Rucho v. Common Cause, No. 18-422, 588 U.S. ___ (2019), is a landmark case of the United States Supreme Court concerning partisan gerrymandering. The Court ruled that while partisan gerrymandering may be "incompatible with democratic principles", the federal courts cannot review such allegations, as they present nonjusticiable political questions outside the remit of these courts.. The case was one of three heard in the 2018 term dealing with issues related to partisan gerrymandering used in the districting plans of states. It was combined with Rucho v.
The Jewish community of Oslo et al. v. Norway (Communication No. 30/2003) was a case decided by the UN Committee on the Elimination of Racial Discrimination in 2005. The case involved an antisemitic speech given during a march in commemoration of the Nazi leader Rudolf Hess. The Supreme Court of Norway acquitted the giver of the speech, and found that penalizing approval of Nazism would involve prohibiting Nazi organizations, which it considered would go too far and be incompatible with the right to freedom of speech.
Perhaps the least unusual alternative biochemistry would be one with differing chirality of its biomolecules. In known Earth-based life, amino acids are almost universally of the form and sugars are of the form. Molecules using amino acids or sugars may be possible; molecules of such a chirality, however, would be incompatible with organisms using the opposing chirality molecules. The Asylum and Immigration (Treatment of Claimants, etc.) Act 2004 (c 19) is an Act of the Parliament of the United Kingdom. It set various rules for immigrants to the United Kingdom. In 2006, section 19 of the Act was declared to be incompatible with the Convention for the Protection of Human Rights and Fundamental Freedoms under section 4 of the Human Rights Act 1998. Section 19 dealt the problem of so-called "sham marriages", where immigrants marry British citizens merely to gain leave to stay.

If the function requires advanced coding language skills, it may be too costly in either time or money to code compared to the amount of enhancement the function will add to the user experience. There's also a risk that advanced interactivity may be incompatible with older browsers or hardware configurations. Carl Linnaeus (17071778), a Swedish botanist, invented the modern system of binomial nomenclature Prior to the adoption of the modern binomial system of naming species, a scientific name consisted of a generic name combined with a specific name that was from one to several words long. Together they formed a system of polynomial nomenclature. These names had two separate functions. First, to designate or label the species, and second, to be a diagnosis or description; however these two goals were eventually found to be incompatible.
This separation is usually done by hand but has become automated in some sorting centers: a spectroscopic scanner is used to differentiate between different types of paper and plastic based on the absorbed wavelengths, and subsequently divert each material into the proper collection channel. Animal cryptochromes and closely related animal (6-4) photolyases contain a longer chain of electron-transferring tryptophans than other proteins of the cryptochrome-photolyase superfamily (a tryptophan tetrad instead of a triad). The longer chain leads to a better separation and over 1000× longer lifetimes of the photoinduced flavin-tryptophan radical pairs than in proteins with a triad of tryptophans. The absence of spin-selective recombination of these radical pairs on the nanosecond to microsecond timescales seems to be incompatible with the suggestion that magnetoreception by cryptochromes is based on the forward light reaction.

Australian bass are found in coastal rivers and streams from Wilsons Promontory in Victoria east and north along the eastern seaboard to the rivers and creeks of the Bundaberg region in central Queensland. Australian bass are not found in the Murray-Darling system. Although the system is extensive, it terminates in a sequence of lakes and lagoons and has only one shallow and changeable entrance to the Southern Ocean—features that appear to be incompatible with the estuarine breeding habits of Australian bass and other aspects of their life cycle.

In the early 1970s the radical Edmund Burke Society (EBS) infiltrated the party electing Paul Fromm as the party's president and other EBSers to the executive. If cementation of a definitive restoration would require a resin-based luting agent, there is evidence indicating the use of a zinc oxide non-eugenol containing cement. Non-eugenol materials use long chain aliphatic acids or aryl-substituted butyric acid to react with zinc oxide particles. Eugenol itself is known to be incompatible with resin polymers, as it is a radical scavenger (like other phenolic compounds) and therefore inhibits polymerisation of resin materials. Further evidence illustrated that the application of eugenol-containing cement to cured composite resin cores before final cementation with resin cement significantly reduced retention of the crowns.
The intention of a Bell inequality is to serve as a test of local realism or local hidden-variable theories as against quantum mechanics, applying Bell's theorem, which shows them to be incompatible. Not all the Bell's inequalities that appear in the literature are in fact fit for this purpose. In 1946 Baumann publicly expressed view brought him into conflict with his Protestant Church, which it found to be incompatible with their basic beliefs and Baumann in 1947 in the waiting state replied. Energetics has a controversial history. Some authors maintain that its origins may be found in the work of the ancient Greeks, but that the mathematical formalisation began with the work of Leibniz. Richard de Villamil (1928) said that Rankine formulated the science of energetics in his paper Outlines of the Science of Energetics published in the Proceedings of the Philosophical Society of Glasgow in 1855. W. Ostwald and E. Mach subsequently developed the study, and by the late 1800s energetics was understood to be incompatible with the atomic view of the atom forwarded by Boltzmann's gas theory.
Judgements which on a bivalent logic would be incompatible or contradictory are further seen as "incongruent", though one may well have more weight than the other. In short, relativistic logic is not, or need not be, the bugbear it is often presented to be. It may simply be the best type of logic to apply to certain very uncertain spheres of real experiences in the world (although some sort of logic needs to be applied to make that judgement). Those who swear by bivalent logic might simply be the ultimate keepers of the great fear of the flux.
Thatcher replied to Cuckney to the effect that the British Government would continue to support Westland in gaining orders in Europe. In early January Heseltine then wrote to David Horne of Lloyds Merchant Bank, who was advising the European consortium (in reply to planted questions from Horne which had been dictated to him over the phone by one of Heseltine's staff), giving him the advice which Thatcher had declined to include in her letter to Cuckney. Contradicting Thatcher's reassurances to Cuckney, Heseltine claimed that the Sikorsky deal would be "incompatible with participation" in European helicopter projects. Heseltine's letter was leaked to The Times.
On October 21, 2010, the European Court of Human Rights issued its verdict. The unanimous decision says that there had been a violation of the articles 11, 13 and 14 of the European Convention of Human Rights. The Court stressed that if the exercise of the right to peaceful assembly and association by a minority group were conditional on its acceptance by the majority, that would be incompatible with the values of the Convention. The Court held that Russia was to pay to Nikolai Alekseev 12,000 EUR in respect of non-pecuniary damage and 17,510 EUR for costs and expenses.
The main points of debate between anthropic mechanists and anti-mechanists are mainly occupied with two topics: the mind—consciousness, in particular—and free will. Anti-mechanists argue that anthropic mechanism be incompatible with our commonsense intuitions: in philosophy of mind they argue that if matter is devoid of mental properties, then the phenomenon of consciousness cannot be explained by mechanistic principles acting on matter. In metaphysics anti- mechanists argue that anthropic mechanism implies determinism about human action, which is incompatible with our experience of free will. Contemporary philosophers who have argued for this position include Norman Malcolm and David Chalmers.
Those factors include national traditions and values, including antisemitism, common throughout contemporary Central Europe, and a more Lithuanian-specific desire for a "pure" Lithuanian nation-state with which the Jewish population was believed to be incompatible. In classical Protestant and Evangelical thought, Hartshorne's theology has received strong criticism. In these theological networks Hartshorne's panentheist reinterpretation of God's nature has been deemed to be incompatible with Biblical revelation and the classic creedal formulations of the Trinity. Critics such as Royce Gordon Gruenler (born January 10, 1930), Ronald Nash and Norman Geisler argue that Hartshorne does not offer a tripersonal view of the Trinity, and instead his interpretation of Christ (Christology) has some affinities with the early heresy of the Ebionites. It is also argued that Hartshorne's theology entails a denial of divine foreknowledge and predestination to salvation.
Musavat is also known for its protests against the Azerbaijani government such as that took place on 16 October 2003, after Isa Qambar had lost the election,Müsavat Partiyasinin Tarixi as well as on March 12, 2011. When Musavat applied for membership of the European Liberal Democrat and Reform Party (ELDR, now Alliance of Liberals and Democrats for Europe Party, ALDE), some members considered Musavat's ideology to be incompatible with Western liberalism. Board member Nasib Nasibli even resigned, stating that the party was committed to Turkic nationalism rather than liberalism. Nevertheless, Musavat was eventually admitted to ELDR.
On 5 November 2018, UGM's student body publication, Balairung Press, published an article containing the account, from a female student ("Agni"), of an alleged rape she experienced at the hands of a male fellow student ("HS") while doing a student work experience (Kuliah Kerja Nyata – KKN) program in Seram Island, Maluku in June 2017. When learning of the rape allegation, UGM–KKN officials chose not to forward Agni's accusation to the police. Instead, they were skeptical of Agni's account. Regardless, HS was pulled from the KKN program about a week later because he was deemed to be "incompatible" with other KKN participants.

According to the Free Software Foundation, the Open Publication License "can be used as a free documentation license" and is "a copyleft free documentation license provided the copyright holder does not exercise any of the 'LICENSE OPTIONS' listed in Section VI of the license." It is not, however, compatible with the GNU FDL. In March 2004, the OPL v1.0 was determined by the Debian legal team to be incompatible with the Debian Free Software Guidelines. In October 2004, an analysis of the Open Public License was published by Andrew M. St. Laurent, the author of Understanding Open Source and Free Software Licensing.
ACPO has supervised the creation of one of the world's largest per-capita DNA databases, containing the DNA profiles of more than one million innocent people. ACPO's guidelines that these profiles should only be deleted in "exceptional circumstances" were found to be unlawful by the UK Supreme Court in May 2011. They were found to be incompatible with the European Convention on Human Rights, following the ruling by the European Court of Human Rights in S and Marper v United Kingdom. In 1848, Karl Marx published a critique of Heinzen's thought on the topics of morality and dignity. But Chief Warrant Officer Darrell Harrison (Van Johnson) is determined to bring them together, so he "fixes up" each of them with a sure-to-be-incompatible blind date. Helen's date is an obstetrician (Sidney Miller) who stands a good head shorter than she ("Darrell had a malicious sense of humor," Helen observes in voice-over); Frank's date is a "hip" girl (Louise Troy) who is not only young enough to be his daughter, but is also far too forward for his taste. As the final touch, Harrison makes sure that both dates take place in the same Japanese restaurant.
In his development of the ontological argument, Leibniz attempted to demonstrate the coherence of a supremely perfect being. C. D. Broad countered that if two characteristics necessary for God's perfection are incompatible with a third, the notion of a supremely perfect being becomes incoherent. The tradition of veiling hair in Iranian culture has ancient pre-Islamic origins, but the widespread custom was forcibly ended by Reza Shah's regime in 1936, as he claimed hijab to be incompatible with his modernizing ambitions and ordered "unveiling" act or Kashf-e hijab. The police arrested women who wore the veil and would forcibly remove it, and these policies outraged the Shi'a clerics, and ordinary men and women, to whom appearing in public without their cover was tantamount to nakedness. The peacock tail in flight, the classic example of an ornament assumed to be a Fisherian runaway Fisherian runaway or runaway selection is a sexual selection mechanism proposed by the mathematical biologist Ronald Fisher in the early 20th century, to account for the evolution of exaggerated male ornamentation by persistent, directional female choice. An example is the colourful and elaborate peacock plumage compared to the relatively subdued peahen plumage; the costly ornaments, notably the bird's extremely long tail, appear to be incompatible with natural selection. Fisherian runaway can be postulated to include sexually dimorphic phenotypic traits such as behaviour expressed by either sex. Extreme and apparently maladaptive sexual dimorphism represented a paradox for evolutionary biologists from Charles Darwin's time up to the modern synthesis.

The Catholic Church in Peru then held a vote to rebuke Gutiérrez's ordination within the group, which ended in a tie. According to Arthur McGovern, controversy regarding Gutiérrez and liberation theology was not limited to the Catholic Church: the New York Times and the Wall Street Journal printed full- scale advertisements warning readers of a potential communist state in Mexico, arguing that "liberation theology… [would] install Communism in the name of Christianity" and encourage acts of terrorism.

The following years proved to be especially tumultuous for Italy as a whole: while traditional trade unionism was being reshaped by the student movement and secondary impact of the decolonization and Third World ideologies, the local scene saw the advent of terrorism of the Red Brigades and the Neo-Fascist Strategy of tension (carried out by the National Vanguard).
The concept of invariance is sometimes used on its own as a way of choosing between estimators, but this is not necessarily definitive. For example, a requirement of invariance may be incompatible with the requirement that the estimator be mean-unbiased; on the other hand, the criterion of median-unbiasedness is defined in terms of the estimator's sampling distribution and so is invariant under many transformations. One use of the concept of invariance is where a class or family of estimators is proposed and a particular formulation must be selected amongst these. One procedure is to impose relevant invariance properties and then to find the formulation within this class that has the best properties, leading to what is called the optimal invariant estimator.

On 2 July, Masoumeh Ebtekar, the head of Vice Presidency for Women and Family Affairs announced the equalization of the "blood money" for both sexes is legal and all of the courts must observe it.
Because of his reputation as a restorer of the works of classic golf course designers such as Donald Ross, Prichard - then a resident of Montgomeryville - was appointed in the 1990s to restore Aronimink Golf Club in Newtown Township, Pennsylvania. This was originally designed by Ross but underwent numerous modifications in the 1980s under Robert Trent Jones, an influential architect but one whose approach to golf course design was later felt to be incompatible with Ross's. The restorations achieved a higher profile when the course was selected to host the Senior PGA Championship for 2003. Prichard's changes, only commenced after a year of planning during which he inspected the course and old photographs, included restoring Ross's original bunkering and expanding the fairways.

Wii access to the BBC iPlayer was interrupted on April 9, 2008, when an update to the Opera Browser turned out to be incompatible with the BBC iPlayer. The BBC chose not to make the BBC iPlayer compatible with the upgrade. This was resolved on November 18, 2009 when they released the BBC iPlayer Channel, allowing easier access to the BBC iPlayer. The BBC had since offered a free, dedicated Wii channel version of their BBC iPlayer application which is only available in the UK. By February 10, 2015, however, the channel was retired and consequently removed from Wii Shop Channel since newer versions are not compatible, and as per BBC's policy to retire older versions as a resource management.
A low cost for the codec itself is not a significant advantage over DVD, however, as the standalone hardware players will be incompatible with standard DVD-Video unless the manufacturer pays the royalties for the technologies necessary to make the player DVD-compatible. Koch has argued that Tartessian is a Celtic language and that the texts can be translated.
Thomas McCoskar (also misspelt as McCosker), an Australian, visited Fiji, was arrested, tried and sentenced to two years jail for sodomy. An appeal was raised on the basis of Fiji's constitution outlawing discrimination on the basis of sexual orientation. On Friday 26 August 2005, his conviction, and that of Dhirendra Nadan, the other man involved, was overturned on constitutional grounds. Anti-sodomy laws were found to be incompatible with the country’s 1997 Constitutional Bill of Rights. The debate over what is and isn’t culturally acceptable was at the heart of the constitutional arguments which were presented during the McCoskar High Court case (Nadan & McCoskar v State also cited as DPP v Nadan and McCoskar) and raised questions about the values enshrined in the country’s Bill of Rights.
In Spain, yé-yé music was at first considered to be incompatible with Catholicism. However, this did not stop the yé-yé culture from spreading, although a bit later than in the rest of Europe; in 1968 Spanish yé-yé girl Massiel won the Eurovision song contest with "La, la, la", while the sweet, naïve-looking singer Karina enjoyed success as the Spanish yé-yé queen with her hits "En un mundo nuevo" and "El baúl de los recuerdos". The Supreme Court began its analysis by noting that deliberately deceiving the trial court and jury by presenting evidence known to be false had been held to be incompatible with the "rudimentary demands of justice" as early as Mooney v. According to academic Derek Royal, Jewish ethnicity is prominent throughout the stories; in "A Contract with God" and "Cookalein", religious and cultural Jewish symbolry are prominent, though in the middle two stories, there is little outward evidence of the characters' Jewishness. The two outer stories further emphasize Jewish identity with the extra-urban portions of their settings—the rural Russian origin of the religious Hersh in "Contract", and the Catskill mountains in "Cookalein", a retreat commonly associated with Jews in the 20th century. Eisner deals with representing Jewish identity through community. He juxtaposes individual stories and individual characters, who have different experiences which may be incompatible with one another; this confounds any single definition of "Jewishness", though there is a communal sense that binds these characters and their Jewishness together.

Geer v. Connecticut, 161 U.S. 519 (1896), was a United States Supreme Court decision, which dealt with the transportation of wild fowl over state lines. Geer held that the states owned the wild animals within their borders and could strictly regulate their management and harvest. According to the Geer Court, “the right to preserve game flows from the undoubted existence in the State of a police power.” Although this statement is often quoted by state advocates, it is followed by the qualification that this power reaches only “in so far as its exercise may not be incompatible with, or restrained by, the rights conveyed to the Federal government by the Constitution.” The Geer decision supported the view that the states owned all resident wildlife, but at the time there were no conflicting federal wildlife laws.

Having a gene that could do all that seems pretty unlikely to me." Hamer responded that the existence of such a gene would not be incompatible with the existence of a personal God: "Religious believers can point to the existence of God genes as one more sign of the creator's ingenuity--a clever way to help humans acknowledge and embrace a divine presence." He repeatedly notes in his book that, "This book is about whether God genes exist, not about whether there is a God.
In July 1959, just over a year after the EEC was established, the government of Portugal began the process of establishing a diplomatic mission to it, and to Euratom the same month. However, Portugal considered its "multi- continental structure" (in reference to its many overseas colonies) to be incompatible with EEC membership; even had it wished to join, its contemporary dictatorship would have made an accession difficult to impossible. In spite of these factors, Portugal was a founding member of the European Free Trade Association (EFTA), which was initially aimed to compete with the EEC as a European common economic zone. For example, various MKW stories state that Kzinti did not establish their own interstellar empire nor invent their own spacefaring technology.
When EU states were negotiating subsuming the Schengen Agreement into the EU by the Treaty of Amsterdam, Ireland and the United Kingdom were the only member states that had not signed the Agreement. The UK did not want to join and Ireland wished to maintain its Common Travel Area with the United Kingdom and associated islands, an arrangement that would be incompatible with Schengen membership while the UK remained out. As a result, both negotiated an opt-out from the part of the treaty which was to incorporate the Schengen rules (or acquis) into EU Law when it came into effect on 1 May 1999.See Article 4 of Protocol (No 19) on the Schengen Acquis integrated into the framework of the European Union (OJ C 83, 30 March 2010, p. 290).

More refined typefaces were soon released by emerging dedicated type design companies, notably the DB series by Suraphol Vesaratchavej and Parinya Rojarayanond of Dear Book (later known as DB Design), and the PSL series by PSL SmartLetter. These new typefaces, as well as digital fonts based on earlier classic types, were widely adopted as the media industry boomed amidst rapid economic growth, until halted by the 1997 financial crisis. For TrueType fonts, proper positioning of some combining characters required the use of private use area glyphs, but these were defined differently between Windows and Mac OS systems, causing font files for each to be incompatible.

Marwan Bishara, senior political analyst at Al Jazeera, alleged that Israel had hoped to disrupt the Palestinian national unity government between Fatah and Hamas by its operation.
Managers at Relate considered his raising of a possible conscionable objection to assisting same-sex couples with sexual issues to be incompatible with the organisation's equal opportunities policy and would reduce the number of couples he were able to help. On 12 December 2007, the applicant was asked to confirm in writing he would continue to counsel same-sex clients in both relationship counselling and PST with regard to all the sexual issues they may have brought, and that he would agree to carry out relationship work where it involved same-sex sexual issues. In January 2008, McFarlane responded that he was unable to confirm this, and disciplinary proceedings were initiated. During these he confirmed that he would provide the required services to same- sex couples and the proceedings were ended.
Regardless of whether Pope Pius IX had been personally involved in the decision to remove Mortara from his parents—whether he had been or not was debated extensively in the press—what is certain is that he was greatly surprised by the international furore that erupted over the matter. He adopted the position, based on Postremo mense, that to return the baptised child to his non-Christian family would be incompatible with Church doctrine. As foreign governments and the various branches of the Rothschild family one by one condemned his actions, Pius IX stood firm on what he saw as a matter of principle. Those angered included Emperor Napoleon III of France, who found the situation particularly vexing as the pontifical government owed its very existence to the French garrison in Rome.
Chirac has been named in several cases of alleged corruption that occurred during his term as mayor, some of which have led to felony convictions of some politicians and aides. However, a controversial judicial decision in 1999 granted Chirac immunity while he was president of France. He refused to testify on these matters, arguing that it would be incompatible with his presidential functions. Investigations concerning the running of Paris's city hall, the number of whose municipal employees increased by 25% from 1977 to 1995 (with 2,000 out of approximately 35,000 coming from the Corrèze region where Chirac had held his seat as deputy), as well as a lack of financial transparency (marchés publics) and the communal debt, were thwarted by the legal impossibility of questioning him as president.
Save as otherwise provided in the Treaties, any aid granted by a Member State or through State resources in any form whatsoever which distorts or threatens to distort competition by favouring certain undertakings or the production of certain goods shall, in so far as it affects trade between Member States, be incompatible with the internal market. The intent of this was that in order to avoid favouring a certain company or commercial group, an EU member state should not provide support by financial aid, lesser taxation rates or other ways to a party that does normal commercial business. For example, it would be considered illegal state aid by the EU if a government took over an unprofitable company with the sole intent to keep it running at a loss. However state aid can be approved by the European Commission in individual circumstances.
The Fifth Street Historic District includes approximately 23 acres of commercial district and residential clusters to the southwest of Lynchburg's central business district. The district includes more than 55 contributing resources and less than 10 non-contributing resources. The Fifth Street Corridor began its development in the early nineteenth century as a gateway to Lynchburg, connecting the booming town with points westward as evidenced by transportation-oriented businesses of the period with names like the Kentucky Hotel (118-0177) and the Western Hotel (118-0020). During the late nineteenth century, Fifth Street (also known variably as Seventh Alley, Cocke Street, or West Street) served as the site of uses that would seem to be incompatible; it hosted high-end residential areas for Lynchburg's white population while at the same time serving as the principal scene of commerce for the area's African American community.

The directors of the West End, however, considered the charter to be incompatible with their interests, in part due to the perceived impracticality of the Meigs system and the prohibition on emulating the Manhattan design. In 1993, a version of Windows NT was released that could operate on processors other than the x86 set. While it required that applications be recompiled, which most developers did not do, its hardware independence was used for Silicon Graphics (SGI) x86 workstations–thanks to NT's Hardware abstraction layer (HAL), they could operate NT (and its vast application library). No mass-market personal computer hardware vendor dared to be incompatible with the latest version of Windows, and Microsoft's annual WinHEC conferences provided a setting in which Microsoft could lobby for—and in some cases dictate—the pace and direction of the hardware of the PC industry. Microsoft and Intel had become so important to the ongoing development of PC hardware that industry writers began using the word Wintel to refer to the combined hardware-software system.
Vamsee Juluri, author and Professor of Media Studies at the University of San Francisco, identifies Indophobia in certain sections of the US media as part of a racist postcolonial/neocolonial discourse used to attack and defame India and encourage racial prejudice against Indian Americans, particularly in light of India's recent economic progress, which some "old-school" colonialists find to be incompatible with their Clash of Civilizations world view. Juluri identified numerous instances of bias and prejudice against Indians in US media, such as The New York Times and Foreign Policy and attempts to erase and disparage the history of India in American school textbooks misrepresent the history of India during the California textbook controversy over Hindu history with the final verdict to retain the term "India" in Californian textbooks and to remove the disparaging contents from textbooks.
In C++03, a class or struct must follow a number of rules for it to be considered a plain old data (POD) type. Types that fit this definition produce object layouts that are compatible with C, and they could also be initialized statically. The C++03 standard has restrictions on what types are compatible with C or can be statically initialized despite there being no technical reason a compiler couldn't accept the program; if someone were to create a C++03 POD type and add a non-virtual member function, this type would no longer be a POD type, could not be statically initialized, and would be incompatible with C despite no change to the memory layout. C++11 relaxed several of the POD rules, by dividing the POD concept into two separate concepts: trivial and standard-layout.

In 1828, the fame of Giorgetti as a composer, teacher, and publicist was established in Florence because he most furiously participated in a written debate regarding German influence in the didactics of Italian music. In the periodicals, space was given to the prevalent idea that there was an excessive penetration of German taste inside the classrooms of the conservatories, while Giorgetti, on the contrary, affirmed that the study of Germans of the Classical period (Mozart, Haydn and Beethoven) was instead essential in acquiring the necessary knowledge that permitted Italian singability to be expressed well. Giorgetti proposed a sort of union between German and Italian style, which in this era were considered to be incompatible.
On 12 November 1927, Trotsky and Zinoviev were expelled from the Communist Party itself, followed by Kamenev at the Fifteenth Party Congress in December 1927. At the Congress, where Kamenev acted as the United Opposition's spokesman due to Trotsky's and Zinoviev's expulsion, the United Opposition were unable to gain the support of more than a small minority of the Communist Party, and they were expelled after the Congress declared United Opposition views to be incompatible with Communist Party membership. While Trotsky remained firm in his opposition to Stalin after his expulsion from the Communist Party and his subsequent exile, Zinoviev and Kamenev capitulated almost immediately and called on their supporters to follow suit. They wrote open letters acknowledging their mistakes and were readmitted to the Communist Party in June 1928, after a six- month cooling-off period.
The Treaty on the Functioning of the European Union (Art. 107, para. 1) reads: "Save as otherwise provided in this Treaty, any aid granted by a Member State or through State resources in any form whatsoever which distorts or threatens to distort competition by favouring certain undertakings or the production of certain goods shall, in so far as it affects trade between Member States, be incompatible with the common market." This sets out the characteristics of a “State aid” and states that the award of a State aid will be unlawful unless compatible with the common market, which is achieved either by applying a block exemption or notification . Five cumulative criteria shall be present for a “State aid” to exist: # "the use of state resources" # "the measure must confer an advantage to a certain undertaking" # "the advantage must be selective" # "the measure must distort competition" # "affect trade between member states".
"Reading down" involves choosing an interpretation that is compatible, where more than one is strictly possible. For example, placing a persuasive burden of proof on a defendant raising a defence - that he need persuade the jury that it is the case, was judged to be incompatible with Article 6(2) of the convention, which related to the presumption of innocence, which had long been a part of English law in R v Lambert. The court read down the burden of proof as merely one of an evidential burden - meaning the defendant merely had to raise some evidence to support the defence, which it believed did not conflict with Article 6(2). However, in Sheldrake v DPP, the court instead requiring a persuasive burden, because it believed in the context of the motoring offence in the case, this was not disproportionate and did not conflict with Article 6(2).
National courts must, in that respect, apply EC law through available national procedures or, failing that, of their own motion. Focusing on the House of Lords' argument that it could not temporarily suspend the application of a national law, the Advocate- General emphasised the importance of interim relief in every legal system, remarking that its purpose was to ensure that the time needed to establish a right would not deprive that right of any substance. Furthermore, he did not believe that national courts were entitled to give priority to national legislation merely because it had not yet been shown to be incompatible with Community law; if that were the case, rights conferred by national law would have greater protection than that offered to Community law rights. Prime Minister Laisenia Qarase told the House of Representatives that the amendments, to which the Opposition Fiji Labour Party had agreed at the Tanaloa Talks in 2003, were necessary to allow chiefs to hold multiple positions if their subjects so wished. In 2005, several prominent figures were affected by the constitutional ban on politicians holding other public offices. These included Ro Teimumu Kepa, the Paramount Chief of the Burebasaga Confederacy, who was required to relinquish her chairmanship of the Rewa Provincial Council, which was deemed to be incompatible with her position as a member of the House of Representatives and as a Cabinet Minister.
As World War II was drawing to a close, there was more political support for redistributive policies than ever before. The working classes had increased influence due to the recent expansion of the electoral franchise and the wealthier classes were generally more sympathetic due to the shared experience of participating in the war and as moderate Keynesian policies were seen as the best measure to stabilise liberal democracy by reducing poverty and unemployment, thus forestalling the rise of extremists such as fascists. This second objective was considered to be incompatible with a full return to the free market system as it had existed in the late 19th century—mainly because with a free market in international capital, investors could easily withdraw money from nations that tried to implement interventionist and redistributive policies.This had recently happened to France after the Popular Front came to power in 1936.
Typical water- based lubricants may be incompatible with sex acts that occur in water (such as in a bathtub, pool, or hot tub) as they can be dissolved or dispersed in water. The Population Council, in a 2011 study, tested commercially available water-based sexual lubricants, and found that many damaged human rectal cells and that some of them - those containing polyquaternium-15 - appeared to actively increase HIV replication in cell cultures and therefore could raise one's risk of HIV transmission. Water-based 'lubes' have been recommended for use in safer sex because they do not weaken condoms like oil-based lubricants do. The researchers concluded: "Since it is the condom that is protecting users from HIV rather than the lube, condom users should still be encouraged to use water-based lubes because condoms are also more likely to break, and trauma to the rectal lining occur, with no lube".

Professors Antonio Fábregas of the University of Tromsø, Elena Felíu Arquiola of the University of Jaén and Soledad Varela of the Autonomous University of Madrid use the concept of a Morphological Local Domain in their discussion of the Lexical Integrity Hypothesis, in which words have multiple binary branching layers composed of roots and functional projections, with the deeper layers of the morphological hierarchy being too far away for the syntax to see and only the higher head of this multi-layered morphological tree has the ability to transmit information. Additionally, some theories of syntax appear to be incompatible with the Lexical Integrity Hypothesis, such as Minimalism.
However, most believe that Viktor Yushchenko's victory in the Ukrainian presidential election of 2004 was a significant blow against the project: Yushchenko has shown renewed interest in Ukrainian membership in the European Union and such membership would be incompatible with the envisioned common economic space. Disparity of cult, sometimes called disparity of worship (Disparitas Cultus), is a diriment impediment in Roman Catholic canon law: a reason why a marriage can not be validly contracted without a dispensation, stemming from one person being certainly baptized, and the other certainly not baptized. The reasons for this impediment is that the marriage will not be a sacrament with one spouse unbaptized, that the unbaptized person's views on marriage may be incompatible with the Catholic views, and that such a marriage may hinder the practice of religion on part of the Catholic spouse and any children. Disparity of worship does not affect the marriage of a Catholic or baptized non-Catholic with one whose baptism, even after careful investigation concerning the baptismal ceremony or its validity, remains doubtful. Neither does it in any way influence the marriage of two who, after diligent examination, are still considered doubtfully baptized.
According to Amnesty International, the intense and prolonged stress means many inmates on death row have poor mental health, suffering from the so- called death row phenomenon. The failure to give advanced notice of executions has been stated by the United Nations Human Rights Committee to be incompatible with articles 2, 7 and 10 of the International Covenant on Civil and Political Rights. South Asia Human Rights Documentation Centre claims that the issuance of death warrants by the Ministry of Justice may be politically motivated. In 1997, Norio Nagayama, a prisoner who committed the first of several murders as a juvenile, was executed during the sentencing phase of "Sakakibara Seito" for the Kobe child murders, also resulting in a high- profile juvenile murder trial – an attempt, according to South Asia Human Rights Documentation Center, to show that the harshest punishment could be administered to juveniles.

(University of North Carolina) Indeed, with Marx's support, the American branch of the organization was purged of its pacifist, anti-racist and feminist elements, which were accused of putting too much emphasis on issues unrelated to class struggle and were therefore seen to be incompatible with scientific socialism. The Verband Fortschrittlicher Frauenvereine (League of Progressive Women's Associations), a turn of the 20th century left-wing organization led by Lily Braun campaigned for the decriminalisation of homosexuality in Germany and aimed at organizing prostitutes into labour unions. In November, 1991, Scott appeared at a news briefing, held as part of the National Gay and Lesbian Task Force's (NGLTF) Creating Change Conference, to predict that the Department of Defense (DOD) would soon be pressured to change its policy stating homosexuality to be incompatible with military service. On Veterans Day, November 11, 1991, Scott organized a Queer Nation demonstration to protest the policy, the first event of its kind. The peaceful demonstration, dubbed "Operation Queer Storm," began with a rally at the Lyndon Baines Johnson Memorial Grove, where Scott and other veterans addressed the crowd, and ended at the Pentagon, where a handful of activists tried but failed to get arrested by pushing through the police line at the top of the Pentagon steps. After presidential candidate Bill Clinton pledged to reverse the Department of Defense' policy on lesbian and gay service members, Scott worked with videographer Tim McCarthy to develop a campaign aimed at getting lesbian and gay voters to the polls.
The Act grants the Secretary of State for Scotland power to direct the Scottish Government not to take any action which he has reasonable grounds to believe "would be incompatible with any international obligations" or to act where he believes such action "is required for the purpose of giving effect to any such obligations".Section 58 . The Act also sets up mechanisms to resolve disputes over questions about legislative competence of the Parliament and powers of the Executive. The "granite wastes" attracted the ascetic "saints-to-be", the "clays and gravels" tempted the would-be tyrants (who "left, slamming the door", an allusion to Goebbels' taunt that if the Nazis failed, they would "slam the door" with a bang that would shake the universe), and an "older colder voice, the oceanic whisper" beckoned the "really reckless" romantic solitaries who renounce or deny life: The immoderate soils together represent the danger of humans "trying to be little gods on earth", while the limestone landscape promises that life's pleasures need not be incompatible with public responsibility and salvation. After seeming to dismiss the landscape as historically insignificant in these middle sections of the poem, Auden justifies it in theological terms at the end.
Georgian flag in front of Council of Europe To enhance their relationship, the EU and Georgia began negotiating an Association Agreement (AA) and a Deep and Comprehensive Free Trade Agreement. In November 2012, EU Commissioner for Enlargement and European Neighbourhood Policy Stefan Fule stated that the AA negotiations could be finalized by November 2013. In February 2013, Tamar Beruchachvili, the Deputy State Minister for European and Euro-Atlantic Integration of Georgia, stated that Georgia had no plans to join the Customs Union of Belarus, Kazakhstan and Russia, which Fule has warned Ukraine would be incompatible with the agreements with the EU. A ceremony on the initialling of the AA by the Georgian Foreign Minister Maia Panjikidze and EU High Representative for Foreign Affairs and Security Policy Catherine Ashton was held at the Eastern Partnership summit on 29 November 2013. It was formally signed on 27 June 2014, and had to be ratified by the EU, Euratom, their member states and Georgia.

After the anti-immigration vote in a popular referendum in 2014, which flew in the face of one of the EU's four freedoms, the free movement of people (the others being the free circulation of goods, services and capital), there was some doubt as to whether Switzerland would continue to participate in Horizon 2020 after 2016. Shortly after the vote, the Swiss government had informed the EU that it would be unable to give Croatian citizens unrestricted access to the Swiss job market, as this would be incompatible with the ‘yes’ vote in the referendum. The European Commission reacted by excluding Switzerland from research programmes potentially worth hundreds of millions of euros for its universities and suspended negotiations on Switzerland's participation as a full member of Horizon 2020.

Such has been compared to the early days of Christianity, when the church opposed the gnostics' belief that salvation came not through faith but through a mystical inner knowledge. The letter also says, "one can see if and how [prayer] might be enriched by meditation methods developed in other religions and cultures" but maintains the idea that "there must be some fit between the nature of [other approaches to] prayer and Christian beliefs about ultimate reality." Some fundamentalist Christian organizations consider yoga to be incompatible with their religious background, considering it a part of the New Age movement inconsistent with Christianity.

Since the passage of the Human Rights Act 1998, the courts have been able to declare an Act of Parliament to be incompatible with the European Convention on Human Rights, but such a declaration of incompatibility has no legal effect unless and until it is acted upon by the government. The wording of the writ of habeas corpus implies that the prisoner is brought to the court for the legality of the imprisonment to be examined. However, rather than issuing the writ immediately and waiting for the return of the writ by the custodian, modern practice in England is for the original application to be followed by a hearing with both parties present to decide the legality of the detention, without any writ being issued. If the detention is held to be unlawful, the prisoner can usually then be released or bailed by order of the court without having to be produced before it.
The Treaty of Lisbon expanded the role of Member States' parliaments in the legislative processes of the EU by giving them a prior scrutiny of legislative proposals before the Council and the Parliament can take a position. The Treaty of Lisbon provides for national parliaments "to contribute to the good functioning of the Union" through receiving draft EU legislation, seeing to it that the principle of subsidiarity is respected, taking part in the evaluation mechanisms for the implementation of the Union policies in the area of freedom, security and justice, being involved in the political monitoring of Europol and the evaluation of Eurojust's activities, being notified of applications for EU accession, taking part in the inter-parliamentary cooperation between national parliaments and with the European Parliament. The Treaty of Lisbon allows national parliaments eight weeks to study legislative proposals made by the European Commission and decide whether to send a reasoned opinion stating why the national parliament considers it to be incompatible with the principle of subsidiarity. National parliaments may vote to have the measure reviewed.
In the beginning of 2014, Argentina attempted to prevent Brazil, Uruguay and Paraguay to negotiate individually a schedule for opening markets with the European Union (EU), within the framework of the free trade agreement with Mercosur. Technicians of the two blocs that gathered in March from 2014 in Brussels did not reach an agreement because of the lack of ambition of the Mercosur proposal, says the Brazilian newspaper Folha de S.Paulo. Brazil and Argentina were in disagreement and Brazilian representative would have mentioned the existence of a B plan, which would consist of different rhythm for opening markets in each country. However, Argentina would have blocked this option, fearful that their products could replaced by European ones in the Brazilian market, one of the most important for Argentina. According to the newspaper Folha de S.Paulo, for the President of Argentina, Cristina Kirchner, the proposal would beincompatible with the deeper integration of the bloc”. Europeans would be disappointed by the possibility of a “grace period” for some products regarding the reduction of import tariffs.
The primary purpose of zoning is to segregate uses that are thought to be incompatible. In practice, zoning is also used to prevent new development from interfering with existing uses and/or to preserve the "character" of a community. In it he showed that a system of bodies at rest tends to reach a position in which any change would create the smallest possible change in a quantity that he argued could be assimilated to action. Colonialists of last two centuries invented the theory of separation of politics from religion and rivalry between the old and the new sciences in order to create a gulf between these two systems. They not only divided the language of religion from language of modern science, culture and philosophy, but also developed a big difference between the two with the result that conciliation between these two languages becomes difficult. That is why whenever an anyone of those religious minded people who had been to Europe and were conversant with modern civilization and culture, tried to defend and transmit whatever of religion was left to him, he in most cases presented religion in an ambiguous form which materialized to be incompatible with modern civilization and modern sciences. Realizing the situation, many of scholars, especially during the last 100 years have tried to bridge this gulf and to introduce modern science and civilization in a perspective compatible with the broad and progressive outlook of Islam and free from all misconception and misrepresentation.
Further key events were the Nixon Shock of 1971 when conversion to gold was suspended even for governments, the collapse of the fixed exchange rate system in 1973, and the United States official abandonment of capital controls in 1974. A common popular view was that the rise of financial power resulted from unplanned trends towards globalisation and technical innovation. This view has been challenged by scholars such as Eric Helleiner, Louis Pauly and Susan Strange, who argue that the US and British administrations encouraged financial liberalization even as early as the late 1950s, when mainstream economics was still largely of the opinion that such a policy would be incompatible with the general welfare. Reasons given include a calculation by the US that with the erosion of the hugely favorable trade balance they had enjoyed for the first few years after the war, financial liberation would be a good peaceful way of promoting continued US hegemony as US banks were far more advanced than their competitors in the rival economies of Europe and Japan.

A state party to the Convention is empowered to demand from any state party the repatriation of any minor from the first state (the "requesting state") who is present in the second state (the "requested state").
