The Supreme Court unanimously overturned the Court of Appeal and held that Mr Prest beneficially owned the assets of the Petrodel Resources Ltd companies under a resulting trust because he contributed to their purchase price. Biosolids are an environmentally friendly product of the water treatment process that supplies organic matter and improves soil structure and porosity to allow plants to more effectively utilize nutrients. Under the Illinois Environmental Protection Act, signed into law in 2015, biosolids were formally recognized as a safe, beneficial and renewable resource that should be used locally. Rather than being hauled miles to distant farms and landfills as in years past, the biosolids are now beneficially reused in Cook County. In Barclays Bank v Anderson, an important case in the South African law of succession, the court said that conditions excluding the jurisdiction of the court are against public policy and are thus invalid. Furthermore, it was stated that the appropriate way to resolve bad-faith attacks is to grant a costs order against the party who acted in bad faith. in clause 12(b) of the will it was provided that every beneficiary "shall....personally, permanently and beneficially occupy" the land bequeathed to him/her. In clause 12(c) it was provided that should a beneficiary fail to occupy his/her land, he/she would lose all right and claim to his/her portion of the farm.

Ms Yasmin Prest claimed under Matrimonial Causes Act 1973 sections 23 and 24 for ancillary relief against the offshore companies solely owned by Mr Michael Prest. Mrs Prest said they held legal title to properties that he beneficially owned, including a £4m house at 16 Warwick Avenue, London. They had married in 1993 and divorced in 2008. He did not comply with orders for full and frank disclosure of his financial position, and the companies did not file a defence. The Matrimonial Causes Act 1973 section 24 required that for a court to be able to order a transfer a property, Mr Prest had to be ‘entitled’ to the properties held by his companies.

Lewy bodies first appear in the olfactory bulb, medulla oblongata, and pontine tegmentum; patients at this stage are asymptomatic. As the disease progresses, Lewy bodies develop in the substantia nigra, areas of the midbrain and basal forebrain, and in the neocortex. This mechanism is substantiated by the facts that α-synuclein lacks toxicity when unable to form aggregates; that heat-shock proteins, which assist in refolding proteins susceptible to aggregation, beneficially affect PD when overexpressed; and that reagents which neutralize aggregated species protect neurons in cellular models of α-synuclein overexpression. Alpha- synuclein appears to be a key link between reduced DNA repair and Parkinson’s disease.

While Venezuelan politicians sought unsuccessfully to entice European farmers to the coffee frontier, Andean peasants and others from Colombia spontaneously colonized extensive areas of the mid-slopes suitable for coffee production. Juan Vicente Gómez, who ruled the country with an iron grip for 27 years (from 1908 to 1935), beneficially utilized the revenue generated by coffee and petroleum for development activities of the country. In 1919, coffee and cacao constituted 75 percent of the country's exports, the principal market being the U.S. In 2003, the Government of Venezuela introduced policy regulations (fixing procurement price limits) on growing coffee which restricted the production of coffee in the country. Consequently, the imports (to the extent of 50% of local production) become imperative to meet the growing domestic demand.

Synbiotics refer to food ingredients or dietary supplements combining probiotics and prebiotics in a form of synergism, hence synbiotics. The synbiotic concept was first introduced as "mixtures of probiotics and prebiotics that beneficially affect the host by improving the survival and implantation of live microbial dietary supplements in the gastrointestinal tract, by selectively stimulating the growth and/or by activating the metabolism of one or a limited number of health-promoting bacteria, thus improving host welfare". Atmospheric methane is an important greenhouse gas with a global warming potential 25 times greater than carbon dioxide (averaged over 100 years), and methanogenesis in livestock and the decay of organic material is thus a considerable contributor to global warming. It may not be a net contributor in the sense that it works on organic material which used up atmospheric carbon dioxide when it was created, but its overall effect is to convert the carbon dioxide into methane which is a much more potent greenhouse gas. Methanogenesis can also be beneficially exploited, to treat organic waste, to produce useful compounds, and the methane can be collected and used as biogas, a fuel. It is the primary pathway whereby most organic matter disposed of via landfill is broken down.

Environmental advantages of sewage sludge consist of, application of sludge to land due to its soil condition properties and nutrient content. Advantages also extend to reduction in adverse health effects of incineration, decreased chemical fertilizer dependency, diminishing greenhouse gas emissions deriving from incineration and reduction in incineration fuel and energy costs.

Although in most legal systems there are certain formalities associated with settling a trust, most legal systems impose few, if any, structures on the trust instrument itself. Historically, the concept of a trust is the intervention of the courts of equity to prevent a legal owner treating the property as beneficially his own; provided that state of affairs exists, a trust arises notwithstanding any lack of formality in relation to the form of the trust instrument. The unanimous Court held that the pith and substance of the Act was in relation to "public safety" which was a matter within the criminal law power of the federal government. The Court cited the Margarine Reference for the requirements of criminal law and noted the danger of firearms, even if in some cases they could be used beneficially. Indeed, the regulations were judged to promote responsible firearm ownership, and the Court went on to argue that there would be a moral danger if firearms are used irresponsibly (morality is an element in criminal law, as established in the Margarine Reference), although the Court said that it was not just a matter of morality that gave Parliament the authority to pass this legislation. The Court also noted that firearms have been subject to federal regulation for years and that the government of Alberta could not reasonably challenge many of the earlier laws.

None of the above will equal a succinct and accurate definition of Liberalism, if they are not implemented in a manner which is consistent with the construct of the RULE OF LAW, which is not the same thing as the "rule by law" or the "rule by force". The rule of law suggests that all people and all entities as governed are to be subject to the same rules and the same consistencies and methods of interpretation, in a universal manner, so that no-one may be considered to be "above the law", or to be considered as having greater access to the law, the courts and the system of justice. The rule of law also suggests that justice cannot be bought and that no amount of influence peddling, quid-pro-quo and the like will ever suffice to exonerate a person who is inherently guilty, and who committed their crimes willfully, intentionally and beneficially.

If someone did try to frustrate a claim, the MCA 1973 section 37 made provision for setting aside certain dispositions. So, MCA 1973 section 24 did not give judges power to order Mr Prest to transfer property that he was not entitled to in law. However, on the facts, the Petrodel Resources Ltd companies could be ordered to transfer the properties under MCA 1973 section 24 because they belonged to him beneficially: under a resulting trust. A split in the shares created two companies; the former EchoStar Communications Corporation changed its name to DISH Network Corporation which consisted mainly of the DISH Network business, and EchoStar Corporation, which retained ownership of the technology side including the satellites, Sling Media, and the set-top box development arm. In Group Seven, Hildyard J outlined the current scope of freezing orders that can be issued by the Court: #It is designed to prevent injustice to a successful claimant by preserving assets and funds from being disposed of or dissipated before a judgment is satisfied. #"His assets" refers to "assets belonging to that person, not to assets belonging to another person" and without words clearly extending the scope of the phrase "his assets", assets owned beneficially by someone else will not be subject to the freezing order. #A freezing order is a precautionary measure taken urgently to protect the claimant against the risk of dissipation, disposal, reduction in value, or loss of assets pending a fuller examination as to what assets would in reality be available to the claimant for the purposes of enforcing a judgment. #If the words are ambiguous, or admit of a more restrictive interpretation, so that it is arguable whether or not the assets in question fall within their scope, the court is unlikely to treat a dealing with such assets as a contempt of court.
