In all cases, we must balance the > opposite experiments…and deduct the smaller number from the greater, in > order to know the exact force of the superior evidence. Hume discusses the testimony of those who report miracles. He wrote that testimony might be doubted even from some great authority in case the facts themselves are not credible: "[T]he evidence, resulting from the testimony, admits of a diminution, greater or less, in proportion as the fact is more or less unusual." Although Hume leaves open the possibility for miracles to occur and be reported, he offers various arguments against this ever having happened in history.

The court relied upon Stein v Blake [1998] 1 All ER 724 (at 727D and 729G per Millett LJ) for the principle that a duality of duties may exist. The adoption of the title prince (Latin princeps, Welsh twysog), rather than king (Latin rex, Welsh brenin), did not mean a diminution in status, according to Davies. The use of the title prince was a recognition of the ruler of Gwynedd in relation to the wider international feudal world.

Angiogenesis represents an excellent therapeutic target for the treatment of cardiovascular disease. It is a potent, physiological process that underlies the natural manner in which our bodies respond to a diminution of blood supply to vital organs, namely the production of new collateral vessels to overcome the ischemic insult. A large number of preclinical studies have been performed with protein-, gene- and cell-based therapies in animal models of cardiac ischemia, as well as models of peripheral artery disease. The Tabernacle that the Israelites Built (illustration from the 1897 Bible Pictures and What They Teach Us by Charles Foster) Rabbi Eliezer in the name of Rabbi Jose ben Zimra taught that whenever the Israelites were numbered for a proper purpose, they lost no numbers; but whenever they were numbered without a proper purpose, they suffered a diminution. Rabbi Eliezer taught that they were numbered for a proper purpose in connection with the standards (as reported in ) and the division of the land, but were numbered without a proper purpose (as reported in ) in the days of David.Numbers Rabbah 2:17, in, e.g., Judah J. Slotki, translator, Midrash Rabbah: Numbers, volume 5, pages 54, 56.

Lauchert wrote that in three later volumes Hontheim defended his book, as Febronius and various other pseudonyms, against a series of attacks. In addition to Judicium academicum from the University of Cologne (1765), refutations appeared from a large number of Roman Catholic authors, Lauchert lists titles by Pietro Ballerini, Tommaso Maria Mamachi, and Francesco Antonio Zaccaria. There were also refutations written from a Protestant standpoint, to repudiate the idea that a diminution of papal power was all that was necessary to bring the Protestants back into union with the Roman Catholic Church, for instance Lauchert lists titles by Karl Friedrich Bahrdt, Johann Friedrich Bahrdt, and Karl Gottlob Hofmann. Stevens Hears the Mermaids Singing in 1965, the novelist May Sarton feared that writing openly about lesbianism would lead to a diminution of the previously established value of her work. "The fear of homosexuality is so great that it took courage to write Mrs. Stevens Hears the Mermaids Singing," she said, "to write a novel about a woman homosexual who is not a sex maniac, a drunkard, a drug-taker, or in any way repulsive, to portray a homosexual who is neither pitiable nor disgusting, without sentimentality ..."Journal of a Solitude, 1973, pp. 90-91. The first English contemporary novelist to come out as a lesbian was Maureen Duffy, whose 1966 book Microcosm explored the subcultures of lesbian bars.

These efforts led to a considerable drop in the quality of expert reports. The Serbsky Center further attempted to eliminate the adversarial character of court proceedings and to degrade the role of specialist reviewers. Lyubov Vinogradova claimed that there has been a diminution in patients' rights because independent experts are now excluded from evaluations and court proceedings. On 28 May 2009, Savenko wrote to the then President of the Russian Federation Dmitry Medvedev an open letter, in which Savenko asked Medvedev to submit to the State Duma a draft law prepared by the IPA to address the sharp drop in the level of forensic psychiatric examinations, which Savenko attributed to the lack of competition within the sector and its increasing nationalization.

Lord Reed then distinguished between (1) cases where claims are brought by a shareholder in respect of loss that was suffered in that capacity (i.e. a diminution in share value or in distributions which is caused by loss sustained by the company, in respect of which the company has a cause of action against the same wrongdoer), and (2) cases where claims are brought by a shareholder (or by anyone else) in respect of loss which does not fall within that description, but where the company has a concurrent right of action in respect of substantially the same loss.Sevilleja v Marex, para 79. Actions in respect of the losses which fall under (2) therefore, are distinct and separate from a company's loss.

A series of partitions and dynastic changes led to a diminution of its territory and to periods of rule by the kings of Aragon (1054–1134) and France (1285–1328). In the 15th century, another dynastic dispute over control by the king of Aragon led to internal divisions and the eventual conquest of the southern part of the kingdom by Ferdinand the Catholic in 1512 (permanently in 1524). It was annexed by the Courts of Castile to the Crown of Castile in 1515. The remaining northern part of the kingdom was again joined with France by personal union in 1589 when King Henry III of Navarre inherited the French throne as Henry IV of France, and in 1620 it was merged into the Kingdom of France.

However, foreign-owned banks (such as Barclays, Standard Chartered and Grindlays) successfully resisted takeover. In 1971, INDECO, MINDECO, and FINDECO were brought together under an omnibus parastatal, the Zambia Industrial and Mining Corporation (ZIMCO), to create one of the largest companies in sub-Saharan Africa, with the country's president, Kenneth Kaunda as Chairman of the Board. The management contracts under which day-to-day operations of the mines had been carried out by Anglo American and RST were ended in 1973. In 1982 NCCM and RCM were merged into the giant Zambia Consolidated Copper Mines Ltd (ZCCM). In 1973 a massive increase in the price of oil was followed by a slump in copper prices in 1975, resulting in a diminution of export earnings.

Calcium carbonate also becomes more soluble at lower pH, so ocean acidification is likely to have profound effects on marine organisms with calcareous shells, such as oysters, clams, sea urchins, and corals, because their ability to form shells will be reduced, and the carbonate compensation depth will rise closer to the sea surface. Affected planktonic organisms will include the snail-like molluscs known as pteropods, and single-celled algae called coccolithophorids and foraminifera. All of these are important parts of the food chain and a diminution in their numbers will have significant consequences. In tropical regions, corals are likely to be severely affected as it becomes more difficult to build their calcium carbonate skeletons, in turn adversely impacting other reef dwellers.

Some authorities suggested that the population of Srinagar had been reduced by half while others estimated a diminution by three-fifths of the entire population of the Valley. During the famine of 1877-9 not a single Pandit died of starvation during these annihilative years for the Muslim cultivators, according to reports received by Lawrence. During the famine the office of Prime Minister was held by a Kashmiri Pandit, Wazir Punnu, who is said to have declared that there was no real distress and that he wished that no Musulman might be left alive from Srinagar to Rambhan (in Jammu). When lands fell fallow temporarily during the famine, Pandits took over substantial tracts of them claiming that they were uncultivated waste.

He also states that one of the tragedies that befell Africa was that to many Africans, their conquerors - European colonialists - not only became their role models; they emulated them in many ways and, by doing so, ended up destroying themselves in terms of their Africanness. He says it was a diminution of African identity and an attack on the African personality that goes on even today. He contends all that is a victory for cultural imperialism not only in terms of language, European manners and mannerisms and culture adopted by many Africans but also in terms of ideas propagated by the West. That is also the imperial logic, deliberately placing Africans in the sub-human category not only in terms of intellect but also in every other conceivable way.

Rather than being a prostitute, a geisha was a woman trained in arts such as music and cultured conversation, and who was available for non-sexual interactions with her male clientele. These women differed from the wives that their patrons probably had at home because, except for the geisha, women were ordinarily not expected to be prepared for anything other than the fulfillment of household duties. This limitation imposed by the normal social role of the majority of women in traditional society produced a diminution in the pursuits that those women could enjoy, but also a limitation in the ways that a man could enjoy the company of his wife. The geisha fulfilled the non-sexual social roles that ordinary women were prevented from fulfilling, and for this service they were well paid.

When stocks recovered, a different method of harvesting was used and now hunting is maintained at a sustainable level. Nevertheless, a further hunting ban covering the whole of Iceland was called for in 2011, although the puffin's lack of recent breeding success was being blamed on a diminution in food supply rather than overharvesting. Since 2000, a sharp population decline has been seen in Iceland, Norway, the Faroe Islands, and Greenland. A similar trend has been seen in the United Kingdom, where an increase in 1969-2000 appears to have been reversed. Assume that in these animals a gene, called a, codes for parental care, and its other allele, called A, codes for an absence thereof. The aa homozygotes care for their young, and AA homozygotes don't, and the heterozygotes behave like aa homozygotes if a is dominant, and like AA homozygotes if A is dominant, or exhibit some kind of intermediate behavior if there is partial dominance. Other kinds of animals could be considered in which all individuals exhibit parental care, but variation among them would be in the quantity and quality thereof. If one considers a life cycle as extending from conception to conception, and an animal is an offspring of parents with poor parental care, then the higher mortality with poor care could be considered a diminution of the offspring's expected fitness.

Girolamo Lucchesini Girolamo Lucchesini (7 May 1751 - 20 October 1825) was a diplomat of the Kingdom of Prussia. Lucchesini was born at Lucca, the eldest son of Marquis Lucchesini. In 1779 he went to Berlin where King Frederick the Great gave him a court appointment, making use of him in his literary relations with Italy. King Frederick William II, who recognized his gifts for diplomacy, sent him in 1787 to Rome to obtain the papal sanction for the appointment of a coadjutor to the bishop of Mainz, with a view to strengthening the German Fürstenbund. In 1788 he was sent to Warsaw, and brought about a rapprochement with Prussia and a diminution of Russian influence at Warsaw. He was accredited ambassador to the king and Poland on 12 April 1789.

The fact finding process that precedes the application of the surrogatum principle is similar to the fact finding process that must be undertaken to determine whether a payment has been made “in lieu of” a specified thing.

With more than a third of English clergy dying in the Black Death, four new colleges were established at the university over the following years to train new clergymen, namely Gonville Hall, Trinity Hall, Corpus Christi and Clare. In 1382 a revised town charter effects a "diminution of the liberties that the community had enjoyed", due to Cambridge's participation in the Peasants' Revolt. The charter transfers supervision of baking and brewing, weights and measures, and forestalling and regrating, from the town to the university. King's College Chapel, was begun in 1446 by King Henry VI. The chapel was built in phases by a succession of kings of England from 1446 to 1515, its history intertwined with the Wars of the Roses, and completed during the reign of King Henry VIII.

During the final Parliamentary stages of the passage of the Railways Act 2005, the Government sustained a defeat in the House of Lords over an amendment which would have protected passenger and train operators against a diminution of infrastructure quality or performance - or being held rigidly to their contracts for the provision of railway services which assumed no such diminution - if the Secretary of State for Transport restricted funds available to Network Rail. However, the amendment was reversed the same day in the House of Commons with a much weaker provision substituted for it. The House of Lords did not insist on their original amendment, and the legislation was passed without the protections which the train operators needed. But as Mariotte observed similar obstructions even in glass pipes where no transverse currents could exist, the cause assigned by Guglielmini seemed destitute of foundation. The French philosopher, therefore, regarded these obstructions as the effects of friction. He supposed that the filaments of water which graze along the sides of the pipe lose a portion of their velocity; that the contiguous filaments, having on this account a greater velocity, rub upon the former, and suffer a diminution of their celerity; and that the other filaments are affected with similar retardations proportional to their distance from the axis of the pipe. In this way the medium velocity of the current may be diminished, and consequently the quantity of water discharged in a given time must, from the effects of friction, be considerably less than that which is computed from theory.

The Synagogue Council of America closed its doors in 1994 after 68 years of existence due to a number of circumstances which combined to render the organization no longer viable, not least of which was the SCA’s inability to raise funds. The constituent agencies historically contributed less than 10% of its operating needs, the balance being produced each year through aggressive fundraising by the SCA itself. There was a diminution of interest in support and participation as the UOJCA, the US, and the UAHC increasingly wanted to establish their own denominational presence in interfaith exchanges and social action work with the very agencies the SCA related to in their names as well. Increasing religious divisions in Israel contributed to increased tensions among the denominations of American Jewry, making cooperation and consensus even more difficult to achieve within the Synagogue Council.

According to the results of the DANE census, the department of Tolima registered between the years of 2001 and 2002 a diminution, to constant prices, of 0.1% in its GDP, falling from Col$2.05 trillion in 2001 to Col$2.04 trillion in 2002. The result is explained by the fact that traditional sectors within the economic structure of the department such as the coffee registered a reduction of 22.4%, reducing 2 percentage points to the total variation, and others did not have important growth or presented/displayed diminutions in its added values. Sipilä's government struggled with Finland's poor economic performance, caused according to Paul Krugman and others by the constraints of its eurozone membership and aftershocks from the European debt crisis, but also by the decline of the paper industry, the fall of Nokia and a diminution in exports to Russia. Its attempts to address the problems through policies of spending cuts and reducing labour costs were controversial, particularly cuts to education spending that were seen as threatening Finland's successful public education system. These austerity measures were partly been implemented due to European Commission pressure, which urged Finland to improve its adherence to the Stability and Growth Pact and reform its labour market to improve competitiveness. On 22 July 2015, Sipilä announced his government's commitment to reducing Finnish wage costs by 5% by 2019, an internal devaluation caused by Finland's loss of the ability to devalue its currency to boost competitiveness.

It appears from a comparison of the table of restraints for 1830, with the table for 1835, given in the appendix to Hill's book, that whereas, with a number of patients in the house, during the first of these years, amounting only to 92 (male and females included), the total number of instances of restraint had been 2364; in the latter of these years, with a number of patients greater, namely, 108, the total number of instances of restraint had only been 313; being a diminution of five-sixths of the number in the former year. One of the improvements introduced by Hill in pursuance of his system was the dormitories, almost entirely established for the prevention of suicides. He attributed most bad cases to alcohol abuse, with religious factors as the next most important. Hill had trouble maintaining a non-restraint system, without a better staff.

The perennial philosophy calls for a diminution of intensity in life, in contrast to the life of risk and engagement that Unger advocates. Unger contends that the most fruitful and promising philosophical position for enhancing human freedom is a form of radicalized pragmatism. Rejecting the distorted pragmatism that disguises insights about humanity as insights about knowledge and being, Unger's radicalized pragmatism celebrates the primacy of the personal over the impersonal and an ethic of vulnerability over a striving for invulnerability. After setting forth his theory of humanity and arguing for radicalized pragmatism, Unger then sets forth a program for the renovation of society in the spheres of democracy, social life, religion, and philosophy, all of which he urges would be transformed for the benefit of humanity by practices of experimentalism, heightened vulnerability, and a social endowment fund that gives people the security to embrace these attitudes and practices.

United States, 160 Ct.Cl. at 301, 311 F.2d at 801, in which "the unavoidable damage [reduction of the highest and best use] to a person's property occasioned by [the noise created during] travel in the navigable air space [is] so severe as to amount to a practical destruction of it." This is a case of first impression in which the court may consider the altitude of the flights over the property, but must give primary consideration to the effect of aircraft noise where the Government itself has adopted and published standards of compatibility of use of the subjacent property. Since the subjacent property owner has suffered a diminution of the value of the property in this case, there has been a taking of an easement over and through the airspace subjacent the property of the plaintiff. It is abundantly clear that under the law established by Causby, Griggs, and Aaron a taking has occurred in this case.

The term information scientist developed in the latter part of the twentieth century to describe an individual, usually with a relevant subject degree (such as one in CIS) or high level of subject knowledge, providing focused information to scientific and technical research staff in industry, a role quite distinct from and complementary to that of a librarian. Developments in end-user searching, together with some convergence between the roles of librarian and information scientist, have led to a diminution in its use in this context, and the term information officer or information professional (information specialist) are also now used. The term was, and is, also used for an individual carrying out research in information science. Brian C. The patent application, for “a new and useful Ocular,” describes “oculars comprising two lenses, each of which consists of a collective and of a dispersive member, and which are so disposed that the two dispersive members lie outermost, hence, that of the double lens to be turned towards the incident light the dispersive member, and of the double lens to be turned towards the eye the collective member lies foremost.” Between these lenses lies “a single collective lens.” This combination of lenses attains “a diminution of the defects in the images, especially of the astigmatism and of the distortion, to the extent that the field of view may be raised to comparatively large angles, amounting to about 70 degrees.

The possibility to secure uniformity of depth in a river by lowering the shoals obstructing the channel depends on the nature of the shoals. A soft shoal in the bed of a river is due to deposit from a diminution in velocity of flow, produced by a reduction in fall and by a widening of the channel, or to a loss in concentration of the scour of the main current in passing over from one concave bank to the next on the opposite side. The lowering of such a shoal by dredging merely effects a temporary deepening, for it soon forms again from the causes which produced it. Extreme heat in Southeast Asia today reduces working hours by 15–20%, and that figure could double by 2050 as climate change progresses, according to a paper published in Asia-Pacific Journal of Public Health. The paper projects a loss of six percent of Thailand's GDP by 2030 due to a diminution of working hours caused by rising temperature. A paper published in Nature, by Mora, et al., forecasts that "...things will start going haywire in the tropics at around [sic] the year 2020,..." Some scientists project that by 2100, "...most of the low and mid latitudes will be uninhabitable because of heat stress or drought..." A study published in the Proceedings of the National Academy of Sciences examined how worst-case CO2 emissions would affect the human habitat: By the end of the century, the average human will experience a temperature increase of 7.5 °C when global temperatures increase 3 °C the study predicts.

Sipilä's government has struggled with Finland's poor economic performance, caused according to Paul Krugman and others by the constraints of its eurozone membership and aftershocks from the European debt crisis, but also by the decline of the paper industry, the fall of Nokia and a diminution in exports to Russia. Its attempts to address the problems through policies of cuts to government spending and reducing labour costs have been controversial, particularly those in relation to education spending that have been seen as threatening to Finland's successful public education system. These austerity measures have partly been implemented due to pressure from the European Commission, which has urged Finland to improve its adherence to the Stability and Growth Pact and reform its labour market to improve competitiveness. On 22 July 2015, Sipilä announced the government's commitment to the reduction of Finnish wage costs by 5% by 2019, an internal devaluation caused by Finland's loss of the ability to devalue its currency to boost competitiveness.

It is probable that during the four centuries that elapsed between the battle of Caphyae and the visit of Pausanias, a diminution of population should have caused a neglect of the drainage which had formerly ensured the cultivation of the whole plain, and that in the time of the Roman Empire an embankment of earth had been thrown up to preserve the part nearest to Caphyae, leaving the rest uncultivated and marshy. Pausanias says that on the inner side of the embankment there flows a river, which, descending into a chasm of the earth, issues again at a place called Nasi (); and that the name of the village where it issues is named Rheunus (). From this place it forms the perennial river Tragus () (modern Tara or Daraiiko). He also speaks of a mountain named Cnacalos () (modern Kastania) in the neighbourhood of the city, on which the inhabitants celebrate a yearly festival to Artemis Cnacalesia.

If two material things are combined, the dual Measures of the one are added to those of the other. The degree to which they exhibit self- preservation is registered in the internal Measure—weight in this case—which ends up being equal, after combination, to the sum of the original two Measures; the degree to which they exhibit Qualitative alteration is registered in the external Measure—space in this case—which does not necessarily result in a sum equal to its parts, but often in the case of material substances exhibits a diminution in overall volume. If we adopt the constant of one specific Real Measure as our Unit, the constants of other Real Measures can be brought into relation to it as Amounts in a (b) series of Measure relations. Since it is arbitrary which one Real Measure in such a series will serve as the Unit, there are as many incommensurable series of Measure relations as there are individual Real Measures.

In the same year (1823) the Reversionary Interest Society was established, and for this company he constructed many elaborate and useful tables. In the first of his reports to the founders of that institution he announced that he had ‘ascertained upon indubitable evidence that a diminution had taken place in the mortality of Great Britain during the last hundred years.’ In 1825 he published ‘Tables of Life Contingencies, containing the rates of mortality among the members of the Equitable Society, and the value of life annuities, reversions, &c.; computed therefrom; together with a more extensive scale of premiums for life assurance, deduced from the Northampton rate of mortality, than any hitherto published, and the progressive values of life policies.’ Davies was the remodeller of George Barrett's columnar plan of constructing mortality tables, and so arranged his tables that they may almost be said to be a new discovery (WALFORD, Cyclopædia, i. 618–23).

Thus at Riedenburg, near Bregenz, in August 1846, he entertained Charles Dickens and his wife and other well-known people. Dickens would later publish Lever's novel A Day's Ride in serial in his weekly journal All the Year Round, running parallel to Great Expectations for part of its run from 1860 to 1861. Like his own Daltons or Dodd Family Abroad he travelled continentally, from Karlsruhe to Como, from Como to Florence, from Florence to the Baths of Lucca and so on, and his letters home are the litany of the literary remittance man, his ambition now limited to driving a pair of novels abreast without a diminution of his standard price for serial work ("twenty pounds a sheet"). In the Knight of Gwynne, a story of the Union (1847), The Confessions of Con Cregan (1849), Roland Cashel (1850) and Maurice Tiernay (1852) we still have traces of his old manner; but he was beginning to lose his original joy in composition.

On 19 June 1935, a social democrat member of the National Council, Fritz Hauser, put forward a postulate in which he called upon the Federal Council to examine how the spiritual independence of culture in Switzerland could be defended in the face of the threat from fascist movements in Germany. One week later, the Swiss Society of Writers (Felix Moeschlin, Karl Naef) presented Federal Councillor Philipp Etter with a proposal for a Swiss cultural policy. The Social Democratic Party of Switzerland gave its approval to the defence proposal – subject to the following condition: "Combating all trends in domestic politics which, in contradiction to the will of the Swiss people, aspire to a diminution of the democratic rights of freedom and self-determination of the citizens and the removal of the influence of the constitutional authorities over the state and its policy." The 1936 Social Democratic Party conference held in Zürich, however, rejected a defence loan. However, unconditional recognition of the legitimacy of national defence followed in January 1937 with the party’s adoption of the ‘Richtlinienbewegung’ (Movement of Guiding Principles).

Conversely, if they reduce the note values in diminution, it can be called a diminution canon or canon by diminution (canon per diminutionem). Prolation canons are among the most difficult canons to write, and are relatively rare in the repertory, though they are most common in the early Renaissance and from the 20th century to the present. Examples of prolation canons from the Renaissance include Le Ray Au Soleyl by Johannes Ciconia (late 14th century); the entire Missa prolationum by Johannes Ockeghem (mid-15th century), in which each separate section of the mass explores a different prolation (or different gap between entries and relative speed of each voice); the Agnus Dei from the Missa L'homme armé super voces musicales by Josquin des Prez (late 15th century); and the Agnus Dei from the Missa L'homme armé by Pierre de la Rue (early 16th century). Johann Sebastian Bach is known for his Canon a 4 per Augmentationem et Diminutionem, the last in a set of 14 canons written as an appendix to the Goldberg Variations.

The most important difficulty the road had to contend with, Moran explained in 1857, was the engineers' strike of the fall of 1856: :... Owing to a policy which occupied itself with minutiae to the exclusion of the main chance, the best set of engineers ever gathered in this country was dispersed. They spread reports all over the country unfavorable to the Erie road; they said it was served by incompetent engineers, by mere boys, and what they said was in part true. The strike was followed by a December and a January change in weather by which the road was blocked by snows, and an inundation in February which destroyed the most important bridges on the line. Constant rains kept the road in a state of liquefaction until July, and the result of all this was that during the first six months of the present fiscal year there had been a diminution of receipts of $534,000, and an increase of expenditure of $482,000, leaving a comparative balance against the Company of $1,016,000.

In a testimony before the Alberta Agricultural Committee of the Alberta Legislature in 1934, Douglas said: > Now we know there are an increasing number of charges which originated from > a period much anterior to three weeks, and included in those charges, as a > matter of fact, are most of the charges made in, respect of purchases from > one organization to another, but all such charges as capital charges (for > instance, on a railway which was constructed a year, two years, three years, > five or ten years ago, where charges are still extant), cannot be liquidated > by a stream of purchasing power which does not increase in volume and which > has a period of three weeks. The consequence is, you have a piling up of > debt, you have in many cases a diminution of purchasing power being > equivalent to the price of the goods for sale. According to Douglas, the major consequence of the problem he identified in his A+B theorem is exponentially increasing debt. Further, he believed that society is forced to produce goods that consumers either do not want or cannot afford to purchase.

In relation to the issue of reflective loss, Lord Bingham summarised the existing case law in three key propositions: # Where a company suffers loss caused by a breach of duty owed to it, only the company may sue in respect of that loss. No action lies at the suit of a shareholder suing in that capacity and no other to make good a diminution in the value of the shareholder's shareholding where that merely reflects the loss suffered by the company. # Where a company suffers loss but has no cause of action to sue to recover that loss, the shareholder in the company may sue in respect of it. # Where a company suffers loss caused by a breach of duty to it, and a shareholder suffers a loss separate and distinct from that suffered by the company caused by breach of a duty independently owed to the shareholder, each may sue to recover the loss caused to it by breach of the duty owed to it but neither may recover loss caused to the other by breach of the duty owed to that other.

Partnership Act 1890 §18, which applies to Scotland as well as England, provides that "a continuing guarantee or cautionary obligation given either to a firm or to a third person in respect of the transactions of a firm, is, in the absence of agreement to the contrary, revoked as to future transactions by any change in the constitution of the firm to which, or of the firm in respect of the transactions of which the guaranty or obligation was given." This section is mainly declaratory of the English common law, which indicates that the changes in the persons to or for whom a guarantee is given may consist either of an increase in their number, of a diminution thereof caused by death or retirement from business, or of the incorporation or consolidation of the persons to whom the guarantee is given. In England the Commissioners of Her Majesty's Treasury to vary the character of any security, for good behavior by the heads of public departmentsGovernment Offices (Security) Act 1875, Amended by the Statute Law Revision Act 1883 given by companies for the due performance of the duties of an office or employment in the public service.
