Based on recent research, his date of birth has been corrected to 1604 from the traditionally given birth year of 1602. Bosse's apprenticeship contract was found in which it is mentioned that he was aged 16 at the date of signing the contract (16 June 1620).
Since the contract was impossible to perform, Judge Blackburn held that the absolute liability set forth in Paradine v Jane would not apply here, as there was an implied term that the music hall would be in existence at the date of the planned concerts.Koffman, Macdonald, p. 520 The requirement of "impossibility" in Taylor v Caldwell was modified in the 1903 case of Krell v Henry,Krell v Henry [1903] 2 KB 740. which concerned a party who had rented a room for the purpose of watching the coronation procession of Edward VII.
In response to the COVID-19 pandemic, several initiatives to improve collaboration between scientists from a variety of fields have been launched. Studies exploring the impact of the COVID-19 pandemic on behavior and mental health are conducted and widely shared across social media such as Twitter. In this context, the PSA made a call for studies surrounding the COVID-19 disease and retrieved 66 study proposals from different experts within one week. At the date of May 2020, three studies have been selected and are being conducted worldwide.
In 1821 he was made secretary of the archives, and in 1827 principal keeper of the royal library at Hanover; from 1832 to 1837 he edited the Hannoverische Zeitung, and more than once sat as representative in the Hanoverian second chamber. In 1842 he was chief librarian at the Royal Library in Berlin, where he shortly afterwards was made a privy councillor and a member of the Academy of Sciences. He resigned all his appointments in 1874. The Monumenta began to appear in 1826, and at the date of his resignation 24 folio volumes in the series Scriptores, Leges, and Diplomata had appeared.
After the Nazi seizure of power in 1933, these facilities were extensively used for propaganda purposes. With the end of World War II, Königs Wusterhausen was part of the Soviet occupation zone and several masts were taken down by order of the military government, though the station remained in use for broadcasting in East Germany. The Central Tower collapsed during the Cyclone Quimburga on 15 November 1972. At the date of German reunification in 1990, there was only one high mast with a longwave aerial, two masts for a T-aerial for medium wave and some small towers.
The non-disturbance clauses were largely ineffective, firstly because the landowners routinely ignored them with impunity, secondly because the land occupied by Africans at the date of the certificate was not recorded and thirdly, the practice of shifting cultivation meant that much of what Johnston thought was unoccupied or waste land near villages was land that was temporarily out of use and resting under local variants of the Chitemene system that is still employed in parts of Zambia.B. Pachai, (1978). "Land and Politics in Malawi 1875-1975", p. 41.R M Moore and M. Vaughan, (1994).
Following his leadership, a small group negotiated with the help of a professional mediator through the remainder of the year, finally agreeing unanimously on a proposal to resolve the major conflicts by restructuring the church through separation. The agreement would allow each part of the Church to remain true to its theological understanding, while recognizing the dignity, equality, integrity, and respect of every person. The agreement was to be presented for possible approval at the next General Conference, originally scheduled for May 2020, until the COVID-19 pandemic interfered. At the date of Yambasu’s death, the proposal had not yet been approved.
The goal of this new system was to expand library services to areas outside of the City of Bremerton. The Kitsap County Rural Library District operated under its own budget and staff until 1955 when it merged with Bremerton Public Library, consolidating resources, budgets, staff and equipment. At the date of its creation, Kitsap Regional Library included a regional service center at Bremerton; stations at Eglon, Retsil, Seabeck, Kingston, Erlands Point, Manchester, Navy Yard City, Port Gamble, Silverdale, Tracyton, Rolling Bay and Suquamish; and one branch library in Poulsbo. Two bookmobiles further extended service to rural areas.
The road was built as initiative from the Crosslinks Further Study, which highlighted the need for another vehicular cross-border link between Hong Kong and Shenzhen. At the date of the study (2001), there were three existing vehicular border crossings, located at Lok Ma Chau, Man Kam To and Sha Tau Kok. At that time, these links were nearing saturation and were expected to reach their maximum handling capacity by 2006. As a result, the government of Hong Kong proposed the Shenzhen Western Corridor and Deep Bay Link as an additional vehicular border crossing to provide additional cross- border road infrastructure.
When financial statements of one or more prior periods are presented on a comparative basis with financial statements of the current period, reporting guidance is provided in section 508. If substantial doubt about the entity's ability to continue as a going concern for a reasonable period of time existed at the date of prior period financial statements that are presented on a comparative basis, and that doubt has been removed in the current period, the explanatory paragraph included in the auditor's report (following the opinion paragraph) on the financial statements of the prior period should not be repeated.
James Nevore was chantry priest at the date of the Commissioners' Report, and the chantry was endowed with land in Rivington, Whittle, Adlington, and Heath Charnock. The lands held at Rivington were purchased from the crown in 1583 by Thurston Anderton and included Higher Knowle farm, Lower Knowle farm and Grut farm, once located opposite the entrance of the current Rivington and Blackrod High School. The possession by the Crown was in consequence of the Abolition of Chantries Act 1547. An earlier record of 1574 recovering rents for the same properties to the benefit of the school suggests freehold and leasehold.
Warkworth Castle, the home of Henry Percy Henry Percy, 'Hotspur', is one of Shakespeare's best-known characters. In Henry IV, Part 1, Percy is portrayed as the same age as his rival, Prince Hal, by whom he is slain in single combat. In fact, he was 23 years older than Prince Hal, the future King Henry V, who was a youth of 16 at the date of the Battle of Shrewsbury. The name of one of England's football clubs, Tottenham Hotspur F.C., acknowledges Henry Percy, whose descendants owned land in the neighbourhood of the club's first ground in the Tottenham Marshes.
It was revived and rebuilt by Sacramento General Shops into a "camera car" for the purpose of shooting motion picture background plates for a ground-based full-motion locomotive training simulator. As camera car number 8799, it was retired in 1984 and donated to the California State Railroad Museum in Sacramento, California. It was de-accessioned by CSRM and acquired by the Pacific Locomotive Association and moved to the Niles Canyon Railway's Brightside, California rail yard in the summer of 2008. At the date of its inception, its type represented the highest-horsepower six-axle diesel locomotives in the world.
In 2005, Williams won an NBA championship as a coaching staff intern with the San Antonio Spurs. In 2005, Williams was hired by new head coach Nate McMillan as an assistant coach for the Portland Trail Blazers. On June 7, 2010, Williams was offered a three-year contract to be the head coach of the New Orleans Hornets. At the date of his hiring, Williams became the youngest head coach in the NBA at 38 years old. In his first season with the Hornets, the team finished with a 46–36 record and made the playoffs.
The special objects contemplated were the religious instruction of the poor, the training of the clergy, and foreign missions. On the eve of the French Revolution, St. Lazare was plundered by the mob and the congregation later suppressed; it was restored by Napoleon in 1804 at the desire of Pius VII, abolished by him in 1809 in consequence of a quarrel with the pope, and again restored in 1816. The Lazarists were expelled from Italy in 1871 and from Germany in 1873. The Lazarite province of Poland was singularly prosperous; at the date of its suppression in 1796 it possessed thirty-five establishments.

British rule in the Indian subcontinent ended in 1947 with the creation of new states: the dominions of Pakistan and India, as the successor states to British India. The British Paramountcy over the 562 Indian princely states ended. According to the Indian Independence Act 1947, "the suzerainty of His Majesty over the Indian States lapses, and with it, all treaties and agreements in force at the date of the passing of this Act between His Majesty and the rulers of Indian States". States were thereafter left to choose whether to join India or Pakistan or to remain independent.
Clause 6 provided for the letting of the timber yard "to enable the foresaid trading agreement to be carried out." Clause 8 gave the Denny, "in the event of the foregoing trading agreement being terminated by either party as aforesaid, ... the right as at the date of the termination of the said agreement" to purchase the timber yard at a certain price or to take a lease of it at a certain rent. Because of the Control of Timber (No 4) Order 1939, further transactions between the parties became impossible from the end of September, 1939. Denny continued to occupy the timber yard.
IFRS 1 requires entities to explain the effect of the transition to IFRS on their financial position, financial performance, and cash flows. For example, it requires entities to present certain reconciliations between accounting amounts under the previous GAAP and that under IFRS. An entity is permitted to use the fair value of an item of property, plant and equipment at the date of transition to IFRSs as its deemed cost at that date. If it does so, the entity is required to disclose the aggregate of these fair values and aggregate adjustments from the previous GAAP.
Tregonning Hill is the westerly of two granite hills overlooking Mount's Bay in west Cornwall, England, United Kingdom, the other being Godolphin Hill. They are approximately west of the town of Helston.Ordnance Survey: Landranger map sheet 203 Land's End The Plymouth chemist William Cookworthy mixed china stone with kaolin, mined from the hill to make Plymouth porcelain; which was the first time porcelain was made in Europe. Part of the hill is designated as a Site of Special Scientific Interest (SSSI) and at the date of notification (1994) was the only known site of western rustwort (Marsupella profunda) in Great Britain.
Although The Rosary cemetery in Norwich had begun to pioneer elements of a non-denominational approach, it had presented only a partial model (it made no progress on designing a non-denominational chapel until the late nineteenth century). Similarly, other cemeteries to date had only been able to apply the term non-denominational in a partial sense, lacking non- denominational entrance lodges or chapels. Consequently, at the date of Hosking's brief, there was no European architectural style for the buildings of a wholly non-denominational cemetery on which he could draw for inspiration. Thus Hosking's brief was both novel and ambitious.

The investigative journalist George Knapp noted Cecil's case on the approach of the incident's one-year anniversary during an annual animal-welfare broadcast concerning issues, the development of law, animal cruelty, and remediation efforts in June 2016. The 2016 broadcast covered various issues, including horses and trophy hunting noting Cecil and the effect the incident was still causing at the date of the show.Coast to Coast AM evening broadcast, 18 June 2016. Money raised in response to Cecil's death has been used by researchers to reduce conflicts between people and lions by paying for lion protectors and other methods.
In its declaration of accession, Russia made a reservation regarding article 18 of the Berne Convention, stating that the treaty "shall not extend to the works which, at the date of entry into force of the said Convention in respect of the Russian Federation, are already in the public domain in its territory."WIPO: Berne Notification 162. This statement effectively denied the retroactivity of the Berne Convention for foreign works within Russia. This was of some importance because of the issue of foreign works published before May 27, 1973, when the USSR had joined the UCC.
The underground graveyard, called di San Sebastiano since the Early Middle Ages, was known since the 3rd century as in memoria apostolorum, a toponym referred to the presence within the catacomb, for some time, of the relics of the Apostles Peter and Paul. In effect, the Depositio Martyrum (half of the 4th century), at the date of 29 June, talks about the recurrence of Peter in catacumbas and Paul on Via Ostiensis. The Martyrologium Hieronymianum (5th century), at the same date, cites the recurrence of Peter in Vatican, Paul on Via Ostiensis and utrumque in catacumbas, Tusco et Basso consulibus (during the consulship of Tuscus and Bassus, that is in 258).
An important question the Court answered was if the equidistance principle was, at the date of the ruling, a customary international law binding on all States. The Court argued that it is indeed possible for Conventions, while only contractual in origin, to pass into the corpus of international law, and thus become binding for countries which have never become parties to the Convention. However, the Court notes that 'this result is not lightly to be regarded as having been attained' (para 71). For the aforegoing to happen, it would first be necessary that the provision should be of a fundamentally norm creating character, i.e.
Of the university he wrote: Accordingly, he set himself vigorously to the task of framing and enforcing regulations for the admission and conduct of members of the university, and also of establishing lectureships. His episcopal labours were still more arduous. There were, at the date of the Restoration, about seventy Presbyterian ministers in the north of Ireland, and most of these were from the west of Scotland, with a dislike for Episcopacy which distinguished the Covenanting party. No wonder that Taylor, writing to James Butler, 1st Duke of Ormonde shortly after his consecration, should have said, "I perceive myself thrown into a place of torment".
Swadif (Pty) Ltd v Dyke NO1978 (1) SA 928 (A). is an important case in South African contract law, especially in the area of novation. It was heard in the Appellate Division by Wessels JA, Muller JA, Miller JA, Joubert JA and Trengove AJA on 15 September 1977, with judgment handed down on 22 November. Whatever the grounds on which the rescission of a judgment may be sought at common law, it is abundantly clear, the court found, that at common law any cause of action relied on as a ground for setting aside a final judgment, must have existed at the date of the final judgment.
303–305 The mansion with columned portico visible in the centre of the picture, No. 43 King Street, is attributed to architect Thomas Archer (later 1st Baron Archer) and occupied by him at the date of Hogarth's works. It was situated on the north side of the piazza, while the coffee house was on the south side, as depicted in Hogarth's original painting. In the picture, it is early morning and some revellers are ending their evening: a fight has broken out in the coffee house and, in the melée, a wig flies out of the door. Meanwhile, stallholders set out their fruit and vegetables for the day's market.
The price for the futures contract at the date of delivery (contract expiry date) may be different. At the expiry date, depending upon the contract specification the "futures" owner may either deliver/receive a physical amount of oil (extremely rare), they may settle in cash against an expiration price set by the exchange, or they may close out the contract prior to expiry and pay or receive the difference in the two prices. In futures markets you always trade with a formal exchange, every participant has the same counterpart. A swap is an agreement whereby a floating price is exchanged for a fixed price over a specified period.
Expenditure on a business (such as a property business) made by an individual can be claimed as an allowance against Capital Gains. Whether expenditure is claimable against income (potentially reducing income tax) or capital (potentially reducing capital gains tax) depends on whether there was improvement of the property: if there was none, it is against income; if there was some, then it is against capital. Transfers between husband and wife or between civil partners do not crystallise a capital gain, but instead transfer the purchase price (book cost). Otherwise, transfers made as gifts are treated for CGT purposes as being made at the market value at the date of transfer.
General Finance Acceptance (GFA) leased a computer to Melrose on a five-year term, with the leasing contract having the term that upon default, that Melrose would pay all the remaining lease payments less the cost of the computer at the date of cancellation, plus interest on top of al this at 32% per annum. Melrose cancelled the contract early, and was billed by GFA for this default as per the default clause in the lease agreement, even though these damages were far higher than Melrose would have paid had the lease gone the whole five-year term, and they disputed liability for these damages.

After the peace he was appointed to with his cousin Thomas, whom he followed to , and by whom, in 1765, while on the coast of Africa, he was promoted to be lieutenant of . It is stated in Foster's Peerage that he was born in 1752, a date incompatible with the facts of his known service: by the Regulations of the Navy he was bound to be twenty years old at the date of his promotion, and though the order was often grossly infringed, it is highly improbable that he was only thirteen: it may fairly be assumed that he was at least eighteen in 1765.
Stewart began to practise at 11 Fownes Street, Dublin, in 1773, and in the same year he was elected a surgeon to the Charitable Infirmary, Inns Quay, which subsequently was removed to Jervis Street. Soon after Stewart moved to South George's Street, and at the date of the foundation of the College he resided at 32 Mary Street. He again changed his residence to 74 Stephen Street, and the latter portion of his life was spent in a fine mansion in Upper Merrion Street. Stewart being well connected, having agreeable manners and much surgical skill, soon acquired an extensive practice amongst the upper classes.
The right to succession of statutory tenants was restricted, provision was made for the transfer of public sector tenancies to certain private sector landlords, Housing for Wales was established having functions relating to housing associations. The Act set up housing action trusts, made amendments to the right to buy, and provisions as to repair notices. In Schedule 2 Part I there were mandatory grounds in which a court must order possession of an assured tenancy and other grounds in Part II in which a court may order possession. The Ground 8 of Part I dealt with the amount of arrears at the date of the court hearing.

Ross states that the marriage did not take place until after the 13th Earl's death. Although the marriage settlement itself does not survive, evidence of its provisions is found in the 13th Earl's will.. On 29 May 1514, Henry VIII, in the exercise of his royal prerogative, treated de Vere's marriage as technically invalid on the grounds that de Vere had been under the age of fourteen at the date of the marriage. As was his prerogative right as king, he offered to de Vere, who by then had succeeded as the 14th Earl and become a royal ward, Margaret Courtenay as a bride. De Vere refused Margaret.
The High Court held that the man held the property on constructive trust for himself and the woman in the proportions in which they had contributed to the improvements to the land. This trust did not arise the moment the woman commenced improvements - that conduct did not involve a breach of duty or an unjust enrichment etc. The trust arose at the date of judgment, to do justice in the case. In Bathurst City Council v PWC Properties, the High Court that as constructive trusts are the most severe remedy in cases of breach of fiduciary duty, they should only be imposed when other remedies are inappropriate in providing relief.
Nixon also argued that with the nation engaged in the Cold War with the Soviets, that Kennedy was too young and inexperienced to be trusted with the presidency. Had Nixon been elected, at 48 years, 11 days, he would have been the fourth-youngest president at the date of inauguration. Kennedy, by contrast, was 43 years, 236 days, on the date of his inauguration; the second-youngest man to begin a Presidency (at 42 Theodore Roosevelt, who assumed the Presidency upon the assassination of United States President William McKinley 60 years previously, was the youngest). During Kennedy's campaign he relied on his youth and promised to bring about change.
Tom Tower seen from Tom Quad Print of 1675, before Wren's additions, David Loggan, Oxonia Illustrata St Aldates Tom Tower is a bell tower in Oxford, England, named after its bell, Great Tom. It is over Tom Gate, on St Aldates, the main entrance of Christ Church, Oxford, which leads into Tom Quad. This square tower with an octagonal lantern and facetted ogee dome was designed by Christopher Wren and built 1681–82. The strength of Oxford architectural tradition and Christ Church's connection to its founder, Henry VIII, motivated the decision to complete the gatehouse structure, left unfinished by Cardinal Wolsey at the date of his fall from power in 1529, and which had remained roofless since.
If the Matching Shares are removed between 3 and 5 years from the date of purchase, then Income Tax and National Insurance will be due on the lower of the value of the Matching Shares at the date of award and their market value on the date on which they are withdrawn from the SIP. If the Matching Shares remain in the SIP for more than 5 years no Income Tax or National Insurance is payable when the shares are eventually removed from the SIP. In certain circumstances, prescribed by HMRC, there can be no Income Tax or National Insurance liability when the employee leaves the company, no matter how long the shares have been held in the plan..
The jurisdiction for Wrotham Park damages has been expanded and clarified in subsequent cases, and was summarized by the Judicial Committee of the Privy Council in 2009:, par. 4654; discussed at #Damages awarded are intended to compensate the claimant for the court's decision not to grant relief in the form of an order for specific performance or an injunction. #The court will award an amount of damages which represents the sum that the claimant might reasonably have demanded from the defendant as compensation for allowing it to breach the relevant contractual provision. The court assesses this by reference to a "hypothetical negotiation" carried out between the parties at the date of breach.
They had a different weapon layout, as stated above, with the two lower cowling machine guns moved into the wings. Only 19 of the 34 commissioned aircraft were built, and six of them were converted to the Serie I standard at the factory. The production version, named Serie I, had the standard armament of three 20 mm MG 151/20s and two 12.7 mm (.5 in) Breda- SAFAT machine guns, plus two underwing hardpoints, allowing it to carry either two bombs (up to 160 kg/350 lb), or two drop tanks (100 L/26 US Gal). At the date of the Armistice, 8 September 1943, 35 G.55s of all Series had been delivered, including three prototypes.
These were all writs in the praecipe form, meaning that they commanded the defendant to perform an act: for example, to keep a promise; to yield up a sum of money or chattel unjustly withheld; or to render accounts. These actions were subject to various limitations. For example, by the middle of the 14th century at the latest, it was necessary for a plaintiff in an action of covenant to have a deed.Waltham Carrier Case (1321) Eyre of London In an action of debt sur contract, a deed was not necessary, but a defendant was able to wage his law and the sum claimed had to be a sum certain fixed at the date of contract.
Impecunity – the Crown argued that they should not be liable for damages due to impecunity as they claimed that the company was insolvent at the date of the spraying. The court disagreed, saying the company was not insolvent, merely its finances were stretched. Failure to mitigate loss – the Crown argued that damages awarded due to Geothermal delaying replanting the flowers because of lack of finance, should not be awarded on the grounds that the Managing Director Mr MacLachlan had land he could or either sold or mortgaged to of financed the immediate replanting of the flowers, which he declined to do. The court ruled that the director had no duty to risk his assets under such circumstances.
Prior to the administration, if customers redeemed their vouchers in Zavvi stores, Zavvi would pay the owner of the stock the retail sale price of the goods. In the normal course of the business, if a company is able to pay all its debts as they fall due, this is not a problem. At the date of the administration, Zavvi was insolvent and there were approximately 510,000 vouchers with a total value of around £4.1 million which had yet to be redeemed. If the administrators allowed vouchers to be redeemed against stock, they would have had to make payments to the owner of the stock, without receiving any monies from the 'sale' of the stock.
A 1968 reference mentions the celuring-set, said at the date of writing to have been a rare instrument found only in the central Javanese principalities. This consisted of a large ornate frame, on top of which was mounted a set of bronze half-coconut-shaped bowls which were struck with a small iron bar. Singing bowls Bowls that were capable of singing began to be imported to the West from around the early 1970s. The musicians Henry Wolff and Nancy Hennings have been credited with the singing bowl's introduction for musical purposes in their 1972 new-age album Tibetan Bells (although they gave no details of the bowls used in the recording).
Arthur died in 1917 and Jessie inherited the property ostensibly until her death in 1952 whereby it was to pass to her eldest son (also Arthur). Available sales particulars however indicate that the property was sold in 1947, purchased by Dr Esmond Millington for £10000. Jessie Nelson Weekes had remained at the property since her marriage to Arthur in 1888, a total of 59 years. At the date of sale, the property was offered as three lots: lot 1 included the house and grounds, all of the land between the house and the adjacent property New Inn and a southern ‘tongue’ of land that extended out to the west of the tower (Conveyance Report, Mansion House - 1947.

On the evening of 20 March, Paget sent a telegram to the War Office in London announcing that almost all the officers of 5th Lancers intended to resign and the same was probably true of 16th Lancers. Seely replied, on behalf of the Army Council, telling Paget to suspend any senior officer who had offered to resign, and ordering Gough and two of his three colonels (the attitude of the third was unclear) to report to the War Office. A second telegram just before midnight confirmed that 57 officers preferred to accept dismissal (it was actually 61 including GoughHolmes 2004, p. 386.): At the date of the incident, 70 officers were serving with the 3rd Cavalry Brigade.
At the date of the Armistice, seventy-two of the 147 bombers still in the hands of Regia Aeronautica were CANT Z.1007s. The largest groups were in Perugia (22 aircraft) and in the Aegean sea (19 aircraft).De Marchi and Tonizzo 1994, p. 41. Three days after the armistice, on 11 September, the CANT Z.1007s that were in Perugia, joined by eight more, took off for the base of Alghero in Sardinia, losing two of their number to German flak. On 16 September these bombers attacked German vessels that were carrying troops and equipment from Sardinia to Corsica, and one more aircraft was lost to flak.De Marchi and Tonizzo 1994, pp. 42-43.

The 2013 Constitution promulgated by the military-backed interim government abolished the Senate and the House of Representatives, instituting a single-chamber 50-member Parliament. Section 54(2) of the Constitution requires the Fiji Electoral Commission to review the composition of the parliament at least one year before a general election and may if necessary increase or decrease the total number of members. In its review the commission will ensure that ratio of members to the population is the same as the ratio at the date of the first general election under this Constitution. Furthermore, the commission is required to consider the most recent census, the Register of Voters or any other official information available when undertaking its review.
The Lilly Ledbetter Fair Pay Act of 2009 (, ) is a federal statute in the United States that was the first bill signed into law by US President Barack Obama on January 29, 2009. The act amends Title VII of the Civil Rights Act of 1964 and states that the 180-day statute of limitations for filing an equal- pay lawsuit regarding pay discrimination resets with each new paycheck affected by that discriminatory action. The law directly addressed Ledbetter v. Goodyear Tire & Rubber Co. (2007), a U.S. Supreme Court decision that the statute of limitations for presenting an equal-pay lawsuit begins on the date that the employer makes the initial discriminatory wage decision, not at the date of the most recent paycheck.
The National Yogurt Association (NYA) of the United States gives a "Live & Active Cultures Seal" to refrigerated yogurt products that contain 100 million cells per gram, or frozen yogurt products that contain 10 million cells per gram at the time of manufacture. In 2002, the FDA and WHO recommended that "the minimum viable numbers of each probiotic strain at the end of the shelf- life" be reported on labeling, but most companies that give a number report the viable cell count at the date of manufacture, a number that could be much higher than what exists at consumption. Because of the variability in storage conditions and time before eating, exactly how many active culture cells remain at the time of consumption is difficult to determine.
Hall was severe on the action of Sir Robert Bell, the speaker, and other members of parliament. Parliament was in recess at the date of the publication, and did not resume its sittings till January 1581. In 1580 the privy council summoned Hall before it, and he apologised for the tone of his book, but still kept a few copies in circulation. On 16 January 1581 Thomas Norton, M.P., at the opening of the new session of parliament, brought the offensive work to the notice of the house. A committee was appointed to examine Hall, Bynneman, and others, but Hall's answers to the committee proved unsatisfactory, and on 14 February 1581 he was for a second time summoned to the bar of the house.
The first large scale system in Tuvalu was a 40 kW solar panel installation on the roof of Tuvalu Sports Ground. This grid-connected 40 kW solar system was established in 2008 by the E8 and Japan Government through Kansai Electric Company (Japan) and contributes 1% of electricity production on Funafuti. Future plans include expanding this plant to 60 kW. A 46 kW solar installation with battery storage at the Motufoua Secondary School on Vaitupu island was brought online on 27 November 2009.Request for Proposals (RFP) Tuvalu – Project Manager for the Renewable Energy and Energy Efficiency Unit, Tuvalu Electricity Corporation, 5 May 2010 At the date of installation it was described as the largest diesel-solar photovoltaic (PV) hybrid electricity system in the South Pacific.
The transitory and final provisions start by declaring the provisional Head of the State the President of the Republic, with the implementation of the Constitution. In case not all Regional Councils had been set up at the date of the election of the next President of the Republic, the Provisions state that only members of the two Houses could participate in the election, while also providing the requirements for appointing the members of the first Senate of the Republic. The Provisions provide a general timeline for the implementation of the Constitution. For example, Article 80 on the question of international treaties which involve budget expenditures or changes in the law, is declared effective as from the date of convocation of Parliament.
It was given the Magdeburg law by Boleslaw-Yuri II of Galicia in 1339. In a Ruthenian chronicle can be found the Hypatian Codex, where at the date of 1150 one can read: The Hungarian King Géza II of Hungary crossed the mountains and seized the stronghold of Sanok with its governor as well as many villages in the Przemyśl area. The same chronicle refers to Sanok twice more, stating that in 1205 it was the meeting place of a Ruthenian princess Anna and a Hungarian king and that in 1231 a Ruthenian prince made an expedition to "Sanok - Hungarian Gate". After 1339 Galicia–Volhynia was seized by King Casimir III of Poland, who reconfirmed the municipal status of Sanok on 25 April 1366.
At the date of commission, this was the largest battery energy storage facility in North America. In 2017, LG Chem announced that it had more than doubled capacity at its manufacturing plant in Nanjing, China, demonstrating a renewed focus on electric vehicle battery production. BYD Company Ltd, a Chinese manufacturer of batteries, vehicles, and other battery- powered products, supplies a utility-scale lithium-iron phosphate battery storage product, known as BYD ESS. BYD supplied batteries that were used at the 31.5 MW / 12.2 MWh Grand Ridge Battery Storage Facility in LaSalle County, Illinois. Greensmith Energy, an American supplier of energy storage products, deployed 20 MW / 80 MWh of lithium-ion batteries at the Altagas Pomona Substation, in Los Angeles County, California in early 2017.
O'Higgins 1960, p.166 In Article 44.1 of the constitution as originally enacted, the state recognised "the special position of the Holy Catholic Apostolic and Roman Church as the guardian of the Faith professed by the great majority of the citizens"; and "also recognise[d] the Church of Ireland, the Presbyterian Church in Ireland, the Methodist Church in Ireland, the Religious Society of Friends in Ireland, as well as the Jewish Congregations and the other religious denominations existing in Ireland at the date of the coming into operation of this Constitution." These statements were removed after a 1972 referendum. In 1956, two Jehovah's Witnesses proselytising in Clonlara were accosted by a mob led by the Catholic parish priest claiming their opposition to Trinitarianism was blasphemous.
On death, CGT assets transferred to beneficiaries (either directly or first to an executor) are not treated as disposed of by the deceased, but instead the beneficiaries are taken to have acquired them at the deceased's date of death and with cost base and reduced cost base as at that date. This rollover does not apply if the beneficiary is not an Australian resident, or is a tax-advantaged entity such as a superannuation fund. In such cases the deceased is taken to have sold to the beneficiary at market value at the date of death, and the usual capital gains tax applies. Churches and charities are regarded as tax-advantaged too, but bequests to registered "Deductible Gift Recipients" are not taxed.

The commission sat in public, and after hearing both sides, issued their report in April 1905. They stated that the feelings of both parties towards the other had made their work difficult. They concluded, however, that the Free Church was in many respects unable to carry out the purposes of the trusts, which, under the ruling of the House of Lords, was a condition of their holding the property. They recommended that an executive commission should be set up by act of parliament, in which the whole property of the Free Church, as at the date of the union, should be vested, and which should allocate it to the United Free Church, where the Free Church was unable to carry out the trust purposes.
Furthermore, very young children tend to do poorly on the test due to the fact that they lack the ability to concentrate long enough to finish it. Current uses for the test include clinical and neuropsychological assessment, educational placement, compensation evaluations, career assessment, adult neuropsychological treatment, forensics, and research on aptitude. Various high-IQ societies also accept this test for admission into their ranks; for example, the Triple Nine Society accepts a minimum qualifying score of 151 for Form L or M, 149 for Form LM if taken in 1986 or earlier, 149 for SB-IV, and 146 for SB-V; in all cases the applicant must have been at least 16 years old at the date of the test.
The fact that F's promise had been repeatedly and sincerely given did not amount to undue influence. Accordingly, the claim to set aside the deed of family arrangement and the gift of the legal title had to fail. (3) Even if, contrary to that finding, T had been entitled to set aside the transaction on the ground of undue influence, that would not have affected the registered estate at the date of the charge in favour of X because the claim based on undue influence would not crystallise until F's misappropriation of the mortgage moneys and the equity would not arise until that time. (4) F had not repaid the £20,000 that T had lent to her and it was still owing.
In the High Court it was argued for Culleton that the annulment retrospectively voided the conviction and that, because he had been convicted in his absence, he had not been liable to any term of imprisonment. The High Court rejected each of these arguments, holding as to the latter that in section 44(ii) the reference to a possible sentence relates to the seriousness of the offence and not to the liability of a particular convict. It said: > Senator Culleton was a person who had been convicted and was subject to be > sentenced for an offence punishable by imprisonment for one year or longer > at the date of the 2016 election. That was so, both as a matter of fact and > as a matter of law.
There was also increasing criticism of the company for the role that its subsidiary Enron Energy Services had in the California electricity crisis of 2000–2001. On August 14, Skilling announced he was resigning his position as CEO after only six months citing personal reasons Observers noted that in the months before his exit, Skilling had sold at minimum 450,000 shares of Enron at a value of around $33 million (though he still owned over a million shares at the date of his departure). Nevertheless, Lay, who was serving as chairman at Enron, assured surprised market watchers that there would be "no change in the performance or outlook of the company going forward" from Skilling's departure. Lay announced he himself would re-assume the position of chief executive officer.
In the interest of clarifying their intentions with respect to their gold holdings, the undersigned institutions make the following statement: Gold will remain an important element of global monetary reserves. The gold sales already decided and to be decided by the undersigned institutions will be achieved through a concerted programme of sales over a period of five years, starting on 27 September 2004, just after the end of the previous agreement. Annual sales will not exceed 500 tons and total sales over this period will not exceed 2,500 tons. Over this period, the signatories to this agreement have agreed that the total amount of their gold leasings and the total amount of their use of gold futures and options will not exceed the amounts prevailing at the date of the signature of the previous agreement.
Pistol crossbows are strictly controlled in all Australian states due to their concealable nature. Crossbows can be bought and owned by adults over 18 years of age, while in most states crossbows can only be owned with a special licence, for instance for members of an official sporting club. Control on transport of crossbows between states has increased to prevent unauthorised use of imported crossbows.Ausbow Industries - Australian crossbow manufacturer and agent for Excalibur crossbow Recent changes to laws in Western Australia to prohibit crossbow ownership require applications to legally possess a crossbow by July 2, 2011 before they became illegal to possess and sporting usage is only legal for people currently participating in the sport at the date of the laws introduction and does not apply to or allow for new participants thereafter.
Instead, Vangelis was accompanied by the London Metropolitan Orchestra augmented with two harpists, sopranos Kathleen Battle and Jessye Norman (both Sony Classical artists as well), and the Greek National Opera Choir and percussion ensemble. Vangelis asked musician Blake Neely to make the instrument transcriptions and conduct the orchestra as well. Although the album was finished by the date of the concert in June 2001, its release was held back until October 23, 2001 to coincide with the entry of the 2001 Mars Odyssey spacecraft in the orbit of Mars. A promotional CD-audio was nevertheless given to the press at the date of the concert and a CD-audio in a blue velvet box was given to guests of a private dinner that took place after the concert.
Utah Lake is one of three lakes in the state that were deemed "navigable" at statehood and granted to the State of Utah. Sovereign lands are managed under the public trust doctrine. The Utah State Legislature has designated the Division of Forestry, Fire & State Lands as the executive authority for the management of sovereign lands, and the state's mineral estates on lands other than school and institutional trust lands. Sovereign lands are defined by the Utah State Legislature as “those lands lying below the ordinary high water mark of navigable bodies of water at the date of statehood and owned by the state by virtue of its sovereignty.” The Commission was created by State statute in Utah's 2007 General Legislative Session, House Concurrent Resolution 1, under authority of the Interlocal Cooperation Act.
From July 6, 1881, until approximately August 1882, Mayon underwent a strong (VEI=3) eruption. Samuel Kneeland, a naturalist, professor and geologist, personally observed the volcanic activity on Christmas Day, 1881, about five months after the start of the activity: > At the date of my visit, the volcano had poured out, for five months > continuously, a stream of lava on the Legaspi side from the very summit. The > viscid mass bubbled quietly but grandly, and overran the border of the > crater, descending several hundred feet in a glowing wave, like red-hot > iron. Gradually, fading as the upper surface cooled, it changed to a > thousand sparkling rills among the crevices, and, as it passed beyond the > line of complete vision behind the woods near the base, the fires twinkled > like stars or the scintillations of a dying conflagration.
The Union of Walls gets his best performance ever in the Cup of Portugal to reach the quarter-finals. Done to highlight because the club was up to the 3rd division. Despite being suffused by the draw (the walls are always the 3rd division clubs, except the 2nd Marinhense already in the quarter-final) was a historic advance that only ended in the stadium on April 25 when Penafiel was eliminated by Benfica. It was the first time the EU faced a "big" in official games, 0–4 and the final result is not so bad if we compare the value of the two clubs at the date of completion of the game (Benfica was national champion and won the Cup). 2 months after the Walls made the festival a new promotion to second grade level.

Lord Browne-Wilkinson held that Smith New Court was entitled to the full loss of £11.3m. He laid down seven principles as follows: :(1) the defendant must make reparation from all damage coming directly from the transaction :(2) foreseeability is irrelevant :(3) the full price paid can be recovered, minus any benefits he received resulting from the transaction :(4) a general rule is that benefits include market price as at the date of acquisition, but this is not to be inflexible to prevent full compensation :(5) that general rule does normally not apply when misrepresentation continues to operate after acquisition, inducing the claimant to retain the asset, or the claimant is locked into holding the property by reason of the fraud :(6) consequential loss is recoverable... :(7) ...subject to mitigation once fraud is discovered. Lord Steyn asked, Lord Keith, Slynn and Mustill concurred.
By March 1658 when work commenced on the library, the chapel was probably well forward, as evidenced by the purchase of "Bottle creasts" from Burford, probably the urns over the buttresses. It is, however, difficult to arrive at the rates of progress of the work in any detail, from the fact that an entry in the book of payments for various materials does not necessarily mean that they were built into the work at the date of the entry. The smiths' work and ironwork came from Birmingham to Banbury by water, and thence to Oxford. In December 1657, when the last payment for ironmongery is made, Nathaniel Brokesby, the schoolmaster of Birmingham, who took great pains to secure these materials for the college, received two pairs of gloves with black fingers, and a pair of white "kid's leather" gloves.
During his detention she lived with him in the Queen's Bench prison, and on his release they retired into the country. On the death of Lord Waldegrave on 28 September 1846, she found herself possessed of the whole of the Waldegrave estates (including residences at Strawberry Hill, Chewton in Somerset, and Dudbrook in Essex), but with little knowledge of the world to guide her conduct. In this position she entered for a third time into matrimony, marrying on 30 September 1847 George Granville Harcourt of Nuneham and Stanton Harcourt, Oxfordshire. Her third husband, who was a widower and her senior by thirty-six years (being sixty-two at the date of the marriage, while she was only twenty-six), was eldest son of Edward Harcourt, archbishop of York, and a follower of Peel, whom he supported in parliament as member for Oxfordshire.
Doubts were cast upon his view of the position. He could have also been an Indian citizen, however this appears to have been discounted on the basis that there was an automatic loss of Indian citizenship on acquisition of another. There were factual issues in relation to Roberts' state of mind and knowledge and Justice Patrick Keane was assigned to determine the facts to be considered by the full court. Roberts and his sister Barbara were cross examined, as well as two expert witnesses on British citizenship.. The following day, Keane handed down his decision on that evidence, finding that at the date of his nomination for the Senate (1) Roberts was a British citizen, (2) he knew that there was at least a real and substantial prospect that he was a British citizen and (3) Roberts could have, but didn't, take steps to renounce his British citizenship..
In 1805 the Beaumont property was bought for about £14,000 by Henry Jeffrey Flower, 4th Viscount Ashbrook, a friend of George IV. After his death in 1847, his widow continued to reside there until 1854, when she sold it to the Society of Jesus as a training college. For seven years it housed Jesuit novices of the (then) English province and on 10 October 1861 became a Catholic boarding school for boys, with the title of St. Stanislaus College, Beaumont, the dedication being to St. Stanislaus Kostka. The 1901 census shows a John Lynch S.J. as headmaster. Resident at the date of the census were one other priest, three "clerks in minor orders" and a lay brother, 8 servants and 23 schoolboys including one American, one Canadian, one Mexican and two Spaniards; one of the latter was Luís Fernando de Orleans y Borbón, a Spanish royal prince.
But it does not follow that a judgment in respect of such a disposition can on that account be set aside under common law, for, when the judgment was granted, no grounds existed for setting it aside. The court was fully entitled to grant the judgment on all the facts, and the causa which existed at the date of the judgment. A judgment, as such, is not a disposition "made by an insolvent," as contemplated by the Insolvency Act. In a case where the only purpose of taking judgment is to enable the judgment creditor to enforce his right to payment of the debt under a mortgage bond, by means of execution, if need be, it seems realistic, and in accordance with the views of the Roman-Dutch writers, to regard the judgment not as novating the obligation under the bond, but rather as strengthening or reinforcing it.
The cable car's location has also caused controversy, with advocates of walking and cycling favouring a Sustrans-sponsored plan for a walking and cycling bridge east of Tower Bridge between Rotherhithe and Canary Wharf. The scheme was also criticised because the original contract forbade the use of funds from Israel, which the UAE did not recognise diplomatically. It imposed restrictions on "(i) any Competitor; or (ii) any person who is a national of, or who is registered, incorporated, established or whose principal place of business is in a country with which the United Arab Emirates does not at the date of this Contract or at any relevant point during the Term maintain diplomatic relations."Cable car sponsorship deal includes anti-Israel clause — MayorWatch The contract also forbade the mayor or Transport for London from criticising the United Arab Emirates royal families, the UAE government, or the contract.
On 7 December 2016, a new series of banknotes (recolors of the previous notes) in denominations of 500, 1,000, 2,000, 5,000, 10,000, and 20,000 bolívares fuertes was unveiled to the Venezuelan public. In November 2017, a 100,000 bolívares fuertes note was unveiled which is similar to the 100 bolívares fuertes note of the 2007 series and the 20,000 bolívares fuertes of the 2016 series, but with the denomination spelled out in full instead of adding an additional three zeros to the number 100. This denomination was worth US$2.42 through black market exchange rates at the date of its release, but by July 2018 increasing hyperinflation had reduced its value by 99.9%, to less than 1 U.S. cent. On 11 December 2016, President Nicolás Maduro wrote into law that the 100 Bs.F. would be pulled from circulation within 72 hours because "mafias" were allegedly storing those particular bills to drive inflation.
A bill of health is a document from officials of a port of departure indicating to the officials of the port of arrival whether it is likely that the ship is carrying a contagious disease, either literally on-board as fomites or via its crewmen or passengers. As defined in a consul's handbook from 1879: > A bill of health is a document issued by the consul or the public > authorities of the port which a ship sails from, descriptive of the health > of the port at the time of the vessel's clearance. A clean bill of health > certifies that at the date of its issue no infectious disease was known to > exist either in the port or its neighbourhood. A suspected or touched bill > of health reports that rumours were in circulation that an infectious > disease had appeared but that the rumour had not been confirmed by any known > cases.
The Military Service Act was passed in 1917 to increase the men enlisted to replace the casualties in World War I. When it was enforced in on 1 January 1918, riots broke out in Quebec in protest at the act.Auger, Martin F. "On the Brink of Civil War: The Canadian Government and the Suppression of the 1918 Quebec Easter Riots" from Canadian Historical Review 89/4 (2008), pp 9, 15-17, 83 By April 1918, the government had amended the act so that most of the exemptions had been removed, such as those working on farms, except "clergy, including members of any recognised order of an exclusively religious character, and ministers of all religious denominations existing in Canada at the date of the passing of this Act.""The Military Service Act," Ottawa: The King's Printer, 1917. However, the question on when a clerical student becomes clergy was an issue.
On 27 October 2017, the High Court, sitting as the Court of Disputed Returns, considered issues raised by the Senate referring to Section 376 of the Commonwealth Electoral Act. The primary issues of contention were the timing of Hughes' appointment to the Australian Administrative Appeals Tribunal and the subsequent recount which took place. In the judgement, delivered by Chief Justice Susan Kiefel and Justices Virginia Bell, Stephen Gageler, Patrick Keane and James Edelman, the court noted that the prevailing issue was "whether holding that disqualifying office during the discrete period between 1 July and 27 October was enough to render Ms Hughes incapable of being chosen". In an affidavit submitted to the Court by Hughes' solicitor, it was submitted that at the date of the 2016 election, Hughes held no such position and was thus eligible to be nominated, despite her subsequent appointment to the tribunal.
Subject to any modifications which the two High Contracting Parties may agree to introduce in the future, the immunities and privileges in jurisdictional and fiscal matters, including freedom from taxation, enjoyed by the British forces in 'Iraq will continue to extend to the forces referred to in Clause 1 above and to such of His Britannic Majesty's forces of all arms as may be in 'Iraq in pursuance of the present Treaty and its annexure or otherwise by agreement between the High Contracting Parties, and the existing provisions of any local legislation affecting the armed forces of His Britannic Majesty in 'Iraq shall also continue. The 'Iraq Government will take the necessary steps to ensure that the altered conditions will not render the position of the British forces as regards immunities and privileges in any way less favourable than that enjoyed by them at the date of the entry into force of this Treaty.
Research has shown that the market value of customers of the failed banks is adversely affected at the date of the failure announcements.Federal Reserve Bank of Chicago, The Value of Banking Relationships During a Financial Crisis, December 2002 It is often feared that the spill over effects of a failure of one bank can quickly spread throughout the economy and possibly result in the failure of other banks, whether or not those banks were solvent at the time as the marginal depositors try to take out cash deposits from these banks to avoid from suffering losses. Thereby, the spill over effect of bank panic or systemic risk has a multiplier effect on all banks and financial institutions leading to a greater effect of bank failure in the economy. As a result, banking institutions are typically subjected to rigorous regulation, and bank failures are of major public policy concern in countries across the world.
Colonel Read was wounded in the head and leg, May 12, on the third day of the battle of Spotsylvania Court House, and was promoted from Lieutenant- Colonel on the 1st of June following, for gallant conduct in the battles of the campaign in which he had participated up to that date. At the date of the mustering out of the first three-years' men, Companies A, B and C, comprising recruits enlisted from time to time, conscripts and re-enlisted veterans, remained in the field before Petersburg. Wishing to preserve to the close of the war the identity of a Regiment that had served so faithfully and bravely, Governor Smith authorized a reorganization, dating from the muster out of the original Regiment. Companies D, E, F, G and H, were recruited and sent forward, and regimental relations were once more established, under the command of Lieutenant-Colonel Elisha H. Rhodes, brevetted Colonel April 2, 1865, for gallant services before Petersburg.
Justice Patrick Keane conducted a hearing to determine factual issues on 21 September. Roberts and his sister Barbara were cross examined as well as two expert witnesses on British citizenship.. The following day, Keane handed down his findings on that evidence, finding that at the date of his nomination for the Senate (1) Roberts was a British citizen, (2) he knew that there was at least a real and substantial prospect that he was a British citizen and (3) Roberts could have, but didn't, take steps to renounce his British citizenship.. Roberts's seat was filled by a countback, which led to his replacement by the third candidate on the Queensland One Nation ticket, Fraser Anning. Despite concerns that Anning would also be ineligible due to bankruptcy, in a similar case to One Nation's Rod Culleton, the bankruptcy petition against him had been withdrawn by 3 October. After he was sworn in, Anning resigned or was expelled from One Nation and opted to sit as an independent.
According to SI, even if the San have no legal right to live in the CKGR (which SI does not accept), the San were undoubtedly in possession of their settlements at the date of the relocations. SI argues that the San were deprived of that possession against their free will, and that they are therefore entitled to be restored to their possessions under the doctrine of "spoliation", which formed the basis of SI and First People of the Kalahari’s claims against the Government of Botswana in a landmark court case. Though the court case was decided in December 2006 in favor of the San applicants, it has been argued that the Botswana Government has not followed through with the ruling and is unlawfully preventing the former CKGR residents from returning to their home villages in the CKGR by preventing access to hunting licenses and boreholes for water. The Botswana Government justified its conduct on various grounds.
The fundamental principle of the Legitimacy Act 1931 is exposed in article 1(1): "Subject to the provisions of this section where the parents of an illegitimate person marry or have married one another, whether before or after the commencement of this Act, the marriage shall, if the father of the illegitimate person was or is at the date of the marriage domiciled in Saorstát Eireann, render that person, if living, legitimate from the commencement of this Act, or from the date of the marriage, whichever is the later.." The Act allowed children to be legitimised by the subsequent marriage of their parents, provided that neither parent had been married to a third party at the time of the birth or the ten months prior. In those circumstances, the legitimised birth was re-entered in the birth indexes for that year (sometimes many years after the original birth). The original entry would be annotated to refer to the new entry. The Act was similar in purpose to the Legitimacy Act 1926 passed by Westminster.
See Section 7 (1) (b): "the suzerainty of His Majesty over the Indian States lapses, and with it, all treaties and agreements in force at the date of the passing of this Act between His Majesty and the rulers of Indian States, all functions exercisable by His Majesty at that date with respect to Indian States, all obligations of His Majesty existing at that date towards Indian States or the rulers thereof, and all powers, rights, authority or jurisdiction exercisable by His Majesty at that date in or in relation to Indian States by treaty, grant, usage, sufferance or otherwise." However, by 1948 almost all had acceded to either India or Pakistan. One major exception was that of the wealthiest and most powerful principality, Hyderabad, where the Nizam, Mir Sir Osman Ali Khan, Asaf Jah VII, a Muslim ruler who presided over a largely Hindu population, chose independence and hoped to maintain this with an irregular army recruited from the Muslim aristocracy, known as the Razakars. The Nizam was also beset by the Telangana uprising, which he was unable to subjugate.
A BGS/DECC report from May 2014 indicates that there is little potential for shale gas fracturing in the Weald Basin, south of London. It does suggest that there is the possibility for the extraction of light tight oil from shales (LTO) Subsequent exploration showed a potentially major oil field near Gatwick Airport, from which oil is being extracted via a conventional technique at a well known as Horse Hill. Initial forecasts of a flow rate of 1000+ barrels per week were not realised, and on 11 April 2019 the firm involved issued a regulatory news release indicating that the initial flow rate achieved had been 360 barrels per week, this had dropped to 220 barrels a week, and as at the date of the news release, the well was being shut down for 60 hours to allow the oil pressure around the well to build back up. This production at Horse Hill is strictly speaking of tight oil from Kimmeridge micrites (Jurassic limestone bands), not of oil from shales.
Bek of Botheby. With the last of these we have no concern. I. From Henry Bek, lord of Eresby, was descended, about the middle of the thirteenth century, Walter Bek, who had three sons: (1) John, lord of Eresby, from whose daughter the Lords Willoughby de Eresby claimed their descent, as they obtained from her their barony; (2) Thomas (d. 1293 ), who became bishop of St. David's in 1280, (3) Antony, the third son (d. 1310), who became bishop of Durham in 1283. II. From Bek of Luceby sprang another Walter, who was constable of Lincoln Castle at the time when his kinsmen Thomas I and Antony I were respectively bishops of St. David's and Durham, and died 25 August 1291. He had three sons: (1) John, born 18 August 1278; (2) Antony II, born 5 August 1279; (3) Thomas II, born 22 February 1282. The three sons were all under age at the date of their father's death, and probably became wards of their kinsman Antony I, the great bishop of Durham.
The commander of Fort McHenry, Major William W. Morris, wrote in reply, > At the date of issuing your writ, and for two weeks previous, the city in > which you live, and where your court has been held, was entirely under the > control of revolutionary authorities. Within that period United States > soldiers, while committing no offense, had been perfidiously attacked and > inhumanly murdered in your streets; no punishment had been awarded, and I > believe, no arrests had been made for these atrocious crimes; supplies of > provisions intended for this garrison had been stopped; the intention to > capture this fort had been boldly proclaimed; your most public thoroughfares > were daily patrolled by large numbers of troops, armed and clothed, at least > in part, with articles stolen from the United States; and the Federal flag, > while waving over the Federal offices, was cut down by some person wearing > the uniform of a Maryland officer. If all this be not rebellion, I know not what to call it.
The court held that De Jager was entitled to an order evicting Sisana from the farm. One who purchases such land with knowledge of the agreement between its former owner and the squatter is, of course, bound by the terms of that agreement, but Sisana lost any rights he might have had against De Jager by declining to render the services to him. The contract of a squatter, then, is not that of a tenant or lessee; it is an innominate contract under which the services of the squatter are due to the owner of the farm, who made the contract, and no one else; and the right of a purchaser of the farm to eject the squatter is not affected by notice of the existence of the contract on the part of the purchaser of the farm at the date of purchase. The Appellate Division held that, to establish a contract of lease, the litigant must show that there was a particular thing let for a specified time and that, in return for the use of occupation of the thing, the lessee undertook to pay rent.
This means that the European patent is granted and confers rights in all its designated Contracting States at the date of mention of the grant, whether or not a prescribed translation is filed with a national patent office later on (though the right may later be deemed never to have existed in any particular State if a translation is not subsequently filed in time, as described below). A translation of a granted European patent must be filed in some EPC Contracting States to avoid loss of right. Namely, in the Contracting States which have "prescribe[d] that if the text, in which the European Patent Office intends to grant a European patent (...) is not drawn up in one of its official languages, the applicant for or proprietor of the patent shall supply to its central industrial property office a translation of this text in one of its official languages at his option or, where that State has prescribed the use of one specific official language, in that language". The European patent is void ab initio in a designated Contracting State where the required translation (if required) is not filed within the prescribed time limit after grant.
Any directions necessary to give effect to the conduct of the special count should be made by a single Justice. However, the Court anticipated that a simple recount, as if Culleton had not been a candidate, would make the votes cast for him (so far as they were "above the line", which was 96% of them) would flow through to the next One Nation candidate. The Court ordered, as the Commonwealth had previously agreed, that most (with specific exceptions) of Culleton's costs of the action would be borne by the Commonwealth (Culleton had initially represented himself, but eventually he had been provided with counsel).; full name "In the matter of questions referred to the Court of Disputed Returns pursuant to section 376 of the Commonwealth Electoral Act 1918 (Cth) concerning Senator Rodney Norman Culleton". The majority stated, in an introductory summary of their judgment (with which Nettle J differed only as to reasoning): at [4] per Kiefel, Bell, Gageler & Keane JJ. > Senator Culleton was a person who had been convicted and was subject to be > sentenced for an offence punishable by imprisonment for one year or longer > at the date of the 2016 election.
At the date of publication of this article there were believed to be 100 Wyoming toads still living in the wild and as a result a recovery group was formed “by the U.S. Fish and Wildlife Service's Saratoga National Fish Hatchery in 1998” (Browne, 2). The goal of this recovery group was to do captive breeding and reintroduce tadpoles into the wild. “Currently, the captive breeding program is limited by low reproductive output due to poor ovulation rates, low egg numbers and low fertilization rates… hence the program would benefit from reproduction technologies” (Browne, 2). Female toads were given a dose of “Luteinizing Hormone Releasing Hormone (LHRHa) which induces spawning in fish,” while male toads were treated with “Human Chorionic Gonadotropin (hCG),” (Browne, 2). “Currently, technologies are available to incorporate IVF into captive breeding programs for the endangered Wyoming toad and may assist in their long-term genetic management. This study showed that extended ‘priming’ of the Wyoming Toad resulted in higher fecundity. Higher fecundity from two primings, when compared to no priming or one priming, occurred through two responses: 1) an increased number of eggs per toad and 2) a greater survival of fertilized eggs to swim-up stage” (Browne, 9).
But > when the Court of Private Land Claims took the opposite view and confirmed > the entire grant, the government immediately appealed the decision to the > Supreme Court.Malcolm Ebright, Land Grants & Lawsuits in Northern New Mexico > University of New Mexico Press (1994) The May 24, 1897, Supreme Court ruling in for United States v. Sandoval was summarized as follows. "Under the laws of the Indies lands not actually allotted to settlers remained the property of the king, to be disposed of by him or by those on whom he might confer that power; and as, at the date of the Treaty of Guadalupe Hidalgo, neither the municipalities nor the settlers within them, whose rights are the subject of controversy in these suits, could have demanded the legal title of the former Government, the Court of Private Land Claims was not empowered to pass the title to either, but it is for the political department [ Congress ] of the Government to deal with any equitable rights which may be involved." The ruling thus reduced the size of the grant from over 300,000 acres with the common lands of the municipality included, to the little more than the 5,000 acres then under private ownership.
It was unclear whether the film would make any profits at all, and so Anglia TV got compensated for its wasted expenses in preparing the set.Note C & P Haulage v Middleton [1983] EWCA Civ 5, [1983] 1 WLR 1461, where expenses of Mr Middleton's improvements to a property could not be recovered given that he did so of his own accord. The level of damages is generally assessed at the date of the breach, but this is variable if the court thinks another time would be fairer.See Johnson v Agnew [1980] AC 367, and also Habton Farms v Nimmo [2004] QB 1 When compensatory damages are an inadequate remedy, restitution may be awarded as where a record company exploited a licence to Jimi Hendrix records in breach of contract.Experience Hendrix LLC v PPX Enterprises Inc [2003] EWCA Civ 323 By way of exception, alternative remedies to compensatory damages are available depending on the contract's nature. If damages would be an inadequate remedy, for instance, because the subject matter was a unique painting, or a piece of land, or was to deliver petrol during an oil crisis,Sky Petroleum v VIP Petroleum [1974] 1 WLR 576 a court may compel literal or specific performance of the contract's terms.
