A same-sex marriage in the United Kingdom Same-sex marriage in the United Kingdom has been the subject of wide debate since the decriminalisation of homosexuality in Britain. However, the Church failed to influence the June 1996 removal of the constitutional prohibition of divorce. It was compiled in close concert with dicasteries that have a related competence, namely, the Congregation for the Doctrine of the Faith, the Congregation for Divine Worship and the Discipline of the Sacraments, the Supreme Tribunal of the Apostolic Signatura, and the Tribunal of the Roman Rota.
The next day, by Act No 2, Pétain defined his powers and abrogated all the laws of the Third Republic that were incompatible with them. Although given full constituent powers by the law, Pétain never promulgated a new constitution. A draft was written in 1941 and signed by Pétain in 1944, but it was never submitted or ratified. The was an promulgated by the Provisional Government of the French Republic after D-Day asserting the nullity of the Constitutional Law of 1940 and other classes of law passed later by Vichy.

Such call was met with preoccupation again, and many jurists argued that Maduro violated the constitution by assuming functions of the citizens to summon a Constituent Assembly. Several sectors of society, including jurists, professionals, dissident chavistas and even government officials. On 17 May, the Tribunal decided on five nullity complaints from 2010 against the Reform of the Organic Law of Municipal Public Power, which replaced the Parochial Meetings with Communal Parochial Meetings. The Tribunal decided that communal councils could elect the members of the Parochial Meetings, implementing an indirect suffrage.
In law, void means of no legal effect. An action, document, or transaction which is void is of no legal effect whatsoever: an absolute nullity—the law treats it as if it had never existed or happened. The term void ab initio, which means "to be treated as invalid from the outset," comes from adding the Latin phrase ab initio (from the beginning) as a qualifier. For example, in many jurisdictions where a person signs a contract under duress, that contract is treated as being void ab initio.
Blair v. Miller was a U.S. Supreme Court case decided in 1800, without oral argument, in which the court held that a writ of error is a nullity if not returned till the term next succeeding that to which it was returnable. A judgment was rendered in the Circuit Court of Virginia on the 28th of May 1799, and a writ of error issued returnable to August term 1799; but the record was not transmitted, nor the writ returned into the office of the clerk of the Supreme Court, till the 4th of February 1800.

These Determinations of Reflection—formerly known as Determinate Beings when they were in the realm of Quality (see above)—therefore share in the nullity that undergirds them.
The Supreme Court declared the ruling issued in Cuenca in 1918 void. As well as establishing Sánchez and Valero's innocence, the supreme court established the nullity of José María Grimaldos' death certificate, and established the corresponding compensations that the State had to pay to the prisoners in such cases. A trial was held of those held responsible for the miscarriage of justice. On November 18, 2005, Judge Moore rejected Thompson's request to withdraw, and instead revoked his Pro Hac Vice admission (a temporary license to practice in a given jurisdiction), in an 18-page decision. Thompson responded with a letter to Alabama's Judicial Inquiry Commission, questioning Judge Moore's ethics and accusing him of violating the first 3 Alabama Canons of Judicial Ethics Sinclair, Brendan. Alabama judge tosses Thompson. GameSpot, 2005-11-18 Thompson also claimed the judge had "absolutely no authority" in preventing him from withdrawing from the case, and so therefore the court's decision to kick him off the case was a "legal nullity".
In the 1983 Amendment to the constitution introduced the constitutional prohibition of abortion, which the Church supported, though abortion for social reasons remains illegal under Irish statute law. However the Church failed to influence the June 1996 removal of the constitutional prohibition of divorce. While the church had opposed divorce allowing remarriage in civil law, its canon law allowed for a law of nullity and a limited divorce "a mensa et thoro", effectively a form of marital separation. In a further repudiation of the church's teaching, on 22 May 2015, 62% of Irish voters approved the legalization of same sex marriage in Ireland.
The term describes a prohibition against a particular behavior or action that is affixed to a party whose marriage was declared found to have been null in a declaration of nullity from a matrimonial tribunal of the Catholic Church. The Court has jurisdiction over all marriage-related cases in all states and territories of Australia, except Western Australia which has its own family court. An avenue of appeal to the Family Court of Australia does however exist in relation to judgments in the Western Australian court. Bilson was knighted on 25 October 1613, soon after his father Bishop Bilson had been appointed an additional judge on the commission on the annulment of the marriage of the Countess of Essex to marry the royal favourite Robert Carr. Bishop Bilson supported Carr and the annulment: his son was therefore known as court as "Sir Nullity Bilson". Bilson served as a JP in Hampshire 1614–1621, Commissioner of Sewers for Winchester in 1617, Commissioner of Subsidy for Hampshire 1621–22 and 1624, and Commissioner of Assessment for Hampshire in 1641. If the contract of sale to Blenkarn was held to be voidable for fraud, then Lindsay & Co would only have recourse against the insolvent Blenkarn. However, if (as was held) the contract of sale was void ab initio, then the title did not pass from Lindsay to Blenkarn in the first place, and Lindsay could claim back the handkerchiefs from Cundy as their property. Cundy was left with only a claim against the insolvent Blenkarn. In every case, third parties involved with bad faith in void or voidable contracts not only are affected by nullity, but may also be liable for statutory damages.
In Family law, the citizens of any state may not be allowed to evade rules like those on marriage by blood relatives or by persons of the same biological sex only by travelling to and going through a ceremony in a state that allows them. Virginia pleading practice differs from that of federal courts and many other states in that it offers no amendments to the pleadings as of right. If a plaintiff files an amended complaint, and the defendant responds to that pleading, both the filing and the response are a legal nullity. A party must instead seek and receive leave to amend before any amended pleading will be accepted, even if that amended pleading is filed before any response to the initial pleading has been received. However, Virginia courts are generally liberal in allowing parties to amend, absent undue delay or prejudice to a party.

In the end, Harun dismissed the suit, citing Article 41 of the Societies Act 1966, which stated any society would automatically become "unlawful" if any of its branches were not registered with the Registrar of Societies. As a result, Harun declared he had no choice but to declare UMNO "an unlawful society", thereby rendering "[w]hat happened in 1987" a nullity. On February 28, 1948 the National Electoral Tribunal issued a ruling on the elections with two opinions, the majority signed by magistrates Gerardo Guzmán and José María Vargas, and the minority signed by magistrate Max Koberg. The majority found inconsistencies in the count and nullity of the padron: 14,000 votes exceeded the voters who had participated in theory and who gave the win to Ulate, inconsistency whereby the elections were canceled. The minority one does not. The Constitutional Congress heard both opinions generated an intense debate between the Calderonistas and communists deputies who advocated in favor of annulling the elections and the opposition deputies.
Walter Devereux was sent in 1608 to a riding academy in Angers, France. He had returned by May 1613 when the divorce suit of his half-brother, Robert Devereux, began, and over the next several months was manipulated by the King and his powerful allies at the expense of Essex and the Devereux family's reputation. However, should this not prove feasible, a civil divorce is acceptable. If someone has been married previously and the first spouse is still alive, he or she must have received a Declaration of Nullity before entering into a marriage in the Catholic Church, even if neither party in the marriage was Catholic (privilege of faith being separate cases). The Catholic Church treats as indissoluble and valid every marriage when it is the first marriage for both parties. However, the church does not recognise as valid a marriage when one of the parties is Catholic but the marriage was not celebrated before a Catholic priest (unless a dispensation was first obtained).
Now persons routinely trade and travel across state boundaries (both physically and electronically), so the need is to provide stability across state lines given that laws differ from one state to the next. Thus, once defined by the personal law, persons take their capacity with them like a passport whether or however they may travel. In this way, a person will not gain or lose capacity depending on the accident of the local laws, e.g. if A does not have capacity to marry her cousin under her personal law (a rule of consanguinity), she cannot evade that law by travelling to a state that does permit such a marriage (see nullity).
In probate and divorce courts, the Queen's Proctor (or King's Proctor) acted as the proctor or solicitor representing the Crown. In petitions of divorce, or for declaration of nullity of marriage, the Queen's Proctor may, under direction of the Attorney General, intervene in the suit for the purpose of arguing any question that the court deems expedient to have argued. Justice Thomas dissented separately, because he felt that the majority attributed a meaning to the Fourteenth Amendment Privileges or Immunities Clause that its framers did not intend. He lamented the decision of the Slaughterhouse Cases which basically turned the clause into a nullity. He looked to the historical meaning and use of the language in the clause, citing the Charter of 1606, which guaranteed the citizens of Virginia therein all the "Liberties, Franchises, and Immunities" of a person born in England. He also noted that the phrase was used in the Articles of Confederation, which was then imported into Article IV of the Constitution.
The Act provided for the transfer of certain tenancies on divorce. The Domestic Violence and Matrimonial Proceedings Act 1976 made provision for varying rights of occupation where both spouses (and a man and woman living together as man and wife) had rights in the matrimonial home. The 1976 Act and the 1983 Acts were further developed by the Matrimonial and Family Proceedings Act 1984, which also gave powers to the court in relation to the transfer of certain tenancies upon a decree of divorce, of nullity of marriage or of judicial separation. The Mobile Homes Act 1983 replaced sections 1 to 6 of the Mobile Homes Act 1976.

Similar differences of interests would have affected many Anglo-American society marriages but few ended in separation because of the scandal of divorce. However Caroline was determined to be free again and, in particular, she had come to love Italy and wanted to live there. She set about getting her marriage nullified because, it was claimed, it had never been consummated. Its jurisdiction is limited to either upholding a contested decision, rendering it final and irrevocable; or either annulling it ("cassation", from the French verb casser, "to break" or "to quash") if the Court finds the decision to violate the law. A legal analysis by the campus free speech organization Foundation for Individual Rights in Education (FIRE) said that the firing violated established First Amendment law for public employees, and rejected Munroe's claim that Durden's remarks made it impossible for her to do her job. They are called mixed causes when they are subjects proper for decision by either the ecclesiastical or civil forum, as usurious contracts, concubinage, violations of the Church's peace, etc. Causes are likewise called mixed when they have both a spiritual and temporal end. Thus matrimony, in its sacramental nature as to validity or nullity, belongs to the Church; in its temporal aspect, as to the property of married persons and similar things, it may be dealt with by the civil tribunals. To this class of mixed causes can also be reduced the suppression of heresy, where Church and State cooperate with each other for the maintenance of the integrity or the faith and the preservation of the civil peace.
With the establishment of the Federal Magistrates' Court in 1999 (now the Federal Circuit Court of Australia (FCCA)), the Family Court has concurrent jurisdiction in most areas, with the FCC. The FMC was initially given jurisdiction to hear applications for nullity and dissolution of marriage, family law property disputes (where the property in dispute was worth less than $0.3m, or property disputes worth more than this if the parties consented), parenting orders providing for matters such as contact, maintenance and specific issues, and where the parties consented, parenting orders providing for the residence of a child. In December 2000, its jurisdiction was extended to encompass ‘residence’. The majority of proceedings under the Family Law Act are now filed in the FMC.

The Catholic Church holds that marriage is a sacrament creating an indissoluble union between one man and one woman. While the Catholic Church allows for the possibility of separation from a marriage in certain cases, it does not recognize the validity of a subsequent marriage unless a declaration of nullity has been obtained regarding the first marriage or the first spouse is deceased. Any sexual act outside of marriage is considered a grave sin, and if the subjective elements of full knowledge and deliberate consent are present in an individual committing such an act, the individual would be deemed to have committed a mortal sin and would be deprived of access to Holy Communion until they have received sacramental absolution.
As to marriage, both formal and common law, the general rule is the lex loci celebrationis determines its validity, i.e. the law of the place where the marriage is celebrated, unless the purpose of the marriage offends a public policy of the domicile/nationality/habitual residence state. Hence, some states limit the capacity of their citizens to celebrate a monogamous marriage to a person of the opposite biological sex, or prohibit marriage between degrees of consanguinity, etc. Questions of nullity and divorce straddle Family Law and status because the outcome of the judicial proceedings affects status and capacities, and also overlap with the more general question of when the courts of one state will recognize and enforce the judgments of another state.
Foreign Compensation Committee (1968), the House of Lords held that ouster clauses cannot prevent the courts from examining an executive decision that, due to an error of law, is a nullity. Subsequent cases held that Anisminic had abolished the distinction between jurisdictional and non-jurisdictional errors of law. Thus, although prior to Anisminic an ouster clause was effective in preventing judicial review where only a non-jurisdictional error of law was involved, following that case ouster clauses do not prevent courts from dealing with both jurisdictional and non-jurisdictional errors of law, except in a number of limited situations. The High Court of Australia has held that the Constitution of Australia restricts the ability of legislatures to insulate administrative tribunals from judicial review using privative clauses.

As it disapproved that the group of Antoine turned away from Spiritism, journals from Spiritist circles criticized Antoinism in its beginnings, and the president of the Belgian Federation of Spiritist (Fédération spirite de Belgique) Chevalier Clement Saint-Marcq considered the religion as one of the "parasitic stems came on the healthy and strong tree of Spiritism".Debouxhtay, 1934, p. 31 From a philosophical standpoint, Antoinism was criticized by René Guénon in an entire chapter of his 1923 book The Spiritist Fallacy (L'Erreur spirite), noting, to his point of view, "the nullity of [Antoine's] "teachings" which are only a vague mixture of spiritualist theories and Protestant "moralism"".Guénon, 1977, pp. 349–62.
On 18 August 1538 he received the surrender of the Carmelites of Denbigh Friary, and in 1539 he cautiously commended confession as very requisite and expedient, though not enjoined by the word of God. He had a plan, the revival of a plan of 1282, for moving the seat of the cathedral and grammar school of his diocese to Wrexham, and he wrote about it to Thomas Cromwell soon after his appointment. Afterwards he thought of Denbigh, where he was in 1538 made free of the borough. In 1537 he was present at the christening of Prince Edward and the funeral of Jane Seymour; in 1538 he was at the reception of Anne of Cleves, the declaration of whose nullity of marriage he afterwards signed.
The last years of Nazariantz's life were characterized by heightened economic hardships that had plagued him throughout his life as a stateless person. At the end of the fifties he was admitted to a hospital in Conversano, where he was surrounded by affection and esteem of some young friends Conversano, not that they wanted to rediscover the enormous human and intellectual value. In recent years, verified the nullity of his first marriage, also died Vittoria Strazzaboschi his faithful companion for many years, wed with Maria Lucarelli. In 1960 he moved from Conversano, a town he so loved, to Casamassima, also in the province of Bari, where he lived in conditions of almost complete destitution with his second wife Maria Lucarelli.
In effect, Māori were safe from the court only until a single tribal member broke ranks and triggered a case, which would invariably result in the sale of the land. By the end of the century, nearly all of the highest quality Māori land had been sold, with only two million hectares remaining in Māori possession. Although the treaty had never been incorporated into New Zealand municipal law, its provisions were first incorporated into legislation as early as the Land Claims Ordinance 1841 and the Native Rights Act 1865. However, in the 1877 Wi Parata v Bishop of Wellington judgement, Judge Prendergast argued that the treaty was a "simple nullity" in terms of transferring sovereignty from Māori to the United Kingdom.
The high court confessed that it is not always very easy to determine what matters go to the jurisdiction of court so as to make its action when erroneous a nullity. But the general rule is that when the court has jurisdiction by law of the offense charged, and of the party who is so charged, its judgments are not nullities. The Association was an instrument created after the failed Jacobite assassination plot of 1696 to pledge loyalty to William III of England. Modelled by Lord Somers on the Elizabethan Bond of Association, it placed intense pressure on nonresistant Tories in public life to acknowledge William as "rightful and lawful King". The Association was widely subscribed to by the public, extending well beyond the circle of officials Somers had targeted, and soon assumed the force of law, all Crown officials being required by statute to subscribe to it. Some Tories were purged from office for failure to do so, and the Association remained in legal force until 1702, when William's death rendered it a nullity and the requirement to subscribe to it was repealed.

But the House of Lords held that the Egyptian company was not Anisminic Ltd's 'successor' in title, that the FCC had therefore taken an irrelevant factor into account (its own error of law) in denying a claim, and that the decision had to be a nullity.
In Germany, only Patentanwälte/patent attorneys (or Rechtsanwälte/attorneys-at-Law, who are per se entitled to represent clients in all fields of law) are entitled to represent clients from abroad before the German Patent and Trade Mark Office (DPMA). German patent attorneys have done their university degrees in engineering or natural sciences and practised in industry before being accepted for an additional three years' education, i. e. completing legal training of 26 month with an established German patent attorney, at the same time studies of German Law and afterwards a training in intellectual property and an examination at the DPMA. They are further entitled to represent their clients before the German federal court of patents (and trademarks) and in patent cases (nullity) before the German Supreme Court.
In cases such as this, where the police are investigating a domestic dispute, officers "need to know whom they are dealing with in order to assess the situation, the threat to their own safety, and possible danger to the potential victim." "The request for identity has an immediate relation to the purpose, rationale, and practical demands of a Terry stop. The threat of criminal sanction helps ensure that the request for identity does not become a legal nullity." Balancing the intrusion into the individual's privacy against the extent to which the stop-and-identify law promotes legitimate government interests, the Court concluded that the Fourth Amendment did not prohibit Nevada from making it a crime for a person detained under conditions of Terry to refuse to disclose his name to a police officer upon request.
All other means of proof certainly remain effective in theory, but in practice, they are far from being as efficient as the saisie- contrefaçon, to the extent that the failure of the saisie-contrefaçon often means that the infringement action will fail. Considering the decisive nature of the saisie-contrefaçon, the dispute with relation to its being valid or void is very significant. The alleged infringer, in addition to arguing that the intellectual property right at issue is invalid, will naturally tend to put forward any and all arguments supporting the nullity of the saisie- contrefaçon, in order to destroy such a decisive item of evidence against it. On famously failing to receive from the Pope a declaration of nullity regarding his marriage, Henry had himself declared Supreme Head of the Church of England in February 1531, and instigated a programme of legislation to establish this Royal Supremacy in law and enforce its acceptance throughout his realm. In April 1533, an Act in Restraint of Appeals eliminated the right of clergy to appeal to "foreign tribunals" (Rome) over the King's head in any spiritual or financial matter. All ecclesiastical charges and levies that had previously been payable to Rome, would now go to the King. By the Submission of the Clergy, the English clergy and religious orders subscribed to the proposition that the King was, and had always been, the Supreme Head of the Church in England.

The Letter on the Secret Workings of Art and Nature and on the Vanity of Magic ('), also known as On the Wonderful Powers of Art and Nature ('), a likely-forged letter to an unknown "William of Paris," dismisses practices such as necromancy but contains most of the alchemical formulae attributed to Bacon, including one for a philosopher's stone and another possibly for gunpowder. It also includes several passages about hypothetical flying machines and submarines, attributing their first use to Alexander the Great. On the Vanity of Magic or The Nullity of Magic is a debunking of esoteric claims in Bacon's time, showing that they could be explained by natural phenomena.
Indigenous Australian customary law was asserted to be a nullity by English colonisers, who asserted a legal fiction that Australia was terra nullius at the time of settlement. For that reason, customary laws were explicitly ignored by Australian courts. The post-colonial legal system recognized Indigenous customary law as giving rise to a valid legal claim in the Mabo decision, in which the legal fiction of terra nullius was discarded. While the court found that the crown held radical title over all land in Australia, (including land subject to indigenous legal claims) the High Court held that it would recognise customary legal rights to land; if and only if those legal rights had been maintained continuously since settlement, and not displaced by an inconsistent grant in title to another person.
An agreement recognizing territories in de facto possession by each country was signed in 1936, but minor military skirmishes began to occur in 1938. Tensions escalated, and war broke out in July 1941, and officially came to an end with the signing of the Rio de Janeiro Protocol on January 29, 1942. The treaty was intended to finally bring the long-running territorial dispute to an end, but in 1960 the then-president of Ecuador José Mª Velasco Ibarra proposed to the Congress a thesis of nullity based in the fact that the 1942 protocol was forced upon the Ecuadorian government under duress. A brief military clash took place in early 1981, when the Peruvian Army forcefully took control of three Ecuadorian military outposts on the eastern slopes of the Cordillera del Cóndor mountain range.
The court is required to analyse the pleadings prepared by the parties and to assign each component element to the most appropriate juridical concept or category. The rules of any given system of law are arranged under different categories, addressing procedure, status, contract, tort, divorce, nullity etc. For each category, there is one or more choice of law rules. In Sikhism, the visible world is a manifestation of God Himself and is therefore real; yet it is not satya or true in the sense of being immutable and eternal. This world of mass, form and movement woven into the warp and woof of time and space is God’s play created at His pleasure and is as such real and sacred; but it represents only one transient aspect and not the Ultimate Reality. Maya is not an illusion in the sense of a mirage, a factual nullity; it is a delusion which represents transient as permanent and a part as the whole. Moh for maya, i.e. for this transient world of the senses, hinders the soul’s search for its ultimate goal and is, therefore, one of the Five Evils.
Ogden edited Bentham's work: Ogden comments: "There is no doubt that Hans Vaihinger reached his conclusions independently of Bentham ... The chief defect of Vaihinger's monumental work was its failure to lay stress on the linguistic factor in the creation of fictions." (p xxxii). In the preface to the English edition of his work, Vaihinger expressed his principle of fictionalism: "An idea whose theoretical untruth or incorrectness, and therewith its falsity, is admitted, is not for that reason practically valueless and useless; for such an idea, in spite of its theoretical nullity[,] may have great practical importance." Moreover, Vaihinger denied that his philosophy was a form of skepticism because skepticism implies a doubting, whereas in his 'as if' philosophy the acceptance of patently false fictions is justified as a pragmatic non-rational solution to problems that have no rational answers.
In 1539, Petre was one of those appointed to prepare a bill for the enactment of 'The Six Articles', and in the following year was on the commission that declared the nullity of Henry's marriage with Anne of Cleves. If they intend to ex officio raise a cause of non-admissibility in non-criminal cases, they must inform the parties of such before the hearing. In criminal cases, the section president of the section that would hear the case, can since 2014 summarily rule to reject the appeal in cassation if the prosecutor-general's office also advises as such. This can only be the case if the appeal in cassation is non-admissible; for example if the term limit to submit a petition has been exceeded, if the petition has not been signed by a proper attorney, or if the claimant does not stipulate any irregularity or cause for nullity that could lead to cassation. The section president will issue such a ruling of non-admissibility without a public hearing and without considering any arguments from the claimant.

The National Electoral Court provisionally declared the opposition candidate Otilio Ulate Blanco provisionally elected, but Calderón Guardia filed a fraud and presented to Congress a nullity of the presidential elections, although not of the legislative ones, in which his supporters had obtained a majority. On March 1, 1948, Congress -where the alliance of Calderonists and communists had a majority-, annulled the presidential elections. This caused a civil war, in which the government forces were defeated militarily by those of rebel caudillo José Figueres Ferrer. Calderón went into exile in Nicaragua, and in December 1948 he invaded Costa Rica with support from the government of Nicaraguan dictator Anastasio Somoza García, but the expedition - known as the counterrevolution - failed.
He then acted for Wilkes in his application for a writ of habeas corpus in May 1763, in the action against George Montagu Dunk, 2nd Earl of Halifax, and in the trial which took place in 1764 on the republication of The North Briton in volumes. He was the advocate of John Almon in 1765, pleaded in the king's bench against the outlawry of Wilkes in 1768, and was counsel for Alderman James Townsend in his action in June 1772 against the collector of land tax, which Townsend had refused to pay, urging the nullity of Parliament through the irregularity of the Middlesex election. Glynn represented Woodfall before Mansfield in the case of the Letters of Junius, of which a subset were alleged to constitute seditious libel. The verdict was mistrial; the Crown decided against further pursuit.
He must be summoned to any trial in which there is question, before a competent judge, of the validity or nullity of a marriage, and any proceeding will be null if he is not duly cited. He must have the opportunity to examine the witnesses, and, orally or in writing, to bring forward whatever arguments may favour the validity of the marriage. On assuming his office he must take an oath to fulfill his duties and he is expected to renew the oath in each case.
In 1879, passed into law a measure consolidating in one act both the Mutiny Act and the Articles of War, and amending their provisions in certain important respects. This measure was called the Army Discipline and Regulation Act 1879. After one or two years experience finding room for improvement, it was superseded by the Army Act 1881, which hence formed the foundation and the main portion of the military law of England, containing a proviso saving the right of the crown to make Articles of War, but in such a manner as to render the power in effect a nullity by enacting that no crime made punishable by the act shall be otherwise punishable by such articles. As the punishment of every conceivable offence was provided, any articles made under the act could be no more than an empty formality having no practical effect.

Based on these a marriage is validated, if not it is termed as void marriage or voidable marriage at the option of either of the spouses. Here upon filing a petition by any one spouse before the Court of law a decree of nullity is passed declaring the marriage as null and void. A valid marriage can be dissolved by a decree of dissolution of marriage or divorce and Hindu Marriage Act, The Divorce Act and Special Marriage Act allow such a decree only on specific grounds as provided in these acts: cruelty, adultery, desertion, apostasy from Hinduism, impotency, venereal disease, leprosy, joining a religious order, not heard of being alive for a period of seven years, or mutual consent where no reason has to be given. Since each case is different, court interpretations of the statutory law gets evolved and have either narrowed or widened their scope.
He was at Cambridge until he attracted Henry VIII's notice by his approval of Thomas Cranmer's book demonstrating the nullity of the king's marriage with Catherine of Aragon. By his action Crome was one of the delegates appointed by the university, 4 February 1530, to discuss and decide the same question proposed by the king. During the following Lent he was three times commanded to preach before the king, and shortly after (24 May) was one of the representatives of his university who, together with the same number from Oxford, assisted the Archbishop of Canterbury and Bishop of Durham in drawing up a condemnation of certain doctrinal views. The obligation of the defender to appeal from the decision of first instance adverse to the validity of a marriage has been modified by the Holy See in several cases where the invalidity depends upon facts indisputably proven. Where the decree "Tametsi" of the Council of Trent was binding, requiring the presence of the parish priest for the validity, if only a civil ceremony was used, the bishop may declare the marriage null without the participation of the defender. In view of new matrimonial law contained in the decree "Ne Temere" of Pius X this also holds anywhere if a marriage is attempted only before a civil authority or non- Catholic minister of religion. Yet if an ecclesiastical form had been used, and the nullity from clandestinity was questioned, the presence of the defender is required; but if the impediment of clandestinity clearly appears he need not appeal.
Wi Parata v Bishop of Wellington was a New Zealand court case of 1877 which ruled that the Treaty of Waitangi was a "simple nullity" having been signed by "primitive barbarians". In 1877 Wiremu "Wi" Parata a wealthy Māori farmer and member of the Executive Council, described by the Dictionary of New Zealand Biography as having been "an astute politician and skilled orator and debater" took Octavius Hadfield, the Bishop of Wellington, to the Supreme Court, over a breach of oral contract between the Anglican Church and the Ngāti Toa, and a breach of the principles of the Treaty of Waitangi. Ngāti Toa had provided land to the church in 1848 in exchange for a promise that a school for young Ngāti Toa people would be built by the church. However no school was built, and in 1850 the church obtained a Crown grant to the land, without the consent of the iwi.
On March 5, 1992, she went back to the Court of Appeals, this time as an Associate Justice. She served in this capacity until July 27, 2001, when she was appointed as the Presiding Justice of the Court of Appeals. However, her occupation of the Office of the Presiding Justice proved to be short-lived because on April 9, 2002 she was named Associate Justice of the High Tribunal.
