Burke criticised policies such as maximum prices and state regulation of wages and set out what the limits of government should be: > That the State ought to confine itself to what regards the State, or the > creatures of the State, namely, the exterior establishment of its religion; > its magistracy; its revenue; its military force by sea and land; the > corporations that owe their existence to its fiat; in a word, to every thing > that is truly and properly public, to the public peace, to the public > safety, to the public order, to the public prosperity.

Despite his many accomplishments both at home and abroad, Bruce's post-prime ministerial career was not well known in Australia, and most still harboured memories of his harsh anti-union legislation and his government's landslide defeat in 1929. His public persona was one of an aloof man, too English for Australia in style and bearing. Upon his death in 1967, The Age of his hometown Melbourne remarked that "for most Australians, he is little more than a shadow." Bruce spent much of his life and career in the United Kingdom, the country that conversely held him in high regard, but never forgot his Australian roots and for much of his career was a tireless advocate for its interests.

Addressing the issue of perjury that was at the core of Bolden's appeal, the Seventh Circuit Court noted what Spagnoli had testified at both trials and said he had not actually perjured himself about his source of income. The Court noted that Spagnoli's "livelihood was clearly a collateral matter bearing upon his credibility" and that they did not believe "the jury's overall appraisal of this witness would have been substantially affected by the knowledge that he was being less than forthright concerning his source of income." Bolden was ordered to begin serving his sentence in June 1966. He served thirty-nine months in prison and was released on two and a half years' probation.

The officers knew that petitioner was unaware of Shepherd's arrest; they knew that he was unaware that the currency was marked; they knew that he was unaware that their presence was pursuant to a plan, initiated by Reed's disclosures, to catch the petitioner in a criminal act. Moreover, they did not actually know that petitioner had made a sale to Shepherd and received the marked money, for Shepherd had not talked, and had not been seen to enter petitioner's apartment. The fact that the marked money was found in the apartment has no bearing upon the petitioner's knowledge of the officers' purpose, since he did not know that the money was marked. This Court said in United States v.

From 1849, she was a contributor to The Southern Quarterly Review, The Southern Literary Messenger, and De Bow's Review. Davidson said that McCord was a contributor to the Southern Literary Messenger, to DeBow's Review, and to the Southern Quarterly Review.

In 1854, the Pennsylvania legislature granted a charter to The Farmers’ High School. The purpose of the institution, according to the 1859 catalogue, was to “adopt a system of instruction which shall embrace […] those departments of all sciences which have a practical or theoretical bearing upon agriculture.” The Pennsylvania State Agricultural Society encountered little resistance to the proposal, and the revised charter – dated February 22, 1855 – became the official founding day of what would become Penn State. A legislative appropriation of $25,000 – along with an additional pledge of $25,000, plus funds raised through public subscription and private donation – was used for the construction of the Main Building on 200 acres of in Centre County, near the geographic center of the state.

225 Lambert applied for a patent on this transmission which became No. 761,384 finalized May 31, 1904. The patent has six claims: 1\. No federal law recognizes a recovery such as claimants seek. The Military Personnel Claims Act,31 U.S.C. § 223b (now superseded by 28 U.S.C. § 2672), permitted recovery in some circumstances, but it specifically excluded claims of military personnel "incident to their service." John afterwards sojourned at Constantinople to study the Greek language and to become better acquainted with the situation of ecclesiastical affairs. Here he completed an etymological work bearing upon the Greek text of Scripture and destined to be of service to Catholic controversialists in treating of the doctrine of the Procession of the Holy Ghost against the Greek "schismatics".

He subsequently sat for the county of Bedfordshire until the day of his death. Being a director of the East India Company for the unprecedented period of forty-seven years, he filled the offices of chairman and deputy-chairman several times, and was actively engaged in the discussion and settlement of most of the many important questions bearing upon Indian administration which arose during that lengthened period. He was chairman of the court at the commencement of the negotiations between that body and the government which preceded the enactment of the East India Company's Charter Act of 1833. Although at first opposed to the abolition of the monopoly which the company enjoyed in respect of its trade with China, Astell eventually acquiesced in the settlement of the question made by Earl Grey's government.

The conflict initially involved a difference in views concerning "religious works" or behavior, as well as the presence and role of the Holy Spirit. For example, the Puritan majority held the view that an individual's salvation is demonstrated by righteous behavior or "good works," while the Antinomians argued that one's spiritual condition had no bearing upon one's outward behavior. However, the debate quickly changed, as the Antinomians began to claim that personal revelation was equivalent to Scripture, under the influence of Anne Hutchinson's teachings, while the Puritan majority held that the Bible was the final authority, taking precedence over any personal viewpoints. Additionally, the State Government or the Central Government under Section 377, CrPC may direct the public prosecutor to appeal to the High Court against the sentence granted by the Court of Session on grounds of inadequacy. Further, exercising of its suo-moto revisional powers under Section 397, CrPC read with Section 401, CrPC, the High Court may, even in the absence of an appeal enhance the sentence awarded by the Court of Session. The High Court may also in accordance with Section 367 of the Code conduct or direct further inquiry into or additional evidence to be taken on any point bearing upon the guilt or innocence of the convicted person. Unless directed by the High Court, the accused need not be present during this period of this inquiry or when additional evidence is taken.

As this suggests, Maule had a particular interest in manuscript research–latterly he taught post-medieval palaeography to graduate literature students in Cambridge–and himself made a number of significant discoveries. The most important of these was his identification in 1997 of an unknown manuscript treatise by Thomas Traherne entitled 'The Kingdom of God' in Lambeth Palace Library. He also brought to light unknown records bearing upon on the early biography of John Milton, a poem by John Ford, and two manuscripts of Elizabeth Cary's play Edward II. At his death he was engaged in producing editions of the poetry of Mildmay Fane, second earl of Westmorland, and also Andrew Marvell's Mr. Smirke; Or, the Divine in Mode. Bearing upon the scholars' above-mentioned suspicion of Hebraic foundations of the Enochic literature is Adolf Jellinek's insinuation or anticipation in 1853 — nearly one hundred years before the mid-20th century Qumran discoveries — when he suggested (in retrospect, rather startlingly) that the book of Enoch was an Essene creation! Milik has speculated the reason why the book was censored by Christian authors was its popular usage by Manichaeans.Gedaliahu A. Guy Stroumsa, Guy G. Stroumsa, Another Seed: Studies in Gnostic Mythology, 1984, Brill, The book was soon banned by such orthodox authorities as Hilary, Jerome, and Augustine in the fourth century and it gradually passed out of circulation, finally becoming lost to the knowledge of Western Christendom — only sundry 'fragments' remained.

After all, Schiller points out, "[i]t is hard ... to see why even the extremest intellectualism should deny that the difference between the truth and the falsehood of an assertion must show itself in some visible way."Schiller, F.C.S. (1905) p. 236 With Peirce's attempts to restrict the use of pragmatism set aside, Schiller unpacks the term "consequences" to provide what he considers as a more substantial restatement of Peirce's pragmatism: > For to say that a [statement] has consequences and that what has none is > meaningless, must surely mean that it has a bearing upon some human > interest; they must be consequences to some one for some purpose. Schiller believes his pragmatism to be more developed because of its attention to the fact that the "consequences" which make up the meaning and truth of a statement, must always be consequences for someone's particular purposes at some particular time.

Ten hours constituted a day's labour, on a voluntary basis, in many trades in Massachusetts and other parts of the country as early as 1853, while in the shipbuilding trades this was the work-day in 1844. In April 1840 President Van Buren issued an order " that all public establishments will hereafter be regulated, as to working hours, by the ten-hours system." The real aggressive movement began in 1845, through numerous petitions to the Massachusetts legislature urging a reduction of the day's labour to eleven hours, but nothing came of these petitions at that time. Again, in 1850, a similar effort was made, and also in 1851 and 1852, but the bills failed. Then there was a period of quiet until 1865, when an unpaid commission made a report relative to the hours of labour, and recommended the establishment of a bureau of statistics for the purpose of collecting data bearing upon the labour question.

Some ten years later, the Dewey Commission was cited in great detail, when in an open letter to the British press dated 25 February 1946, written by George Orwell and signed by Arthur Koestler, C. E. M. Joad, Frank Horrabin, George Padmore, Julian Symons, H. G. Wells, F. A. Ridley, C. A. Smith and John Baird, among others, it was suggested that the Nuremberg Trials then underway were an invaluable opportunity for establishing "historical truth and bearing upon the political integrity" of figures of international standing. Regardless of which, Albrecht-Carrié says the reparation section of the treaty proved "to be a dismal failure". Campbell says, "although there was much in the peace that was 'petty, unjust, and humiliating', there was little aside from reparation clauses and certain territorial concessions, which had much real bearing upon Germany's economic future". Summarizing the view of economists throughout the 1920s, she says the territorial changes to Germany were "not necessarily ... economically unsound", but than the removal of the Saar and territory to Poland "depriv[ed] Germany of her resources in excess of the amount necessary to fulfill the legitimate economic demands of the victors ... Campbell also said the treaty failed to include "provisions looking to the restoration of Germany to her former position as the chief economic and financial stabilizing influence in central Europe" and that this was economically shortsighted and was an economic failing of the treaty.

According to its Constitution, :The Society for Historical Archaeology shall be an educational not-for-profit organization to promote scholarly research and the dissemination of knowledge concerning historical archaeology; to exchange information in this field; to hold periodic conferences to discuss problems of mutual interest relating to the study of historical archaeology; and to obtain the cooperation of the concerned disciplines for projects of research. The focus shall be the era since the beginning of explorations of the non-European parts of the world by Europeans, with prime concern in the Western Hemisphere. The society may additionally concern itself with European, Oceanic, African, and Asian archaeology having definite bearing upon scholarly problems in the Western Hemisphere. The SHA’s “Ethical Principles of The Society for Historical Archaeology” provide further guidance to society members, historical archaeologists, and those in allied fields regarding one’s ethical obligations to the archaeological record, colleagues, employers, and the public.

In this way, the measures employed at first for > their coercion, and afterwards for their advancement in civilization, came > naturally to be separate from those directed to the subjugation (if I may > use the phrase) and improvement of the Eastern tribes. Conversely, the use of implants for breast reconstruction after breast cancer mastectomy appears to have no negative effect upon the incidence of cancer-related death. That patients with breast implants are more often diagnosed with palpable—but not larger—tumors indicates that equal-sized tumors might be more readily palpated in augmented patients, which might compensate for the impaired mammogram images. The ready palpability of the breast-cancer tumor(s) is consequent to breast tissue thinning by compression, innately in smaller breasts a priori (because they have lesser tissue volumes), and that the implant serves as a radio-opaque base against which a cancerous tumor can be differentiated. Breast MRI of a patient with implant (Blue) The breast implant has no clinical bearing upon lumpectomy breast-conservation surgery for women who developed breast cancer after the implantation procedure, nor does the breast implant interfere with external beam radiation treatments (XRT); moreover, the post- treatment incidence of breast-tissue fibrosis is common, and thus a consequent increased rate of capsular contracture.

The court considered the FTC's cease-and desist order against several US manufacturers of tetracycline in American Cyanamid Co. v. FTC. In that case Pfizer and Cyanamid cross-licensed one another; Cyanamid made erroneous representations to the Patent Office concerning matters bearing upon the patentability of tetracycline; and although Cyanamid soon discovered that these representations were inaccurate, it did not disclose this fact to the Patent Office until after the tetracycline patent had been granted to Pfizer, thereby aiding Pfizer in its efforts to obtain a patent monopoly. The FTC ruled that this suppression of material information, combined with the cross-licensing agreement between Pfizer and Cyanamid and the acceptance by the latter of a license from the former to produce and sell tetracycline, constituted an illegal attempt to share a monopoly with Pfizer and amounted to a combination in restraint of trade. Although the court vacated and ordered retrial on a technical issue (disqualification of a commissioner) and evidentiary shortcomings, it upheld the FTC's jurisdiction in the matter.

Dudgeon was appointed Professor of Anatomy and Physiology at the Imperial College (Tongwen guan) during the 1870s and 1880s. In Wanderings in China, Constance Frederica Gordon Cumming wrote: He was an accomplished Chinese scholar, and during his long residence at Pekin he studied the manners and customs of the inhabitants, and the semi-annual reports that he forwarded to the Chinese Maritime Customs Service contain a large amount of valuable information regarding the climatic condition, physical features and drainage, and general habits of the people bearing upon health. He was the author of an Historical Sketch of the Ecclesiastical, Political, and Commercial Relation of Russia with China, of a Chinese work 脱影奇观 On the Principles and Practice of Photography, the first of its kind, and of an article in the Pekin Magazine (in Chinese) on the virtues of quinine, in which he pointed out the dangers of the imported spurious article. To the Chinese Medical Journal he contributed papers on A Modern Chinese Anatomist, and A Chapter on Chinese Surgery.

It is submitted that this is the position under the penal code, as the words of section 156 of the Code appears to be very general without any limitation that the false evidence shall have any bearing upon the matter in issue. But explanation 2 to section 156 of the Penal Code seems to approve of the materiality concept, as it states that a material particular within the meaning of that section means a particular which is material to any question then in issue or intended to be caused in that proceeding. said: ‘… it is not material to the judicial proceeding, and it is not necessary that it should have been relevant and material for the issue being tried…’ This proposition differ from the position under Nigerian penal laws and, under the English Perjury Act. Maule, J, proposition in Phillpots is approved by Stephen, who contended that: ‘it is difficult to imagine a case in which a person would be under any temptation to introduce into his evidence a deliberate lie about a matter absolutely irrelevant to the matter before the court.

According to the rules of the society: "The Annual Oration, to be called the Hunterian Society Oration, shall be delivered by the Orator for the current session, at a Meeting of the Society. The primary setting is a hotel brothel called Nam Kok, based on the actual Luk Kwok hotel where Mason himself stayed at the suggestion of a friend. (The hotel has since been replaced by an upscale concrete and glass construction that bears no resemblance.) The novel's tremendous success owes much to keen psychological insight, a strength apparent in all of Mason's novels, deft and often touching characterization, and the unfolding of a love story that explores the many difficulties inherent in a relationship between a respectable British artist and a Hong Kong prostitute, forced into the trade from economic necessity. (China had been embroiled in a turbulent civil war compounded by Japanese invasion in the period immediately preceding the events of the novel.) The psychological pressures bearing upon the essentially conservative Suzie, and the social consequences for her lover Robert Lomax are particularly well developed. Mason, however, felt that the novel fell short of its full potential and would have been stronger had he explored more fully life as it was then being lived in Hong Kong.

There are two theories on how the account of Chlochilaicus' raid came to be preserved in the epic Beowulf, and they have a bearing upon the date assigned to the poem.

The suspense building up to the mutinies delineates in a telling way the motivation of the mutineers and their fate, in particular Vizard, the strong but ill-starred radical. As well as that ‘lively fidelity with which the author caught the everyday life of ordinary men and women’ The Times obituary referred to, Tilsley was not afraid to tackle the large issues of the period he lived through, and latterly explored historical themes bearing upon important contemporary concerns of social morality and power. When mapping twentieth century working-class writing Frank Tilsley must be reckoned a significant figure, whose work suggests some interesting continuity in bridging the 1930s and the 1950s; his career of course almost straddling these decades. This continuity is indicated stylistically and in terms of his approach to dealing with people’s experiences in their everyday working lives. That public libraries have sold off, or are busy selling off, Tilsley’s books from stock in a sorry short-sighted policy based on current ‘popularity’, and that his twenty-seven novels are all now out of print, must be a source of more than idle regret.
