Ross's memo stated that he'd considered four options for obtaining citizenship data — to continue to ask about it in the American Community Survey, which goes out to a small percentage of American households each year; to put a citizenship question on the decennial form, which bureau officials warned would scare off noncitizens from responding; to pull data from other agencies, such as immigration enforcement offices and the Social Security Administration, which is what bureau officials recommended; or to combine a citizenship question with agency data.

It also demands a great number of systemic updates: the Oliphant fix, which would allow tribes to prosecute noncitizens; the dissolution of pipeline projects and their accompanying worker camps that are a source of danger to Native women; adequate public service funding for tribes that require it (or are owed it through their treaties) to strengthen the struggling economies that often accompany these stories; and an admission by Congress—like the one offered by Canada—that this is, in large part, a crisis enabled by the state.

The administration has argued that the question would allow the Department of Justice to better enforce the Voting Rights Act because it would provide more information about the number of noncitizens in the US. Documents discovered last month on the hard drive of Thomas Hofeller, a recently deceased Republican strategist, show that Hofeller in a 2015 study pushed the citizenship question as a way to "to create a structural electoral advantage" for "Republicans and Non-Hispanic Whites," according to court documents filed in federal court in New York.

While only cash benefits are considered right now — benefits that only 3 percent of noncitizens use — the new approach would include Medicaid, SNAP (food stamps), Section 8 and other housing benefits, and subsidies for low-income earners in Medicare Part D. … The message that immigrants are likely to receive is simple: that they shouldn't use public benefits if they want to stay in the US. Local service providers (from public assistance clinics to pediatricians) are already seeing this "chilling effect" just based on rumors of the rule and the Trump administration's generally hawkish tone toward immigrants.
