Emperor Charles V captured Tunis in 1535, liberating 20,000 Christian slaves The Spaniards were the first Europeans to use African slaves in the New World on islands such as Cuba and Hispaniola, due to a shortage of labor caused by the spread of diseases, and so the Spanish colonists gradually became involved in the Atlantic slave trade. The first African slaves arrived in Hispaniola in 1501; by 1517, the natives had been "virtually annihilated" mostly to diseases. The problem of the justness of Native American's slavery was a key issue for the Spanish Crown. It was Charles V who gave a definite answer to this complicated and delicate matter.

A technical defense would argue that the alleged crime did not occur as a matter of fact or law. In a political defense, a defendant may assert the political motivations behind the conduct in an attempt to convince the jury or the public of the justness of the political motivations and of the injustice of the prosecution. The second Archbishop of Mexico (1551–72), the Dominican Alonso de Montúfar, wrote to the king in 1560 protesting the importation of Africans, and questioning the "justness" of enslaving them. Tomás de Mercado was a theologian and economist of the School of Salamanca who had lived in Mexico and whose 1571 Summa de Tratos y Contratos ("Manual of Deals and Contracts") was scathing about the morality of the enslavement of Africans in practice, though he accepted "just-title" slaves in theory. Pressure for the end of slavery and forced labour among the indigenous Indians worked to increase the demand for African slaves to do the work instead.

It has been noted that the current constitutional arrangements enable "[a] well-meaning Executive, sincerely believing in the justness and legitimacy of its governmental programme, ... to appoint Judges who, in essence, believe in the same fundamental policies. In an environment in which two belligerents compete, the chances of success greatly diminish if those whose actions are necessary lack faith in the justness of the cause or its chance for success or are discouraged, morally defeated, disconsolate, antagonistic, sullen, inattentive, or lazy. Demoralization can be used to lessen the chances of success for an opponent by fostering these attitudes, and it can generally be done in one of two ways: demoralization through objective conditions or demoralization through perception. Demoralization through objective conditions most commonly takes the form of a military defeat on the battlefield that has tangible consequences directly resulting in the indicators of a demoralized party, but it can also result from an adverse physical environment where basic needs go unmet.

As far back as can be traced, the standard weights and measures, the primary instruments for determining the justness of all other weights and measures used in the United Kingdom, were kept at the Exchequer, and the duties relating to these standards were imposed upon the chamberlains of the Exchequer. The office of chamberlains was abolished in 1826 using the Receipt of the Exchequer Act 1783, but the custody of the standards and any duties connected to them remained attached to an officer in the Exchequer until that department was abolished by the Exchequer and Audit Departments Act 1866. Meanwhile, in pursuance of recommendations of Standard Commissions of 1841 and 1854 and a House of Commons committee of 1862, the Standards of Weights, Measures, and Coinage Act 1866 was passed. This act created a special department of the Board of Trade, called the Standard Weights and Measures Department, and a head of that department styled the Warden of the Standards.
