The Commission found that Intel acted unlawfully by granting rebates to four computer manufacturers (Dell, Lenovo, HP, and NEC) on condition that they purchased from Intel. In its decision it fined Intel €1.06 billion for abuse of dominance through exclusivity rebates. This also illustrated the Courts recognition for an effects based approach despite the relatively recent cases of Solvay and ICI, where the Court has seemed reluctant to move away from a formalistic approach.
United States. Stanfield Johnson has called her the court's "great dissenter". He has said that her dissents in the area of federal contracts "consistently reflect the view that a primary responsibility of the court is to serve 'the national policy of fairness to contractors'". He writes: > At the core of Judge Newman's dissenting jurisprudence is the premise that > the sovereign as a contracting party should be accountable for its actions, > subject only to limited exceptions not to be presumed, unnecessarily > expanded, or imposed in a formalistic doctrinaire way that ignores or masks > the facts of government conduct.

On the Metacritic website, which aggregates reviews from critics and assigns a normalized rating out of 100, Peepers received a score of 78, based on 1 mixed and 8 positive reviews. The Independent write that Peepers is "a little more formalistic than before" but conclude that "the resoluteness of the Bear in their Britishness .... is one of the rowdier pleasures of the age". The Guardian awarded the album 4 stars, complimenting the "freshness" given to the music by Rochford's choice of recording and rehearsal techniques.
In literary theory, formalism refers to critical approaches that analyze, interpret, or evaluate the inherent features of a text. These features include not only grammar and syntax but also literary devices such as meter and tropes. The formalistic approach reduces the importance of a text’s historical, biographical, and cultural context. Formalism rose to prominence in the early twentieth century as a reaction against Romanticist theories of literature, which centered on the artist and individual creative genius, and instead placed the text itself back into the spotlight to show how the text was indebted to forms and other works that had preceded it.

Particularly involved with software art and internet art, he is a part of the readme culture and uses code as a form of art. In 1997, he released his first interactive work, Form Art, in which only minimum factors are programmed in the form of HTML. Shulgin describes this page as a "formalistic" aesthetic art site - a play on words taking into account the clean composition as well as the tools of its creation. Navigating this site requires aimless click-throughs of blank boxes and links, which lead the viewer through 19 pages of "form art" animations.
Developing on the discussion of the first chapter, Gilmore begins by focusing on the change from a subjective approach to an objective approach in the theory of contracts. Contract law in the 19th century was experiencing a shift from a formalistic regime toward a more flexible paradigm that tended to uphold the validity of contracts. This was due in part to the Industrial Revolution and the need to facilitate commerce between parties. The requirement of ceremonial trappings such as seals and ribbons gave way to a more reality based emphasis on consideration as indicia of the parties' intent to contract.

Duff became a champion of the importance of the Barbeau-Beynon corpus, though he distanced himself from Barbeau's more controversial theories on the recent peopling of the Americas. In 1960 he did fieldwork in Gitksan and Nisga'a communities, and in 1969 he served in court as an expert witness in the Nisga'a land-claims case Calder vs. Attorney-General of B.C., the famous "Calder case." In his later years he was consumed with studying Haida art in all its formalistic and cosmological complexity—taking in structuralist and psychoanalytical insights—an endeavour which he undertook with his friend the Haida artist Bill Reid but which never resulted in a comprehensive published articulation.

Later, committee member Hermann Lauter demanded the inclusion of historical events that had no direct connection with Thälmann's life, such as the October Revolution.
In this way, the more formalistic or abstract aspect of her cinema, with a structural vocation, is pierced by an emotional tone, at the same time as it gives rise to false clues about ambiguous fictions. For Lenin, the primary feature of Marx's "dialectical materialism" (Lenin's term) was its application of materialist philosophy to history and social sciences. Lenin's main input in the philosophy of dialectical materialism was his theory of reflection, which presented human consciousness as a dynamic reflection of the objective material world that fully shapes its contents and structure. Later, Stalin's works on the subject established a rigid and formalistic division of Marxist–Leninist theory in the dialectical materialism and historical materialism parts. While the first was supposed to be the key method and theory of the philosophy of nature, the second was the Soviet version of the philosophy of history.
Another telegram indicates that the plan to reinstate the Duke as king had been discussed with the Duke and Duchess: "Both seem to be completely bound up in formalistic ways of thought since they replied that according to British constitution this was not possible after abdication ... The movement was based on revolt against what the Tachtigers perceived as the formalistic and overly wrought style of mainstream literature in their day, particularly as favored by the predominant literary journal in Amsterdam, De Gids (The Guide). The Tachtigers instead insisted that style must match content, and that intimate and visceral emotions can only be expressed using an intimate and visceral writing style. For guidance in this effort, they tended to draw inspiration from Shakespeare, and from the then recent Impressionist painters and Naturalist writers. After De Gids continued to reject most of their submissions, the Tachtigers founded their own competing literary journal, mockingly called De Nieuwe Gids (The New Guide), first published in October 1885.
His most current work embraces the digital medium, in places like Cuba, Venezuela and in his native America, which is more candid, but still formalistic in approach. The portrait style is up-close and painterly, with very warm earth tones against a mottled canvas. The style is usually medium-shot and classically lit using medium format cameras, referencing the Dutch painting masters such as Rembrandt and Holbein. The portraits have a quality about them that is less about fashion than about personality and as groups there is attempt to show their disparity as well what is relatable among the earth's faces in a manner that is real, non-compromising, or over- glamorized.
While often noted for their politics, the aesthetics of City Symphonies such as Alberto Cavalcanti's Rien que les heures (1926), Walter Ruttmann's Berlin: Symphony of a Metropolis (1927), and Dziga Vertov's Man with a Movie Camera (1929) also attempt to arrest the viewer's perception and create a highly formalistic visual poetry. While striving for what amounts to peak formalism, Regen differs from other city films in that its focus is subtly shifted from city life to the rainstorm itself, and how it transforms the city. Its subjects are numerous and anonymous, and few shots identify the setting of the film as Amsterdam, focusing instead on raindrops, clouds, and other small details of the rain's interaction with the city.
From the time of the Bolshevik Revolution in 1917 until 1932, the historical Russian avant-garde flourished and strove to appeal to the proletariat. However, in 1932 Stalin's government took control of the arts with the publication of "On the Reconstruction of Literary-Artistic Organizations"; a decree that put artists' unions under the control of the Communist Party. Two years later, Stalin instituted a policy that unified aesthetic and ideological objectives, which was called Socialist Realism, broadly defined as art that was, "socialist in content and realist in form." Moreover, the new policy defined four categories of unacceptable art: political art, religious art, erotic art, and "formalistic" art, which included abstraction, expressionism, and conceptual art.

In Kidwell v The Master, an important case in the South African law of succession, the testator had signed right at the bottom of the will; there was about between the end of the will (which included the witnesses’ signatures) and the testator's signature. The question before the court was where the end of the will was. The court held that the will was invalid as it did not comply with section 2(1)(a)(i) of the Wills Act. The decision has been criticised as overly formalistic by some commentators, who believe the overriding criteria for the courts should be to give effect to the wishes of the testator, and this case did not do this over something seemingly insignificant.

Scholar and lawyer Rajeev Dhavan has described the Tagore Lecture Series as the 'most celebrated' of Indian endowed lectures on law, noting that the research produced for these lectures represents a 'black-letter' tradition, aimed at documenting the law and not critically assessing it. This assessment is echoed by e Rajkumari Agrawala, who has critiqued the series for its focus on a formalistic approach to law, and noted a lack of theoretical appreciation in the lectures delivered under this endowment. The Tagore Law Lectures have been often cited by courts in India as references for the interpretation of Indian laws. The Privy Council in 1941 relied on Upendra Nath Mitra's Tagore Law Lecture in 1932, concerning the law of limitation.
Though Anneville was a serene and stately manor house, it was a far cry from the palace at Het Loo, and symbolized a formal break from the highly formalistic and class conscious existence the royal family had been confined to before the war. While the queen was in residence the ground floor of the coach house served as a motor garage, while the rooms above the garage housed the small guard detail. Anneville was the scene of a number of spontaneous gatherings of the people of the Netherlands. When the people of Breda and the surrounding communities learned the queen was present they gathered there to greet here, and a spontaneous procession filed past the house to greet their queen.
However, Chávez applied the word "toccata" in its original sense, using its root meaning of toccare, or "to touch", which he used to display the various touches an artist can give a performance, rather the different lyrical shades. For the U.S premiere, during which the composer himself conducted the Los Angeles Philharmonic, Chávez wrote in the program notes that "The Toccata was written as an experiment in orthodox percussion instruments – those used regularly in symphony orchestras, that is, avoiding the exotic and the picturesque. Therefore it relies on its purely musical expression and formalistic structure." The first and last movements of the three-movement work are both in sonata form, during which the composer explores long, sustained rolls, and syncopated patterns.
With agreement from Li Xiǎn as well, the coup leaders acted on 20 February,兩千年中西曆轉換 killing Zhang Yizhi and Zhang Changzong, and then surrounding Wu Zetian. She, in fear, asked, "Who is disturbing me?" Zhang Jianzhi responded, in a formalistic manner: Wu Zetian subsequently tried to have Li Xiǎn returned to the palace of the Crown Prince, but the coup leaders ignored her. While the coup leaders allowed Wu Zetian to retain the title of "emperor," they had her put under house arrest at the secondary palace Shangyang Palace () and forced her to yield the throne to Li Xiǎn, who was formerly emperor, and he was restored to the throne (as Emperor Zhongzong).
Although it influenced the course of subsequent German philosophy dramatically, exactly how to interpret this concept was a subject of some debate among 20th century philosophers. Kant first describes it in his Critique of Pure Reason, and distinguished his view from contemporary views of realism and idealism, but philosophers do not agree how sharply Kant differs from each of these positions. Transcendental idealism is associated with formalistic idealism on the basis of passages from Kant's Prolegomena to any Future Metaphysics, although recent research has tended to dispute this identification. Transcendental idealism was also adopted as a label by the subsequent German philosophers Johann Gottlieb Fichte and Friedrich Wilhelm Joseph von Schelling, Arthur Schopenhauer, and in the early 20th century by Edmund Husserl in the novel form of transcendental-phenomenological idealism.
The period between the fourteenth century and the beginning of the nineteenth century had been largely one of decline and neglect, and is generally regarded as barren by historians of logic. The revival of logic occurred in the mid-nineteenth century, at the beginning of a revolutionary period where the subject developed into a rigorous and formalistic discipline whose exemplar was the exact method of proof used in mathematics. The development of the modern "symbolic" or "mathematical" logic during this period is the most significant in the 2000-year history of logic, and is arguably one of the most important and remarkable events in human intellectual history. The main critique of formalism is that the actual mathematical ideas that occupy mathematicians are far removed from the string manipulation games mentioned above. Formalism is thus silent on the question of which axiom systems ought to be studied, as none is more meaningful than another from a formalistic point of view. Recently, some formalist mathematicians have proposed that all of our formal mathematical knowledge should be systematically encoded in computer-readable formats, so as to facilitate automated proof checking of mathematical proofs and the use of interactive theorem proving in the development of mathematical theories and computer software. Because of their close connection with computer science, this idea is also advocated by mathematical intuitionists and constructivists in the "computability" tradition—see QED project for a general overview.
Geometric abstract artists, minimalists, and hard-edge painters may, for example, elect to use the edges of the image to define the shape of the painting rather than accepting the rectangular format. In fact, the use of the shaped canvas is primarily associated with paintings of the 1960s and 1970s that are coolly abstract, formalistic, geometrical, objective, rationalistic, clean-lined, brashly sharp-edged, or minimalist in character. There is a connection here with post- painterly abstraction, which reacts against the abstract expressionists' mysticism, hyper-subjectivity, and emphasis on making the act of painting itself dramatically visible – as well as their solemn acceptance of the flat rectangle as an almost ritual prerequisite for serious painting. While the shaped canvas first challenged the formalized rectangular shape of paintings, it soon questioned the constraints of two-dimensionality.
The late United States Supreme Court Justice Antonin Scalia was noted for his formalist views about a variety of topics, particularly his view that the United States Constitution should be interpreted in accord with its original meaning and his view that statutes should be read in accord with their plain meaning. In A Matter of Interpretation, Scalia defended textualism – and, by extension, formalism – saying: :Of all the criticisms leveled against textualism, the most mindless is that it is formalist. The answer to that is, of course it's formalistic! The rule of law is about form ... A murderer has been caught with blood on his hands, bending over the body of his victim; a neighbor with a video camera has filmed the crime and the murderer has confessed in writing and on videotape.
For the first half of the 20th century, Bartók and Kodály were potent symbols for a generation of composers, especially Kodály. Starting in about 1947, a revival in folk choir music began, ended as an honest force by 1950, when state-run art became dominant with the rise of Communism. Under Communism, "(c)ommitment and ideological affiliation (were) measured by the musical style of a composer; the ignominious adjectives 'formalistic' and 'cosmopolitan' gain currency ... (and the proper Hungarian style was) identified with the major mode, the classical aria, rondo or sonata form, the chord sequences distilled" from Kodály's works. Music was uniformly festive and optimistic, with every deviation arousing suspicion; this simplicity led to a lack of popular support from the public, who did not identify with the sterile approved styles.
The literary criticism of Germán Gullón offers three different facets: the scholarly one, the author of literary studies, the text editor of Spanish literature of the 19th, 20th and 21st centuries, and the one as literary critic. As author of literary studies emphasizes his works about the 19th century and about the modernism (end of the century and Generation of '98). His contribution has been very important, within the line of formalistic works started by Ricardo Gullón, Fernando Lázaro Carreter, Francisco Rico and Darío Villanueva Prieto, because it is the one who has insisted on the importance of the way in which the works are narrated and his influence in the configuration of the meaning. Their editions have also supposed a landmark in the edition of classic Spanish moderns, for taking an original point of view.
This court was not burdened by the ordo iudiciarius, the slow and formalistic rules of the papal courts, but rather gave expedited and summary rulings. It was in no small part due to the unwillingness of Murat to coerce the extreme taxation ordered by Gregory XI, that the pontiff found himself bankrupt by his wars against the Visconti and ultimately by the War of the Eight Saints, fought against a coalition of Italy city states led by the Republic of Florence, which instigated rebellion in the Papal States. While Gregory XI was forced to borrow from the Duke of Anjou, Murat excelled at diplomacy, convincing Bologna to relent in exchange for a lifting of the interdict. De Cros drafted and persuaded his cousin Gregory XI to adopt Futuris peculis on March 19, modifying the laws of the papal conclave.
Traditionally, society has considered reading and writing in their formalistic senses, and viewed children as being knowledgeable about literacy only when they were capable of identifying written words without picture clues, and spelling words that adults could read. In 1966, New Zealand researcher Marie Clay introduced the concept of emergent reading, using it to describe the earliest behaviors and concepts young children employ in interacting with books even before they are capable of reading in the conventional sense. The 1970s and early 1980s saw robust research activity in children's early language development, early childhood education, and reexamination of the concept of reading readiness. This work resulted in Teale and Sulzby assembling a book authored by various leading researchers of the time that proposed reconceptualizing what happens from birth to the time when children reading and write conventionally as a period of emergent literacy.
For the last three decades of her life, Lex‐Nerlinger continued as a well‐known graphic designer and portraitist in the GDR, working until the day she died in 1975, but under the state's sanctioning of Socialist Realism her photomontages, that she had worked so hard to master, were denounced as "formalistic". However, the force of her image Paragraph 218 was restored when it was taken up by the women's movement of the 1970s. Even without a contract in the fifties Lex- Nerlinger created photo-derived portraits of workers, among which is the painting Schaffnerin Anni (‘Conductor Anni’) the now legendary streetcar artist. Anni faces the viewer head-on, looks us in the face with a challenging smile and points to her tram-conductor’s money changer, which in street jargon is a “Krautkasse” (“Herb’s purse”), which she wears around her neck.
Czech philosophers Václav Bělohradský and Stanislav Komárek use the term "neonormalization" (neonormalizace) for a stage of Czech society in the post-communist period, which is compared with the torpidity and hypocrisy of the 1970s and 1980s. Bělohradský in his book Společnost nevolnosti (Slon, 2007) calls "neonormalization" the direction since 1992 that all alternative opinions are crowded out, a culture shifts into the trash of entertainers, next the deepening of democracy is blocked, the public space is infested with right-wing ideology and Czech Republic participated in all sorts of nefarious wars. Komárek, a philosopher and biologist, in many his articles since 2006Stanislav Komárek: "Neonormalizace", In: Vesmír 85, No. 9, 2006, p. 565. popularizes his opinion that in certain stages of society development, the administrative and formalistic aspect (or the "power of mediocres") outweighs a common sense, creativity and utility,.
All of these projects were carried out with the aid of the experts from the Soviet Union, particularly in terms of urban economic development and physical urban design. Urban planning at that time was mainly based on Soviet planning principles and the model of the post-war Soviet planning practice. Soviet-style communist planning concentrated on "formalistic street patterns and grand design for public buildings and monuments, huge public squares, and the predominance of master plans".Tang, Wing-Shing; Chinese Urban Planning at Fifty: An Assessment of the Planning Theory Literature Journal of Planning Literature 2000 14: 350 The role of communist planners during this period was to focus on location selection of factories and industrial plants, arrangement of service facilities, design of the layout of industrial towns, functional division of urban land use zones and development of residential districts.
In the works of painters such as Isaac Golombek and Nahum Tevet this preoccupation with deconstructing the personal narrative by dealing in a formalistic way with the relationship between form and content, is also very much in evidence. If in the 1970s Israeli art is full of social and political messages, art in the 1980s is more concerned with "protest". This attribute is especially evident in the second half of the 1980s, under the influence of events such as the 1982 Lebanon War and the outbreak of First Intifada. The painter David Reeb, for example, painted works of a clear political nature, such as "Green Line With Green Eyes" (1987), which showed the borders of Israel without the land that was conquered in the Six-Day War, beyond the green line, combined with portraits of Arabs with their face covered and the coastline of the Tel Aviv beach.
Kim Yol went on to accuse Chang Sun-myong in the latter half of his speech, charging that he had failed to perform his duty as a member of the 1st Central Inspection Commission. By this stage, the Soviet- Koreans were contributing to consolidating the position of Kim Il-sung in the party hierarchy; during the struggle between Kim Il-sung and his allies against the domestic faction, the Yanan faction remained neutral. Because of the pressure asserted on him, O Ki-sop went on to "admit" his mistakes to the congress. He acknowledged that he had not taken in the criticism given to him by Kim Il-sung at the 4th Plenary Session of the North Korean Bureau (held in February 1946); his apology to Kim Il-sung in 1946 was formalistic, and he had in reality been committing double-dealing ever since.
