For example, if a defective product causes a personal injury, a contractual provision limiting recovery in such a case will be deemed prima facie unconscionable.

Bender continued his "investigation" with the same degree of intensity until early May 1959 and charged the Teamsters a formidable $58,636.07 in salary and expenses for his efforts. His political career eventually became clouded by allegations of corruption in his ties to the Teamsters.

From there, many pioneers in the social science world modified and brought their knowledge to the original theory. In 1989 Berkowitz published an article, Frustration-Aggression Hypothesis: Examination and Reformulation, which addressed the inconsistency of empirical studies aiming to test the hypothesis, as well as its criticism.

Gray explains that "Kittens" is unlike any of Follen's typical poems, but also notes that Follen is just the sort of person who would write such a piece. It is unlikely Follen composed "Kittens" wholecloth, Gray believes, but rather far more likely that she developed and refined an existing but rude version of the piece. In doing so, she made the poem her own. Although Follen disclaimed authorship following the poem's first appearance in print, she continued to publish it under her name in succeeding years.
Unlike Kōshirō Onchi (1891–1955), father of the sōsaku- hanga movement, who advocated artists’ expression of the "self" in creating prints, Munakata disclaimed all responsibilities as creator of art. Munakata called prints itaga instead of hanga, emphasizing the material instead of the process of printing. (written in the same kanji, han refers to the process of printing, whereas ita refers to the woodblock itself).

Harold Macmillan resigned as Prime Minister in October 1963. Despite Macleod's ability, as a result of his difficult term as Party Chairman, and memories of his time as Colonial Secretary, he was not a realistic candidate for the succession. Macleod believed that the Earl of Home (later Sir Alec Douglas-Home after he had disclaimed his peerage) had behaved with less than complete honesty. He had initially appeared to rule himself out and had offered to help sample Cabinet opinion, before announcing his own candidacy.

By the 1960s, it was unacceptable for a prime minister to sit in the House of Lords, so Home disclaimed his hereditary peerage and successfully stood for election to Parliament as Sir Alec Douglas-Home. The manner of his appointment was controversial, and two Macmillan Cabinet ministers refused to stay in office under him. Criticised by the Labour Party as an out-of-touch aristocrat, he came over stiffly in television interviews, by contrast with Labour leader Harold Wilson. As Prime Minister, Douglas-Home's demeanour and appearance remained aristocratic and old-fashioned.
On 23 October 1963, four days after becoming Prime Minister, Home disclaimed his earldom and associated lesser peerages, under the Peerage Act 1963. Having been made a knight of the Order of the Thistle in 1962, he was known after stepping down from the Lords as Sir Alec Douglas-Home. The safe Unionist seat of Kinross and West Perthshire was vacant following the sudden death of Gilmour Leburn and the candidate initially adopted, George Younger, agreed to stand aside. Douglas-Home was thus adopted as his party's candidate.
At the same time as Juli started out with their success, there were a couple of other bands with German lyrics who experienced a breakthrough. Just before Juli rose to fame, the bands Wir sind Helden (first release in 2003) and Silbermond (first release in March 2004) for example, celebrated their first success. The fact that all 3 of those bands appear with a female singer and German lyrics got them a lot of attention at first. From the start of their career they had to face such comparisons, which they strictly disclaimed.
Once a part of the fleet, Baltar is haunted by visions of Number Six, with whom he converses often (cf. Head Six). It is unclear to Baltar whether these projections are from a chip Number Six implanted in his brain while they were together on Caprica (the explanation originally given by the Number Six vision, which she later disclaimed) or if she is simply a manifestation of Baltar's own mind. Although the vision of Number Six manipulates Baltar through his fear of discovery, she lends him an edge by granting him knowledge of situations.

In a book review, the newspaper Aftenposten stated that the Mercantile Biographical Encyclopedia had a "pretentious" title as it was a "strange mixture of book and advertising". A fictional version of Lord Rothermere appears in Dennis Wheatley's 1934 novel Black August about an attempted Communist takeover of Britain, under the name of "Lord Badgerlake" (mere is another word for lake). Badgerlake supports a paramilitary force called the "Greyshirts", which backs the government during the uprising. Any connection with Fascism is disclaimed, and the novel does not end with a dictatorship.
An disclaimed any involvement and advocated sending an army to attack Yang. Emperor Mingzong thus sent the generals Suo Zitong () and Yao Yanchou () to attack Yang but giving them instructions to capture Yang alive. Suo and Yao, apparently at An's instruction, however, killed Yang when they captured Hezhong. Thereafter, An had Feng Dao and Zhao Feng propose that Li Congke be punished for losing the circuit to a mutiny, but Emperor Mingzong rebuffed them, as he did An when An personally requested, citing how Li Congke had been his son ever since a young age.
The book was first published in 1932, as Short Stories, Scraps and Shavings. In December 1932 Constable and Company published an edition engraved and designed by John Farleigh with the title The Adventures of the Black Girl in her Search for God. A 1934 reprinting including Black Girl, already serialized in 1932, along with a companion essay that disclaimed the supernatural origin of the Bible. In the essay, Shaw declares the Bible to be a book without divine authority—but still important for its ethical messages and valuable as history.
The Yakama tribe argued first that the Washington state constitution did not allow the state to assume jurisdiction over Indians without a constitutional amendment. On becoming a state, Washington disclaimed any jurisdiction over Indian lands. Wash. Const. art. XXVI Both the tribe and the United States, as amicus curiae argued that to be able to apply Public Law 280, the state had to amend their constitution to assume jurisdiction. The state argued that the state legislature, in passing Chapter 36, had complied with the requirements of federal law to assume jurisdiction.
In the aftermath of the Conservative caretaker government's defeat in the 1945 general election, Grigg was raised to the peerage as Baron Altrincham, ending his political career. Three years later, he assumed the editorship of the National Review, a post he held until failing health forced his retirement in 1954. Grigg died a year later in Gloucestershire aged 76. His son, John Grigg, who became the second Baron Altrincham upon his father's death, disclaimed the peerage in 1963 under the terms of the Peerage Act of that year.
715 (1936). In 1969, the Uniform Law Commission included No Profit theory language in its first promulgation of the Uniform Probate Code (UPC).“An individual who feloniously and intentionally kills the decedent forfeits all benefits under this [article] with respect to the decedent's estate, including an intestate share, an elective share, an omitted spouse's or child's share, a homestead allowance, exempt property, and a family allowance. If the decedent died intestate, the decedent's intestate estate passes as if the killer disclaimed his [or her] intestate share.” § 2-803.
Appendix IV - Revised Draft of Agreement Concerning Persia, Sent to Sir A. Nicholson by Sir Edward Grey on June 6, 1907Yale Law School: "Agreement concerning Persia" (in English) For Siam (Thailand), Britain and France signed an agreement in 1904 whereby the British recognised a French sphere of influence to the east of the River Menam's (Chao Phraya River) basin; in turn, the French recognised British influence over the territory to the west of the Menam basin and west of the Gulf of Thailand. Both parties disclaimed any idea of annexing Siamese territory.
The field of her labor gradually broadened, and from 1880, she gave lecture courses in nearly all the principal cities of the U.S.. Her name became prominently identified with art education, both in the U.S. and abroad. While Adsit disclaimed being an artist, she was a competent and thorough critic and elucidator of art. Her criticisms of prints, especially, were sought by connoisseurs and collectors. The secret of her success lay in the fact that her work was simply the expression of her own personality, including an abounding enthusiasm which carried her audiences.
Therefore, a program is automatically subject to a copyright, and if it is to be placed in the public domain, the author must explicitly disclaim the copyright and other rights on it in some way, e.g. by a waiver statement.Open Source: Technology and Policy by Fadi P. Deek, James A. M. McHugh "Public domain", page 227 (2008). In some jurisdictions, some rights (in particular moral rights) cannot be disclaimed: for instance, civil law tradition-based German law's "Urheberrecht" differs here from the Anglo-Saxon common law tradition's "copyright" concept.
The last such creation was for Harold Macmillan, who resigned in 1963. Unusually, he became Earl of Stockton only in 1984, over twenty years after leaving office. Macmillan's successors, Alec Douglas-Home, Harold Wilson, James Callaghan and Margaret Thatcher, all accepted life peerages (although Douglas-Home had previously disclaimed his hereditary title as Earl of Home). Edward Heath did not accept a peerage of any kind and nor have any of the prime ministers to retire since 1990, although Heath and Major were later appointed as Knights of the Garter.
Mogoeng is the chairperson of the JSC's Judicial Conduct Committee, which is mandated to decide this complaint. Mogoeng initially disclaimed responsibility, however, on the basis that he lacks any legal power to take disciplinary action against a judge. This argument has been rejected by commentators and the JCC's refusal to take action described as "bizarre". Later, however, in July 2020, Mogoeng decided that the complaint against Hlophe should be adjudicated by the JCC, and said that, if true, the complaint would be grounds for a finding of gross misconduct.
On receiving his BA he was ordained as a Deacon at Worcester Cathedral. He was made a priest in 1879, and was a curate of Coventry from 1878 to 1880. In 1880 he became the Rector of Heswall, until he availed himself of the provisions of "The Clerical Disabilities Relief Act 1870", and disclaimed his Orders in 1886 to study law. On 2 December 1886 he was admitted to the Inner Temple, though by 1888 he was a captain in the 3rd Battalion of the Royal Welsh Fusiliers.
This arrangement was not a success, however, and Ma'afu retired to the island of Vanuabalavu. He maintained his claim, however, to be the overseer of the Tongan population, and when the Tui Nayau raised the Tongan flag over Lakeba, Ma'afu took control of the Lau archipelago on the pretext that its Paramount Chief had declared it be Tongan territory, rather than Fijian. Ma'afu's personal flag as King of Lau, 1869-1871. Ma'afu was faced with a crisis in June 1868, when the Tongan government disclaimed all sovereignty over Fijian territory, including the Lau Islands.
The Symphony in C is representative of Stravinsky's neoclassical period, which had been launched by his ballet Pulcinella (1919–20), the opera Mavra (1921–22), and Octet for winds (1922–23). The symphony has a traditional, four-movement structure and lasts approximately 30 minutes: The Symphony in C is entirely abstract and seems a retreat into the "pure music" styles of Bach, Beethoven, and Haydn. Stravinsky disclaimed any link between his personal experiences and the symphony's content.Jonathan Cross, The Cambridge Companion to Stravinsky (Cambridge, UK: Cambridge University Press, 2003), p. 115.
In 1914 Kipp was one of the signatories to the letter "To the Civilized World" signed by 93 German professors, known as the Manifesto of the Ninety-Three, in which the signatories disclaimed responsibility by Germany for starting World War I (1914–18), denied improper action by Germany in invading Belgium, and denied violation of international law. Kipp was rector of the University of Berlin until 1915. He was chairman of the Berlin Law Society from 1929 to 1931. Theodor Kipp died at Ospedaletti on the Italian Riviera on 2 April 1931.
Capozzola, 2008, pp. 67–9 From the day he registered for the draft until he returned from the war on May 29, 1919, York kept a diary of his activities. In his diary, York wrote that he refused to sign documents provided by his pastor seeking a discharge from the Army on religious grounds and similar documents provided by his mother asserting a claim of exemption as the sole support of his mother and siblings. Despite his initial, signed request for an exemption, he later disclaimed ever having been a conscientious objector.
The Court could hear original habeas petitions, but disclaimed the authority to grant the writ post-conviction unless the sentence had already been completed. Thus, the majority of the Marshall Court's opinions on criminal law were issued in response to questions certified by divided panels of the circuit courts by a certificate of division. Most of the Marshall Court's criminal opinions involved defining the elements of federal crimes. Criminal statutes considered by the Court during this period involved assimilative crimes, counterfeiting, embargoes, insurance fraud, piracy, and slave trading.
Zion's Branch believes that Joseph Smith was a prophet of God, but subject to error and deception like any man, and thus they do not accept all that he allegedly said or taught. Baptism for the Dead, a temple Endowment, Eternal Marriage, polygamy, and certain priesthood offices that are common within the Latter Day Saint movement, such as church president, are not accepted. For a short time, Zion's Branch endeavored to practice the United Order, but has since ceased doing so. At present, there are no apostles within the Zion's Branch organization, though the organization has not formally disclaimed belief in such.
Herguan obtained government approval to admit foreign students based on an application that included letters purporting to be from accredited colleges stating that they would accept credits from Herguan for transfer students. However, the letters were disclaimed by those colleges. An official at another college stated that Herguan staff offered payments in exchange for recognition. However, as recently as late 2010, most of Herguan's students were employed outside of California in full-time jobs, an apparent violation of the condition of their visas requiring them to be full-time students taking no more than one on-line class each term.
The Sultán displeased with the part Imád-ul-Mulk had taken in the rising summoned him to Chámpáner where, with the Sultán's connivance, his camp was given over to pillage. The Sultán disclaimed all knowledge of this attack and at Imád-ul- Mulk's request allowed him to go on pilgrimage to Mecca. In 1545 as he was preparing to start for pilgrimage, Imád-ul-Mulk was killed. He was succeeded in Surat by Khudáwand Khán Rúmi, who had held Surat under him, and who, in spite of Portuguese opposition and intrigue, had five years before completed the building of Surat Castle.
Moi sponsored irregular army units that attacked the Luo, Luhya and Kikuyu communities, and he disclaimed responsibility by assigning the violence to ethnic clashes arising from a land dispute. Beginning in 1998, Moi engaged in a carefully calculated strategy to manage the presidential succession in his and his party's favour. Faced with the challenge of a new, multiethnic political coalition, Moi shifted the axis of the 2002 electoral contest from ethnicity to the politics of generational conflict. The strategy backfired, ripping his party wide open and resulting in its humiliating defeat of his candidate, Kenyatta's son, in the December 2002 general elections.
In 2011, the Parents Action League circulated an online petition supporting the Anoka-Hennepin school district's sexual orientation curriculum policy, which has been challenged by advocates for LGBT students. The School district has disclaimed connection with the outside group. As part of their list of demands to the school district, members of PAL included "incorporating ex-gay (conversion therapy) into the school resources." They specifically called for a new division within the student support services and a special section on the District 11 website devoted to "students of faith, moral conviction, ex-homosexuals and ex- transgenders".
"Political Feud Kept Ruse Quiet" Flanagan and Ruse had been involved in a behind the scenes dispute over details of an auditor's report about the treasurer's office; Flanagan disclaimed any interest in the treasurer's post."Political Feud Kept Ruse Quiet" As a result of Ruse's decision not to run again, only Republican Jim Douglas had filed as a major party candidate for treasurer; in the absence of a Democratic candidate, Douglas won the Democratic nomination by write in vote.Election results: "Vermont State Treasurer: 1813-2014". p. 22 In the general election, Douglas faced only token opposition, and received over 91% of the votes.
The book begins with the Conservative leadership contest of 1963, following the resignation of Harold Macmillan, which turned into a fight between Iain Macleod, the modernising chairman of the party, and the Earl of Home, the aristocratic dark horse. Home won, disclaimed his peerage, became Alec Douglas-Home and was elected to the House of Commons at a hastily arranged by-election. Wheatcroft depicts this contest as a clash between supporters of "the virtues of an hereditary governing class" and those of "worth proved by ability".Charlish, Nicky, The Strange Death of Tory England online at culturewars.org.
Dokken are considered players of the hair/pop/glam metal subgenre by many critics and fans and Tooth and Nail is included in various polls of best glam metal albums. However, in a recent interview, Don Dokken disclaimed the band's belonging to that category and any comparison with acts like Poison, Winger and Mötley Crüe. A more thorough analysis by Canadian music journalist Martin Popoff places Tooth and Nail in transition from the NWOBHM-influenced debut album towards a more melodic and poppier kind of music, similar to the rising glam metal which would dominate the LA scene in the following years.Popoff: pp.
Jerry Laiserin helped popularize and standardize the term as a common name for the digital representation of the building process.Laiserin, in his foreword to Eastman, et al (2008, op cit) disclaimed he had coined the term, adding "it is my opinion that the historical record ... shows that Building Information Modeling was not an innovation attributable solely to any individual or entity." (p.xiii) Facilitating exchange and interoperability of information in digital format had previously been offered under differing terminology by Graphisoft as "Virtual Building", Bentley Systems as "Integrated Project Models", and by Autodesk or Vectorworks as "Building Information Modeling".
The West Sussex case considered the effect of the association's dissolution on the rights held by the trust where the trust did indeed fail. In such a case, the monies paid to the association will ordinarily be held on resulting trust for the contributors. However, there may be situations (including money collected through collection boxes) where the contributor can be said to have "disclaimed" the resulting trust and it will be considered bona vacantia. If the contract-holding theory is preferred, then the distribution of the rights held by the association will be governed by the rules of the association.
" A number of other militia and anti-government groups, including multiple armed men, arrived in Burns, the nearest town, and at the refuge. The views of the militants to these new groups were mixed. On January 8, the 3 Percenters of Idaho, an Idaho-based militia who had earlier disclaimed support for the occupation, announced it was sending some of its members to "secure a perimeter" around the MNWR compound and prevent a repeat of the Waco siege. Bundy welcomed the arrival of the additional militants, saying, "If they weren't here, I'd worry [about a law enforcement raid].
For the first time in over sixty years, a sitting Prime Minister was a member of the House of Lords rather than of the House of Commons. Because he believed that it was impractical and unconventional to remain a member of the Lords, the Earl disclaimed his peerages on 23 October 1963 under the Peerage Act passed in the same year. He then contested the House of Commons seat of Kinross and Western Perthshire by standing in the 1963 Kinross and Western Perthshire by-election. The seat had been vacated by the death of the previous Member of Parliament, Gilmour Leburn.
Parsons disclaimed any such notion, noting that he had urged the workers not to strike but to go to the polls to elect new representatives. With the agitated worthies present in the room audibly muttering such sentiments as "Hang him" and "Lynch him," the Chief of Police advised Parsons that his life was in danger and urged him to leave town. Parsons was allowed to leave, but he remained in Chicago despite the implied threat on his life. The afternoon Chicago papers trumpeted that "strike leader" Albert Parsons had been "arrested" that day — neither of which things were true.
Viscount Camrose, of Hackwood Park in the County of Hampshire, is a title in the Peerage of the United Kingdom. It was created on 20 January 1941 for the prominent newspaper magnate William Berry, 1st Baron Camrose. He had already been created a Baronet, of Long Cross in the County of Surrey, in the Baronetage of the United Kingdom, on 4 July 1921, and Baron Camrose, of Long Cross in the County of Surrey, on 19 June 1929, also in the Peerage of the United Kingdom. His second son, the third Viscount, disclaimed the peerages in 1995 on succeeding his elder brother.
Yvon Dumont disclaimed any knowledge of the identity of the burglars, though he later said that "if it's a Métis person that has it, I would consider that person a hero, not a criminal." Negotiations were begun to secure the official transfer of ownership of the bell to the Métis Nation, and Dumont offered to pay for the damage caused by the break-in. However, the Ontario legion hall initially refused to negotiate until the McCorry medals were returned. In 2000, Saskatchewan Aboriginal Affairs Minister Jack Hillson issued a statement promising no charges would be laid if the bell was returned.
Lambton was made a Parliamentary Under-Secretary of State for Defence (RAF) in 1970. He succeeded to the Earldom of Durham upon his father's death on 4 February 1970 but disclaimed it on 23 February to continue as an MP and Government Minister. He nonetheless insisted on being addressed as "Lord Lambton", the form of address appropriate to his former courtesy title, though a ruling of the Committee for Privileges said that he should not do so in the House of Commons since he had renounced his peerage. Contradictory rulings from two Speakers, Horace King and Selwyn Lloyd, then left the point unresolved.
A 2010 Organization of American States report found concerns with freedom of expression, human rights abuses, authoritarianism, press freedom, threats to democracy, as well as erosion of separation of powers, the economic infrastructure and ability of the president to appoint judges to federal courts. OAS observers were denied access to Venezuela; Chávez rejected the OAS report, pointing out that its authors did not even come to Venezuela. He said Venezuela should boycott the OAS, which he felt is dominated by the United States; a spokesperson said, "We don't recognize the commission as an impartial institution". He disclaimed any power to influence the judiciary.
Burges declared that he had spoken in haste; his mature judgement was in favour of the right of the state to apply to its own purposes the lands which had been assigned for the support of offices since abolished. He had advanced £3,500 to the parliament, and took the lands in payment. The date of his resignation of one of his livings should be noticed: he ceased to be a pluralist within two months of his speech against useless dignities. In the conflict with the king, Burges disclaimed altogether the attitude of rebellion, and his 'Vindication' proves his case.
By order of the French National Convention, elections in the French-occupied territories west of the Rhine were held on 24 February 1793. 130 cities and towns sent their deputies to Mainz. The first democratically elected parliament on the territory of future Germany, called the ' (), met initially on 17 March 1793, in the Deutschhaus building in Mainz (today the seat of the Rhineland-Palatinate state parliament). The convention declared the represented territory (which extended to Bingen in the west and to Landau in the south) to be free and democratic, and disclaimed any ties to the empire.
The main thesis of his famous Philosophical Letters was that Russia had lagged behind Western countries and had contributed nothing to the world's progress and concluded that Russia must start de novo. As a result, they included criticism of Russia's intellectual isolation and social backwardness. When in 1836 the first edition (and only one published during his life) of the philosophical letters was published in the Russian magazine Telescope, its editor was exiled to the Far North of Russia. The Slavophiles at first mistook Chaadayev for one of them, but later, on realizing their mistake, bitterly denounced and disclaimed him.
The UKB has sued the United States for a share of the proceeds under HR-3534, a bill that required the United States to compensate the Cherokee Nation and two other Oklahoma tribes for claims to the disclaimed drybed lands of the Arkansas River. The legislation set aside ten percent of each tribe's share of the settlement for other claimant tribes; it afforded other claimant tribes an opportunity to file claims within 180 days of the legislation. The UKB filed suit against the United States in the Court of Claims. The Cherokee Nation moved to intervene and to dismiss the UKB suit.
Siegel refused the screen credit, feeling that he had done only minor work on the picture, and Totten also disclaimed the credit, angry that he had been replaced. In consequence, the credit was given to Alan Smithee, the infamous pseudonym designated by the Directors Guild of America as "director" on films which are disowned by their true creators. In the February 15, 1971 Gunsmoke episode entitled "Cleavus", Totten plays the title guest-starring role, a red-bearded man who finds a gold mine after he accidentally kills the owner. He grabs $200 worth of gold dust from the mine owner's pocket.
The proclamation also stated that Dr. Kapp only regarded his administration as provisional, and that he would "restore constitutional conditions" by holding new elections. The new government disclaimed any intention of restoring the monarchy, but all Kapp's chief supporters were monarchists, and he had the old imperial colours—black, white, and red—hoisted in the capital. It was also perhaps significant that immediately after the coup d'état much coming and going was reported from ex- Kaiser Wilhelm II's Dutch home at Amerongen. Ebert and his associates were not slow to decide upon the measures to be taken against the reactionaries.
Goffe and his father-in-law Edward Whalley, another regicide, fled to New England. They were well known to Increase Mather and Daniel Gookin among others, and were able to move freely in Boston until it was known that Charles II was likely to order their arrest. Goffe and Whalley fled to the New Haven Colony, where John Davenport, a sympathetic minister, sheltered them for a time, and the political leadership disclaimed knowledge of their whereabouts. It is likely that Davenport connected them with John Russell, the minister at Hadley, Massachusetts, where the two men eventually settled into a highly secluded life.
He disclaimed responsibility for the Williams Station incident, which he blamed on a group of Bannocks over whom he had no authority. However, he said that if the whites had come to him afterwards to discuss the problem, as had been agreed by treaty, there would have been no need for fighting. Lander asked Numaga to try to restrain the Paiutes from hostilities for a year, and he would try to arrange a treaty under which they would retain possession of the lands they held and regain possession or be paid for lands that had been seized from them. Numaga accepted this.
Ash from this eruption may have reached The Dalles, Oregon, 48 miles (80 km) southeast of the volcano. In October 1843, future California governor Peter H. Burnett recounted a very likely apocryphal story of an Indigenous man who badly burned his foot and leg in lava or hot ash while hunting for deer. The story went that the injured man sought treatment at Fort Vancouver, but the contemporary fort commissary steward, Napoleon McGilvery, disclaimed knowledge of the incident. British lieutenant Henry J. Warre sketched the eruption in 1845, and two years later Canadian painter Paul Kane created watercolors of the gently smoking mountain.
The organization disclaimed any intent to be a political party, instead professing a desire to build "cooperation with all forces working for the [its] general aims." In May 1918 the British-born Spargo appealed to the Wilson administration to send him on a mission to Europe in an effort to rally the flagging spirits of the socialist movement there to the war effort. Wilson, fearful of weakening popular resolve in France, Great Britain, and Italy, approved this idea and a six-member labor mission including Spargo was dispatched on a mission lasting two months.Ruotsila, John Spargo and American Socialism, pg. 80.
Intermittent fighting erupted everywhere, harassing the Greek forces throughout Cilicia. In 1168, emperor Manuel I, obsessed with his dilemma with Thoros, marched his armies into Cilicia for the third time under the command of Konstantinos Kalamanos. But Kalamanos was able to produce only limited successes which in the end induced Byzantium to renounce its right of possession of the whole of Cilicia so long as it had access to the ports of the Gulf of Alexandretta. Byzantium also disclaimed all rights to direct government of Cilicia and accepted in settlement only Thoros's recognition of Byzantine suzerainty.
Home succeeded to his father's disclaimed earldom after his death in October 1995. When the hereditary peers of the House of Lords were reduced under the House of Lords Act 1999, he was elected as one of the 92 that were allowed to remain. He sits as a Conservative, having served some time on the Conservative front bench. Apart from his political career Lord Home was, until 2013, Chairman of the private bank Coutts & Co.. He is also the current President of the British Association for Shooting and Conservation and Chief of the Name and Arms of Home.
", Ensign, December 1975, p. 15.Book of Mormon (LDS Church edition), "Introduction" In the 21st century, Mormon scholars who favor a limited geography model have disclaimed a primary genetic connection between the Lamanites and indigenous American peoples. However, the matter remains unsettled while the field of DNA ancestry continues to develop, and many Latter Day Saints believe that the Lamanites comprise some part, if not the primary origin, of Native Americans by stating that the Lamanites "are among the ancestors of the American Indians." Prior to 2007, the non-canonical introduction to the Book of Mormon stated that the Lamanites were the "principal ancestors of the American Indians.
The only kind of widespread hardware modification nowadays is case modding. An encounter of the programmer and the computer security hacker subculture occurred at the end of the 1980s, when a group of computer security hackers, sympathizing with the Chaos Computer Club (which disclaimed any knowledge in these activities), broke into computers of American military organizations and academic institutions. They sold data from these machines to the Soviet secret service, one of them in order to fund his drug addiction. The case was solved when Clifford Stoll, a scientist working as a system administrator, found ways to log the attacks and to trace them back (with the help of many others).
Quintin McGarel Hogg, Baron Hailsham of St Marylebone (9 October 1907 – 12 October 2001), known as the 2nd Viscount Hailsham between 1950 and 1963, at which point he disclaimed his peerage, was a British barrister and Conservative politician. Like his father, Hailsham was considered to be a contender for the leadership of the Conservative Party. He was a contender to succeed Harold Macmillan as prime minister in 1963, renouncing his hereditary peerage to do so, but was passed over in favour of the Earl of Home. He was created a life peer in 1970 and served as Lord Chancellor, the office formerly held by his father, until 1987.
On his death in October 2001, just after his 94th birthday, the viscountcy that he had disclaimed in 1963 was inherited by his elder son Douglas. As a result of the House of Lords Act 1999, which removed the right of most hereditary peers to sit in the House of Lords, it was not necessary for him to disclaim his viscountcy to remain a member of the House of Commons. Like his father and other members of the family, he was buried in the churchyard at All Saints, Herstmonceux, Sussex. Hailsham's wealth at death was valued for probate at £4,618,511 (around £7.5m at 2018 prices).
A surveyor, Eric Bush, was employed by a building society, Abbey National, to inspect and value 242 Silver Road, Norwich.By section 25 of the Building Societies Act 1962, now section 13 of the Building Societies Act 1986, the Abbey National was bound to obtain 'a written report prepared and signed by a competent and prudent person who is experienced in the matters relevant to the determination of the value' of the house. Eric Bush disclaimed responsibility to the purchaser, Mrs Smith, who was paying a fee of £36.89 to the building society to have the valuation done. The building society had a similar clause in its mortgage agreement.
He was succeeded by his son, Quintin Hogg, who became the second Viscount, who was also a prominent lawyer and Conservative politician. On 20 November 1963 he disclaimed his peerages under the Peerage Act 1963, so that he could be elected to the House of Commons. However, in 1970 he accepted a life peerage as Baron Hailsham of St Marylebone, of Herstmonceux in the County of Sussex, and returned to the House of Lords, and like his father served twice as Lord Chancellor of the United Kingdom. The first and second Viscounts Hailsham are the only father and son ever to both serve as Lord Chancellor.
A few days later, Juncker disclaimed responsibility and called the leak a mistake, Der Spiegel magazine reported that Angela Merkel was annoyed with Juncker for the leak, while European Council President Tusk admonished participants to use discretion during the negotiations. The background for German nervousness allegedly is the possibility that Britain may veto EU budget increases, which for example in the immediate term amount to four billion euros. A continued British veto would have far-reaching consequences and "will hurt us" according to German MEP Jens Geier. On 22 May 2017, the Council of the EU authorised its negotiators to start the Brexit talks and it adopted its negotiating directives.
Macmillan's resignation saw a three-way tussle for the party leadership and premiership. Given that it was not considered appropriate for a Prime Minister to be a member of the House of Lords, the Earl of Home and Lord Hailsham both disclaimed their peerages under the Peerage Act 1963, and became known respectively as Sir Alec Douglas-Home and Quintin Hogg. Rab Butler was also in the running for the post, but Douglas-Home was finally chosen to succeed Macmillan. This was seen as controversial, for it was alleged that Macmillan had pulled strings and used the party's grandees, nicknamed "The Magic Circle", to ensure that Butler was once again overlooked.
Bates p. 102. From 1782 he published almanacs under his own name at Hartford and as "Hosea Stafford" in New Haven (1776–1804). In addition, finding that he was publicly assumed to be the "Isaac Bickerstaff",The character Isaac Bickerstaff had been invented as a pseudonym by Jonathan Swift as part of a hoax to predict the death of then famous almanac–maker, astrologer, and quack John Partridge. having disclaimed authorship in a letter to the Connecticut Journal, New Haven, 27 October 1784, he apparently decided to take up the slack and issue almanacs as "Bickerstaff" himself: they appeared at Hartford for several years after 1785.
Wilford referred the matter back to Lawton Gilliver; it was eventually dropped, but Swift's responsibility came out. Early in 1735 Wilford published Dr. John Armstrong's Essay for Abridging the Study of Physick. During the same period he was publisher of the Daily Post-Boy, and a sharer in Edmund Curll's venture with Alexander Pope's quasi-unauthorised Letters. The advertisement to this work in May, giving the names of Pope's titled correspondents, was held to be a breach of privilege, and Wilford was summoned with Curll to attend in the House of Lords, where he was examined but disclaimed responsibility, and after a second attendance on 13 May 1735 he was discharged.
Kirton and his associates (including Jenyns and Tyngeldon) refused to surrender the evidences to Ernley, who brought suit and writ dated June 1512. Ernley's interrogation of Lewknor sought to identify his advisors. Dudley's receiver disclaimed any record of profits taken from Sheffield: Lewknor's indentures of sale, reserving an annuity for himself, were to Kirton's use entirely, and he stated that no interest of Dudley's had ever been expressed or intended. Jenyns also knew of none, and called for the executors to be summoned: Windsor and Colet described the declaration of the will.Public Records (Chancery), T.N.A. Discovery Catalogue C 1/305/42-52, C 1/330/38 (cited by Whittick).
The backwards playing of a portion of the song purportedly results in words beginning with "Here's to my sweet Satan" (). Swan Song Records issued a statement to the contrary: "Our turntables only play in one direction—forwards." Led Zeppelin vocalist Robert Plant denied the accusations in an interview: "To me it's very sad, because 'Stairway to Heaven' was written with every best intention, and as far as reversing tapes and putting messages on the end, that's not my idea of making music." Another widely known alleged message, "It's fun to smoke marijuana", in Queen's song "Another One Bites the Dust", is similarly disclaimed by the group's spokesperson.
Whenever an applicant makes a clear and unambiguous argument that a claim does not cover a certain feature, this argument becomes binding on the applicant and the applicant cannot later argue in court that the claim would cover such a feature. Coverage of that feature is considered "disclaimed" by the applicant and cannot be recovered. The scope of the resulting patent is narrower than it might be if the applicant had said nothing. Prosecution disclaimer ensures that an applicant cannot obtain a patent by arguing that its claimed invention is narrow, and then turn around and enforce that patent against competitors with an argument that it is broader.
Coat of arms of the Earls of Sandwich Alexander Victor Edward Paulet Montagu (22 May 1906 – 25 February 1995), known as Viscount Hinchingbrooke from 1916 to 1962, as the Earl of Sandwich from 1962 to 1964 (when he disclaimed his peerages) and as Victor Montagu from 1964 to 1995, was a British Conservative Member of Parliament (MP). He was usually known to family and friends as 'Hinch Hinchingbrooke' or 'Hinch Sandwich' or, later, as 'Hinch Montagu'. In 2015, it was revealed that he was cautioned for indecently assaulting a child for a period of two years between 31 December 1970 and January 1972.Laville, Sandra; Travis, Alan (15 May 2015).
In 1843, after his removal to Göttingen, he began his great Handwörterbuch der Physiologie mit Rücksicht auf physiologische Pathologie123.13.24, and brought out the fifth (supplementary) volume in 1852. His only original contributions to this work were on the sympathetic nerve, nerve-ganglia and nerve-endings, and he modestly disclaimed all merit except as being the organizer. While resident in Italy for his health from 1845 to 1847, he occupied himself with research on the electrical organ of the torpedo genus of electric eels and on nervous organization generally; these he published in 1853–1854 (Neurologische Untersuchungen, Göttingen), and therewith his physiological period may be said to end.
The Croatian Democratic Union (HDZ) stated that they will not endorse any candidate in the second round, and have censored local branches that attempted to explicitly endorse Bandić. This happened to HDZ's mayor of Zadar Zvonimir Vrančić who first endorsed him but later disclaimed official support, and also to the HDZ branch of Makarska which also retracted their support under threat of sanction. The Catholic Church in Croatia claimed that they're neutral in this; the Croatian Bishops' Conference states that they never endorse anyone. But, there are some signs of subtle pro-Bandić attitude: Croatian archbishop Josip Bozanić was visited by Milan Bandić in the Archbishop's office on January 2.
Almost all other representations are content to present the famous hand-washing scene, the last act of the trial, in which Pilate disclaimed responsibility for the decision taken. In the Rossano Gospel's Trial of Christ, there are three acts and three interludes. The inscription on the rector at the top (Matt 27:2) announced the opening of trial in which Christ's silence and refusal to answer charges is the focal point, interpolated with the fate of Judas (27:3-5). The second event of the trial, the choice between Christ and Barabbas (Luke 23:18 or Matt 27:21), has an interluding scene featuring Herod (Luke 23:6-12).
However, there was a rumour a fortnight after the election that Coates would resign his seat to allow Sir Arthur Griffith-Boscawen, a Conservative Minister unexpectedly defeated in the general election to return; Coates disclaimed any knowledge and Griffith- Boscawen continued looking."Suggested by-election in the Isle of Ely", Isle of Ely and Wisbech Advertiser, 6 December 1922, p. 5. He was active in parliament, promoting the interests of potato farmers in the constituency and opposing government agricultural policy. In particular he sought the ending of potato imports, the provision of credit to farmers and the decrease in rates charged by railways for transporting agricultural produce.
The origins of the essay may be traced to an open letter which Wagner wrote to Berlioz in February 1860, in response to a printed article by Berlioz.Hector Berlioz: Concerts de Richard Wagner, la musique de l'avenir, 1862 Berlioz had poked fun at 'la musique de l'avenir'. In his letter Wagner disclaimed the use of this formulaic term, attributing it to his enemies Hiller and Bischoff, and asserted the principles he had set out in his essay The Artwork of the Future. He also took the opportunity in his letter to flatter Berlioz and to look forward to the premiere of his opera Les Troyens.
The case is notable because The Software Link argued that it had disclaimed the implied warranties via a license agreement on the software's shrinkwrap licensing. The result of the case, which Arizona Retail Systems won, helped to establish US legal precedent regarding the enforceability of shrinkwrap licenses. There was a year 2000 problem-like issue in this operating system, first manifesting on 1 August 2012 rather than 1 January 2000: files created on the system from this date on would no longer work. On 21 July 2017 PCMOS/386 was relicensed under GPL v3 and its source code uploaded to GitHub, with the "year 2012" issue corrected.
"Panama releases former CIA operative wanted by Italy", July 20, 2013, The Washington Post In January 2016, former C.I.A. agent Sabrina De Sousa, one of the agents convicted in Italy, was ordered by Portugal to be extradited to Italy, although that order will be appealed. She was briefly detained at the Lisbon airport in October 2015, and her passport was confiscated pending a court review of the European arrest warrant issued for her arrest. She has disclaimed any involvement in the affair and has been working to clear her name, including writing a memoir about her activities. Her appeal was denied on April 11, 2016.
But more studies should be done to find out whether music lessons could raise your child's IQ in the long term". Popular presentations of the "Mozart effect", including Alex Ross's comment that "listening to Mozart actually makes you smarter" and Zell Miller's "don't you feel smarter" query to the Georgia legislature, almost always tie it to "intelligence." Rauscher, one of the original researchers, has disclaimed this idea. In a 1999 reply to an article challenging the effect, published along with the article, she wrote (emphasis added): On efforts like Miller's budget proposal, and the press attention surrounding the effect, Rauscher has said, "I don't think it can hurt.
His son, the tenth Earl, represented South Dorset in Parliament as a Conservative from 1941 to 1962, when he succeeded his father in the earldom and had to resign his seat in the House of Commons and enter the House of Lords. He disclaimed his peerages in 1964 but never returned to the House of Commons. , the titles are held by his eldest son, the eleventh Earl, who succeeded in 1995. Lord Sandwich is one of the ninety elected hereditary peers that remain in the House of Lords after the passing of the House of Lords Act 1999, and sits as a cross-bencher.
The jeweled corset was widely reported in the UK tabloid media at the time as having a 16 inch waist, although these claims were exaggerated and Minogue herself disclaimed them. A full length corset dress made for Jean- Paul Gaultier in 2001 is now in the collection of the Metropolitan. By the 2000s, Mr Pearl was regularly described as a corsetière. He had earlier stated in a 1993 interview that he did not yet consider himself a corsetière, but a designer who used corsetry and lacing in his work, and aspired to become good enough to rank alongside the handful of true corsetières remaining in the world.
The full version of the music video premiered on October 1 on The CW Television Network, during the second day broadcast of the iHeartRadio Music Festival. Upon rumors that the production costs for the making of the music video were expensive, director ben Mohr refuted all claims on the production costs. However, industry insiders from Planet Hollywood reported that the music video's total production and editing costs amounted to $6.5 million, as stipulated by the contract Spears signed in her residency requirements, making it the second most expensive music video of all time. Later, the director disclaimed the costs, they were not nearly to $6.5 million at all.
The design of the buildings and the therapeutic regime were seen as models to be followed elsewhere, including at the Nottingham General Lunatic Asylum at Sneinton, and the drafting of the 1808 County Asylums Act and Lunacy Act 1845. The asylum continued to be owned and run by physicians from the Fox family until the Second World War. The asylum did not become part of the National Health Service when it was formed in 1948, being categorised as a "disclaimed hospital". In 1951 it was sold to the Royal United Hospital, who used it as a nurses' home until the 1980s, when it became a care home for the elderly.
She then summoned Edward and demanded his help for Harthacnut, but he refused as he had no resources to launch an invasion, and disclaimed any interest for himself in the throne. Harthacnut, his position in Denmark now secure, planned an invasion, but Harold died in 1040, and Harthacnut was able to cross unopposed, with his mother, to take the English throne. In 1041, Harthacnut invited Edward back to England, probably as heir because he knew he had not long to live. The 12th-century Quadripartitus, in an account regarded as convincing by historian John Maddicott, states that he was recalled by the intervention of Bishop Ælfwine of Winchester and Earl Godwin.
He was a candidate for the post of master of the wards in the same year; was one of four commissioners sent to Ireland on 11 September 1613 to investigate Irish grievances, and reported that Ireland had no very substantial ground for complaint. In 1614 Cornwallis was suspected of fanning the parliamentary opposition to the king. John Hoskins, who had made himself conspicuous in the House of Commons of England by his denunciation of Scots and Scottish institutions, declared when arrested that he was Cornwallis's agent. Cornwallis disclaimed all knowledge of Hoskins, but admitted that he had procured the election of another member of parliament, and had supplied him with notes for a speech against recusants and Scotchmen.
France disclaimed any desire to seize Egypt and asked what sort of satisfaction was required but the British were unable to give a response. There was still no thought of going to war; Prime Minister Addington publicly affirmed that Britain was in a state of peace. In early March 1803 the Addington ministry received word that Cape Colony had been re-occupied by the British army in accordance with the orders which had subsequently been countermanded. On 8 March they ordered military preparations to guard against possible French retaliation, and justified them by falsely claiming that it was only in response to French preparations and that they were conducting serious negotiations with France.
Nor could politics be excluded, though officially taboo, for economics must be considered by social idealists, and economics everywhere ran into politics. Thus it was with the railway question. Railways had been extended into frontier states; there were heavy crops in sparsely settled regions where freight-rates were high, so that given the existing distributive system there were over production and waste; there was notorious stock manipulation and discrimination in rates; and the farmers regarded absentee ownership of railways by New York capitalists much as absentee ownership of land has been regarded in Ireland. The Grange officially disclaimed enmity to railways: Though the organization did not attack them, the Grangers, through political farmers clubs and the like, did.
" Anders highlights that the fact that Falun Gong practitioners are not allowed to participate in the Olympics is comparable with Adolf Hitler's issue with Jewish participation in the 1936 Berlin Olympics." Anders has also said that no Canadian politician should attend the games, nor should any Canadian athletes be used as "propaganda tools." His comments were criticized by local Chinese trade association as well as fellow Calgary Tory MP Deepak Obhrai, who disclaimed Anders "was speaking as an individual and his comments are not reflective of government policy."Calgary MP compares China to Nazi regime In February 2010, nineteen members of Anders' Calgary West riding association resigned en masse, citing interference from the Conservative Party.
At the latter meeting it was decided to create a permanent organization, a "Continuation Committee", to act for the group in between meetings, which were now dubbed International Lutheran Theological Conferences. The committee was also tasked with publishing a theological journal and a committee bulletin, and with facilitating exchanges of pastors, theological professors, and students. However, the meeting explicitly disclaimed it was founding a group in opposition to the LWF.International Lutheran Council; Summary of International Conferences Compiled by E. Geo Pearce and Peter H. F. Ahlers, pp.3-4 Five more "theological conferences" were held until the name was shortened to International Lutheran Conference at the Eighth conference in Porto Alegre, Brazil.
During his tenure as Vermont State Treasurer, Democrat Paul W. Ruse Jr. was criticized for being too friendly with financial services firms that had an interest in matters handled by the state treasurer, including accepting campaign contributions from them, and appearing in an advertisement for one. Because of the controversy, in 1994 Ruse decided not to run for reelection. This decision was not widely known; Ruse stated that he withheld his decision not to run so that Ed Flanagan, the incumbent Vermont State Auditor, would not run for treasurer. Flanagan and Ruse had been involved in a behind the scenes dispute over details of an auditor's report about the treasurer's office; Flanagan disclaimed any interest in the treasurer's post.
Douglas Hogg, elder son of Lord Hailsham of St Marylebone and former Lord Chancellor, inherited the viscountcy on 12 October 2001 upon the death of his father who had disclaimed that title for life in 1963, but who later accepted a life peerage in 1970; he is the grandson of Douglas Hogg, 1st Viscount Hailsham, formerly Lord Chancellor and Lord President of the Council until 1938. He was educated at Eton College and Christ Church, Oxford. He served as the President of the Oxford Union in Michaelmas (autumn) Term 1965, before graduating with a degree in History in 1966. He was called to the Bar in 1968, after which he practised as a barrister.
In the same article, a woman identified as Armendria alleged that David Berg sexually abused her when she was 13 years old. His distant Jewish ancestry notwithstanding—in 1745, one of his mother's forebears, Jewish by birth but a Christian convert, moved to the American colonies and lived as a Mennonite—David Berg was outspokenly anti-Semitic, believing that the Jews were responsible for the death of Jesus, as well as all persecution of Christians in the world. In support of his views of an international Jewish conspiracy, he cited the forged Protocols of the Elders of Zion, but disclaimed the label "anti-Semitic". Berg predicted several apocalyptic events that did not occur.
A separate report by public broadcasting network Oregon Public Broadcasting (OPB) put the number of the militants at the MNWR at "between six and 12." In a statement posted to the Facebook page of the 3 Percenters of Idaho (one of the militias identified by media as involved in the takeover), the group disclaimed involvement, stating that the seizure was "carried out by a small group of persons who chose to carry out this takeover after the rally." The Harney County Sheriff's Office initially reported that the Oregon State Police (OSP) was "handling the incident." At the same time, a spokesperson for the Federal Bureau of Investigation (FBI) said the agency was "aware" of the situation.
Some People's Daily employees under the leadership of editor Wu Xuecan organised the printing of an unauthorised "extra" edition, which re-printed student flyers and took the point of view of the student protestors. Only about 1000 copies were reportedly printed, all of which were distributed to the protesting students. The "extra" was a direct response to the "April 26 Editorial", an article written by hawkish party leaders and published in the People's Daily, and which took a hostile attitude to the students. Despite immediately printing a notice that disclaimed the Extra as unauthorised, both Qian and Tan Wenrui were removed from their posts in the purge at the People's Daily that followed the protests.
In April 1943, when Chief Counterintelligence Directorate of the People's Commissariat of Defence of the USSR (or GUKR NKO USSR) better known as SMERSH was created, Abakumov was put in charge of it, in the rank of Commissar (2nd rank) of State Security, and held the title of vice-Commissar of Defense. During the war, he reported directly to Joseph Stalin, and appears to have been able to bypass Beria. For example, Beria disclaimed responsibility for the arrest in 1941 of the Red Army Marshal, Kirill Meretskov, for which he blamed Stalin and Abakumov. However, Nikita Khrushchev - who later denounced Stalin and had both Beria and Abakumov executed - did not believe him.
Murray 2006 Fredendall took the blame but Anderson, the First Army commander, was judged to be at fault for the failure to concentrate Allied armored units and keep forces concentrated, that later disintegrated into individual units. When Fredendall disclaimed all responsibility for the poorly equipped French XIX Corps and denied French requests for support, notably when under pressure at Faïd, Anderson allowed the request to go unfulfilled. Anderson was also blamed for dispersing the three combat commands of the U.S. 1st Armored Division, despite the objections of Major General Orlando Ward, the divisional commander. U.S. Brigadier General Irwin later became commander of the 5th Infantry Division in Europe and went on to higher command, as did British Brigadier Nicholson.
Dutcher had disclaimed interest in running for office again, but had created speculation that Minnesota Attorney General Mike Hatch would choose her as his running mate for Lieutenant Governor after she strongly endorsed him and spoke on his behalf at the 2006 DFL state convention. Perhaps not surprisingly, Hatch named her as his running mate on June 25, 2006. In the final stage of the campaign, Dutcher made headlines for a political gaffe in which she responded to then KSAX-TV reporter Corey Poppe's question on E85 ethanol by saying "What's E85?" Hatch attributed part of his loss to that remark, noting that he lost heavily in southern Minnesota counties where E85 production facilities are located.
Alastair Payne, the family's aristocratic advisor, tricks Libby into leaving, telling her it is best for Henry's duties not to know she is pregnant, then he lies to Henry, hiding the pregnancy from him and saying that Libby claimed to be leaving because she was in love with someone else. Libby has always been honest with Daphne about who her father is, though Daphne feels a sense of emptiness without him. When Daphne graduates from high school, she runs off to London to try and meet her father. Henry has disclaimed his seat in the House of Lords to run for election to the House of Commons, hoping to eventually become Prime Minister.
Fijian warriors put up some resistance and one American service man was killed and two were wounded. Ultimately the men of John Adams were successful in routing a contingent of natives from Lautoka but Cakobau and the survivors escaped capture. Cakobau's claim to be King of Fiji was by no means universally recognised by his fellow-chiefs, who jealously guarded the independence of their fiefdoms. His dilemma was that if he acknowledged the debt, he did not have sufficient funds to pay it, but that if he disclaimed it by saying that it fell under the jurisdiction of another chief, he would jeopardize his claim to the kingship, which he wanted foreign powers to recognize.
Retrieved July 15, 2007. The title threatened to sue the Salt Lake Tribune for making false and defamatory statements about the publication after an editorial had disclaimed the Tribune's involvement. The salacious details of the Smart story were retracted by the publication, and a rare apology was issued to the Smart family. One of the fired reporters acknowledged that his behavior was unethical, but expressed surprise that the story had been taken seriously, stating, "When I dealt with the National Enquirer, I never dreamed that I was accepting money for 'information'." The National Enquirer settled a libel lawsuit with the wife of Gary Condit out of court in 2003"Carolyn Condit and National Enquirer settle suit" rcfp.
In common law jurisdictions, an implied warranty is a contract law term for certain assurances that are presumed to be made in the sale of products or real property, due to the circumstances of the sale. These assurances are characterized as warranties irrespective of whether the seller has expressly promised them orally or in writing. They include an implied warranty of fitness for a particular purpose, an implied warranty of merchantability for products, implied warranty of workmanlike quality for services, and an implied warranty of habitability for a home. The warranty of merchantability is implied, unless expressly disclaimed by name, or the sale is identified with the phrase "as is" or "with all faults".
On 16 June 1647 eleven members including Holles were charged by the army with various offences against the state, followed on 23 June by fresh demands for their impeachment and for their suspension, which was refused. On the 26th, however, the eleven members, to avoid violence, asked leave to withdraw. Their reply to the charges against them was handed into the House on 19 July 1647, and on the 20th Holles took leave of the House in a "grave and learned speech." After the riot of the apprentices on the 26th, for which Holles disclaimed any responsibility, the eleven members were again (30 July) recalled to their seats, and Holles was one of the Committee of Safety appointed.
He also published the Journal of Christian Reconstruction and was an early board member of the Rutherford Institute, founded in 1982 by John W. Whitehead. In 1972, Cornelius Van Til "disclaimed affiliation" with Rushdoony and the Christian Reconstructionist movement, writing "...I am frankly a little concerned about the political views of Mr. Rushdoony and Mr. North and particularly if I am correctly informed about some of the views Gary North has with respect to the application of Old Testament principles to our day. My only point is that I would hope and expect they would not claim such views are inherent in the principles I hold". citing letter to Gregg Singer, 11 May 1972.
Academics have criticised it, however, both for the economic damage such a doctrine could cause and for its limited applicability. The tort of Rylands v Fletcher has been disclaimed in various jurisdictions, including Scotland, where it was described as "a heresy that ought to be extirpated", and Australia, where the High Court chose to destroy the doctrine in Burnie Port Authority v General Jones Pty Ltd. Within England and Wales, however, Rylands remains valid law, although the decisions in Cambridge Water Co Ltd v Eastern Counties Leather plc and Transco plc v Stockport Metropolitan Borough Council make it clear that it is no longer an independent tort, but instead a sub-tort of nuisance.
Giles Green was an English politician who sat in the House of Commons at various times between 1621 and 1648. Green was the son of John Greene a merchant of Dorchester and a friend of Rev John White.Members of the Dorchester Company 1624-1626 He was a prominent citizen of Weymouth, and the town records show payments to him "towards a key and slipp which he hath built upon the town ground on the East side of his house in Hell Lane". In 1621 Green was elected Member of Parliament (MP) for Weymouth. The "Visitation of Dorset" in 1623 disclaimed him and he is listed at Dorchester as having "usurped the name of Gentleman without authoritie".
The last Prime Minister to be a member of the House of Lords was Alec Douglas-Home, 14th Earl of Home, who became Prime Minister in 1963. To adhere to the convention under which he was responsible to the Lower House, he disclaimed his peerage and procured election to the House of Commons within days of becoming Prime Minister. Governments have a tendency to dominate the legislative functions of Parliament, by using their in-built majority in the House of Commons, and sometimes using their patronage power to appoint supportive peers in the Lords. In practice, governments can pass any legislation (within reason) in the Commons they wish, unless there is major dissent by MPs in the governing party.
In the UK's acceptance of Irish unity by consent was not new. It had been there in 1973 at Sunningdale, in the Anglo-Irish Agreement of 1985 and again in the 1993 Downing Street Declaration in which London had disclaimed any "selfish strategic or economic interest" in the matter. Unionists were nonetheless discomforted by the republican claim that the 1998 Agreement had, in the words of Gerry Adams, "dealt the union a severe blow": "there was now no absolute commitment, no raft of parliamentary acts to back up an absolute claim, only an agreement to stay until the majority decided otherwise." In the May 1998 referendum on the Good Friday Agreement, on a turnout of 81%, 71.1% voted in favour.
Nick Jr. is an American pay television channel run by ViacomCBS through its domestic networks division's Kids and Family Group. It launched on September 28, 2009 as a spin-off of Nickelodeon's long-running preschool programming block of the same name, and primarily targets children aged 2 to 7. The channel's lineup features a mix of originally-produced programming, along with series previously and concurrently aired on the Nickelodeon block and its previous iterations; because of the two entities, Nick Jr. is sometimes disclaimed on-air as "the Nick Jr. channel" to avoid confusion, especially at times of day where both services are carrying preschool programming. The channel replaced Noggin, which was relaunched as a streaming service in 2015 and acts as a separate sister brand.
After Dark in 1988, more here Hogg served in the Conservative shadow cabinet during the Wilson government, and built up his practice at the bar where one of his clients was the Prime Minister and political opponent Harold Wilson. When Edward Heath won the 1970 general election he received a life peerage as Baron Hailsham of St Marylebone, of Herstmonceux in the County of Sussex, and became Lord Chancellor. Hogg was the first to return to the House of Lords as a life peer after having disclaimed an hereditary peerage. Hailsham's choice of Lord Widgery as Lord Chief Justice was criticised by his opponents, although he later redeemed himself in the eyes of the profession by appointing Lord Lane to succeed Widgery.
The amendment disclaimed any intention on the part of the United States to exercise jurisdiction or control over Cuba for other than pacification reasons, and confirmed that the armed forces would be removed once the war is over. Senate and Congress passed the amendment on 19 April, McKinley signed the joint resolution on 20 April and the ultimatum was forwarded to Spain. War was declared on 20/21 April 1898. "It's been suggested that a major reason for the U.S. war against Spain was the fierce competition emerging between Joseph Pulitzer's New York World and William Randolph Hearst's New York Journal", Joseph E. Wisan wrote in an essay titled "The Cuban Crisis As Reflected In The New York Press" (1934).
She plans on making a strong statement for female artists, while commenting on social issues.Queen of Kwaito Singing a in Tune: Kwaito has also been criticized in that it has been labeled as the African version of hip hop or an imitator. In Thokozani Mhlambi's article "Kwaitofabulous," he points out various European scholars who have disclaimed the authenticity of hip hop as they believe it to undermine the cultural and historical struggles of the South African people because of Kwaito's similarity with American hip hop. Mhlambi, however, disclaims by pointing out that the Black youth of America and South Africa have faced similar oppressive histories by the white population, and thus makes sense to have its music similar as well.
After the death of the 12th duke, José Joaquín Álvarez de Toledo, none of his sons claimed the title, so the dukedom of Fernandina became dormant. Eighty years later, the 21st duchess of Medina Sidonia and her son the Count of Niebla ceded their rights to the title to their daughter and sister, Pilar González de Gregorio, who asked for the resumption of the dormant dukedom. On 1 February 1993, the title was restored with grandeeship of SpainA Royal Decree of Isabella I, given on 10 October 1876, established that all Dukes were Grandees of Spain, so all the dormant duchies restored after that date received the grandeeship, even if they didn't hold it before being disclaimed. Soler Salcedo, Juan Miguel, Nobleza Española.
As is, when employed as a term with legal effect, is used to disclaim some implied warranties for an item being sold. Certain types of implied warranties must be specifically disclaimed, such as the implied warranty of title. "As is" denotes that the seller is selling, and the buyer is buying an item in whatever condition it presently exists, and that the buyer is accepting the item "with all faults", whether or not immediately apparent. This is the classic "buyer beware" situation, where the careful buyer should take the time to examine the item before accepting it, or obtain expert advice. On the other hand, the phrase "as is" does not disclaim ‘’express’’ warranties: these may, for example, be created by the seller's description of an item.
In the meantime and due to his good reputations he received offers from the emperor court of Wien, from the Universities of Bern, Kiel, Helmstedt, Frankfurt (Oder), Tübingen or Celle, but he disclaimed all of this, because he wanted to stay at Halle. Instead of this he advised his son Georg Ludwig Böhmer to the University of Göttingen and his son Johann Samuel Friedrich von Böhmer to the University of Frankfurt (Oder). After the death of the chancellor of the Duchy of Magdeburg, Johann Peter von Ludewig, Böhmer was assigned Ludewig's function on December 14, 1743 and at the same time was promoted to full professor in Halle. But only a few years later suddenly he died with an apoplectic stroke.
The film then presented as experts several people without identifying them as creationists and intelligent design advocates. Lippard thought perhaps the most deceptive aspect of the film was that these people were shown as though they were on a par with established experts, misleadingly representing their subject areas and not mentioning that two work for CMI while an intelligent design proponent is a professor at Biola University. They identified Stuart Burgess as "Design & Nature, Bristol University": Burgess, the Professor of Engineering Design and department head at Bristol University, is Lecturer and Unit Director for a 4th year course on Design and Nature about mechanical solution principles found in nature. In their emails, Wieland and Murray disclaimed any attempt to be deceptive in choice of on-screen credentials.
In the 1960s, Rigg lived for eight years with director Philip Saville, gaining attention in the tabloid press when she disclaimed interest in marrying the older and already-married Saville, saying that she had no desire "to be respectable". She was married to Menachem Gueffen, an Israeli painter, from 1973 until their divorce in 1976, and to Archibald Stirling, a theatrical producer and former officer in the Scots Guards, from 25 March 1982 until their divorce in 1990 after his affair with the actress Joely Richardson. With Stirling, Rigg had a daughter, actress Rachael Stirling, who was born in 1977, five years before their marriage. Rigg was a patron of International Care & Relief and was for many years the public face of the charity's child sponsorship scheme.
In June 2010, a conference with "over 90 academics, practitioners and public interest organizations from six continents" concluded "that the terms of the publicly released draft of ACTA threaten numerous public interests, including every concern specifically disclaimed by negotiators." A group of over 75 law professors signed a letter to President Obama demanding that ACTA be halted and changed. A full consolidated text of the proposed ACTA, dated 1 July 2010, apparently coming from the civil liberties committee (LIBE) of the European Parliament was leaked providing the full text from the Luzern round of negotiations, including the name of the negotiating parties along with their positions. The revised and final text, dated 15 November 2010, was leaked on 16 November 2010 by several websites.
The last to do so was Robert Gascoyne-Cecil, 3rd Marquess of Salisbury, from 1895 to 1902.The last prime minister to be a member of the Lords during any part of his tenure was Alec Douglas-Home, 14th Earl of Home in 1963. Lord Home was the last prime minister who was a hereditary peer, but, within days of attaining office, he disclaimed his peerage, abiding by the convention that the prime minister should sit in the House of Commons. A junior member of his Conservative Party who had already been selected as candidate in a by-election in a staunch Conservative seat stood aside, allowing Home to contest and win the by-election, and thus procure a seat in the lower House.
In 1994 on the death of George Nigel Douglas-Hamilton, 10th Earl of Selkirk, Selkirk inherited the earldom, although the succession was disputed, as Alasdair Douglas-Hamilton, a nephew of the 10th Earl, claimed it, ultimately without success. Due to the terms of the Peerage Act 1963, Selkirk was considered to be unable to vote in the House of Commons until he had disclaimed the title, even though the succession to it had not been decided. As the Conservative government of the day had a small majority, he felt obliged to disclaim immediately. After losing his seat in the 1997 general election, he was elevated to the House of Lords as a life peer, being created Baron Selkirk of Douglas, of Cramond in the City of Edinburgh.
By convention, ministers are members of either the House of Commons or the House of Lords. A handful have been appointed from outside Parliament, but in most cases they then entered Parliament in a by-election or by receiving a peerage (being made a peer). Since 1902, all prime ministers have been members of the Commons; the sole exception was during the long summer recess in 1963: the 14th Earl of Home disclaimed his peerage (under a new mechanism which remains in force) three days after becoming prime minister, and became Sir Alec Douglas-Home. The new session of Parliament was delayed to await the outcome of his by- election, which happened to be already under way due to a recent death.
The elder Richardson originally wanted his son to become a clergyman, but he was not able to afford the education that the younger Richardson would require, so he let his son pick his own profession. He selected the profession of printing because he hoped to "gratify a thirst for reading, which, in after years, he disclaimed". At the age of 17, in 1706, Richardson was bound in seven-year apprenticeship under John Wilde as a printer. Wilde's printing shop was in Golden Lion Court on Aldersgate Street, and Wilde had a reputation as "a master who grudged every hour... that tended not to his profit".. While working for Wilde, he met a rich gentleman who took an interest in Richardson's writing abilities and the two began to correspond with each other.
Granite Rock suggested that the Property Clause not only vests unlimited power in Congress over the use of federally owned lands, but also exempts federal lands from state regulation, whether or not those regulations conflict with federal law. The Supreme Court previously held that "the State is free to enforce its criminal and civil laws" on federal land so long as those laws do not conflict with federal law. The court held that because Congress specifically disclaimed any intention to preempt preexisting state authority in the Coastal Zone Management Act, even if all federal lands are excluded from the Coastal Zone Management Act definition of "coastal zone", the act does not automatically preempt all state regulation of activities on federal lands. They ruled in favor of the Coastal Commission.
In estate or inheritance law, a disclaimer (also called disclaimer of interest) is a written document voluntarily signed by an heir to an estate in which the said heir does not accept (disclaims) the part of the estate of a deceased person which the heir is entitled to receive. The disclaimed part of the estate is then inherited not necessarily by a person of the disclaiming heir's choice, but by the next heir in line to receive that part of the estate as if the disclaiming heir were also deceased, either according to the will, beneficiary designation, or the laws of intestacy. Government tax agencies have further rules on such disclaimers. Reasons for such disclaimers may include imminent death of the disclaimant or the fact that the disclaimant already has enough wealth.
The union actions Grossman documented were a response to the 1940 'Little Red Scare', which saw twenty- one states impose ‘loyalty oaths’ on teachers before, by 1946, fifteen more states had joined them. The House Un-American Activities Committee, supported at times by military authorities, inspected public school and college textbooks and curricula to ensure that the authors, even those long deceased, had 'disclaimed Communism'. New York's State Senator Frederic Coudert in 1940 scoured schools for "subversives", leading to the dismissal of professors without regard for their value and record as teachers. Post-war, the purge instituted in New York in the state's 1949 Feinberg Law (Named after its sponsor, state senator Benjamin Feinberg) requiring school districts to report on the loyalty of every teacher, annually, targeted left-wing leaders of the city's Teachers Union.
To do so, the peer must deliver an instrument of disclaimer to the Lord Chancellor within 12 months of succeeding to the peerage, or, if under the age of 21 at the time of succession, within 12 months of becoming 21 years old. If, at the time of succession, the peer is a member of the House of Commons, then the instrument must be delivered within one month of succession; meanwhile, the peer may not sit or vote in the House of Commons. Prior to the House of Lords Act 1999, a hereditary peer could not disclaim a peerage after having applied for a writ of summons to Parliament; now, however, hereditary peers do not have the automatic right to a writ of summons to the House. Irish peerages may not be disclaimed.
Hezbollah came into existence in 1985 as a result of the Israeli occupation of South Lebanon which began in 1982 and lasted until 2000. On 14 August, Hezbollah's leader, Hassan Nasrallah, said on Hezbollah's Al-Manar TV that he is not in favor of Hezbollah's disarmament, since the Lebanese army is not strong enough to defend Lebanon and the Israeli army is still occupying Lebanon, and that his fighters would not be forced to disarm by "intimidation or pressure." Similarly, after adoption of the resolution Lebanese Defence Minister Elias Murr said on 14 August 2006, in a television interview that "the army won't be deployed to south Lebanon to disarm Hezbollah." Soon after the resolution's passage, both the UN and UNIFIL contributing nations such as France disclaimed responsibility for disarming Hezbollah.
Upon this state of facts, it was plain that the mere employment by the defendants of the old and well known automatic safety valve afforded no ground upon which to base the relief prayed for in the appellant's bill. Appellant's counsel therefore disclaimed any right to the exclusive use of an automatic safety valve, and said: "We do not claim the valve any further than in this combination with a steam fire engine." If it be conceded, therefore, that the second claim of appellant's patent covered the use of an automatic relief valve applied to a steam fire engine and hose, the question is presented whether the appellant's patent thus construed is valid. Justice Horace Gray speaking for the court; The decree of the circuit court was affirmed.
As a young man, Brugmann sided with the emerging Neogrammarian school, which asserted the inviolability of phonetic laws (Brugmann's law) and adhered to a strict research methodology. As well as in laying stress on the observation of phonetic laws and their operation, it emphasized the working of analogy as an important linguistic factor in modern languages. As joint editor with Curtius of The Studies in Greek and Latin Grammar, he wrote an article for this work on “Nasalis Sonans,” in which he defended theories so radical that Curtius afterward disclaimed them. Brugmann's fame rests on the two volumes on phonology, morphology, and word formation which he contributed to the five-volume Grundriss der vergleichenden Grammatik der indogermanischen Sprachen (“Outline of the Comparative Grammar of the Indo-Germanic Languages”), published from 1886 to 1893.
His claim was at first understood by some of the public at the time to be merely a reference to the Gate of the Hidden Imám of Muhammad, but this understanding he publicly disclaimed. He later proclaimed himself, in the presence of the heir to the Throne of Persia and other notables, to be al-Qā'im. In the Báb's writings, the Báb appears to identify himself as the gate (báb) to Muhammad al-Mahdi and later he begins to explicitly proclaim his station as equivalent to that of the Hidden Imam and a new messenger from God. Saiedi states the exalted identity the Báb was claiming was unmistakable, but due to the reception of the people, his writings appear to convey the impression that he is only the gate to the Hidden Twelfth Imam.
Harry Levine (August 1, 1895 – May 1, 1977) was the Massachusetts President and Chairman of the Board of the U.S. Plastic and Chemical Company. He made major, multifaceted contributions to the creation and development of the State of Israel, related primarily to the facilitation of the construction and import of Uzi submachine guns into then British-Mandated Palestine. He played a central role in the founding of the Weizmann Institute of Science; he provided initiatives for the practical application of science research there, and was a pioneer of a science-based industrial complex in Rehovot, adjacent to the Weizmann Institute, which was the first of its kind in Israel. A man of great reserve throughout his career, Levine disclaimed public acclaim for his contributions and avoided public disclosure of them during his lifetime.
UDA member Sammy Duddy said: "After Milltown, two UDA brigadiers from two Belfast battalions telephoned the IRA to say they didn't know Michael Stone [...] But Michael was UDA, he was a travelling gunman who went after the IRA and Republicans and he needed no authority for that because that was his job. Those two brigadiers were scared in case the IRA would retaliate against them or their areas [...] so they disclaimed Michael, one of our best operators". Sinn Féin and others "claimed that there must have been collusion with the security forces, because only a small number of people knew in advance of the reduced police presence at the funerals". Stone later claimed he had assurances that British soldiers and RUC officers would not be deployed in the graveyard.
This was adopted by resolution of Congress and included the Teller Amendment, named after Colorado Senator Henry Moore Teller, which passed unanimously, stipulating that "the island of Cuba is, and by right should be, free and independent". The amendment disclaimed any intention on the part of the United States to exercise jurisdiction or control over Cuba for other than pacification reasons, and confirmed that the armed forces would be removed once the war is over. The amendment, pushed through at the last minute by anti-imperialists in the Senate, made no mention of the Philippines, Guam, or Puerto Rico. Congress formally declared war on April 25. The Senate and House passed the amendment April 19, McKinley signed the joint resolution on April 20, and the ultimatum was forwarded to Spain. War was declared on April 20/21, 1898.
In view of the lack of internal resistance, it appeared that the chief danger to the new government lay in the possibility of a reaction inspired by the absent King Idris or his designated heir, Hasan ar Rida, who had been taken into custody at the time of the coup along with other senior civil and military officials of the royal government. Within days of the coup, however, Hasan publicly renounced all rights to the throne, stated his support for the new government, and called on the people to accept it without violence. Idris, in an exchange of messages with the RCC through Egypt's President Nasser, dissociated himself from reported attempts to secure British intervention and disclaimed any intention of coming back to Libya. In return, he was assured by the RCC of the safety of his family still in the country.

On the morning of 2 September, with the battle of Sedan raging about him, Napoleon III, Emperor of the French, ordered a white flag hoisted above the fortress of Sedan. The emperor then order the commander of the XII Corps, General Barthélémy Lebrun, to send a negotiator (parlementaire) to the Prussians with a request for an armistice. The chief of staff of the Army of Châlons refused to sign any such agreement on behalf of the nominal, but wounded commander, Patrice de Mac-Mahon, and General Auguste- Alexandre Ducrot disclaimed any authority to do so because he had already been countermanded once by his superior, General Emmanuel de Wimpffen. Nevertheless, Lebrun and a non-commissioned officer with a white pennant crossed the lines to seek an armistice "equally acceptable to both armies", bearing a formal letter to that effect.
Moreover, on the death of prelates, fitting successors were to be appointed with the advice and approval of the archbishop, without any royal intervention; such action would nullify the election; and lay interference was expressly disclaimed as being outside the limits of the laity's rights. The cathedral churches of Canterbury and Rochester were granted in perpetuity, immunity from royal requisitions or tribute otherwise than voluntary, and these were never to create precedent; all these privileges being secured under severe spiritual penalties for infringement. The interest and importance of this document rest on the fact that Henry Spelman and others have regarded it as the most ancient English charter. Its authenticity has been called in question; but though different versions of it exist, there can be little doubt of the general genuineness of the terms common to all, as here summarized.
Gelfand represents a certain group among the conquerors, namely the young officers who were sure that their front experience gave them the right to laugh at a dull instructor, to avert denunciation, to speak plainly to a high-ranged party functionary or to go their own way in occupied Germany. Gelfand’s experience with women also proves the existence of love relations between masculine conquerors and feminine conquered in 1945–46. The diary illustrates that German women searched contact to Soviet soldiers on their part, too, and that not only for material matters or in need of protection." Dr. Elke Scherstjanoi, Institute of Contemporary History (IfZ), Munich-Berlin "A Diary of a Soviet Soldier—it is the description of reality that makes it so impressive, a reality that had been disclaimed for a long time and of everyday life that had never been depicted.
His political attitude is curiously illustrated by his speech in the debate on the Abjuration Bill. Lord Wharton, after owning that he had taken more oaths than he could remember, said that he should be "very unwilling to charge himself with more at the end of his days", whereupon Macclesfield rose and said that "he was in much the same case with Lord Wharton, though they had not always taken the same oaths; but he never knew them of any use but to make people declare against government that would have submitted quietly to it if they had been let alone". He also disclaimed having had much hand in bringing about the revolution. In July 1690 he was one of a commission appointed to inquire into the conduct of the fleet during a recent engagement with the French off Beachy Head, which had not terminated so successfully as had been anticipated.
Ennis saw the bill as crucial to the DOJ's efforts to retain custody of Japanese Americans suspected of disloyalty; he feared that the courts would find continued internment of U.S. citizens to be unconstitutional, and hoped that "militants" among Japanese American internees would voluntarily renounce citizenship under the bill's provisions, in which case the DOJ could continue to detain them until they could be deported to Japan. A. Leonard Allen (D-LA) introduced the bill on February 1, 1944. It was referred to the House Committee on Immigration and Naturalization, which unanimously reported the bill two days later. Allen first spoke about the bill on the House floor on February 8; he described it as "a bill to expatriate certain Japanese nationals ... who have openly avowed their disloyalty to the United States and have disclaimed loyalty to the United States, although they were born in this country".
It is often assumed that Fordism derives from Taylor's work. Taylor apparently made this assumption himself when visiting the Ford Motor Company's Michigan plants not too long before he died, but it is likely that the methods at Ford were evolved independently, and that any influence from Taylor's work was indirect at best.. Charles E. Sorensen, a principal of the company during its first four decades, disclaimed any connection at all. There was a belief at Ford, which remained dominant until Henry Ford II took over the company in 1945, that the world's experts were worthless, because if Ford had listened to them, it would have failed to attain its great successes. Henry Ford felt that he had succeeded in spite of, not because of, experts, who had tried to stop him in various ways (disagreeing about price points, production methods, car features, business financing, and other issues).
Fobis sent up to 100 cease and desist letters to retailers, and offered to sell Nintendo the trademark; Nintendo declined, responding that it "does not use and does not plan to use the Weemote trademark". The trademark application for the Wii was filed in 2006, but it was not registered by the US government until July 2010. The trademark application for the Wii Remote was initially rejected by the United States Patent and Trademark Office after the trademark was filed in March 2008. The USPTO said that the word "remote" is commonly used, and therefore should not be trademarked. The USPTO said they would accept Nintendo's trademark filing if the company disclaimed exclusive rights to the word "remote" in the term and if the word “remote” would always follow the word “Wii” in marketing and manuals; the “Wii Remote” trademark was accepted in July 2012.
The play was commissioned by the National Theatre as part of a policy of staging new plays by leading authors in the company's new South Bank home.Peter Hall's Diaries edited by John Goodwin, Hamish Hamilton, 1983 p. 168 At the time Brenton was a Marxist and seen as something of a polemicist; however, in an interview with Theatre Quarterly from around the time the play was being written, he expressed dissatisfaction with fringe theatre - the context in which his plays had previously been seen - and a desire to reach the bigger audiences subsidised theatre companies would provide.Peter Hall's Diaries edited by John Goodwin, Hamish Hamilton, 1983 p. 170 Furthermore, in the play's programme, Brenton disclaimed being a moralist. Weapons of Happiness became the first commissioned play to be performed at the reopened National Theatre when it premièred on the Lyttelton stage on 14 July 1976.
Since 1986, the Saudi monarchy has disclaimed all royal titles except "Custodian of the Two Holy Sanctuaries" or "Custodian of the Two Holy Mosques" (). In addition, the term ḥaram is commonly used to refer to certain other holy sites, such as the Temple Mount () in Jerusalem — though over the protests of some, such as Ibn Taymiyyah, who declared that the only places which could be legitimately called "ḥaram" were Mecca, Medina, and probably also the valley of Wajj in Ta'if, thus rejecting other places like Hebron and even Jerusalem. Includes Arabic text of manuscript of Ibn Taymiyya's short work [']. In fact, one of the Islamic names of Jerusalem, thālith al-ḥaramayn (, literally "the third of the two holy places") resolves the tension between the unchallengeable pre-eminence of Mecca and Medina versus the desire to recognize Jerusalem as having a special status in Islam in a somewhat paradoxical manner.
Under some conditions, the second patent might expire later than the first (based upon the respective earliest claimed priority dates). If the applicant is required to file, and does file, a terminal disclaimer in the later filed patent, then the later filed patent will expire at the same time as the earlier filed patent, the extra term having been disclaimed ("terminal disclaimer"). In filing the terminal disclaimer, the later filed patent and the earlier filed patent must be, and remain, commonly owned. In the case of co-pending applications, either or both of the applications may have claims rejected for obviousness-type double patenting, and a terminal disclaimer may be required in either or both, in which case the earlier expiration date will control. After the Uruguay Round Agreements Act of 1994 (URAA), some patents with terminal disclaimers were eligible for a term adjustment because their referenced patents received a term adjustment under the URAA.
In September 1928, Jews praying at the Wall on Yom Kippur placed chairs and a mechitza that looked like a simple room divider of cloth covering a few wooden frames to separate the men and women. Jerusalem's British commissioner Edward Keith-Roach, while visiting a Muslim religious court building overlooking the prayer area, mentioned to a constable that he had never seen it at the wall before, although the constable had seen it earlier that day and had not given it any attention. The sheikhs hosting the commissioner immediately protested the screen on the grounds that it violated the Ottoman status quo forbidding Jews from bringing physical structures, even temporary furniture, into the area due to Muslim fears of Zionist expropriation of the site. The sheikhs disclaimed responsibility for what could happen if the screen was not taken down, and Keith-Roach told the Ashkenazic beadle to remove the screen because of the Arabs' demands.

Petition to Roman Emperor Gordian III from the inhabitants of ancient Scaptopara A Hellenistic settlement called Scaptopara (market town in Thracian, Σκαπτοπάρα in Greek) emerged on the site of ancient Thracian settlement around 300 BC and was later incorporated into the Roman Empire with the rest of Thrace in 48 AD. The settlement was known for its hot springs supplying thermae. During the Crisis of the Third Century, the Scaptoparans wrote a petition to the emperor Gordian III, whose Latin and Koine Greek text is preserved in an inscription discovered there in 1868 and dated 238 AD.Corpus Inscriptionum Latinarum, vol. III 12336=AJ 139IGR 1674 The petition complained about the conduct of soldiers and visitors to the baths and that appeals to the governor of the province of Thrace had failed; the emperor's reply, also inscribed, disclaimed responsibility and again referred the citizens to the governor for redress. The inscription has since been lost.
Wagner later perceived Rienzi as an embarrassment; in his 1852 autobiographical essay, "A Communication to My Friends", he wrote "I saw it only in the shape of 'five acts', with five brilliant 'finales', with hymns, processions and the musical clash of arms".cited in Charlton (2003), 328 Cosima Wagner recorded Wagner's comment in her diary for 20 June 1871: > Rienzi is very repugnant to me, but they should at least recognize the fire > in it; I was a music director and I wrote a grand opera; the fact that it > was this same music director who gave them some hard nuts to crack – that's > what should astonish them.cited in Millington (1999), 10 Thus the work has remained outside today's Wagner canon, and was only performed at the Bayreuth Festival in 2013, staged by Matthias von Stegmann. Although the composer disclaimed it, it can be noted that Rienzi prefigures themes (brother/sister relationships, social order and revolution) to which Wagner was often to return in his later works.
Both major parties had changed leadership in 1963; after the sudden death of Hugh Gaitskell early in the year, Labour chose Harold Wilson (who was then thought of as being on the party's centre-left), while Sir Alec Douglas-Home (then the Earl of Home) had taken over as Conservative leader and Prime Minister in the autumn after Harold Macmillan announced his resignation. Douglas-Home shortly afterwards disclaimed his title under the Peerage Act 1963 in order to lead the party from the Commons. Macmillan had led the Conservative government since January 1957. Despite initial popularity and a resounding election victory in 1959, he had become increasingly unpopular in the early-1960s, and while it was for a while thought likely that the Conservatives would win the scheduled 1964 general election, albeit with a reduced majority, the emergence of the Profumo affair in March 1963 and Macmillan's handling of the matter all but destroyed the credibility of his government.
Two years after the Brest Bible was completed the Calvinist and Radical wings of the Reformed church split in 1565, and the Bible was suspect to both groups: The Calvinist Ecclesia Major suspected it of Arian interpretations; the Radical Ecclesia Minor complained that it was not accurate enough. Symon Budny, a Belarusian of the Judaizing wing of the Ecclesia Minor especially charged against the Brest Bible that it was not prepared according to the original texts, but after the Vulgate and other modern versions, and that the translators cared more for elegant Polish than for a faithful rendering. He undertook a new rendering, and his translation ("made anew from the Hebrew, Greek, and Latin into the Polish") was printed in 1572 at Nesvizh. As changes were introduced in the printing which were not approved by Budny, he disclaimed the New Testament and published another edition (1574) Zasłaŭje, and then finally a third edition (1589) where he withdrew some of his Judaizing and Talmudic readings.
The judge noted that Mr Ismael was part of the Lebanese community which was fleeing Nigeria at the time due to instability. He noted that Mr Ismael saw nothing dishonest in his actions of seeking to evade currency restrictions,[1975] 1 QB 654 at 663H and the judge indicated "I am satisfied that in his own mind he was at all times acting honestly."[1975] 1 QB 654 at 664A Mr Ismael tried to recover the sums from the rogue in Nigeria but was unable to do so, and counsel for the bank disclaimed any reliance that Mr Ismael's conduct was unlawful. The judge noted (at [1975] 1 QB 654 at 665E) that it would, theoretically, have been open to the bank to argue that a contract to breach the laws of a friendly state is unenforceable on the basis of public policy, see Foster v Driscoll [1929] 1 KB 470 at 519.
In April 2014, the company announced that it had changed its legal terms on its website to introduce an arbitration clause requiring all disputes with General Mills to be resolved in small claims court or arbitration and not as a participant in a class action. The change was made shortly after a judge's March 26, 2014, denial of a motion to dismiss a class action regarding the marketing of the company's Nature Valley brand products. Users would be deemed to accept the terms by interacting with General Mills on its website in various ways, such as downloading coupons, subscribing to newsletters, or participating in Internet forums hosted on the website. The New York Times stated that the agreement could be interpreted to additionally construe purchasing General Mills products at a grocery store or liking the company's Facebook page as assent to the terms; General Mills disclaimed that interpretation, calling it a "mischaracterization".
Moreover, in 1949, he disclaimed his first four claims, which were the foundation of his following patent claims. It was not until 1941 that the aerosol spray can was first put to effective use by Americans Lyle Goodhue and William Sullivan of the United States Bureau of Entomology and Plant Quarantine, who are credited as the inventors of the modern spray can., filed October 3, 1941, and granted October 5, 1943. Patent No. 2,331,117 (Serial No. 413,474) for an aerosol “dispensing apparatus”, filed by Lyle D. Goodhue and William N. Sullivan (including dispenser drawing) Their design of a refillable spray can dubbed the aerosol bomb or bug bomb, is the ancestor of many commercial spray products. It was a hand-sized steel can charged with a liquefied gas under 75 pounds of pressure and a product to be expelled as a mist or a foam.Article “Aerosol Bomb”, by The Golden Home and High School Encyclopedia, Golden Press, New York, 1961.
Kirchhoff These statements, containing as they do the physical basis on which spectroscopy rests, and the way in which it is applicable to the identification of substances existing in the sun and stars, make it appear that Stokes anticipated Kirchhoff by at least seven or eight years. Stokes, however, in a letter published some years after the delivery of this address, stated that he had failed to take one essential step in the argument—not perceiving that emission of light of definite wavelength not merely permitted, but necessitated, absorption of light of the same wavelength. He modestly disclaimed "any part of Kirchhoff's admirable discovery," adding that he felt some of his friends had been over- zealous in his cause. It must be said, however, that English men of science have not accepted this disclaimer in all its fullness, and still attribute to Stokes the credit of having first enunciated the fundamental principles of spectroscopy.
According to The New York Times, "All of the most influential jihadist theorists are criticising the Islamic State as deviant, calling its self-proclaimed caliphate null and void" and they have denounced it for its beheadings of journalists and aid workers. ISIL is widely denounced by a broad range of Islamic clerics, including Saudi and al-Qaeda-oriented clerics. Muhammad al- Yaqoubi states, "It is enough of a proof of the extreme ideology of ISIS that the top leaders of Salafi-Jihadism have disclaimed it." Other critics of ISIL's brand of Sunni Islam include Salafists who previously publicly supported jihadist groups such as al-Qaeda: for example, the Saudi government official Saleh Al-Fawzan, known for his extremist views, who claims that ISIL is a creation of "Zionists, Crusaders and Safavids", and the Jordanian- Palestinian writer Abu Muhammad al-Maqdisi, the former spiritual mentor to Abu Musab al-Zarqawi, who was released from prison in Jordan in June 2014 and accused ISIL of driving a wedge between Muslims.
The Jets/Coyotes franchise has never appeared in the Stanley Cup Finals, and has advanced to the second playoff round only three times (1985, 1987, 2012) and the conference final once (2012). Notwithstanding the NHL's non-recognition of WHA records, all four surviving WHA teams subsequently retired at least one jersey number in recognition of on-ice endeavors achieved exclusively or primarily in the WHA. The three teams that re-located in the 1990s took different approaches with respect to the retired numbers - both Colorado and Carolina disclaimed their teams' pre-relocation histories in both the WHA and NHL and re-entered all previously retired numbers into circulation, regardless of league (although notably, the Hurricanes have never issued the #9 worn by Gordie Howe and retired by the Whalers). On the other hand, the Coyotes decided to hang all previously retired Jets' numbers in the rafters including, notably, the #9 of Bobby Hull notwithstanding the fact Hull only played 18 games for the Jets in their first NHL season (the last of his career).
The eventual consequences for the game, the players and the fans were substantial. A memo circulated in 1991 by baseball commissioner Fay Vincent stated that "The possession, sale or use of any illegal drug or controlled substance by Major League players and personnel is strictly prohibited ... [and those players involved] are subject to discipline by the Commissioner and risk permanent expulsion from the game.... This prohibition applies to all illegal drugs and controlled substances, including steroids…" Some general managers of the time do not remember this memo; it was not emphasized or enforced and, confusingly, Vincent himself has disclaimed any direct responsibility for a ban on steroids, saying they were deemed "illegal" without a prescription by Congress. Ephedra, a herb used to cure cold symptoms, and also used in some allergy medications, sped up the heart and was considered by some to be a weight-loss short-cut. Overweight pitcher Steve Bechler, who wanted to stay on the Baltimore Orioles roster, took just such a shortcut. He collapsed on February 17, 2003 while pitching, and was soon pronounced dead.
