In the United States, collateral consequences can include loss or restriction of a professional license, ineligibility for public funds including welfare benefits and student loans, loss of voting rights, ineligibility for jury duty, and deportation for immigrants, including those who, while not American citizens, hold permanent resident status. In general, all states impose such consequences. In all jurisdictions throughout the U.S., judges are not obligated to warn of these collateral consequences upon a finding of guilt by trial, or prior to an admission of guilt by plea agreement, except as regards deportation. Deportation has been made an exception by the Supreme Court in Padilla v.

The Saxbe fix , or salary rollback, is a mechanism by which the President of the United States, in appointing a current or former member of the United States Congress whose elected term has not yet expired, can avoid the restriction of the United States Constitution's Ineligibility Clause. That clause prohibits the President from appointing a current or former member of Congress to a civil office position that was created, or to a civil office position for which the pay or benefits (collectively, "emoluments") were increased, during the term for which that member was elected until the term has expired. The rollback, first implemented by an Act of Congress in 1909, reverts the emoluments of the office to the amount they were when that member began his or her elected term. To prevent ethical conflicts, James Madison proposed language at the Constitutional Convention that was adopted as the Ineligibility Clause after debate and modification by other Founding Fathers.

Patrik Sinkewitz (born 20 October 1980) is a German professional road racing cyclist, who is currently suspended from the sport until 2024 for doping and ineligibility offences. In March 2019, UP high court stayed the arrest of Abdullah and his father Azam Khan and mother Tazeen Fatma until the probe was completed by the police. In December 2019, the Allahabad high court annulled the election of Abdullah on account of his ineligibility to contest polls as MLA. Following this he moved an appeal against the order in the Supreme court. However, in January 2020 the court declared the three Abdullah and his parents to be absconders for failing to appear in the court during the hearings in the case.

They finished the season 13–17, 5–9 WAC play to finish in fifth place. Due to Grand Canyon's postseason ineligibility, they received the No. 4 seed in the WAC Tournament where they lost in the quarterfinals to Utah Valley.

The 2016–17 UTRGV Vaqueros men's basketball team represented the University of Texas Rio Grande Valley during the 2016–17 NCAA Division I men's basketball season. In September 2016, the Paris criminal court, which had opened an investigation when the facts were revealed, found Anne-Sophie Leclère guilty of the crime of public insult and sentenced her to a suspended fine of 3,000 euros.

A native of California, in 1925 Weldon moved to Graceland Academy in Lamoni, Iowa for the final two years of high school. He continued there to Graceland University for his first year of college before transferring to the University of Iowa. As an athlete at Graceland, he won the javelin throw at the nearby Drake Relays and at the Kansas Relays in 1928. After a year of forced ineligibility due to the change in schools, he returned in 1930 to again win the Drake Relays and Kansas Relays plus added the Texas Relays for the trifecta of the top competitions in the country.

Avianca Bohm was crowned “Miss New Zealand 2012″ by Priyani Puketapu (Miss New Zealand 2011) at the grand finale of Miss New Zealand 2012 beauty pageant at the Amora Hotel, Wellington, New Zealand on Sunday, 3 June 2012. Bohm was representing Auckland although she did not meet the requirements (New Zealand citizenship) of the Miss Universe pageant for which the winner automatically qualifies. There was dispute as to whether the judges were aware of this ineligibility.

Ellen May Gandy (born 15 August 1991), also known by her nickname Elly Gandy, is an Australian female butterfly swimmer originally from Great Britain. She represented Great Britain at the 2008 Summer Olympics and 2012 Summer Olympics in the 200m butterfly swimming event, and was the 2011 World silver medalist at that distance. Following a disappointing 2012 Games, Gandy expressed an intention to swim for Australia, having lived and trained there since 2007, and served a period of ineligibility in order to do so. She represented Australia for the first time at a FINA World Cup event in Eindhoven in August 2013.

Despite the ineligibility of Deportivo Fabril for promotion, due to the relegation of Deportivo La Coruña to Segunda División, the reserve team participated in the promotion playoffs. Fuenlabrada and Rápido de Bouzas demanded the Royal Spanish Football Federation to not allow the Galicians to play, by filing a lawsuit. The disassociation formally ended on May 8, 2013. The additional year of post- season ineligibility was overturned on appeal. The punishment cost the 17–13 2002–03 team its post-season eligibility, cost past teams the 1997 National Invitation Tournament and the 1998 Big Ten Tournament championships as well as 1992 and 1993 NCAA Division I Men's Basketball Tournament Final Four recognition. It cost Traylor his MVP awards in the 1997 NIT and 1998 Big Ten Tournament, as well as Bullock's standing as the school's third all-time leading scorer and all-time leader in 3-point field goals.

Another theory of Obama's ineligibility is that, regardless of his place of birth, he does not meet the constitutional definition of a natural-born citizen. The Fourteenth Amendment to the United States Constitution states: "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States...." According to law professor Gabriel J. Chin, "there is agreement that 'natural born citizens' include those made citizens by birth under the 14th Amendment." Despite this agreement, two similar but distinct theories nonetheless contend Obama, although born in Hawaii, does not qualify as a "natural-born citizen".

Chaudhry had been removed from his position by Musharraf and the decision was not reversed under the presidency of Asif Ali Zardari until the lawyers began a mass march from Lahore to Islamabad that was supported by large crowds and coincided with rioting. In 2012, Kurd was considered as a nominee for the post of Chief Election Commissioner of Pakistan by the Pakistan Muslim League-Nawaz but was ruled out of contention due to constitutional ineligibility. He had also been considered as a possible caretaker prime minister.

While still serving as National League president, Giamatti suspended Cincinnati Reds manager Pete Rose for 30 games after Rose shoved umpire Dave Pallone on April 30, 1988. Later that year, Giamatti also suspended Los Angeles Dodgers pitcher Jay Howell, who was caught using pine tar during the National League Championship Series. Giamatti, whose tough dealing with Yale's union favorably impressed Major League Baseball owners, was unanimously elected to succeed Peter Ueberroth as commissioner on September 8, 1988 and assumed office on April 1, 1989. Giamatti was commissioner on August 24, when Pete Rose voluntarily agreed to permanent ineligibility from baseball.

Legal scholars have accorded this clause little attention in their academic writings and there have been no cases which directly applied the clause, as no plaintiff has been able to establish legal standing. In fact, some general guides to Constitutional research, such as the clause-by- clause The Constitution of the United States: A Guide and Bibliography to Current Scholarly Research, do not discuss the Ineligibility clause. Most scholarly texts on the Constitution ignore the clause. Although the Saxbe fix is named for Nixon nominee William Saxbe, the device's first intentional use predates him by several decades.

The Nixon administration skirted the Ineligibility Clause during its first year, when Nixon named Representative Donald Rumsfeld as Director of the Office of Economic Opportunity in 1969. Although the salary for that office had been increased to $42,500 during Rumsfeld's term in Congress, Rumsfeld was not paid a salary for the position. Rather, Rumsfeld was dually employed as Assistant to the President at the same $42,500 salary, a position presumably outside the scope of the Clause. The rollback device gained its name when President Richard Nixon sought to appoint Senator William Saxbe as Attorney General following the Saturday Night Massacre.

The Senate then acted upon the advice of acting Attorney General Robert Bork that reducing the Attorney General's salary to its pre-1969 level by enacting () would cure the ineligibility.119 Congressional Record 37,017-26 (1973). passed in the Senate by a 75–16 roll-call vote on November 28 after it was approved by the Senate Post Office and Civil Service Committee and sharply criticized by the Senate Judiciary Committee. The Bilski case involved a patent application on methods for hedging against commodity price fluctuations, which the PTO had rejected. The Federal Circuit, in In re Bilski, upheld the PTO's rejection on the grounds that the claims failed the machine-or-transformation test, which the court held should be used as the sole test of patent eligibility. The court did not hold that all business methods are patent ineligible, though a minority of the judges would have ruled that business methods are not properly the subject of patents. The Supreme Court affirmed the judgment of ineligibility, in Bilski v.

The war started over a dispute of the ascension of Maria Theresa to the throne of the Hapsburg dominions. The cause of the War of the Austrian Succession was Maria Theresa's alleged ineligibility to succeed to the hereditary lands of her father, Emperor Charles VI, because Salic law precluded royal inheritance by a woman. A nullity order is one which annuls a void or voidable civil partnership. Section 49 of the Act provides that a civil partnership is void on grounds of ineligibility to register, if the parties: disregarded certain requirements as to the formation of the partnership, where any party is a minor, where any person whose consent is required (e.g. a parent) has forbidden the formation of the partnership and the court has not given its consent. Where a civil partnership is voidable, applications for nullity orders are subject to the bars of time, knowledge of defect and approbation.

Dufferin—Caledon is a federal electoral district in Ontario, Canada, that has been represented in the House of Commons of Canada since 2004. It was created in 2003 from parts of Dufferin—Peel—Wellington—Grey riding. This riding gained a fraction of territory from Vaughan during the 2012 electoral redistribution. After David Tilson's resignation, in March 2019 the Dufferin—Caledon nomination for the Conservative Party in the 2019 election was won by Harzadan Singh Khattra, amid accusations within the party of vote tampering, membership reimbursement, and payments to foreign students to attend, despite their ineligibility within party rules.

To be a senator, a person must be a natural- born Colombian citizen over the age of 30 at the time of the election. Representatives of indigenous communities seeking election as a representative of indigenous communities in the Senate must have held a traditional authority role in their community or have been the leader of an indigenous organization. On 7 February 2020, the Constitution (Amendment) Bill, 2020 was introduced in the Rajya Sabha by Anil Desai, a Shiv Sena MP. Desai proposed to amend the Article 47A of the Constitution of India to state \- The 2020 bill proposes to introduce a two-child policy per couple and aims to incentivize its adoption through various measures such as educational benefits, taxation cuts, home loans, free healthcare, and better employment opportunities. The 2019 bill proposed by Sinha talks about introducing penalties for couples not adhering to the two-child policy such as debarment from contesting in elections and ineligibility for government jobs.

On January 3, 2010, USC announced that it had implemented self-imposed sanctions for violations of NCAA rules related to Mayo.USC, USC Announces Sanctions on Men's Basketball Team, January 3, 2010, Accessed March 16, 2010. The sanctions include a one- year ban on postseason competition following the 2009–2010 regular season, a reduction of one scholarship for the 2009–2010 and 2010–2011 academic years, and reductions in the numbers of recruiting days and coaches participating in off-campus recruiting through 2011. The school also vacated all wins earned during the 2007–2008 season, due to Mayo's ineligibility at that time.

The 2016–17 Chicago State Cougars men's basketball team represented Chicago State University during the 2016–17 NCAA Division I men's basketball season. The Cougars, led by seventh-year head coach Tracy Dildy, played their home games at the Emil and Patricia Jones Convocation Center as members of the Western Athletic Conference. They finished the season 6–26, 1–13 in WAC play to finish in last place. Due to Grand Canyon's ineligibility for postseason play, they received the No. 7 seed in the WAC Tournament where they lost in the quarterfinals to New Mexico State.

The district court ruled that Fung had committed copyright infringement by allowing inducement of Columbia's copyrighted material over the Bit Torrent peer-to-peer network. The court also held that Fung was not entitled to protection from damages liability under any of the safe harbor provisions of the Digital Millennium Copyright Act, 17 U.S.C. § 512(a). Furthermore, the court entered a permanent injunction that prohibited Fung from engaging in any activity that would infringe Columbia's copyrighted works. Fung appealed, contesting the district court's ruling of copyright infringement as well as his ineligibility for safe harbor protection under the DMCA.

In 1994, the United States Supreme Court decided the case of Simmons v. South Carolina. The men's volleyball team is the only program that plays in Division I. In 2003 the men's volleyball team won the NCAA Division I/II National Collegiate Men's Volleyball Championship, defeating BYU in the final, but it later voluntarily gave back its title after an internal investigation found ineligibility issues that were kept private from the NCAA. This disgrace hurt the program for a few years, but they have slowly climbed their way back into the Top-10 rankings of DI-II schools. The bill would include rescissions of funds previously appropriated to various federal agencies. The Secure the Southwest Border Act of 2014 would amend the William Wilberforce Trafficking Victims Protection Authorization Act of 2008 to change the procedures for screening and processing unaccompanied alien children who arrive at the border from certain countries. The bill would amend the Immigration and Nationality Act to include the commission of certain drug-related offenses as grounds for per se ineligibility for asylum. The bill would permit appropriations provided to DOD under this Act to be used for the National Guard to provide support for operations on the southern border.

Torao Takahashi came from Japan to the United States and became a resident of Terminal Island in Los Angeles County, California in 1907. Air Mobility Command (AMC) previously reported that throughout fiscal 2005 it planned to award more than $1.5 billion in additional business beyond the guaranteed portion of the contract. To join Civil Reserve Air Fleet, carriers must maintain a minimum commitment of 40 percent of its Civil Reserve Air Fleet capable passenger and cargo fleet. Aircraft committed must be U.S. registered and carriers must also commit and maintain at least four complete crews for each aircraft. Carriers with aircraft whose performance does not meet minimum Civil Reserve Air Fleet requirements are issued a certificate of technical ineligibility so they can still compete for government airlift business.

Overall, undocumented immigrants are likely to be uninsured due to lack of employer- sponsored insurance and ineligibility for Medicare, Medicaid, CHIP, and PPACA Marketplaces. The museum conducted a controversial sale of an Ancient Egyptian statue of Sekhemka in July 2014, with questions relating to the ownership and the ethics of selling the statue being raised by various organizations. The statue was sold to an unknown buyer for £15.76m, which broke the existing world record for Ancient Egyptian artwork at auction. On 1 August 2014, Northampton Museums had its accreditation removed by the Arts Council England, which ruled that the sale broke the required standards for how museums manage their collections; loss of accreditation includes ineligibility for a range of arts grants and funding, and is in effect until at the earliest, August 2019.

Critics of distance learning law schools have noted that graduates of online law schools face some disadvantages, including (initial) ineligibility in some states to take the bar exam outside of California.See Rule 4.241, "California State Bar Rules For Unacceredited Law Schools." Infamy of law is contracted in one of three ways. Either the law itself attaches this juridical ineligibility and incapacity to the commission of certain crimes, or makes it contingent upon the decision of a judge, or finally connects it with the penalty imposed by the judge. The I-77 Bus Rapid Transit is a proposed bus rapid transit (BRT) service, connecting the towns northern Mecklenburg and southern Iredell counties to Uptown Charlotte, North Carolina. The BRT replaces the previously planned commuter rail service, the Lynx Red Line, that was routed along the existing Norfolk Southern O Line right-of-way. However, several issues had arisen that included ineligibility for federal funding and Norfolk Southern refusal to allow access to its right-of-way. In 2019, after a reevaluation of the entire corridor, the Charlotte Area Transit System (CATS) decided to move forward with BRT and shelve the commuter rail; which had been met with frustration by various city leaders and residents impacted by it.

During the campaign process, several charges were leveled against Mirabeau Lamar. First, in June 1838, Lamar's opponents claimed that he was constitutionally ineligible for the office of the presidency because he had not been a citizen of Texas for at least three years. In a June 16, 1838 letter written by Lamar to journalists Samuel Whiting of the Houston-based National Intelligencer and J.W.J. After his professional career ended Roberts returned to LSU to complete his degree.

Above was challenged by ArcelorMittal in the Hon'ble Supreme Court. On 4 October 2018, the Hon'ble Supreme Court gave its order thereby removing the ambiguity over the interpretation of the Section 29A of IBC and also upheld the ineligibility decision of the Resolution Professional but also gave another chance to both parties to clear any past outstanding dues and resubmit the Resolution Plan. The Commission pronounced penalties against elections personnel in nine districts due to their negligence in failing to follow guidelines and detect candidate ineligibility. It also announced that further elections would be held in the near future to address quashed results, ties, and remaining vacancies. The August 12 reelection in Goenshari was announced on August 1; campaigning recommenced until August 10.

In 2014, baseball player Joel Piniero tested positive as well as St. Louis Cardinals minor league baseball player Yeison Medina. On March 22, 2019, Cycling South Africa reported that Ricardo Broxham has been sanctioned for an anti-doping rule violation of Articles 2.1 and 2.2 of the UCI Anti-Doping Rules after an in-competition test conducted on 18 August 2018 confirmed the presence of Heptaminol in his sample. The UCI Anti-Doping Tribunal has imposed a period of ineligibility of 12 months for the violation, applicable as of 22 September 2018 up to and including 22 September 2019 and a disqualification of all results from the 2018 UCI Junior Track Cycling World Championships.

The government decided to have both passes more closely examined. Rose won both of his Gold Gloves when he was an outfielder, in 1969 and 1970. In August 1989 (his last year as a manager and three years after retiring as a player), Rose was penalized with permanent ineligibility from baseball amidst accusations that he gambled on baseball games while he played for and managed the Reds; the charges of wrongdoing included claims that he bet on his own team. In 1991, the Baseball Hall of Fame formally voted to ban those on the "permanently ineligible" list from induction, after previously excluding such players by informal agreement among voters. After years of public denial, Rose admitted in 2004 that he bet on baseball and on the Reds.

Under current law, most juveniles and anyone sentenced to a term of imprisonment up to and including two years less a day will serve time in a provincial prison or reformatory (although they may be released far earlier due to overcrowding or a determination that further incarceration is unjustified). Controversially, the use of "two years less a day" sentences has been used by some judges to avoid mandatory sentences such as deportation, weapons prohibitions, prohibitions to entry to the US, or harsh pardon ineligibility barriers. The use of the terms "prison", "correctional centre", and "reformatory" vary by province and category of offender. In contrast, federal penitentiaries are mostly referred to simply as "institutions".

A1 The Kentucky Supreme Court rejected that argument on May 7, 2003, though the justices' reasons for doing so varied and the final opinion conceded that "[t]his is a close case on the law, and Heleringer has presented legal issues worthy of this court's time and attention". The state Board of Elections instructed all county clerks to count absentee ballots cast for Fletcher and Bates as votes for Fletcher and Pence.

The government's constitutional reform in 2015 stripped the accusations commission of most of its power and restricted the existing fuero constitucional to the President. In its stead, the 2015 reform created the Comisión de Aforados, which will investigate and indict the aforementioned judges and Attorney General, even if they may have ceased to exercise their functions. The commission will be made up of five members elected by a joint session of Congress for individual eight-year terms, from lists sent by the Council of Judicial Government and elaborated through a public competition. The eligibility, ineligibility and incompatibility rules for the commission will be the same as for members of the Supreme Court of Justice.

Two professional speed skaters, Mark Tuitert and Niels Kerstholt, lodged a complaint and on 5 October 2015, the European Commission initiated formal antitrust proceedings into alleged anti-competitive restrictions imposed by the International Skating Union on athletes and officials' economic activities and alleged foreclosure of competing alternative sport event organisers. On 20 October 2015, the ISU published the procedure for independent organisers to receive authorisation from the ISU Council. Under the 2016 Eligibility rules, the sanctions imposed on a skater participating in non-authorised events ranged from a warning to periods of ineligibility running from an unspecified minimum to a maximum of a lifetime. In December 2017, the European Commission decided that ISU's eligibility rules breach EU competition laws.

At the 2007 federal election, it was claimed by the Liberal Party that George Newhouse, the high-profile Australian Labor Party candidate for the seat of Wentworth, was ineligible to stand for parliament under subection 44(iv). The basis of the claim was that Newhouse had not resigned from the New South Wales Consumer Disputes Tribunal and so was occupying an "office of profit under the Crown". Liberal frontbencher Andrew Robb claimed that a by-election in Wentworth would be necessary if Newhouse were to win the seat, due to his ineligibility. The matter never came to a head, however, as Newhouse was comfortably defeated by the incumbent Liberal Party candidate and federal Minister Malcolm Turnbull.

Article I, Section 6, clause 2 of the U.S. Constitution, the Ineligibility Clause, states that "no Person holding any Office under the United States, shall be a Member of either House during his Continuance in Office." The Reservists Committee and several of its members brought suit to challenge the legality of members of Congress holding officer's commissions in the reserve components of the armed forces. Wong Kim Ark had determined that all persons born in the United States, including Asian Americans, were citizens, these cases confirmed that foreign-born Asian immigrants were legally excluded from naturalized citizenship on the basis of race. During this period, Asian immigrants continued to face racial discrimination. In addition to first- generation immigrants whose permanent ineligibility for citizenship curtailed their civil and political rights, second-generation Asian Americans (who formally had birthright citizenship) continued to face segregation in schools, employment discrimination, and prohibitions on property and business ownership. On February 16, 2012, the Supreme Court ruled that the law did not violate the Brazilian Constitution and was in force for the 2012 elections and for elections to come. STF justices voted 7-4 in favour of the law. The affirmative votes were based on the "principle of morality," in the ninth paragraph of Article 14 of the Constitution of Brazil: "conditions of ineligibility to protect the administrative probity, morality for the exercise of mandate, considered the candidate's past life." The four dissenting opinions argued on the basis of the principle of presumption of innocence, in section 57 of Article 5 (an entrenched clause) of the Constitution of Brazil, which says that no one shall be considered guilty until a penal sentence was final and unappealable.

The crown asked for a 50-year parole ineligibility, citing "the enormity of McArthur's crimes", his lack of remorse (McArthur declined to address the court), the betrayals upon his victims, the effect of his crimes on the community, and how he had been a danger up to his arrest. McArthur's defence counsel James Miglin said such a sentence would be "unduly harsh" given McArthur's age, and noted McArthur had waived a preliminary hearing and pleaded guilty, which benefited all involved in the proceedings. On February 8, 2019, Justice McMahon sentenced McArthur to life imprisonment with no parole eligibility for 25 years. McMahon described the crimes as "pure evil" and stated that McArthur showed "no evidence of remorse" and would have continued killing had he not been apprehended.

Eventually he confessed to having accepted some of the money he was charged with having borrowed. For his perjury during a federal grand jury investigation, he was both fined in the legal system and briefly suspended by National Basketball Association after performing public service. The state could not, consistent with the United States Constitution, use federally created racial ineligibility for citizenship as a basis for barring petitioner from earning his living as a commercial fisherman in the ocean water off the state coast. The refusal to issue petitioner a commercial fishing license violated U.S. Const. amend. XIV, and there was no special public interest to support the state ban on petitioner's commercial fishing. A state prohibition of the issuance of commercial fishing licenses to persons ineligible to citizenship makes an unreasonable classification in violation of the equal protection clause of the Fourteenth Amendment (distinguishing Terrace v. Thompson, 263 US 197; Porterfield v. Webb, 263 US 225; Webb v. O'Brien, 263 US 313; and Frick v. Webb, 263 US 326). 1\.

The NCAA considers all paid fantasy games—including daily fantasy—to fall under its prohibition of sports wagering by student athletes, punishable by ineligibility to participate in NCAA- sanctioned athletics for one year. Advertising for daily fantasy services are also forbidden from being broadcast during telecasts of the NCAA's tournaments. In August 2015, the NCAA and a group of ten conferences jointly campaigned against daily fantasy games featuring college sports, asserting that DFS is inconsistent with the NCAA's policies and values. The SEC had discussions with its broadcast partners in an attempt to discourage the advertising of daily fantasy games during its telecasts, while both Big Ten Network and Pac-12 Network prohibited advertising for daily fantasy games involving college sports.

Mentor was dropped by England for the next 18 months due to England Netball's new policy of limiting selection to domestic-based players. The policy, an attempt to improve the standard of domestic netball, stated England Netball were not prepared to accommodate athletes plying their trade in overseas leagues and consequently disqualified Mentor from playing for England. She was considered ineligible for the England national team for that entire year, including the 2011 Netball World Championships in Singapore, although this ineligibility was later overturned via a compromise agreement between the players and the management team allowing Mentor to play for England in the World Championships. In 2014 Mentor played her fourth season with Melbourne Vixens as their number 1 Goal Keeper.

Controversy has been raised over such issues as inaccurate voter lists, cancellation of voting in some violent areas, vilification of Burmese Muslims as a campaign tool, and the ineligibility to vote of the Muslim Rohingyas. According to The Economist, "No matter how many millions of Burmese vote against the Union Solidarity and Development Party, which rules the country and is backed by the army, the army will remain the real power in Myanmar." There have been allegations of fraud in many townships where unknown ballots cast as advance votes boosted the results of the Union Solidarity Development Party. The Union Election Commission has defended these votes, stating that they had arrived before the polling booths closed, and thus they were legitimate votes.

Due to National Hockey League (NHL) players' ineligibility in the Winter Olympics and the annual World Championships, both amateur competitions, Canada was not able to send its best players to top international tournaments. While the top players in Europe qualified as amateurs, all the best Canadian players competed in the professional NHL or World Hockey Association. Following the 1972 and 1974 Summit Series, in which Canadian players from the NHL and WHA competed against the top players from the Soviet Union, there was interest in a world hockey championship where each country could send its best players. In a combined effort from Doug Fisher of Hockey Canada and Alan Eagleson of the NHL Players' Association, plans for such a tournament soon began.

The Tigers finished the 2017–18 season 16–20, 12–6 in SWAC play to finish in a three-way tie for second place. Due to Grambling State's Academic Progress Rate violations and subsequent postseason ineligibility, they received the No. 3 seed in the SWAC Tournament where they defeated Alabama State, Prairie View A&M; and Arkansas–Pine Bluff to become SWAC Tournament champions. It is thus possible that careful claims drafting techniques will succeed in elevating form over substance, to avoid the impact of the machine-or-transformation test. The Supreme Court warned the deputies and the Venezuelans that "sowing doubts about the origins of the president" may "lead to the corresponding criminal, civil, administrative and, if applicable, disciplinary consequences" for "attack against the State". On 11 January 2018, the Supreme Tribunal of Justice of Venezuela in exile decreed the nullity of the 2013 presidential elections after lawyer Enrique Aristeguita Gramcko presented evidence about the presumed non-existence of ineligibility conditions of Nicolás Maduro to be elected and to hold the office of the presidency. Aristeguieta argued in the appeal that, under Article 96, Section B, of the Political Constitution of Colombia, Nicolás Maduro Moros, even in the unproven case of having been born in Venezuela, is "Colombian by birth" because he is the son of a Colombian mother and by having resided in that territory during his youth. The Constitutional Chamber admitted the demand and requested the presidency and the Electoral Council to send a certified copy of the president's birth certificate, in addition to his resignation from Colombian nationality.

In keeping with the strange season where the uncommon became commonplace, four of the top nine teams lost and the muddy national title picture got a little clearer when the AP poll was released on November 13. The #2 Washington Huskies, poised for a possible shot at the title, lost a stunner at home to UCLA, 25–22, when the Bruins kicked the game-winning FG with seven seconds left, ending a national title dream, although the Huskies still had the inside track to the Rose Bowl. #3 Houston, with Heisman Trophy candidate David Klingler filling the shoes of departed 1989 Heisman winner, Andre Ware, finally lost, falling to #14 Texas, 45–24, and ending speculation that the national championship might go to a team on probation. Houston's bowl ineligibility assured they would be given no consideration in the final poll for a top ranking. #6 Iowa stumbled at home and lost to Ohio State, 27–26, as the Buckeyes scored the game-winning touchdown with one second left, ending the Hawkeyes' title bid.

In late 2009, some homeless advocacy organizations, such as the National Coalition for the Homeless, reported and published perceived problems with the HEARTH Act of 2009 as a HUD McKinney-Vento Reauthorization bill, especially with regard to privacy, definitional ineligibility, community roles, and restrictions on eligibile activities.National Coalition for the Homeless, "NCH Public Policy Recommendations: HUD McKinney-Vento Reauthorization", Washington, D.C., September 14, 2009 On June 22, 2010, the United States Interagency Council on Homelessness presented Opening Doors: Federal Strategic Plan to Prevent and End Homelessness to the Obama Administration and Congress. This is the nation's first comprehensive strategy as mandated by the HEARTH Act and includes Housing First as a best practice for reaching the goal of ending chronic homelessness by 2015. On June 11, 2014, the 100,000 Homes Campaign in the United States, launched in 2010 to "help communities around the country place 100,000 chronically homeless people into permanent supportive housing", announced that it reached its four-year goal of housing 100,000 chronically homeless people nearly two months before its July 29 deadline.

After his stint in Texas, Harvey went back to Queens in 1987. He said that the time spent away from home made homesick, which is why he decided to attend St. John's University instead of Syracuse. The school is located in Queens, making the decision easy for him. Harvey also admitted that St. John's did not recruit him while he was in high school because they already had Mark Jackson at the point guard position. By the time he returned in 1987, the Redmen had a spot available for him, so he jumped on the opportunity. Harvey started as a junior in 1987–88. He averaged 11.9 and 4.8 assists in 27 games played, but failed to show any shooting range, connecting on only 15-of-39 three-point attempts. Harvey did not thrive playing in a half-court offense, something he later said he found difficult to do. In what should have been his senior season in 1988–89, Harvey was forced to sit out due to academic ineligibility from the year before.

A report on the rules of royal succession was prepared by the Political and Constitutional Reform Select Committee of the House of Commons, chaired by Graham Allen, and was published in December 2011. The report welcomed the proposals, but drew attention to "connected issues that may be raised when the proposals are debated, depending on the scope of the bill, especially the future role of the Crown in the Church of England, and the continued ineligibility of women to succeed to the majority of hereditary peerages, which remains a matter of public interest for as long as it has an impact on gender balance in the House of Lords".House of Commons Political and Constitutional Reform Committee, Rules of Royal Succession: Eleventh Report of Session 2010–12, 7 December 2011. Retrieved 3 December 2012 On 9 September 2012, the British government published a response to the report, reiterating that it intended to implement the Perth Agreement but had no plans to change the laws of succession to peerages or the established status of the Church of England.

The bill directs the Director of National Intelligence to report to Congress on security issues caused by the Chinese government's reported crackdown on Uyghurs in Xinjiang, the Federal Bureau of Investigation to report on efforts to protect Uyghurs and Chinese nationals in the United States, the U.S. Agency for Global Media to report on Chinese media related issues in Xinjiang, and for the United States Department of State to report on the scope of the reported Chinese government crackdown on Uyghurs in Xinjiang. U.S. President Donald Trump has to submit a report to Congress within 180 days. The report shall designate Chinese officials and any other individuals who are responsible for carrying out torture; prolonged detention without charges and a trial; abduction; cruel, inhumane, or degrading treatment of Muslim minority groups; and other flagrant denials of the "right to life, liberty, or the security" of people in Xinjiang. Persons identified in the report would then be subject to sanctions which include asset blocking, visa revocation, and ineligibility for entry into the United States.

In a brief per curiam opinion, the court dismissed the case for want of standing: > The grounds of this motion are that the appointment of Mr. Justice Black by > the President and the confirmation thereof by the Senate of the United > States were null and void by reason of his ineligibility under Article I, > Section 6, Clause 2, of the Constitution of the United States, and because > there was no vacancy for which the appointment could lawfully be made. The > motion papers disclose no interest upon the part of the petitioner other > than that of a citizen and a member of the bar of this Court. That is > insufficient. It is an established principle that to entitle a private > individual to invoke the judicial power to determine the validity of > executive or legislative action he must show that he has sustained or is > immediately in danger of sustaining a direct injury as the result of that > action and it is not sufficient that he has merely a general interest common > to all members of the public.

In 2005, a local electoral court suspended Rosinha's political rights for three years, on the grounds of abuse of economic and political power, misuse of public structure and staff, and distributing money without proven legal source during the 2004 municipal elections. The court found that she and her husband had interfered heavily to keep their local power-base in Campos, by supporting the election of Geraldo Pudim.Latin American regional report: Brazil & Southern cone, Volume 105, Issues 1-12 Along with her husband and Pudim, Rosinha was found guilty of, according to the sentence, distributing social help at random, including houses sold by the government at the symbolic 1R$ rate, offering money for votes, and distributing "school kits" (paper notebooks, briefcases, backsacks, pens and pencils, and other similar items) to students during the electoral campaign in Campos, something forbidden under Brazilian Electoral Law. The ineligibility penalty was, however, later quashed by the regional electoral court, something that allowed Pudim to present himself as candidate in the extraordinary 2006 mayoral elections, while his adversaries were found guilty on the same charges of electoral corruption and prevented from running; Pudim, was, however, defeated.

On 13 March 2018, businessman Wong Tai-hoi of the Taxi Drivers & Operators Association accompanied by former legislator Wong Kwok-hing of the Hong Kong Federation of Trade Unions (FTU) lodged a judicial review application challenging Au Nok-hin and returning officer Anne Teng Yu-yan, who approved Au’s candidacy to run in the by-election, claiming that Au was ineligible to run because he burned a copy of the Basic Law during a protest against Beijing’s interpretation of the Basic Law over the oath-taking controversy on 2 November 2016. The application was however rejected by the court on 29 March. In September 2019, Court of First Instance Judge Anderson Chow overturned the returning officers' decision to disqualify Agnes Chow and Ventus Lau in the by-elections respectively, on the basis of that the disqualified candidates were not given any reasonable opportunity to respond to the returning officers' questions which led to their ineligibility. The decisions meant that the winners of the Hong Kong Island and New Territories East, Au Nok-hin and Gary Fan, were not duly elected and therefore lost their seats.

Each house has its own eligibility requirements established by the Constitution, but there are common rules of ineligibility and incompatibility (régimen de inhabilidades e incompatibilidades), determined by the Constitution. Anyone who has been sentenced to deprivation of liberty (detention) at any time except for political crimes and culpable negligence; hold dual citizenship and are not native-born citizens; held a public employment position with political, civil, administrative or military authority or jurisdiction within the year prior the election; participated in business transactions with public entities or concluded contracts with them, or were legal representatives of entities which handled taxes or quasi-fiscal levies within the six months prior to the election; lost their mandate (investidura) as members of Congress or holds ties of marriage or kinship with civil servants holding civil or political authority may not be elected to Congress. In addition, relatives through marriage or kinship who are registered candidates for the same party for an office elected on the same day may not be members of Congress. The constitution also bans election to or membership in more than one office or body, even if the terms only overlap partially.

Still there are great criticisms of the Constitution, stating that it is of discriminatory nature, since in many of its articles it discriminates against citizens that are not from "constituent peoples", such as the Article V which sets out the rules for the election of the Presidency of Bosnia and Herzegovina. There has been an attempt to challenge the Electoral law, which has the basis in the Constitution, which is seen as being discriminatory to "Others", as well as to "constituent peoples" to some degree, by trying to interpret the Article II(2) in a way that the European Convention for the Protection of Human Rights and Fundamental Freedoms and its Protocols have the supremacy over the Constitution of Bosnia and Herzegovina itself. However, the Constitutional Court of Bosnia and Herzegovina declined this position in its decision number U-5/04. This has led Jakob Finci, the leader of Jewish community in Bosnia and Herzegovina, to file a suit against Bosnia and Herzegovina in front of European Court of Human Rights, which acknowledged his ineligibility for Presidency and House of Peoples to be in violation of the European Convention on Human Rights.

The effort lasted twenty months, and involved fifty-one meetings with government officials and MPs, as well as officials in the opposition party leaders' offices and in the newly elected Coalition Avenir Québec government. Targets of SNC-Lavalin's lobbying included the Minister of Public Services and Procurement and Accessibility, Carla Qualtrough, as well as officials in the Prime Minister's Office (PMO). The company advocated for the rapid adoption of legislation to allow a new type of sentencing agreement called deferred prosecution agreement (DPA) and changes to Ottawa's Integrity Regime to amend the 10-year contract ineligibility for suppliers with ethics- related criminal convictions. On recommendation from the Director of Public Prosecutions (DPP) Kathleen Roussel, former SNC-Lavalin Executive Vice President Normand Morin was charged in the Court of Quebec in May 2018 with making illegal donations to Canadian federal political parties. The charges, which were unrelated to the federal charges against the company, alleging that from 2004 to 2011, Morin orchestrated and solicited political donations from employees or their spouses to Canadian federal political parties anonymously on behalf of SNC-Lavalin, to be reimbursed afterwards.

During his first two terms, he contributed to the radical re-shaping of Levallois-Perret, transforming the deliquescent industrial zones or wastelands (occupying nearly a quarter of the city's area) into residential and office districts. During the presidential campaign of 1995, he supported the candidacy of Édouard Balladur, who was defeated by Jacques Chirac. In the following municipal elections, he lost to the Chiric-supporting Olivier de Chazeaux. In May 1996, Balkany was convicted (decision upheld on appeal on 30 January 1997) by the 9th chamber of the Nanterre Criminal Court, to 15 months suspended sentence, 200,000 francs fine and two years of ineligibility, for "misappropriation of public funds for personal gain".. Between 1985 and 1995, he had put three people on the city's payroll as municipal employees, while these individuals dealt only with his Levallois-Perret apartment and his second home near Giverny.. His wife Isabelle, vice-president of the general council of Hauts-de-Seine and city councilor in Levallois-Perret, was sentenced to the same penalty for misappropriation. On 28 July 1999, the Regional Auditor of Ile-de-France sentenced Patrick Balkany to reimburse the municipality of Levallois-Perret the amount of salaries of municipal employees subject to his conviction, in the amount of €523,897.96. .

After a loss to the UCLA Bruins, Nebraska won their remaining regular season games with the exception of a 38–63 loss to eventual Big Ten Leaders Division champion Ohio State. The Cornhuskers' 7–1 conference record earned the team their first Big Ten Legends Division title, and first appearance to the 2012 Big Ten Football Championship Game. Due to postseason ineligibility of both Ohio State and Penn State, they played the third place team in the Leaders Division, Wisconsin. The Cornhuskers never led during the game and were defeated by a score of 31–70. In their second appearance in as many seasons, the Cornhuskers played in the 2013 Capital One Bowl and lost to Southeastern Conference East Co-Champions Georgia Bulldogs, 31–45. 2013 season The Cornhuskers began the 2013 season ranked #18 in the AP Poll. After a loss to the UCLA Bruins, Nebraska lost starting quarterback Taylor Martinez, the first of many injuries during the 2013 season. Nebraska would go on to lose to the Minnesota Golden Gophers, Michigan State Spartans and Iowa Hawkeyes to finish the regular season 8–4. Nebraska went on and defeated Georgia 24–19 in the Gator Bowl, avenging last year's bowl loss to the Bulldogs.

Some examples include Nick Van Exel (1993, Los Angeles Lakers of the NBA and Rapid City Thrillers of the CBA), Dontonio Wingfield (1994, Seattle SuperSonics and Rapid City Thrillers), Stephen Jackson (1997, Phoenix Suns and La Crosse Bobcats), Jason Hart (2000, Milwaukee Bucks and Idaho Stampede); and several others. CBA franchises usually selected players who had the higher chance to sign for them instead of signing overseas or in the NBA, even though some teams used their picks in the later rounds to select players who were likely to be drafted in the NBA, in the event these players were cut in the preseason. Some teams also used their picks for publicity: for example, Cheryl Miller, a female player who played for USC in college, was selected by the Rockford Lightning with the 57 pick in the 1986 CBA draft; in the 1994 CBA draft Mexican soccer player Jorge Campos was drafted by the Mexico Aztecas, despite his ineligibility. In 1997, Lamar Odom, then a highly recruited high school prospect, was given the opportunity to enter the CBA draft and choose the team he wanted to play for, reversing the traditional drafting process; Odom, however, decided not to hire an agent and opted to play in college.
