the state of Illinois. In his second biennial message to the state legislature, he discussed how buildings were being constructed without consideration for their outward appearance. He stated that it was time for buildings to become more aesthetically pleasing in addition to being functional, and he suggested the "Tudor-Gothic style" as the most inexpensive way to do this. Consequently, several of the state universities in Illinois erected buildings which resembled castles in his honor. College folklore states that these buildings have aligned corridors and rooms so that they could all be “put together” to create one large building, but there is no evidence to support this rumor.
23 of Act no. 204/1910, shows "the absolute inconsistency and absurdity of the thesis" of Auriti, according to which "the supply of money would be made by the Bank of Italy, charging the state and society at large the full amount without consideration." Therefore, the Bank concludes, "there is no experience of anything arbitrary or unlawful within the prerogatives exercised by the Central Bank in the monetary field, because, contrary to what is alleged by the plaintiff, the whole subject is fully regulated by the legislature, so assigned or that any matter relating to the exercise of the function of emission can be said to be regulated by customs interpret and, least of all, by customs violation of law." The request was rejected and the Court condemned Auriti to pay the legal costs.
While France is considered to have been worst affected, the blight also did a great deal of damage to vineyards in other European countries. How the Phylloxera aphid was introduced to Europe remains debated: American vines had been taken to Europe many times before, for reasons including experimentation and trials in grafting, without consideration of the possibility of the introduction of pestilence. While the Phylloxera was thought to have arrived around 1858, it was first recorded in France in 1863, near the former province of Languedoc. It is argued by some that the introduction of such pests as phylloxera was only a problem after the invention of steamships, which allowed a faster journey across the ocean, and consequently allowed durable pests, such as the Phylloxera, to survive the trip.
Writers may also make the magic of the fairy tale self- consistent in a fantasy re-telling, based on technological extrapolation in a science fiction, or explain it away in a contemporary or historical work of fiction. Other forms of fantasy, especially comic fantasy, may include fairy tale motifs as partial elements, as when Terry Pratchett's Discworld contains a witch who lives in a gingerbread house, or when Patricia Wrede's Enchanted Forest is rife with princesses and princes trying to fit in their appointed fairy tale roles. The settings of fairytale fantasies, like the fairy tales they derive from, may owe less to world-building than to the logic of folk tales. Princes can go wandering in the woods and return with a bride without consideration for all the political effects of royal marriages.
The three lawsuits were consolidated into a single case within the United States District Court for the Southern District of California by Judge Gonzalo P. Curiel. Oral arguments were heard in February 2018, and Curiel ruled by the end of the month in favor of the government, citing that the Department of Homeland Security has several waivers in its authorization to expedite construction of border walls, which includes bypassing the EIS statement. Curiel had written his opinion without consideration of the other political issues regarding the border wall, ruling only on the environment impact aspect. The ruling was challenged to the U.S. Supreme Court by the Sierra Club, Defenders of Wildlife, and the Animal Legal Defense Fund, but the Court denied their petition for writ of certiorari by December 2018, allowing Curiel's decision to stand.
The most common fantasy world is one based on medieval Europe, and has been since William Morris used it in his early fantasy works, such as The Well at the World's End.Diana Waggoner, The Hills of Faraway: A Guide to Fantasy, p 37, and particularly since the 1954 publication of J.R.R. Tolkien's The Lord of the Rings. Such a world is often called "pseudo-medieval"—particularly when the writer has snatched up random elements from the era, which covered a thousand years and a continent, and thrown them together without consideration for their compatibility, or even introduced ideas not so much based on the medieval era as on romanticized views of it. When these worlds are copied not so much from history as from other fantasy works, there is a heavy tendency to uniformity and lack of realism.
"Tomorrow Never Knows" is a song by the English rock band the Beatles, written primarily by John Lennon and credited to Lennon–McCartney. It was released in August 1966 as the final track on their album Revolver, although it was the first song recorded for the LP. The song marked a radical departure for the Beatles, as the band fully embraced the potential of the recording studio without consideration for reproducing the results in concert. When writing the song, Lennon drew inspiration from his experiences with the hallucinogenic drug LSD and from the book The Psychedelic Experience: A Manual Based on the Tibetan Book of the Dead by Timothy Leary, Richard Alpert and Ralph Metzner. The Beatles' recording employed musical elements foreign to pop music, including musique concrète, avant-garde composition and electro-acoustic sound manipulation.
A Donation, when referred to in canon law in the Roman Catholic Church, is defined as the gratuitous transfer to another of some right or thing. When it consists in placing in the hands of the donee some movable object it is known as a gift of hand (donum manuale, an offering or oblatio, an alms). Properly speaking, however, it is a voluntary contract, verbal or written, by which the donor expressly agrees to give, without consideration, something to the donee, and the latter in an equally express manner accepts the gift. In Roman law and in some modern codes this contract carries with it only the obligation of transferring the ownership of the thing in question; actual ownership is obtained only by the real traditio or handing over of the thing itself, or by the observation of certain juridically prescribed formalities.
Avadhūta (IAST ') is a Sanskrit term from the root 'to shake' (see V. S. Apte and Monier-Williams) that, among its many uses, in some Indian religions indicates a type of mystic or saint who is beyond egoic-consciousness, duality and common worldly concerns and acts without consideration for standard social etiquette. Avadhuta is a Jivanmukta who gives his insight to others and teach them about his realisation of the true nature of the ultimate reality (Brahman) and self (Atman) and takes the role of a guru to show the path of moksha to others.Roaming: Webster's Quotations, Facts and Phrases (accessed: Sunday May 9, 2010) Some Avadhuta also achieve the title of Paramahamsa. Similar figures (colloquially called 'mad/crazy monks') are also known in Buddhist traditions, such as the medieval Zen monk Ikkyū, and the 20th century Tibetan tulku Chögyam Trungpa Rinpoche.
This summary is based largely on the summary provided by the Congressional Research Service, a public domain source. The Ranch A Consolidation and Management Improvement Act would direct the Secretary of Agriculture (USDA), acting through the Forest Service, to convey to Wyoming, upon state request, without consideration and by quitclaim deed, all interest of the United States in approximately 10 acres of National Forest System land located in the Black Hills National Forest in Crook County, Wyoming. The bill would repeal the requirement that Ranch A be used for: (1) fish and wildlife management and educational activities; and (2) maintenance and restoration of the museum-quality real and personal property there. It would repeal as well the reversionary interest of the United States in the property if the state of Wyoming uses it for any other purpose or develops the property.
At this time, Neto came to be seen as a figure in Tropicalism, having written the breviary "Tropicalismo para principiantes" ("Tropicalism for Beginners"), in which he argued for the necessity of creating a genuinely Brazilian "pop": "Accept completely all that the life of the tropics can give, without preconceptions of aesthetic order, without consideration of tackiness or bad taste, solely living the tropical and the new universe it contains, still unknown." Neto was also an important lyricist of iconic songs of the tropicalist movement. At the end of the 1960s, after the exile of his friends Gil and Caetano under the military dictatorship, he traveled to Europe and the United States with his wife Ana Maria and lived in London for a brief period. On returning to Brazil in the early 1970s, Neto began to isolate himself, feeling alienated by both the military regime and the "ideological patrols" of the left.
This summary is based largely on the summary provided by the Congressional Research Service, a public domain source. The Natchez Trace Parkway Land Conveyance Act of 2013 would require the Secretary of the Interior to convey to Mississippi, by quitclaim deed and without consideration, all interest of the United States in two parcels of identified land totaling approximately 67 acres. The bill would require the deed of conveyance to the parcel of land located southeast of U.S. route 61/84, and which is commonly known as the bean field property, to reserve an easement to the United States that restricts the use of such parcel only to uses which are compatible with the Parkway. Finally, the bill would adjust the boundary of the Natchez Trace Parkway to exclude the conveyed land and provides for inclusion in the Parkway of the approximately 10 acres identified as the proposed addition.
The channel name CarniK Con was derived by Dugan Ashley, Randy Broshankle and Stanley Childs in 2012. The name is a compression of Carnivorous Kinetic Concepts. Initially, the three considered filming episodes in traditional firearms coverage fashion, without consideration of the comedy that the channel is known for. “But we did our research and thought this was the way to take things up a notch.” They began writing and filming in November 2012. Dugan Ashley also writes the music featured in their videos along with Ted Craig who joined the group and began co-writing soon after CarniK Con’s inception. The first video the channel released is simply titled “CarniK Con Opener.” It is the opening title sequence of the show that plays at the beginning of most episodes, ending with Randy wearing American flag patterned apparel firing a machine gun with the words excellence displayed behind him.
Fowler began the 2001–02 season controversially, after being dropped by the then manager Gérard Houllier from the Liverpool squad for the 2001 Charity Shield match, following a training ground confrontation with assistant manager Phil Thompson. He made an appearance in Liverpool's 3–2 European Super Cup victory over Bayern Munich, but starts were intermittent. In October 2001, he scored his first league hat-trick for three years, helping Liverpool beat Leicester City 4–1, but was dropped for the following league match. Though Fowler had been on a contract extension from 1999 (unlike Steve McManaman – who exercised his Bosman entitlement the very same year), Fowler was linked to Lazio, Arsenal and Leeds United, and Liverpool's management as well as fans and the media constantly reported that what happened with McManaman (regarded as a huge financial loss) would never be repeated and thus the club never rejected those bids without consideration.
This principle has been upheld in case law, such as the case of R v Eccles Justices, ex parte Farrelly (1992) in which the Queen's Bench Divisional Court quashed convictions because a court clerk had apparently participated in the decision making process. A justices' clerk has the powers of a single magistrate, for example to issue a summons, adjourn proceedings, extend bail, issue a warrant for failing to surrender to bail where there is no objection on behalf of the accused, dismiss an information where no evidence is offered, request a pre-sentence report, commit a defendant for trial without consideration of the evidence and make directions in criminal and family proceedings.Justices’ Clerks’ Rules 2005 The justices' clerk may delegate these functions to a legal adviser (referred to as "assistant justices' clerk" in the relevant legislation). The Role of the Justices' Clerk and the Legal Adviser, Justices' Clerks' Society, December 2008.
Bermuda became important for British Security Co-ordination operations with the ability to vet radio communication and search passengers and mail using flying boats to transit the Atlantic, with over 1,200 people working on opening packages secretly, finding coded messages, secret writing, micro dots and identifying spies working for Nazi Germany, Fascist Italy and Vichy France in the Americas, much of the information found being passed to the FBI. The Island was a base for direction finding equipment to help identify locations of German submarines and took down Enigma encoded messages, which were sent for Cryptanalysis of the Enigma to Bletchley Park. In 1941, the United States signed a lend-lease agreement with the United Kingdom, giving the British surplus U.S. Navy destroyers in exchange for 99-year lease rights to establish naval and air bases in certain British territories. Although not included in this trade, Winston Churchill granted the US similar 99-year leases "freely and without consideration" in both Bermuda and Newfoundland.
The ruins of Šebeš (Sebeskő) Castle near Podhradík, Slovakia, owned by Sinka Sebesi and his descendants Sinka's role in this incident perhaps remained undiscovered, as he was able to participate in the royal campaign against the rebellious Roland Borsa, Voivode of Transylvania, when Andrew laid siege to Borsa's fort at Adorján (present-day Adrian in Romania) in the summer of 1294. Sinka injured during the siege, which lasted three months before the fort fell to Andrew in October. In 1297, Andrew III sent auxiliary troops to the Kingdom of Poland in order to provide assistance to his first wife's uncle Władysław Łokietek, Duke of Greater Poland against Henry III, Duke of Głogów.
They insisted that "a Catholic Christian is not free to form his conscience without consideration of the teaching of the magisterium, in the particular instance exercised by the Holy Father in an encyclical letter". Catholics for Choice stated in 1998 that 96% of U.S. Catholic women had used contraceptives at some point in their lives and that 72% of U.S. Catholics believed that one could be a good Catholic without obeying the church's teaching on birth control. According to a nationwide poll of 2,242 U.S. adults surveyed online in September 2005 by Harris Interactive (they stated that the magnitude of errors cannot be estimated due to sampling errors, non-response,etc.), 90% of U.S. Catholics supported the use of birth control/contraceptives. A survey conducted in 2015 by the Pew Research Center among 5,122 U.S. adults (including 1,016 self-identified Catholics) stated 76% of U.S. Catholics thought that the church should allow Catholics to use birth control.
This summary is based largely on the summary provided by the Congressional Research Service, a public domain source. The Powell Shooting Range Land Conveyance Act would direct the Secretary of the Interior to convey to the Powell Recreation District in Wyoming, without consideration, the land managed by the Bureau of Land Management (BLM) in the Wind River District and identified as the Powell Gun Club for use as: (1) a shooting range, or (2) for any other public purpose consistent with the uses allowed under the Recreation and Public Purposes Act. The bill also instructs the Secretary of the Interior to require the Powell Recreation District to pay all survey and other administrative costs necessary for the preparation and completion of any patents for, and transfers of title to, such land. The bill also requires the conveyed land to revert, at the discretion of the Secretary, to the United States if such land ceases being used for a public purpose.
The above limits of legal possession apply to the total combined property of the cardholder, caregiver, and grower. If a grower is growing plants for more than one cardholder, he or she may possess up to 18 immature plants per cardholder. A grower may not grow plants for more than four cardholders at a time. Also, in addition to legal possession and manufacture as outlined above, cardholders, caregivers, and growers may legally deliver marijuana to each other, and to other cardholders, so long as the delivery is made without consideration. The privileges which normally protect cardholders, caregivers, and growers from citation, arrest, and penalty do not excuse possession, manufacture, or delivery in cases where they are simultaneously guilty of certain offenses listed in ORS 475.316, such as driving under the influence of marijuana or using marijuana in public. In 1994, Portland cannabis activist Chris Iverson, who was chairman of the NW Hemp Foundation opened the first cannabis buyers club in Oregon.
Existential nihilists will refute this as a play on words by critics to blur the distinction between universal truth and the entire conception of truth. They would argue that the fact that a person edited an article about nihilistic paradoxes is objectively true (though epistemological nihilists and metaphysical nihilists would both question this) since the article was edited by someone, but that the editor and action itself has no more "universal" meaning than the existence of disease or the creation of life via sex. It is unfair, existential nihilists would argue, to denigrate a philosophy which simply denies the absence of universal truth in a moral sense (the idea that there is a moral God or Gods who designed the world and people with an innate morality and purpose) as one that happily rejects meaning without consideration for the logic of the universe. Secondly, it isn't a paradox in the sense that all truths result in the Münchhausen trilemma, and every truth claim can be traced back to an axiom, circular argument, or infinite regress.
Dungeon Crawl Stone Soup is a roguelike game where the player creates a character and guides it through a dungeon, mostly consisting of persistent levels, full of monsters and items, with the goal of retrieving the "Orb of Zot" (a MacGuffin) located there, and escaping alive. To enter the Realm of Zot where the Orb is located, the player must first obtain at least three "runes of Zot" of the 15 available; these are located at the ends of diverse dungeon branches such as the Spider Nest, Tomb, and Slime Pits. The game has an explicit design philosophy intended to provide interesting strategic and tactical choices within a balanced game; to offer replayability based on random dungeon generation; to make the game accessible and enjoyable without deep knowledge of its internal mechanics; and to present a friendly user interface that can optionally automate several tasks like exploration and searching for previously seen items. Conversely, the developer team seeks to avoid providing incentives for repeating boring actions without consideration, or providing illusory gameplay choices where one alternative is always superior.
Led by Llewellyn Briggs,Richard Hughes (2003) Capricorn: David Stirling's African Campaign, The Radcliffe Press, p180 the Independent Group was a European party that called for ministerial positions to be awarded without consideration for the racial makeup of the cabinet, using the slogan "Merit and Ability",Kenya from Mau Mau to Independence Michael Farquhar effectively seeking to exclude Africans from government.William Ernest Frank Ward (1963) A History of Africa: Egypt and the Sudan. The UPMAA was subsequently promulgated in 2012 by the ULC to clarify and modernize inconsistent state laws, and create a uniform approach to all prenuptial agreements and postnuptial agreements that: # Requires marital agreements to be in writing and declares them to be enforceable without consideration, modernizing existing state laws; # Offers couples a flexible framework for premarital agreements that promotes responsible planning and informed decision-making; and # Provides courts in every state a framework for determining an agreement's validity, regardless of where it was executed. Why States Should Adopt the Uniform Premarital and Marital Agreements Act, 2012, Uniform Law Commission, National Conference of Commissioners on Uniform State Laws. The laws enacted by states adopting the UPAA/UPMAA do have some variances from state-to-state, but this framework of laws has certainly made it much easier for legal practitioners to prepare enforceable marital agreements for clients by clearly stating the requirements. For instance, under Florida law, there is a very material difference in what is required to enter into a legally binding prenuptial agreement versus a postnuptial agreement.
GeoHazards International's work in Nepal gained heightened media attention in the aftermath of the country's April 25, 2015 earthquake, its May aftershock, and other later aftershocks. Around two weeks before those earthquakes, GeoHazards International published a warning that "the 1.5 million people living in the Kathmandu Valley were clearly facing a serious and growing earthquake risk," because an absence of any building code had meant most construction had taken place without consideration of natural disaster risk, technical information about earthquake risk in the Kathmandu Valley was incomplete and dispersed among several governmental agencies, and rapid population growth with one of the highest urban densities in the world made it challenging for Nepal's preliminary progress on reducing its earthquake vulnerability to occur quickly enough. In the aftermath of the Nepal earthquakes, a rush of non-profits, NGOs, family foundations, relief organizations, and individual donors looked to raise money to rebuild the damaged Nepalese infrastructure. In a publication on their website a week after the first earthquake and its aftershocks, Tucker warned that well- meaning people might inadvertently recreate the conditions that made the recent earthquake so devastating, due to their lack of experience or expertise in building earthquake-resistant buildings.
