On January 7, after Russian gas deliveries to Europe through Ukraine were completely halted, German Chancellor Angela Merkel phoned both the Russian and Ukrainian Prime Ministers and reached an agreement with them that "experts from the European gas industry and the EU be sent quickly to determine on both sides of the Russia–Ukraine border..the cause of the transmission problems". On the use of decisions from other common law jurisdictions, their Honours stated that caution should be used when applying decisions from other countries, holding "Judicial decisions about employment contracts in other common law jurisdictions, including the United Kingdom, attract the cautionary observation that Australian judges must 'subject [foreign rules] to inspection at the border to determine their adaptability to native soil'. That is not an injunction to legal protectionism. It is simply a statement about the sensible use of comparative law" Similarly Gageler J held that "in its intersection with the law of unfair dismissal, the implied term would intrude a common law policy choice of broad and uncertain scope into an area of frequent, detailed and often contentious legislative activity".

Swift was launched on November 20, 2004, at 17:16 UTC aboard a Delta II 7320-10C from Cape Canaveral Air Force Station and reached a near-perfect orbit of altitude, with an inclination of 20.6°. On December 4, an anomaly occurred during instrument activation when the Thermo-Electric Cooler (TEC) Power Supply for the X-Ray Telescope did not turn on as expected. The XRT Team at Leicester and Penn State University were able to determine on December 8 that the XRT would be usable even without the TEC being operational. Additional testing on December 16 did not yield any further information as to the cause of the anomaly. On December 17 at 07:28:30 UTC, the Swift Burst Alert Telescope (BAT) triggered and located on board an apparent gamma-ray burst during launch and early operations. The spacecraft did not autonomously slew to the burst since normal operation had not yet begun, and autonomous slewing was not yet enabled. Swift had its first GRB trigger during a period when the autonomous slewing was enabled on January 17, 2005, at about 12:55 UTC.
